49 Record of proceedings
(1) In this section:
relevant provisions means the following provisions of the
Magistrates Court Act 1930:
• section 314 (Registrar to give directions for preparation of
transcript)
• section 315 (Applications for transcripts)
• section 316 (Record of proceedings)
• section 317 (Record of proceedings and transcript).
(2) The relevant provisions apply in relation to the depositions of a
witness who gives evidence at a hearing as if the depositions were
depositions in a proceeding in the Magistrates Court and as if—
(a) a reference to the Magistrates Court were a reference to a
coroner; and
(b) a reference to the registrar of the Magistrates Court were a
reference to the registrar of the Coroner’s Court; and
(c) in section 315—the following subsection were substituted for
subsection (2):
‘(2) A person is entitled to a copy of a record made at an inquest
or inquiry only if the person has satisfied the registrar or a
coroner that the person has good reason for applying for
the copy.’; and
(d) in section 316 (6)—proceedings at an inquest or inquiry were
proceedings mentioned in that subsection; and
(e) all other necessary changes, and any changes prescribed by
regulation, were made.
