147  President to arrange business of Tribunal   The President may give directions as to the arrangement of the business of the Tribunal and, subject to subsection 146(2) or (3), as to the constitution of the Tribunal for the purposes of particular proceedings. Division 3—Applications and references to the Tribunal Subdivision B—Applications relating to Parts III and IV 149  Applications to Tribunal for determination of remuneration payable for making recording or film of a work  (1) This section applies where an application is made to the Tribunal in pursuance of subsection 47(3) or 70(3) for the determination of an equitable remuneration to be paid to the owner of the copyright in a work for the making of a sound recording or cinematograph film of the work or of an adaptation of the work.  (a) the owner of the copyright in the work; and  (b) the maker of the recording or film.  (3) Where an application in relation to which this section applies is made to the Tribunal, the Tribunal shall consider the application and, after giving to the parties to the application an opportunity of presenting their cases, shall make an order determining the amount that it considers to be equitable remuneration to the owner of the copyright for the making of the recording or film. 150  Applications to Tribunal for determination of remuneration payable to owner of copyright in recording for making of a copy of the sound recording  (1) This section applies where an application is made to the Tribunal in pursuance of subsection 107(3) for the determination of an equitable remuneration to be paid to the owner of the copyright in a sound recording for the making of a copy of the sound recording.  (a) the owner of the copyright in the sound recording; and  (b) the maker of the copy of the sound recording.  (3) Where an application in relation to which this section applies is made to the Tribunal, the Tribunal shall consider the application and, after giving to the parties to the application an opportunity of presenting their cases, shall make an order determining the amount that it considers to be equitable remuneration to the owner of the copyright for the making of the copy of the sound recording. 151  Applications to Tribunal for determination of remuneration payable to owner of copyright in recording in respect of public playing of the recording  (1) This section applies where an application is made to the Tribunal in pursuance of subsection 108(1) for the determination of an equitable remuneration to be paid to the owner of the copyright in a sound recording for the causing of the recording to be heard in public.  (a) the owner of the copyright in the recording; and  (b) the person who caused the recording to be heard in public.  (3) Where an application in relation to which this section applies is made to the Tribunal, the Tribunal shall consider the application and, after giving to the parties to the application an opportunity of presenting their cases, shall make an order determining the amount that it considers to be equitable remuneration to the owner of the copyright for the causing of the recording to be heard in public.
