71Matters to be included in application under paragraph 108(1)(a) of the Act

#### 71 Matters to be included in application under paragraph 108(1)(a) of the Act An application to the Tribunal under paragraph 108(1)(a) of the Act (to determine equitable remuneration for causing a published sound recording to be heard in public): (a) must set out the circumstances or events giving rise to the application and, in particular, must: (i) identify the sound recording; and (ii) state whether the applicant is the owner of the copyright in the recording or the person causing the recording to be heard in public; and (iii) if the applicant is the owner of the copyright—state the name of the person causing the recording to be heard in public; and (iv) if the applicant is the person causing the recording to be heard in public—state the name of the owner of the copyright; and (b) must request the Tribunal to determine the amount that is equitable remuneration to the owner of the copyright for the causing of the recording to be heard in public.
