41 Interpretation

(1)  *[Section 41 Subsection (1) substituted by No. 33 of 1995, s. 5 ]*In this Division –

civil matter means a matter other than a criminal matter;

Corporations Law has the extended meaning given by subsection (2) ;

judgment means a judgment, decree or order, whether final or interlocutory;

lower court means a court of a State or Territory that is not a superior court;

[Section 41 Subsection (1) amended by No. 11 of 2001, s. 17, Applied:01 Jun 2001] superior court means the Supreme Court of a State or Territory or a State Family Court;

superior court matter means a civil matter that the Corporations Law clearly intends (for example, by use of the expression "the Court") to be dealt with only by a superior court.

(a) a reference to the Corporations Law of Tasmania includes a reference to –

(i) the Corporations Regulations of Tasmania; and

(ii) [Section 41 Subsection (2) amended by No. 74 of 1999, Sched. 1, Applied:01 Jan 2000] the ASIC Law of Tasmania; and

(iii) [Section 41 Subsection (2) amended by No. 74 of 1999, Sched. 1, Applied:01 Jan 2000] the ASIC Regulations of Tasmania; and

(iv) any other applicable provisions (as defined in ) of Tasmania; and
