Controlled Substances (Pesticides) Regulations 2017

Definitions and scope set the conceptual frame. "Pest control work" is work that uses a pesticide to kill, stupefy, repel, inhibit feeding, or modify pest physiology, and includes mixing and preparing pesticides (regulation 3). "Pesticide" is defined as a substance containing any proportion of an S5, S6 or S7 poison and authorised under the Agvet Code for use in pest control work (regulation 3). The Agvet Code is a cross-reference point: several obligations require complying with approved labels or permit conditions issued under the Agvet Code (regulation 19). Part 7 permits under the Agvet Code are expressly contemplated (regulation 3 and regulation 19).

Licensing is central. Regulation 6 makes it an offence to carry on a pest control business unless authorised by a pest controller's licence under these regulations, or by certain interstate instruments (Tasmania, Victoria, Western Australia) specified in regulation 6(1)(b)-(d). Regulation 6 also requires pest management technicians to hold a licence to perform pest control work in the course of a pest control business. The Minister is the licensing authority, with statutory discretion to grant full or limited pest management technician licences (regulation 9) and pest controller licences (regulation 8). A pest controller's licence authorises the business and the use of pest management technicians who themselves must be licensed (regulation 7).

Supervision is carefully articulated. Regulation 4 sets a binary test: work is "performed under the supervision of another" only if the supervisor is licensed to perform that kind of work, licensed to use the pesticides involved, and present within sight and sound and available to advise or intervene. Regulation 4(2) creates an administrative escape valve: if the Minister is satisfied on application that the trainee's competence is such that sight-and-sound presence is unnecessary, the supervisor instead must be contactable in a Minister-approved manner while the person performs the work.

Operational standards are anchored to both statutory conditions in the regulations and external technical standards. Regulation 18(3) lists the prescribed standards and codes (AS 3660.1:2014, AS 3660.2,2000, and two South Australian Health Commission codes) which both pest controllers and pest management technicians must comply with (regulation 18(1)-(2)). Regulation 19 ties handling and use to the Agvet Code: instructions on approved labels must be followed unless a Part 7 permit applies; where a Part 7 permit applies the permit conditions must be complied with (regulation 19(1)-(2), (3)-(4)).

Risk management duties are explicit for storage and transport. Storage must be in a prescribed container, kept securely closed in a roofed structure with an impervious floor, adequate ventilation, lockable when unattended, access to water to wash spillage, and located so spillage cannot drain into a water supply or soak into soil (regulation 16). Transport obligations include labelled containers, secure storage in vehicles (or secured spray tanks prominently marked and fixed to the vehicle), and a gas-tight barrier separating the driving compartment from the pesticide storage area (regulation 17).

Information, record-keeping and reporting obligations are detailed. Pest controllers must keep personnel records for each technician (name, address, DOB, employment start/end and pesticides handled) and application-specific records (date, time, location, pesticide name and quantity, technician, proximity of others, weather for outdoor applications, and specific details for pre- or during-construction termiticide applications) and retain those records for seven years (regulation 21). Spillage that requires assistance or has immediate environmental or public health impact must be reported immediately to the Minister or police (regulation 20).

Regulatory discretion and review are formalised. The Minister may impose conditions in addition to those in the regulations (regulation 10), vary licences either on application or if the Minister considers proper reasons exist (regulation 13), and suspend or cancel licences on specified grounds including false application statements, convictions, medical fitness and competency (regulation 14). Review rights exist to the South Australian Civil and Administrative Tribunal under section 34 of that Act for applicants and licence-holders in certain decisions (regulation 15), and the Minister must provide written reasons on request (regulation 15(4)).

Finally, there are transitional provisions carrying existing licences and exemptions forward from the repealed 2003 regulations (Schedule 1), and the legislative history shows later amendments (2020 and 2024) which, among other things, transition certain functions to the Minister and amend technical definitions and procedural provisions (Legislative history).

The regulations affect four principal groups: pest controllers (business owners), pest management technicians (workers), consumers or occupiers who receive pesticide applications, and the Minister and regulatory apparatus that grant, supervise and enforce licences. Each group's obligations and liabilities are set out in the text.

Pest controllers: A "pest controller" is anyone who carries on a business of pest control work performed for another for fee or reward (regulation 3, definition of "pest control business" and "pest controller"). Regulation 6(1) makes it an offence to carry on such a business without a pest controller's licence, subject to limited interstate recognition (regulation 6(1)(b)-(d)). Pest controllers must ensure that pest management technicians employed in their business hold pest management technician licences (regulation 6(3)), maintain premises and equipment in a clean, efficient and safe condition (regulation 8(2)(a)), ensure pesticides are under direct control of a licensed technician (regulation 8(2)(b)), and manage disposal of unused pesticides and containers so they do not endanger health (regulation 8(2)(c) and regulation 9(4)(d)). Pest controllers also face record-keeping duties about their technicians and applications (regulation 21) and must notify the Minister of changes in business name or address within 14 days (regulation 22). Penalties for non-compliance (including maximum fines and expiation fees) are attached to many of these obligations.

Pest management technicians: These are the persons who personally perform pest control work in the course of a pest control business (regulation 3). They must hold either a full or limited pest management technician's licence to perform such work (regulation 6(2)), and limited licences require employment by a pest controller and supervision by a full technician and carry a prohibition on making recommendations or giving advice (regulation 9(3), (5)). Technician licences are conditioned on wearing protective clothing, keeping first aid materials, not handling pesticides in a manner dangerous to health, appropriate disposal, compliance with approved cleaning and decontamination methods after spillage, submitting to medical examinations and to assessments to maintain adequate knowledge (regulation 9(4)(a)-(g)). Limited licence-holders must notify the Minister within 14 days of changing or ceasing employment (regulation 23). Technicians are directly subject to the duty to perform work in accordance with prescribed standards and the Agvet Code (regulations 18 and 19).

Interstate operators and licence recognition: Regulation 6(1)(b)-(d) recognises certain commercial operator licences from Tasmania, Victoria and registration under Western Australia’s Health Act 1911, meaning holders of those specified interstate instruments can lawfully carry on pest control business in South Australia without taking a local pest controller's licence, subject to those instruments being as amended from time to time. This reduces licensing friction for specified interstate operators.

People and the environment proximate to pesticide use: The regulations reflect attention to public and environmental health through storage and transport rules (regulations 16-17), compliance with label instructions and Part 7 permits (regulation 19), prescribed standards for termite management and dilution codes (regulation 18), mandatory spillage reporting (regulation 20), and requirements to avoid drainage into water supplies (regulation 16(1)(vi)). Where spillage has magnitude, toxicity or location that may impact environment or public safety, licence-holders must immediately report it to the Minister or police (regulation 20).

Regulatory decision-makers: The Minister is the central decision-maker; the regulations repeatedly vest the Minister with power to grant, impose conditions, approve courses, approve manners of contact for supervision, approve cleaning methods, approve containers and warnings, and to grant, vary or revoke exemptions (regulations 4(2), 8(1), 9(3)(a), 9(4)(e), 12, 16(2), 17(2)(b)(i) and others). The Minister also must provide written reasons for decisions upon request and decisions are reviewable by the South Australian Civil and Administrative Tribunal within the time limits in regulation 15.

Other affected parties include suppliers of termiticides (specified to be recorded in some records, regulation 21(4)(f)(ii)), vehicular equipment manufacturers and designers (because transport rules require a gas-tight barrier and secure enclosed storage, regulation 17), and training providers whose courses may be approved by the Minister for conversion of limited to full licences (regulation 9(3)(a)).

The distribution of obligations places primary operational compliance duties on pest controllers and technicians, administrative and discretionary control in the Minister’s office, and incident reporting duties that implicate public authorities and potentially police when spillages require assistance (regulation 20). The regulations also carve out minimal exemptions for a narrow class of glyphosate applications (regulation 5), limiting their coverage for certain small-scale uses.

Duties are allocated principally to pest controllers and pest management technicians, with rights concentrated on procedural review and, in limited contexts, exemption.

Core duties of pest controllers:

• Hold a pest controller's licence to carry on a pest control business (regulation 6(1)). This is enforced by a maximum penalty of $5,000 and an expiation fee of $315.
• Ensure any person performing pest control work in the course of the business is authorised by a pest management technician's licence (regulation 6(3)).
• Maintain premises and equipment in clean, efficient and safe condition (regulation 8(2)(a)).
• Ensure pesticides handled or used are under the direct control of a holder of a pest management technician's licence (regulation 8(2)(b)).
• Ensure disposal of unused pesticides and containers does not endanger health (regulation 8(2)(c)).
• Comply with prescribed standards and codes of practice (regulation 18(1)) and with instructions on approved labels or Part 7 permits under the Agvet Code (regulation 19(1)-(2)).
• Maintain records for each technician and for each pesticide application and forward technician records to the Minister within 28 days after cessation of employment (regulation 21(1)-(3), (4)-(6)).
• Notify the Minister of changes to business name or address within 14 days (regulation 22).

Core duties of pest management technicians:

• Hold a full or limited pest management technician's licence to perform pest control work in the course of a pest control business (regulation 6(2) and regulation 9).
• Full licence-holders must have appropriate qualifications, be medically fit and be fit and proper persons (regulation 9(1)). Limited licence-holders must be employed by a pest controller, be medically fit, be fit and proper persons, and undertake to commence training to qualify for a full licence as soon as practicable (regulation 9(3)).
• Follow licence conditions: wear protective clothing, keep first aid materials available when using pesticides, not handle or use pesticides in a manner dangerous to any person's health, dispose of unused pesticides/containers safely, clean and decontaminate after spillage in a Minister-approved manner, submit to medical examinations and assessments as required (regulation 9(4)(a)-(g)).
• Limited licence-holders must not give recommendations or advice about pesticide use (regulation 9(5)) and must notify the Minister of employment changes or cessation within 14 days (regulation 23).
• Perform work in accordance with prescribed standards and codes of practice (regulation 18(2)) and in accordance with label instructions or Part 7 permit conditions (regulation 19(3)-(4)).
• Immediately report certain spillages to the Minister or police where the scale or location or toxicity requires assistance or may have immediate environmental or public health impacts (regulation 20).

Rights and procedural protections:

• The Minister may grant exemptions from licensing obligations with conditions (regulation 12). Exemptions can be varied or revoked by written notice (regulation 12(2)) but may only be granted or varied if the Minister is satisfied the conditions will not entail significant risk to public health or the environment (regulation 12(3)).
• Applicants and licence-holders have a right to review decisions by the Minister to refuse, impose conditions, suspend or cancel a licence, or to vary a licence, by applying to the South Australian Civil and Administrative Tribunal under section 34 of that Act (regulation 15(1)-(2)). An application for review must generally be made within one month from the Minister's decision (regulation 15(3)), but the time runs from written reasons where those are requested under regulation 15(5).
• The Minister must, on application by a person seeking review, state in writing the reasons for the decision (regulation 15(4)).
• Licence-holders may apply for renewal of certain licences and may choose 1- or 3-year terms for pest controller or full technician licences (regulation 11(1)), while limited licences have more restrictive terms and renewal rules (regulation 11(2)-(4)).

Ministerial discretions and administrative conditions:

• The Minister may impose additional conditions in licences (regulation 10(1)(b)), vary licences to extend or limit scope, vary or revoke conditions or impose further conditions (regulation 13), and suspend or cancel licences on enumerated grounds including false application information, convictions, or lack of competence or medical fitness (regulation 14).
• The Minister also has a role in approving training courses (regulation 9(3)(a)), methods of contact for supervision where sight-and-sound supervision is waived (regulation 4(2)), manners of cleaning/decontamination (regulation 9(4)(e)), types of approved containers (regulation 16(2)), and warnings for spray tanks (regulation 17(2)(b)(i)).

Enforcement and sanctioning:

• Many duties are enforced by fines up to $5,000 for serious breaches (e.g. unlicensed operations, failing to comply with standards, failing to follow Agvet Code instructions, failure to report spillages) and lower maxima for storage, transport and record-keeping contraventions (e.g. $2,500; see regulations 16, 17, 21). Expiation fees are specified in multiple places (e.g. $315 for licensing offences, $210 for storage/transport/record-keeping failures, and $80-$250 for notification failures; see regulations 6, 16, 17, 21, 22, 23).
• Making a false or misleading statement in information provided under these regulations is an offence with a maximum penalty of $5,000 (regulation 25).

Operational constraints that affect duties and rights include the narrow exemption for small-scale glyphosate application (regulation 5), and the cross-recognition of certain interstate licences (regulation 6(1)(b)-(d)), which modify who is required to obtain a South Australian licence.

The regulations specify a range of maximum penalties and expiation fees tied to specific contraventions, and they vest enforcement and disciplinary powers primarily in the Minister with a statutory avenue of review to the South Australian Civil and Administrative Tribunal.

Monetary penalties and expiation:

• Licensing and unauthorised practice: It is an offence to carry on a pest control business without an appropriate licence, with a maximum penalty of $5,000 and an expiation fee of $315 (regulation 6(1)). Performing pest control work without a pest management technician's licence and failing to ensure only authorised persons perform pest control work each attract the same maximum penalty and expiation fee (regulations 6(2)-(3)).
• Compliance with prescribed standards and codes of practice: Failure by a pest controller or pest management technician to comply with prescribed standards and codes of practice under regulation 18 carries a maximum penalty of $5,000 and an expiation fee of $315 (regulation 18(1)-(2)).
• Compliance with Agvet Code instructions or permit conditions: Contravention of regulation 19 concerning compliance with approved label instructions for registered pesticides, and with Part 7 permit conditions where relevant, carries a maximum penalty of $5,000 and expiation fee of $315 (regulation 19(1)-(4)).
• Spillage reporting: Failure to immediately report a qualifying spillage under regulation 20 is an offence with a maximum penalty of $5,000 and expiation fee of $315 (regulation 20).
• Storage and transport technical offences: Contravening storage obligations under regulation 16 is punishable by a maximum penalty of $2,500 and an expiation fee of $210 (regulation 16(1)). Contravening transport obligations under regulation 17 similarly carries a maximum penalty of $2,500 and expiation fee of $210 (regulation 17(1)).
• Records and notifications: Record-keeping obligations and failure to forward records within 28 days (regulation 21) carry maximum penalties of $2,500 and expiation fees of $210. Notification failures under regulations 22 and 23 have lower maximum penalties ($250) and expiation fees ($80) (regulations 22-23).
• False or misleading statements: A person must not make false or misleading statements in information provided under these regulations; that offence carries a maximum penalty of $5,000 (regulation 25).

Enforcement mechanisms and administrative sanctions:

• Ministerial powers: The Minister has express administrative powers to grant licences, impose conditions, vary licences (regulation 13), and suspend or cancel licences if satisfied of specified grounds (regulation 14). Grounds for suspension or cancellation include false statements in licence applications, convictions for offences under the Act or regulations or other pesticide laws, medical unfitness, lack of competence, or other reasons that make the holder not fit and proper (regulation 14).
• Exemptions: The Minister can grant, vary or revoke exemptions from licence obligations under regulation 12, but only where satisfied compliance with exemption conditions will not entail significant risk to public health or the environment (regulation 12(3)). Contravening a condition of an exemption is an offence with a maximum penalty of $5,000 and an expiation fee of $315 (regulation 12(4)).
• Review rights: Affected applicants and licence-holders may apply to the South Australian Civil and Administrative Tribunal for review of Ministerial decisions under regulation 15. Review rights cover refusals to grant licences, imposition of conditions, suspension or cancellation, variations, and imposition or variation of particular conditions (regulation 15(1)-(2)). The Tribunal avenue is the statutory review mechanism specified by reference to section 34 of the South Australian Civil and Administrative Tribunal Act 2013 (regulation 15).
• Procedural protections: The Minister must provide written reasons on request (regulation 15(4)), and the one-month review period runs from receipt of those written reasons where they were not provided at the time of the decision (regulation 15(5)).

Operational enforcement details requiring administrative capacity:

• The Minister may require applicants to verify information by statutory declaration and to provide specified information to determine applications (regulation 24(2)(a)-(b)). This creates a compliance and verification workload for both applicants and the Minister's office.
• The Minister also approves technical matters (approved labels, prescribed containers, cleaning and decontamination methods, training courses, manners of contact for supervision) which require the Minister to maintain and publish such approvals or to notify individual licence-holders, thereby imposing ongoing administrative responsibilities.

The enforcement architecture therefore combines criminal sanctions (penalties and expiation), administrative regulation of licences including conditions and disciplinary powers, and a statutory review path. The combination imposes compliance costs and potential sanction risk on pest control businesses and technicians while placing discretionary and operational enforcement burdens on the Minister and the agency supporting the Minister.

The regulations are expressly cross-referential to several external instruments and statutes, which shapes their application and operational effect.

Controlled Substances Act 1984: These regulations are made under the Controlled Substances Act 1984 and operate as subordinate legislation to that Act (title and first lines). The Act supplies the statutory head of power and the enforcement framework into which these regulations fit.

Agvet Code and Agricultural and Veterinary Chemicals (South Australia) Act 1994: The regulations repeatedly cross-reference the Agvet Code and its definitions. "Agvet Code" is defined in regulation 3 by reference to section 5 of the Agricultural and Veterinary Chemicals (South Australia) Act 1994. Key duties require compliance with the approved label for registered pesticides and with Part 7 permits under the Agvet Code (regulation 19). The definition of "pesticide" depends on authorisation under the Agvet Code (regulation 3). Consequently, the Agvet Code governs the technical parameters of pesticide approval, labelling and Part 7 permits, and the regulations defer to those instruments for what pesticide uses are permitted and what label instructions or permit conditions apply.

Australian Standards and South Australian Health Commission codes: Regulation 18(3) makes compliance with particular Australian Standards and South Australian Health Commission codes a statutory duty. The listed instruments are AS 3660.1:2014, AS 3660.2,2000 and two Health Commission codes relating to diluting pesticides and termiticides. Since these referenced standards are "as in force from time to time", the regulations create a dynamic linkage: when the standards are updated, their content flows into the regulatory duties.

Interstate Acts and interstate licensing: Regulation 6(1)(b)-(d) recognises specified interstate licensing regimes: commercial operator licence under Tasmania's Agricultural and Veterinary Chemicals (Control of Use) Act 1995 (as amended), Victoria's Agricultural and Veterinary Chemicals (Control of Use) Act 1992 (as amended), and registration as a commercial pesticide firm under Western Australia's Health Act 1911 (as amended). Where an operator holds one of those instruments, they are authorised to carry on a pest control business under the South Australian regulations without a local licence. Interaction here reduces duplication but ties South Australian application to the continuance and compatibility of those interstate instruments.

Corporations Act 2001: Regulation 3 borrows the definition of "director" for a body corporate from the Corporations Act 2001 when assessing fitness and propriety for directors of corporate pest controllers (regulation 8(1)(d)(ii) and regulation 3 definition of "director").

South Australian Civil and Administrative Tribunal Act 2013: Review rights reference section 34 of that Act, establishing the Tribunal as the statutory review body for decisions under these regulations (regulation 15).

Other pesticide or poisons regulations: The definition of S5, S6 and S7 poisons in regulation 3 references the Controlled Substances (Poisons) Regulations 2011. Compliance with these classifications is part of defining what substances are captured by the pesticide definition.

Transitional interaction: The regulations revoke the Controlled Substances (Pesticides) Regulations 2003 and provide transitional savings so that existing licences and exemptions continue under the new regulations (Schedule 1, clauses 1, 3-4). Later amendment regulations (2024 No 70) effect transitions regarding the licensing authority and reassign certain approval functions to the Minister; Schedule 1 to that amendment contains savings ensuring licences, approvals and applications under the previous authority continue as Ministerial actions post-amendment (Transitional provisions of Controlled Substances (Pesticides) (Licensing Authority) Amendment Regulations 2024).

Administrative interplay and delegation: The regulations vest wide approval and discretionary powers with the Minister, such as approving training courses, containers, warnings, cleaning methods and manners of contact for supervision (regulations 4(2), 9(3)(a), 9(4)(e), 16(2), 17(2)(b)(i)). These approvals will likely operate alongside administrative policies and guidance within the Minister's department, though the regulations themselves do not stipulate detailed procedural rules beyond giving the Minister discretion.

The combined effect is that technical compliance (labelling, permits, standards) is governed by other technical instruments, while the regulations provide the licensing envelope, duties, enforcement penalties and administrative paths for oversight. Entities operating across states must be attentive to both South Australian licensing duties and the compatibility or recognition of their interstate licences as specified in regulation 6(1)(b)-(d).

The regulations were made in 2017 and revoke the Controlled Substances (Pesticides) Regulations 2003 (Schedule 1, Part 1). The legislative history appended to the instrument lists subsequent variations and the dates on which they took effect. The document includes specific entries for variations in 2020 and 2024, indicating multiple areas amended.

Key entries in the legislative history:

• 2017: Principal regulations commences (Gazette 15.8.2017 p3589; commencement reg 2 effective 1.9.2017).
• 2020: Variation 16, Gazette 27.2.2020 p447, commenced 4.5.2020; regulation 15 was substituted by 16/2020 r 4 and various other items amended (see the "Provisions varied" table; regulation 15 substitution effective 4.5.2020).
• 2024: Variation No 70 (Controlled Substances (Pesticides) (Licensing Authority) Amendment Regulations 2024), Gazette 18.7.2024 p2185, commenced 18.7.2024; multiple regulations were amended by this instrument. The 2024 instrument removed the role or references to a "licensing authority" from some provisions and transitioned certain approvals and functions to the Minister (see "Provisions varied" table noting deletions and amendments, and the associated Transitional and savings provisions in Sch 1 to the 2024 amendment).

Transitional savings in Schedule 1:

• The principal regulations include Schedule 1, Part 2, which preserves the continuation of licences and exemptions granted under the 2003 Regulations as licences and exemptions under the 2017 Regulations for their remaining term (Schedule 1, clauses 3-4).
• The 2024 amendment regulation included its own transitional and savings provisions (Controlled Substances (Pesticides) (Licensing Authority) Amendment Regulations 2024, Sch 1) which treat licences and approvals previously made by the former licensing authority as having been made by the Minister after commencement, and treat pending applications as having been made to the Minister, and preserve prior approvals (manner of contact, courses, cleaning and decontaminating methods, approved containers and warnings) as Ministerial approvals after commencement.

Substantive topics varied by the 2024 amendment: the table in the legislative history shows that the 2024 instrument amended or deleted references to the licensing authority (r 3), altered regulation 4(2), amended numerous provisions in Part 2 regarding licence grant criteria and conditions (r 8, r 9, r 10, r 11, r 12, r 13, r 14, r 15), modified parts of Part 3 (including r 16 definition of prescribed container, r 17(2), r 20, r 21(2) and (6), r 22 and r 23), and amended application requirements in r 24. The legislative history table identifies which clauses were amended and by which amending regulation number.

Operational consequence of amendments:

• The 2024 amendment moves certain functions and approvals to be taken by the Minister and removes references to the "licensing authority". The transitional provisions in the 2024 instrument make clear that licences and approvals previously made by the licensing authority are taken to be made by the Minister after commencement (Transitional provisions, Controlled Substances (Pesticides) (Licensing Authority) Amendment Regulations 2024, Sch 1(1)-(3), (6)-(9)). That change centralises decision-making and approvals in the Minister instead of a separate licensing authority.

Record of historical versions:

• The instrument's notes indicate that historical versions are listed at the end of the legislative history and that references to other legislation or offices may not be automatically updated. The legislative history entry "Historical versions 4.5.2020" suggests that earlier consolidated texts are available reflecting the 2020 amendments, and the 2024 amendments further altered the text.

For practitioners, the amendment history means that compliance obligations and the identity of the decision-maker have changed over time: licences and approvals granted under prior arrangements continue but are now treated as Ministerial actions where the 2024 amendments applied. Any administrative practices or approvals issued by the prior "licensing authority" remain valid under the Minister after transitional saving, but new applications and approvals post-commencement will flow through the Minister.

The text of the regulations as provided does not record or cite any case law or adjudicated decisions. The only judicial or quasi-judicial forum expressly referenced in the regulatory text is the South Australian Civil and Administrative Tribunal. Regulation 15 creates a statutory right to apply to the Tribunal under section 34 of the South Australian Civil and Administrative Tribunal Act 2013 for review of specific Ministerial decisions, including refusals to grant licences, imposition of conditions, suspension or cancellation, and variations of licences. Regulation 15 also prescribes timing for applications for review and the Minister's obligation to state reasons in writing upon request.

Beyond that procedural right of review, there are no cases, decisions or litigation outcomes recorded in the regulations themselves. The legislative history and schedules record statutory amendments and transitional provisions, but do not include judicial determinations or precedent. Therefore, any litigation history , for example, Tribunal decisions on review of licence refusals or cancellations , is not provided in this source and cannot be cited here.

Practitioners should note that while the Tribunal is the statutory review avenue, the regulations do not specify internal appeal steps, merits criteria beyond "fit and proper" and other grounds, nor do they provide published guidance on how the Minister applies those criteria. Where parties seek review of Ministerial decisions, the Tribunal will interpret and apply the statutory provisions; however, any Tribunal jurisprudence arising from such reviews is outside the text supplied and should be researched separately in Tribunal and court databases.

The text contains numerous specific operational requirements and administrative traps that create compliance risk if overlooked.

Supervision strictness and limited licence constraints: Regulation 4 requires supervisors to be present within sight and sound and available to intervene, unless the Minister approves an alternative manner of contact under regulation 4(2). That is a narrow statutory standard: merely being "available by phone" will not qualify unless the Minister has approved that manner of contact for the specific person. Limited pest management technician licences require employment by a pest controller, supervision by a full licence-holder, and a statutory undertaking to commence training to obtain full qualifications as soon as practicable (regulation 9(3)(a)-(b)). Limited licence-holders are explicitly prohibited from making recommendations or giving advice (regulation 9(5)), which restricts their scope. Failure to observe these particular constraints can trigger offences under regulation 6.

Label and permit compliance: Regulation 19 requires strict compliance with approved label instructions for registered pesticides, unless the pesticide is supplied under a Part 7 permit, in which case the permit conditions must be complied with. That is a layered compliance duty: even if a technician thinks a different usage is better, they must follow label or permit instructions. Using a registered pesticide contrary to its label or the conditions of a Part 7 permit draws maximum penalties of $5,000 (regulation 19).

Storage and transport technicalities: Storage must meet multiple structural requirements (roofed, impervious floor, ventilation, locking, water supply, no drainage into water supply; regulation 16(1)). Transport demands include labelled containers bearing the approved label (or Part 7 permit label), secure locked enclosed storage in vehicles if left unattended, and a gas-tight barrier separating the driving compartment from the storage area (regulation 17). Failing to ensure a gas-tight barrier or leaving pesticides in an unattended vehicle without an enclosed and locked storage facility both attract $2,500 maximum penalties (regulation 17). The transport exception for spray tanks requires that the tank be fixed to the vehicle and prominently marked with "CAUTION" or "POISON" or another Minister-approved warning, and name of the pesticide (regulation 17(2)).

Record-keeping burden and short deadlines: Pest controllers must maintain detailed records for each technician and each pesticide application (regulation 21(1), (4)) and retain them for seven years (regulation 21(3), (5)). When a technician ceases employment, the pest controller must forward the technician record to the Minister within 28 days (regulation 21(2)). These deadlines, and the breadth of records (including weather conditions and proximity of other people for each application), create administrative burden and expose pest controllers to penalties for late or missing records ($2,500 maximum and $210 expiation).

Immediate spillage reporting: Regulation 20 requires that a licensed person who observes a spillage that either requires assistance to manage or may have an immediate environmental or public health impact must "immediately" report it to the Minister or a police officer. The term "immediately" is strict and coupled with a maximum penalty of $5,000 and $315 expiation fee. There is no separate time window provided , practitioners must have procedures and contacts ready.

Medical assessments, monitoring and privacy: Regulation 9(4)(f) requires licence-holders to "submit to such medical examinations as the Minister considers necessary to monitor exposure" to pesticides, and 9(4)(g) requires submission to assessments to ensure knowledge. These requirements impose on individuals a duty to undergo health surveillance at Ministerial direction, potentially raising workplace privacy and occupational-health considerations and coordination with occupational health providers. The Minister's broad discretion in calling for examinations introduces uncertainty for technicians and employers.

Ministerial discretion and fit-and-proper tests: The Minister's powers to impose conditions, vary, suspend or cancel licences (regulations 10, 13-14) are broad. The "fit and proper person" character tests for individual applicants and directors (regulation 8(1)(d)) are high-level and may be applied subjectively, creating uncertainty and exposing licence-holders to discretionary administrative decisions. While regulation 15 provides a review path to the Tribunal, there is a short timeframe (one month) to lodge review applications, and written reasons are required on request (regulation 15(3)-(5)). Practitioners should ensure timely requests for reasons where needed to preserve review rights.

Interstate recognition limited and conditional: Although regulation 6(1)(b)-(d) recognises specified interstate licences, recognition is limited to those exact instruments and to the extent they are "as amended from time to time". Operators holding other interstate licences or who rely on mutual recognition in different forms may be surprised that such recognition is not automatic and is narrowly prescribed.

Exemptions subject to non-significant-risk test: The Minister may grant exemptions under regulation 12, but only if satisfied that pest control work performed under the exemption will not entail any significant risk to public health or the environment (regulation 12(3)). Exemptions can be varied or revoked by written notice (regulation 12(2)) and breaching an exemption condition is an offence (regulation 12(4)). Exemptions therefore are fragile and come with conditions and termination risk.

Administrative formality and prescribed fees: Applications must be made in a manner and form approved by the Minister and accompanied by the prescribed fee (regulation 24(1)). The Minister can require verification by statutory declaration and provision of specified information (regulation 24(2)). Failure to comply with procedural formality can delay or invalidate an application.

False or misleading statements: Making a false or misleading statement in any information provided under the regulations is a separate offence with a maximum penalty of $5,000 (regulation 25). Because many application processes and records require specific factual details (including dates of employment and pesticide handling), errors or omissions can attract criminal liability.

Narrow exemption for low-capacity glyphosate use: Regulation 5 exempts application of glyphosate using hand-held equipment with tanks of 15 litres or less or by brush, and the preparation for such application. Other glyphosate uses are captured. Operators who assume glyphosate is broadly exempt may be mistaken.

Taken together, these "gotchas" mean pest control businesses should build administrative systems to manage licences, supervision, technical compliance with labels and standards, structural storage/transport requirements, record-keeping, rapid spillage reporting, medical surveillance processes, and ready responses to Ministerial requests for information or statutory declarations.

Compliance requires administrative systems, technical controls, staff training and engagement with Ministerial approvals. The following steps, grounded in the regulations, map to major obligations.

1. Determine licensing needs and obtain appropriate licences

• If you carry on a pest control business, you must hold a pest controller's licence unless you hold one of the specified interstate instruments listed in regulation 6(1)(b)-(d) (regulation 6(1)). Confirm whether an interstate licence you hold qualifies under those specific cross-recognition provisions.
• Ensure all individuals performing pest control work in the course of the business hold a full or limited pest management technician's licence as required by regulation 6(2). For full licences ensure applicants hold the qualifications the Minister considers appropriate, are medically fit and are fit and proper persons (regulation 9(1)). For limited licences ensure employment and supervision requirements, and an undertaking to commence training, are in place (regulation 9(3)).

2. Meet and document qualification, fitness and fit-and-proper criteria

• Maintain documented records to support the Minister’s assessment of qualifications, medical fitness, and "fit and proper" status for individual applicants and, for corporate pest controllers, for directors (regulation 8(1)(d), regulation 9(1)-(3)). The Minister may require verification by statutory declaration on application (regulation 24(2)(b)).

3. Prepare for licence conditions and Ministerial approvals

• Be ready to accept licence conditions beyond those set in regulation 8 and 9; the Minister may impose additional conditions (regulation 10(1)(b)). Ensure business plans and operational procedures address potential conditions.
• Where limited technicians are employed, ensure supervision meets regulation 4: the supervisor must be licensed for the work and pesticides used, and be present within sight and sound and able to intervene, unless the Minister has approved another manner of contact on application (regulation 4). If seeking an alternative contact arrangement, prepare an application to the Minister referencing regulation 4(2).

4. Implement technical operational controls

• Storage: Construct or retrofit storage facilities to meet regulation 16(1): prescribed containers, securely closed, roofed structure with impervious floor, adequate ventilation, lockable when unattended, provision of water for spillage washdown, and siting or construction so spillages cannot drain into water supplies or soak into soil (regulation 16(1)). Ensure containers bear approved labels or are of a Minister-approved kind (regulation 16(2)).
• Transport: Ensure pesticides are transported in securely closed containers bearing approved labels or Part 7 permit labels, or in securely fixed spray tanks prominently marked per regulation 17(2). If pesticides are left in a vehicle, provide an enclosed storage facility securely fixed to the vehicle and keep the pesticide locked (regulation 17(1)(b)). Fit a gas-tight barrier between the driving compartment and storage area in vehicles used to transport pesticides (regulation 17(1)(c)). Document compliance checks for transport arrangements.
• PPE and first aid: Ensure technicians wear protective clothing sufficient to prevent contamination and have suitable first aid materials available where pesticides are used (regulation 9(4)(a)-(b)). Keep records of PPE issued and first aid inventory.

5. Follow labels, permits and standards

• For registered pesticides, follow all instructions on the approved label for containers unless the pesticide is the subject of a Part 7 permit (regulation 19(1), 19(3)). For Part 7 permit pesticides, ensure compliance with permit conditions and avoid using such pesticides for unauthorised purposes (regulation 19(2), 19(4)).
• Ensure pest control work complies with the prescribed standards and codes of practice listed in regulation 18(3). Maintain copies or access to AS 3660.1:2014, AS 3660.2,2000, and the South Australian Health Commission codes and ensure staff are trained in them.

6. Record-keeping and information flows

• Maintain a technician file for each pest management technician employed, including name, address, date of birth, dates of employment and pesticides handled (regulation 21(1)). Retain technician records for 7 years after the date of last entry (regulation 21(3)). Forward a copy to the Minister within 28 days after the technician ceases employment (regulation 21(2)).
• For each pesticide application, record date, time, location, pesticide name and quantity, technician name, proximity of other people, prevailing weather conditions for outdoor work, and for pre/during-construction termiticide applications the total surface area treated and supplier details (regulation 21(4)). Retain application records for 7 years (regulation 21(5)).
• Establish document control, backups and secure storage for these records to ensure retention and rapid production if the Minister requests specified information (regulation 21(6)).

7. Spillage and incident management

• Draft and implement a spillage response plan consistent with regulation 20 and ensure personnel understand immediate reporting obligations to the Minister or police for spillages that require assistance or pose immediate environmental or public health risk (regulation 20).
• Ensure cleaning and decontamination methodologies comply with the Minister-approved manner for cleaning and decontaminating following spillage where required by licence conditions (regulation 9(4)(e)).

8. Medical surveillance and knowledge assessment

• Prepare to submit technicians to medical examinations that the Minister considers necessary to monitor exposure to pesticides (regulation 9(4)(f)). Engage occupational health providers to be available and maintain consent and privacy procedures.
• Implement internal assessments and continuing training so technicians can demonstrate the knowledge required by the Minister under regulation 9(4)(g).

9. Notifications, changes and employment transitions

• Maintain a process to notify the Minister within 14 days of any change in business name or address for pest controller licence-holders (regulation 22).
• For limited pest management technicians, ensure notification to the Minister within 14 days of change or cessation of employment (regulation 23).
• For licence renewals, calendarise renewal windows: pest controller's licences and full technician licences may be for 1 or 3 years (applicant choice) and require renewal applications before expiry (regulation 11(1)). Limited licences expire on the first anniversary and have limited renewal and extension rules (regulation 11(2)-(4)).

10. Application process and procedural compliance

• Submit applications in the manner and form approved by the Minister and with the prescribed fee (regulation 24(1)). Be prepared to supply additional specified information and statutory declarations if the Minister requires them (regulation 24(2)).
• Where the Minister refuses a licence or imposes conditions, request written reasons promptly if not provided at the time of decision, to preserve the right to apply to the Tribunal within the one-month window (regulation 15(3)-(5)).

11. Exemptions and interstate business

• If seeking an exemption under regulation 12, prepare evidence that the exemption conditions will not entail significant risk to public health or the environment (regulation 12(3)). Note that exemptions can be varied or revoked by written notice (regulation 12(2)) and breach of exemption conditions is an offence (regulation 12(4)).
• If relying on interstate licencing recognition (regulation 6(1)(b)-(d)), verify that the interstate instrument is one of the specifically listed instruments and remains in force as amended.

12. Monitor legislative changes and approvals

• Keep track of Ministerial approvals and any updates to the prescribed standards and codes of practice, since these are applied "as in force from time to time" (regulation 18(3)). Also monitor amendments to the regulations themselves and any published guidance from the Minister's office.

13. Internal audit and legal review

• Conduct periodic internal compliance audits focused on storage, transport, labelling, PPE, record-keeping, spillage response, supervision, and evidence of compliance with label and permit conditions. Retain audit reports to support "fit and proper" and compliance narratives in licence renewals or Ministerial inquiries.
• Have legal counsel review licence conditions and any proposed Ministerial variations to assess grounds for Tribunal review where necessary and to manage risks associated with "fit and proper" and medical fitness determinations.

Taken together, compliance requires business process controls, training, engineering controls (storage/vehicle fit-out), occupational health arrangements, record management systems that can produce seven-year retention and 28-day reporting, and an administrative interface with the Minister’s office to manage licences, approvals and potential reviews.
