### 84B Determination of existence, &c., of overriding interests > *\[Section 84B Inserted by No. 3 of 1978, s. 3 \]* > > > (1)  On an application by a person interested the appropriate tribunal may, by order – > > > > > > (a) declare whether or not, by virtue of the instrument specified in the order, any land is subject to an overriding interest; > > > > > > > (b) declare what, on the true construction of an instrument purporting to create an overriding interest, is the nature and extent of that interest and whether any person, and if so what person, is entitled to enforce the interest or exercise any rights conferred thereby. > > > (2)  The powers conferred by [subsection (1)](#GS84B@Gs1@EN) include power to declare that an overriding interest has been extinguished as a consequence of the conduct of the persons interested in the land affected by the interest or any circumstances arising since its creation.
