This Order makes the Conveyancing Act 2004 apply to contracts for the sale of land and to instruments that amend those contracts (s3). It takes effect when notified in the Gazette (s2) and is administered by the Department of Justice. Practically, buyers, sellers and their conveyancers must meet the 2004 Act’s requirements when preparing or amending sale contracts, increasing compliance tasks for practitioners and exposing such instruments to the 2004 Act’s enforcement and procedural rules.
