CORONERS REGULATIONS 1994

The Regulations operationalise key coronial concepts through defined procedures, timelines and templates. Principal concepts in the instrument are:

• Reporting channels and timelines: r 4 allows reporting of deaths by telephone or facsimile and mandates that the reporter provide Form 1 within 24 hours. r 5 prescribes a 28‑day outer limit for persons and police holding relevant information to give that information to the coroner named in s 13 of the Act. Schedule 2 supplies the content and structure for those notifications (Forms 1 and 2).
• Coroner-directed autopsy: r 6 sets the decision criteria the coroner must consider in directing an autopsy, including timeliness, appropriate facilities and access to laboratory services. There is an explicit preference for qualified forensic pathologists and a fallback to suitably experienced qualified pathologists (r 6(2)). Form 7 (Schedule 2) is the prescribed direction to perform an autopsy.
• Duties and reporting by medical practitioners: a practitioner directed to perform an autopsy must perform it as soon as practicable (r 7(1)), preserve material deemed relevant for periods the coroner considers necessary (r 7(2)), notify the coroner in writing of preliminary results (r 7(3)) and provide a written report within 28 days of completing the autopsy (r 7(4)). The practitioner must not release copies of the report to other persons unless the coroner authorises it (r 7(4)).
• Attendance rules and family participation: a person who demonstrates a “sufficient interest” may be permitted to attend an autopsy on request (r 8(1)), but must not interfere (r 8(2)). For deaths in custody, the coroner must not start an inquest without the senior next of kin or a nominated family representative unless the coroner is satisfied the senior next of kin does not wish to attend and that wish has been communicated (r 9).
• Disaster reporting and fire-specific reporting: r 10 requires police with relevant information about disasters to report to the coroner within 28 days, and prescribes Form 2 for fires.
• Assistance and legal support for coroners: r 11 requires the person appointed to assist the coroner (pursuant to s 41(2) of the Act) to be a legal practitioner, preferably experienced in coronial matters.
• Access, publication and confidentiality controls: r 13 gives coroners discretion to permit inspection or copying of coronial records, to restrict inspection to particular persons or classes, and to align inspection orders with non-publication orders under s 43 of the Act.
• Flexibility and legal effect of non-compliance: r 14 confirms that procedural failure does not automatically make acts or documents a nullity, and vests the coroner with power to dispense with requirements or make amendments or orders to rectify failures.
• Prescribed forms and templates: Schedule 1 links statutory sections to forms; Schedule 2 contains the full text of Forms 1-12 used in coronial practice (initial notifications, direction to autopsy, records, certificates, authorities, undertakings, summonses, warrants, exclusion orders).
• Penalties: r 16 prescribes a general maximum penalty of 17 penalty units for contravening the Regulations; Schedule 2 (Form 9) reproduces the content of a “Restricted Area” notice which references a different maximum penalty (40 penalty units or imprisonment for 6 months), reflecting the source text.

Each concept is connected to operational rules or templates rather than substantive changes to substantive criminal law. The Regulations translate statutory powers in the Coroners Act 1993 into forms, deadlines and standards for medical and police practice and coronial administration. The coroner is given centralized discretion over many operational matters: authorising access to reports (r 7(4)), permitting attendance (r 8), restricting publication and inspection (r 13) and dispensing with compliance where procedural requirements have not been met (r 14).

The Regulations create obligations and rights that fall on identifiable groups. The primary affected actors, as reflected in the text, are:

• Members of the Police Force: Police are required to report deaths (r 4(1) permits telephone/facsimile reporting) and to complete and forward prescribed forms in accordance with instructions in Schedule 2 (Forms 1 and 2 include explicit police duties and internal timelines). Police holding information relevant to death or disaster investigations must report it to the coroner within 28 days (r 5, r 10). Form 5 authorises police entry, inspection and seizure under coroner authorisation (Schedule 2, Form 5).
• Medical practitioners and pathologists: A medical practitioner directed by a coroner to perform an autopsy must act “as soon as practicable” (r 7(1)), preserve relevant material as the coroner requires (r 7(2)), notify preliminary findings (r 7(3)) and deliver a written report within 28 days (r 7(4)). r 6 constrains who coroners should direct to perform autopsies: where possible a qualified forensic pathologist, otherwise a suitably experienced qualified pathologist (r 6(2)). These duties impact hospital pathology services, forensic providers and mortuary service arrangements (r 6(1)(b)-(c)).
• Next of kin and family members: The Regulations recognise family participation rights. Individuals demonstrating “sufficient interest” can be permitted to attend autopsies (r 8), and for deaths in custody the senior next of kin (or their nominee) must be given opportunity to attend the inquest before it commences (r 9). r 13 limits public access to records, but allows parties and family members to be included where a coroner orders otherwise (r 13(2)-(3)).
• Coroners and the coronial administration: The coroner is the central decision-maker for many operational matters: direction of autopsies (r 6), authorisation of disclosure of reports (r 7(4)), appointment of legal assistance (r 11), exclusion orders and giving written reasons on request (r 12), and restriction of inspection and publication of records (r 13). r 14 grants the coroner broad remedial discretion to cure procedural defects.
• Legal practitioners and advisers: r 11 requires the person assisting a coroner to be a legal practitioner and, where practicable, experienced in coronial matters. The forms provide for summonses (Form 10), warrants (Form 11), and exclusion orders (Form 12), all of which engage legal representation and practice.
• Funeral, cremation and burial services: The coroner issues certificates permitting disposal of bodies (Form 4, Schedule 2); the Burial and Cremation Act 2022 is listed among amending instruments in the endnotes (Endnote 2), indicating regulatory interdependency with post-mortem disposal and transfer processes (see Schedule 2, Form 4).
• Journalists, researchers and the public: r 13 enables coroners to limit publication and inspection of reports and files. Where a coroner orders non-publication under s 43 of the Act, the coroner may also restrict access to the record and file (r 13(2)-(3)). Form 9’s “Restricted Area” wording (Schedule 2) further signals criminal penalties attached to entering a coronial restricted area (the form reproduces a maximum penalty of 40 penalty units or imprisonment for 6 months).
• Insurers, workplaces, and other private parties: The prohibition on medical practitioners releasing copies of autopsy reports unless authorised by the coroner (r 7(4)) affects third parties who commonly rely on autopsy findings (insurers, employers, civil litigants). Those parties will need coroner authorisation or to rely on other disclosure routes.

Who pays and who decides: operational costs fall on police (time and administration to complete and forward forms within tight timelines), medical services (performing autopsies in properly equipped premises, preserving materials, preparing reports within 28 days), legal practitioners (assisting coroners and representing family members) and the coroner’s office (administering discretion, record-keeping, providing reasons where requested). Decision-making authority is concentrated with the coroner; police and medical practitioners act largely as obligated information providers and executors of directions.

The Regulations impose specific duties on reporters, police, medical practitioners and coroners and confer procedural rights on families and parties. Key duties and rights, with their regulatory location, are:

• Duty to report and to follow up with Form 1: r 4 allows initial reporting by telephone or facsimile but makes it mandatory that the person who reports a death furnish the prescribed Form 1 to the person they reported to within 24 hours. The content and required fields for Form 1 are set out in Schedule 2 (Form 1). The regulation thus splits immediate notice from the formal written record, imposing a strict 24‑hour deadline for the written record.
• Duty to provide investigatory information within 28 days: r 5 requires both persons who report deaths and police members who hold relevant information to give that information to the coroner investigating the death, “not later that 28 days after the death was reported” (r 5(a)-(b)). For disasters, r 10 mirrors this requirement for police.
• Coroner’s criteria and duties in directing autopsies: r 6 requires the coroner, when selecting the medical practitioner to perform an autopsy, to have regard to timeliness, adequate facilities, and access to pathological laboratory services (r 6(1)(a)-(c)). r 6(2) adds a preference for a qualified forensic pathologist or, if none available, a suitably experienced qualified pathologist in the coroner’s opinion. The coroner therefore has an obligation to consider these matters and a power to direct.
• Duties of medical practitioners conducting autopsies: r 7(1) obliges the directed medical practitioner to conduct the autopsy as soon as practicable. r 7(2) requires preservation of materials relevant to cause of death for periods the coroner considers necessary. r 7(3) requires prompt written notification of preliminary findings and r 7(4) requires a written report within 28 days of completion, but prohibits providing copies to others unless the coroner authorises.
• Right to attend autopsy if “sufficient interest” shown: r 8(1) gives an entitlement to request attendance at an autopsy for persons who demonstrate sufficient interest; r 8(2) conditions attendance on non-interference.
• Right of senior next of kin in deaths in custody: r 9 prevents commencement of inquests into deaths in custody in the absence of the senior next of kin or their nominated representative unless the coroner is satisfied they do not wish to attend, and that wish has been communicated directly or via legal counsel.
• Police powers and obligations under coroner authority: Form 5 (Schedule 2) is the coroner’s authority to police to enter, inspect, copy and take possession of specified places or things for specified periods (not exceeding one month from date of authority). Form 8 is an order to remove human remains for autopsy. These instruments give police powers of entry/seizure when authorised by a coroner.
• Coroner’s control over access to records and publication: r 13(1) allows the coroner during an investigation or inquest to direct that only particular persons or classes may inspect or copy the record and file. r 13(2) links non-publication orders under section 43 of the Act to concomitant restrictions on file access, and r 13(3) permits a coroner at completion of an investigation to limit inspection to parties or family members.
• Right to reasons for exclusion orders on request: r 12 obliges the coroner, if requested by an affected person, to provide written reasons for an order to exclude persons from an inquest “as soon as practicable” after receiving the request.
• Power to dispense with or cure non-compliance: r 14(2)-(3) allows a coroner to dispense with compliance whether before or after the occasion, and to cure failures by dispensing, amending documents, or making appropriate orders.
• Penalty for non‑compliance: r 16 prescribes a maximum penalty of 17 penalty units for contravening or failing to comply with a provision of the Regulations. The content of Form 9 (Schedule 2) reproduces a “Restricted Area” notice which states a different maximum penalty (40 penalty units or imprisonment for 6 months), which the Regulations themselves record in the form text.

Mechanisms at work: the coroner’s discretion shapes disclosure and operational practice. Medical practitioners’ obligations to preserve material and to restrict distribution of autopsy reports (r 7(2), r 7(4)) create an information bottleneck under coroner control. Police obligations to report and to take coroner-authorised actions (r 4, r 5, r 10; Forms 5 and 8) house the investigative search and seizure functions within the coronial process. Families have procedural rights to participation that are mapped onto timelines and coroner satisfaction tests (r 8, r 9, r 12). The regulatory design thus centralises control of sensitive information and physical processes with the coroner, while setting firm administrative deadlines and templates for those who must supply information or execute directions.

The Regulations set a general statutory enforcement mechanism and also embed penalties in the prescribed forms. Key enforcement provisions are:

• General penalty: Regulation 16 states that a person who contravenes or fails to comply with a provision of the Regulations commits an offence against the Regulations and exposes themselves to a maximum penalty of 17 penalty units (r 16). That is the blanket sanction for breach of the Regulations themselves.
• Form-based warning and higher penalties: Schedule 2, Form 9 (Notice Restricting Access to Disaster Area) contains the text for a “RESTRICTED AREA” notice and includes the line “MAXIMUM PENALTY: 40 PENALTY UNITS OR IMPRISONMENT FOR 6 MONTHS.” The presence of that statement in the prescribed form indicates that certain breaches tied to restricted areas carry higher penalties, as set out in the form’s wording. The Regulations reproduce that wording; the legislative source for the higher penalty is the Act (not contained in the Regulations text), but the form text is part of the Regulations as published in Schedule 2.
• Undertakings and liabilities: Schedule 2, Form 6 (Undertaking to Comply with Conditions of Release) requires a person entering into that undertaking to acknowledge receipt and understand that failure to comply carries liability to a penalty. The form records that the coroner satisfied him/herself that the person understood the obligations and consequences of failure to comply, thereby creating a contractual/administrative instrument backed by penalty exposure.
• Enforcement via police powers under coroner authority: Schedule 2, Form 5 (Coroner’s Authority to a Member of the Police Force) and Form 8 (Order to Take and Remove Human Remains) provide the operational instruments by which coroners can require police to enter, inspect, copy or seize documents or to remove remains, which in turn can lead to enforcement action for obstruction or disobedience.
• Arrest warrant for non-appearance: Schedule 2, Form 11 is the prescribed warrant for arrest of a person who does not appear after being duly summoned by a coroner (pursuant to s 41(4) of the Act). This provides an enforcement route for compelling witness attendance.
• Non-voidability coupled with remedial powers: r 14(1) states that failure to comply does not make a document, step or proceeding a nullity. r 14(3) empowers the coroner to dispense with compliance, amend or make orders to cure non-compliance. This means that enforcement action (penalties) is available, but the coroner also has remedial discretion to avoid voiding proceedings for procedural error.

Practical enforcement pattern: the primary enforcement mechanisms are administrative and criminal. Administrative control rests with the coroner who can exercise discretion to release reports, restrict access, and remedy procedural non-compliance. Criminal enforcement is real where the Regulations or forms refer to penalties (r 16; Schedule 2, Form 9; Form 6 references liability on breach). Where a coroner authorises police to seize or enter premises (Form 5), police have executive tools to enforce compliance. The combination of penalty statements in forms and the general penalty in r 16 means that regulated persons should treat the timelines and undertakings as binding; however, the coroner’s broad curative powers (r 14) create legal uncertainty about whether a breach will be prosecuted, remedied, or retrospectively relieved.

The Regulations are expressly subordinate to the Coroners Act 1993 and are framed as regulations under that Act (header). They reference specific Act sections (for example s 13 in r 5, s 41(2) in r 11) and provide the procedural detail necessary to implement coronial powers. The text contains several explicit interactions and indirect linkages:

• Coroners Act 1993: The Regulations operationalise multiple sections of the Act. Schedule 1 links forms to Act sections (for example Form 3 to s 11, Form 4 to s 17, Form 7 to s 20, Form 10 to s 41(1), Form 12 to s 42). r 13(2) explicitly references section 43 of the Act in relation to publication restrictions. The coroner’s authority to direct autopsies, to order entry, and to preside over inquests flows from powers in the Act and the Regulations provide the templates and timing details necessary for practice.
• Police internal orders and administrative guidance: Schedule 2, Form 1 and Form 2 include instructions to reporting members referencing internal police procedures (the forms require completion in triplicate, specific deadlines for delivery to coroners or divisional officers and reference to a “General Order ‘Coroners and Inquests’ - Code C9”). This ties coronial practice into police administrative processes and places operational demands on police to comply with both the Regulations and their internal orders.
• Burial and Cremation law: The Endnotes record that the Burial and Cremation Act 2022 (Act No. 16, 2022) amended Schedule 2 (Endnote 2 and Endnote 4 note Sch 2 amended by Act No. 16, 2022, s 222). Form 4 is a coroner’s certificate permitting disposal of a body and the Regulations’ interaction with burial and cremation law affects timing and conditions for disposal decisions made under s 17 of the Act (Form 4). Practitioners handling body disposal must therefore reconcile coronial certificates with the statutory scheme in the Burial and Cremation Act.
• Legal profession and appointment of assisting counsel: Endnotes show the Legal Profession (Consequential Amendments) Act 2007 amended r 9 (Endnote 4). r 11 requires the person appointed to assist the coroner to be a legal practitioner and, if practicable, experienced in coronial matters, which interacts with legal professional qualification and appointment frameworks under legal profession legislation and administrative arrangements.
• Penalties and criminal law: The Regulation’s general penalty provision (r 16) sets the administrative criminal sanction for breach. The wording of Form 9 that appears in Schedule 2 references different penalties (40 penalty units or imprisonment for 6 months) that likely derive from provisions in the Act dealing with restricted areas (the Act text is not provided here). Users must cross-reference the Act when considering the precise criminal sanction for entering restricted areas.
• Evidence, privacy and coronial confidentiality regimes: r 13’s control over inspection and non-publication orders interacts with broader legal regimes on privacy, freedom of information and the admissibility of coronial records in civil or criminal proceedings (not set out in the Regulations). The Regulations themselves restrict release of autopsy reports (r 7(4)) and control record access (r 13), which bears on discovery and disclosure obligations in other proceedings; practitioners must therefore coordinate requests for coronial material with the coroner rather than assuming automatic disclosure.
• Other amending Acts: The Endnotes list the Justice Legislation Amendment (Penalties) Act 2010 as amending r 16 (Endnote 4) and the Interpretation Legislation Amendment Act 2018 made formal amendments to r 1 and sch 2 (Endnote 3). Those amending instruments demonstrate the Regulations’ susceptibility to broader statutory reform, including penalty adjustments and interpretive updates.

The Regulations are a procedural bridge between the statutory Coronial framework and operational actors (police, pathologists, families, legal practitioners). Where the Regulations refer to other legislative instruments (for example the Burial and Cremation Act 2022 or amendments effected by other Acts), users must cross-check the Act and amending statutes for substantive legal effects, penalty levels and compatibility. The Regulations both constrain and enable interaction: they require coroner authorisation for certain disclosures and actions (r 7(4), r 13) while equipping police with forms to execute powers (Forms 5 and 8).

The published instrument includes an Endnotes section recording commencement and amendments. The amendment history, as set out in the source, is:

• Initial notification and commencement: Coroners Regulations (SL No. 5, 1994) were notified 31 March 1994 and commenced 3 April 1994 (r 2, s 2 Coroners Act 1993 and Gazette S24, 31 March 1994) (Endnote 2).
• Legal Profession (Consequential Amendments) Act 2007 (Act No. 7, 2007): The Endnotes record that r 9 was amended by Act No. 7, 2007, s 16 (Endnote 4). This indicates a change to regulation 9’s text in consequence of legal profession amendments; r 9 in the reprint concerns persons to attend inquests into death in custody.
• Justice Legislation Amendment (Penalties) Act 2010 (Act No. 12, 2010): Assent date 20 May 2010; the Act commenced 1 July 2010 (Gazette references). The Endnotes show r 16 was amended by Act No. 12, 2010, s 3 and Schedule 2 was amended by Act No. 12, 2010, s 3 (Endnote 4). That suggests adjustments to penalty provisions and schedule forms were made by the 2010 amendments.
• Burial and Cremation Act 2022 (Act No. 16, 2022): Assent date 9 August 2022, commenced 28 November 2022 (Gazette S60, 23 November 2022). Endnotes record Sch 2 was amended by Act No. 16, 2022, s 222 (Endnote 4). The reprint is “as in force at 28 November 2022”, incorporating the Burial and Cremation Act changes to Schedule 2.
• Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018): The Endnotes state the Act made general amendments of a formal nature (not detailed in the reprint table) to r 1 and sch 2 (Endnote 3). These were formal/technical amendments rather than substantive policy changes.
• General note on formal amendments: Endnote 3 describes the 2018 Act’s formal amendments as not being individually listed in the amendment table but recorded as changes of a formal character.

The reprint records the specific regulations amended: r 9 (Act No. 7, 2007), r 16 (Act No. 12, 2010) and Schedule 2 (Act No. 12, 2010; Act No. 16, 2022). The reprint’s inclusion of Schedule 2 as amended by the Burial and Cremation Act 2022 suggests the prescribed forms (e.g. Form 4 permitting disposal of a body) were adjusted to align with changes to the law on burial and cremation. The amendments cited are specific and limited; the reprint does not record any substantive deletions or wholesale rewriting beyond these cited amendments.

For a practitioner, the amendment history signals areas to double-check against the current Act: any changes to r 9 (deaths in custody protocol), r 16 (penalty structure), and Schedule 2 (forms governing notices, certificates and police authorisations). The Endnotes provide the explicit amending Acts and sections to consult when tracing the legislative history.

The source document (this reprint of the Coroners Regulations 1994 as in force at 28 November 2022) does not include any case law or litigation history. It names no judicial decisions, and there are no references to particular cases in the Regulations, Schedules or Endnotes. The instrument is an administrative procedural regulation and the reprint contains only the text of the Regulations, the Schedules of forms and an Endnotes section that records amendments and commencement dates.

Consequently, within the boundaries of the source text:

• There is no litigation history recorded in the Regulations themselves.
• No cases are cited or relied upon in the text.
• Any judicial interpretation of these Regulations, of coroner discretion under r 13 or r 14, of the duty of medical practitioners under r 7, or of procedural rights under r 8-r 9 would need to be sought in case law databases and reported decisions under the Coroners Act 1993 and related provisions, which are not reproduced here.

Users requiring precedent or judicial interpretation of these Regulations should therefore consult independent legal databases, court and tribunal records and reported coronial decisions. The Regulations themselves do not record or summarise any litigation about their construction or application.

The Regulations contain specific procedural traps and discretionary concentrations that practitioners should note. The following are concrete, text-based "gotchas" to watch for:

• Tight deadlines for formal notification: r 4(2) requires the person who reports a death to furnish the prescribed Form 1 to the person they reported the death to within 24 hours. The Form 1 instructions in Schedule 2 include additional operational deadlines for police (e.g. deliver to coroner in Darwin/Alice Springs by 0900 the day after death). Failure to meet these timelines can expose presenters to regulatory penalties (r 16) and may affect the timing of inquests.
• 28‑day timelines for information and autopsy reports: r 5 and r 10 require persons with relevant information (including police) to report that information to the coroner not later than 28 days after the death was reported or disaster occurred. r 7(4) requires the medical practitioner who performed an autopsy to provide a written report no later than 28 days after completing the autopsy. These fixed outer limits are operationally demanding for busy pathology services and police districts; missing them can provoke compliance issues and delay coronial processes.
• Coroner-controlled disclosure of autopsy reports: r 7(4) prohibits the medical practitioner from providing a copy of the autopsy report to any person unless authorised by the coroner. This can frustrate families, insurers and civil litigants who commonly expect direct access to autopsy findings. Practitioners must secure coroner authorisation or rely on other legal pathways instead of assuming automatic medical disclosure.
• Centralised coroner discretion over access to records and publication: r 13 permits the coroner to restrict inspection and copying to certain persons or classes and to align this with non-publication orders under the Act. This centralised gatekeeping requires affected parties and journalists to seek coroner permission rather than expect open access; failure to respect restrictions can carry penalty exposure (see Form 9 wording).
• Form 9 vs regulation 16 penalty mismatch: r 16 sets the general maximum penalty at 17 penalty units, while Form 9 reproduces wording of a “RESTRICTED AREA” notice carrying “MAXIMUM PENALTY: 40 PENALTY UNITS OR IMPRISONMENT FOR 6 MONTHS.” Both are present in the reprint. Practitioners should cross-check the Act provisions referenced by Form 9 (for example s 32(1) of the Act, cited in the form) and the applicable penalty provisions in the Act and recent amending statutes to determine which penalty applies in a particular breach. The coexistence of two different penalty figures in the documents is a practical source of uncertainty.
• Coroner’s power to dispense with compliance: r 14(2) allows the coroner to dispense with regulatory requirements before or after the compliance occasion. r 14(3) gives power to amend or make orders to remedy non-compliance. While this is a useful curative mechanism, it also creates uncertainty for parties relying on strict procedural rights; whether a breach will be dispensed with depends on coroner discretion rather than a fixed rule.
• Attendance at autopsy conditioned on “sufficient interest” and non-interference: r 8(1) and r 8(2) allow attendance by those who demonstrate sufficient interest but condition attendance on non-interference. The Regulations do not define “sufficient interest” and leave assessment to the coroner, which can lead to disputes about who may attend an autopsy and potential exclusion of some family members or stakeholders.
• Senior next of kin requirement for deaths in custody: r 9 prevents commencement of an inquest into a death in custody without the senior next of kin or nominated representative being present unless the coroner is satisfied they do not wish to attend and that that wish has been properly communicated. This procedural protection can delay inquests where next of kin cannot be located or where disputes exist about who is the senior next of kin.
• Confidential undertakings and liability for breach: Form 6 requires undertakings from persons to whom things are released and records that failure to comply can attract penalties. Persons accepting coroner authorisations or returning seized items must understand the coroner-imposed conditions and the legal consequences of breach.
• Restricted access to coronial files post-investigation: r 13(3) allows the coroner at the completion of an investigation to restrict file access to parties and family members. Researchers, journalists and other third parties may be unable to access coronial files even after the investigation concludes unless they are party or family members or the coroner orders otherwise.

Each of these practical traps is anchored in the Regulation text or in the prescribed forms. They create implementation risks: missed timelines can produce non‑compliance, coroner discretion can yield unpredictability, and the combination of restricted disclosure and police handling obligations generates administrative friction. For those operating around coronial matters , police, forensic providers, lawyers, funeral directors and families , adherence to prescribed forms, early engagement with the coroner and careful documentation of undertakings are essential.

The Regulations are heavily procedural; compliance requires structured administrative steps coupled with proactive engagement with the coroner’s office. Practical compliance guidance, grounded in the text, is below for the principal actors.

Police and initial reporters

• Use permitted reporting channels (telephone or facsimile) for initial notification (r 4(1)). Immediately after reporting, ensure Form 1 is completed and furnished to the person who was reported to within 24 hours (r 4(2); Schedule 2, Form 1).
• Follow the delivery instructions embedded in Forms 1 and 2: deliver originals and duplicates to the coroner’s office by the specified times (e.g. within Darwin/Alice Springs by 0900 the day immediately following the death or fire) and forward triplicate copies as directed (Schedule 2, Forms 1 and 2).
• For disasters and fires, ensure Form 2 (Schedule 2) is used and the coroner is given relevant information within 28 days after the disaster (r 10(1)-(2)).
• If acting under a coroner’s authority, use Form 5 to record the coroner’s authorisation to enter, inspect, copy or take possession of specified things for the specified period (Schedule 2, Form 5). Ensure the period of authority does not exceed the maximum stated in the form.

Medical practitioners and mortuary/pathology services

• If directed by a coroner to perform an autopsy, perform the autopsy “as soon as practicable” after being directed (r 7(1); Schedule 2, Form 7).
• Ensure the autopsy is conducted on premises adequately equipped for autopsy and with access to a laboratory for pathological tests, as the coroner must have regard to these matters in selecting a practitioner (r 6(1)(b)-(c)). If not a forensic pathologist, be prepared to demonstrate suitable experience if appointed under r 6(2)(b).
• Preserve material the practitioner handles which is, in the practitioner’s opinion, relevant to the cause of death for such period as the coroner considers necessary (r 7(2)).
• Notify the coroner in writing, promptly after autopsy completion, with preliminary findings or that the cause is undetermined or under investigation (r 7(3)). Deliver the full written autopsy report to the coroner within 28 days of completing the autopsy (r 7(4)).
• Do not provide copies of the autopsy report to third parties unless authorised by the coroner (r 7(4)). Advise families, insurers and solicitors that coroner authorisation is required.

Coroners and coronial administration

• Where directing autopsies, record consideration of the criteria in r 6(1) and the preference for a qualified forensic pathologist under r 6(2). Use Form 7 and Form 8 where appropriate to direct practitioners and to order removal of human remains (Schedule 2, Forms 7 and 8).
• Manage disclosure: when restricting access to records under r 13, document the reasons and ensure orders under s 43 of the Act are reflected in inspection restrictions (r 13(2)). Provide reasons for exclusion orders promptly when requested as required by r 12.
• Use r 14’s curative powers prudently: dispense with compliance only where appropriate, and document amendments and orders made to remedy procedural defects.
• When appointing assisting legal practitioners under r 11, select qualified practitioners and record relevant experience in coronial matters.

Families and next of kin

• If you wish to attend an autopsy, be prepared to demonstrate a “sufficient interest” and to agree not to interfere with the autopsy procedure (r 8). Make the request to the coroner in writing if possible, and clarify whether attendance will be permitted.
• For deaths in custody, the senior next of kin should make their wishes about attendance known promptly. Coroners are prevented from commencing inquests in the absence of the senior next of kin unless the coroner is satisfied they do not wish to attend (r 9). Act promptly to nominate representatives if you cannot attend.
• Recognise that autopsy reports are delivered to the coroner and are not automatically released to family members; seek coroner authority if you require a copy (r 7(4)).

Legal practitioners and third parties (insurers, employers, media)

• Seek coroner authorisation for access to autopsy reports or coronial file material (r 7(4), r 13). Do not rely on direct access to medical autopsy reports without coroner permission.
• If subpoenaing witness evidence or documents, use the prescribed summons form (Schedule 2, Form 10) and, if necessary, be prepared to obtain a warrant for arrest of a non-attending witness under Form 11.
• For restricted area or non-publication matters, cross-check the Act’s provisions referenced in the forms (for example s 32(1) and s 43 of the Act) to determine the correct penalty regime and enforcement mechanisms.

General administrative recommendations

• Build calendaring and recordkeeping systems to meet the 24-hour, 28-day and other timing thresholds in the Regulations. These are recurrent sources of regulatory exposure.
• Retain chain-of-custody documentation for preserved materials as required by r 7(2). Where materials are released under an undertaking (Form 6), ensure copies of the undertaking are retained and that both the undertaking and the coroner’s certification of understanding are on file.
• Where the coroner directs entry, inspection or seizure, document the coroner’s authorisation on the prescribed forms and ensure police and other officers comply with the time limits and conditions recorded in the authorisation (Schedule 2, Form 5).
• When in doubt about penalties (for example the difference between the general 17 penalty unit figure in r 16 and the 40 penalty units/6 months imprisonment wording in Form 9), consult the Coroners Act 1993 and the amending Acts cited in the Endnotes for the current offence provisions and penalties.

Concluding practical note: compliance is largely administrative and depends on prompt reporting, correct use of prescribed forms in Schedule 2 and early engagement with the coroner’s office. Because key actions and disclosures require coroner authorisation (autopsy report release, file access, undertakings, seizure authorisations), build coroner-centred workflows into police, medical and legal practice to avoid inadvertent non-compliance and to reduce the risk of contested disclosure or procedural delay.
