### 71 Benefit of covenant relating to land

> > (1) A covenant relating to land of the covenantee shall be deemed to be made with the covenantee and his successors in title and the persons deriving title under him or them and shall have effect as if those successors and other persons were expressed.
>
> > (2) For the purposes of [subsection (1)](#GS71@Gs1@EN) , in connection with covenants restrictive of the use of land, ***successors in title*** shall be deemed to include the owners and occupiers for the time being of the land of the covenantee intended to be benefited.
>
> > (3) This section applies to covenants made after the commencement of the [Local Government Act 1962](/view/html/inforce/2026-04-12/act-9999-999) , but the repeal of this section as it stood at the commencement of that Act does not affect the completion of covenants made before the commencement of that Act.
