### 90 Covenants to be implied by use of certain forms of words

V No. 78 \]*Such of the covenants set out in [Schedule 5](#JS5@EN) as shall be expressed as to be implied in any instrument executed or made by way of security for the repayment of moneys shall, if expressed in the form of words appointed and described for the case of each such covenant respectively, be so implied as fully and effectually as if such covenants were set forth fully, and in words at length in such document, except so far as the same may be altered or added to in such document, and, where the word "mortgagor" is used, the same shall include all and each of the mortgagors if more than one, and will imply a joint and several covenant on their behalf, and that the word "mortgagee" shall, if there are more mortgagees than one, include the survivors and survivor of them and the personal representatives of any such survivor and his assigns.
