Controlled Sports Regulation 2019

The Regulation builds from the Act’s terminology and supplies operational definitions and required practices. Key statutory and regulatory concepts are:

• Controlled sport: The Regulation clarifies when an activity is not a combat sport by prescribing a four-part test for exclusion. An activity is not a combat sport if it is unlikely to involve forceful contact with head, neck, spine or groin; is carried out solely for entertainment; includes choreographed movements or a predetermined outcome; and there is no official score kept and no official winner recorded (s 5A). This gives a precise exclusion for staged, choreographed entertainment.

• Controlled sports official and support trainer: The Regulation prescribes the capacity of a support trainer (s 5B). A “support trainer” is a person registered as a trainer who supports or acts as a second for another trainer but is not registered as a second. The section cross-references the Act’s list of capacities (Act, s 11(3) as cited).

• Registrable vs non-registrable events: The Regulation distinguishes obligations for registered events (those registered under the Act) and non-registrable events (events that are not registrable under the Act but may be approved by an authorised controlled sports body). Different minimum ages, approval conditions, and notice requirements apply depending on this classification (ss 13-19).

• Registrar and authorised controlled sports body: The registrar is the decision-maker for registrations and renewals; the authorised controlled sports body is the entity that may approve non-registrable events and be declared by the Minister. The Regulation prescribes factors the Minister must consider when declaring an authorised body, including constitution, board structure, policies for risk management, insurance, communication, education and medical procedures (s 17).

• Medical regime and record-keeping: The Regulation establishes required content in certificates of fitness (s 20), the investigations that must support pre-event medical clearance certificates (s 22), and the role of a medical record book with specified entries and who issues it (s 15(2), s 15(1)(a)). Registered medical practitioners must record pre-event clearance results and must report serious injury or death immediately to inspectors and the registrar and follow with a written statement within 24 hours (s 15(1)(a), (c)).

• Renewals and evidentiary requirements: For renewals, the registrar must consider photographic evidence and, where applying in a new capacity, evidence of qualifications or experience (s 9). For corporate registrations, evidence of identity for each relevant person is required (s 7).

• Corresponding laws: The Regulation lists specified interstate Acts that are treated as corresponding laws (s 21). This list affects how out-of-jurisdiction events and registration equivalence are treated, and it includes statutes from SA, WA, NSW and Victoria.

• Minimum ages and exceptions: The Regulation sets minimum ages and grants the Minister power to approve lower ages for certain non-registrable events, subject to specified considerations including rules, protective measures, compliance history and advice from an advisory committee (s 19).

• Draw and event specification: The dictionary defines “draw” as a list of contestants and includes the controlled sport and number of rounds for each contestant (Dictionary, draw definition). Applications to register events must include a draft draw unless the registrar dispenses with it (s 13(1)(c)).

These concepts interact through obligations on contestants, officials, organisers, registrars and the Minister. The Regulation frequently cross-references provisions of the Act and other Acts, embedding administrative discretion (eg, the registrar may require or waive a draft draw) and Ministerial decision-making with statutory considerations.

The Regulation imposes duties and creates operational requirements for a clearly defined set of participants and decision-makers. Principal affected groups are:

• Individual contestants and registered controlled sports contestants: Individuals seeking registration as contestants must supply photographic evidence of identity (s 10), comply with event directions (s 11(1)(a)), notify address and medical fitness changes (s 11(1)(b)), and report participation in events in unregulated jurisdictions with detailed post-event information within prescribed timeframes (s 11(1)(c)-(2)). The minimum ages differ by event type: 18 years for registered events (s 14) and 14 years for non-registrable events, subject to exceptions (s 19).

• Registered medical practitioners and other medical staff: Registered medical practitioners at events are required to record pre-event medical clearance examinations in the contestant’s medical record book and to record fitness opinions and restrictions (s 15(1)(a)). They must provide written recommendations to the registrar where suspension or cancellation of registration is recommended and must report serious injuries or deaths immediately to any inspector present and the registrar, and in writing within 24 hours (s 15(1)(b),(c)).

• Controlled sports officials (individuals): Officials seeking registration must provide photographic evidence of identity and comply with conditions once registered, including following directions from the registrar, inspectors, medical practitioners and referees at events, and notifying changes to address/contact details (ss 6, 8).

• Corporations and entities conducting events: Corporations applying to be registered controlled sports officials must provide photographic evidence of each relevant person’s identity (s 7). Event organisers must include specified details in applications to register a registrable event (s 13) and non-registrable events must be approved by an authorised controlled sports body that must be satisfied of conflict-of-interest absence, compliance with stated conditions, and insurance (s 16). Non-registrable event notices must include the organiser’s contact details, names and ages of contestants, lists of officials, rules and a copy of written approval (s 18).

• Authorised controlled sports bodies: These bodies approve non-registrable events and must satisfy statutory conditions before approval (s 16). The Minister is required to consider a list of organisational and governance matters before declaring an entity an authorised controlled sports body (s 17). The authorised body’s compliance history and procedures may influence Ministerial decisions on minimum-age exceptions (s 19(3)).

• The registrar and inspectors: The registrar decides registrations and renewals, can require or waive elements of event applications (eg, draft draws or lists of officials, s 13(1)(c),(d)), and receives immediate and written reports of serious injuries/deaths (s 15(1)(c)). Inspectors appointed under the Act carry powers at events and are recipients of immediate injury reports (s 15(2) and cross-reference to Act, s 71 in s 15(2) note).

• The Minister and advisory committee: The Minister makes declaration decisions and may approve lower minimum ages for non-registrable events subject to considerations and may consult an advisory committee as part of the decision-making process (s 17, s 19(3), (7)).

• Entities in other jurisdictions and national sporting organisations: The Regulation interacts with interstate laws listed as corresponding laws (s 21) and preserves a role for national sporting organisations to authorise events conducted under their rules (s 19(2)(a)).

Who pays. The Regulation implicitly places costs on applicants, organisers and contestants: photographic identity evidence, medical examinations and certificates, insurance to satisfy code-of-practice requirements, administrative preparation of event documentation and notification materials, and the logistical burden of timely reporting required by s 11 and s 15.

Who decides. Decisions are distributed: the registrar decides registrations and can set documentary expectations (ss 9, 12, 13); authorised controlled sports bodies decide non-registrable event approval subject to Ministerial declaration (ss 16-18); the Minister declares authorised bodies and may approve lower minimum ages (ss 17, 19); inspectors and registrars issue directions at events enforceable under registration conditions (ss 8, 11). The ACAT provides review rights for Ministerial refusals on minimum-age approvals (s 19(4)-(5)).

The Regulation assigns precise duties to registrants, medical practitioners, organisers and decision-makers, and affords discrete rights, including review rights. The principal duties and rights, with section references, are:

Duties on applicants and registrants

• Photographic evidence: Applicants for individual registration as officials and contestants must provide photographic evidence of identity (ss 6, 10). Corporations must provide photographic evidence for each relevant person (s 7). Renewal applications must include photographic evidence and relevant supporting documents (ss 9(a)(i), 12(a)).

• Compliance with directions at events: Registered controlled sports officials and contestants are obliged to comply with directions given by the registrar; inspectors under the Act, s 73; registered medical practitioners at the event; and registered referees (ss 8(a), 11(1)(a)).

• Notification obligations: Registered officials and contestants must tell the registrar of changes to address or contact details (s 8(b), s 11(1)(b)(i)), and contestants must tell the registrar of changes to medical fitness that may indicate they are no longer fit to compete (s 11(1)(b)(ii)). Contestants must report participation in events in unregulated jurisdictions within prescribed timeframes and include specified details (s 11(1)(c)-(2)).

• Medical certificate content: A certificate of fitness must contain prescribed details, such as current injuries or medical conditions, date last competed, and details of head trauma since the prior certificate (s 20). Pre-event medical clearance must include the listed investigations such as dehydration, recent alcohol or prohibited-substance use, recent injury, illness, skin infection and pregnancy (s 22).

Duties on medical practitioners

• Pre-event examinations and records: Registered medical practitioners must record the results of pre-event clearance examinations in the contestant’s medical record book and record fitness opinions and any recommended restrictions (s 15(1)(a)).

• Suspension/cancellation recommendations: If recommending suspension or cancellation of registration, the practitioner must provide a written statement to the registrar setting out the recommendation, reasons, recommended suspension period (if for suspension), and anything else relevant; and record the same in the contestant’s medical record book (s 15(1)(b)).

• Serious injury and death reporting: If a contestant sustains a serious injury or dies at a registered event, the practitioner must immediately tell any inspector present and the registrar, and within 24 hours provide a written statement to the registrar and record the details in the medical record book (s 15(1)(c)).

Duties on event organisers and authorised bodies

• Event application contents: Applications to register a registrable event must include prescribed items such as place, maximum number of tickets, a draft draw (unless waived), list of officials (unless waived), each controlled sport and its rules, insurance evidence as set out in the code of practice, and specifications for gloves/hand wraps/bandaging (s 13(1)).

• Approval conditions for non-registrable events: Authorised controlled sports bodies may only approve non-registrable events if satisfied that the person conducting the event does not have conflicting interests, has met any stated conditions (examples given), and the event will be appropriately insured (s 16). The Regulation gives examples of conditions, including proving contestants are medically fit, emergency management procedures, and agreeing to reporting requirements (s 16 examples).

• Notice requirements for non-registrable events: Notices must include a set list of content items including the authorised body’s written approval, names and ages of contestants, draw, rules including modified rules for children, and written evidence the event is not registrable (s 18).

Duties on the Minister and rights of review

• Considerations for declaration: Before declaring an authorised controlled sports body, the Minister must consider whether the entity has a constitution and board, risk-management policies, appropriate insurance, member communication, training and accreditation for officials, medical procedures, and agreement to comply with conduct requirements in the code of practice (s 17).

• Discretion on minimum ages: The Minister has the power to approve a lower minimum age for non-registrable events subject to the considerations in s 19(3). If the Minister refuses to approve a lower minimum age, that refusal is a reviewable decision and a reviewable decision notice must be given. The authorised controlled sports body may apply to the ACT Civil and Administrative Tribunal for review (s 19(4)-(5)).

Enforcement and sanctions

• Medical practitioners may recommend suspension or cancellation of registration and must provide reasons to the registrar (s 15(1)(b)), which triggers action under the Act (reference to Act, s 58(3) in s 15(1)(b)). The Regulation itself does not specify monetary penalties for particular breaches but situates offences within the Criminal Code and penalty-unit regime (s 5 and republication notes). The registrar and inspectors have practical enforcement roles at events, and registered persons are subject to directions from those office-holders (ss 8, 11).

Documentary rights and administrative processes

• The registrar has discretion to require or waive some application elements, for example a draft draw or list of officials (s 13(1)(c),(d) noting “unless the registrar has told the applicant a draft draw is not needed”).

• The Regulation prescribes that medical record books may be issued by the registrar or a registrar under a corresponding law (s 15(2)(a)), which preserves cross-jurisdictional recognition.

These duties and rights allocate routine operational responsibilities (identity evidence, reporting, medical testing and event paperwork) and preserve administrative decision-making channels including review to ACAT for certain Ministerial decisions (s 19(4)-(5)).

The Regulation frames offences and enforcement by reference to other statutory regimes and by prescribing compliance obligations that, if breached, may trigger powers and sanctions under the Act and general criminal law.

Statutory framing

• Offences against the Regulation are subject to the Criminal Code, chapter 2, which sets general principles of criminal responsibility, burdens of proof and defences (s 5). The Regulation expressly states other legislation applies to offences against it (s 5). This means that the elements of criminal liability, including intention, recklessness and strict liability dimensions, are governed by the Code’s definitions and principles.

• Penalty units: The republication notes state the value of a penalty unit for offences against this law at the republication date, being $160 for individuals and $810 for corporations (Legislation Act, s 133), and the Regulation refers readers to the Legislation Act for the meaning of penalty units (s 5, note 2). The Regulation itself does not attach discrete monetary penalties to specific contraventions but anchors offences to the Code and the penalty-unit system.

Operational enforcement mechanisms and duties

• Directions and compliance at events: Registered controlled sports officials and contestants must comply with directions given by the registrar, inspectors, registered medical practitioners and registered referees while participating at a registered event (ss 8(a), 11(1)(a)). Non-compliance with directions could amount to a regulatory breach and expose a person to action under the Act or associated enforcement provisions.

• Medical practitioner recommendations: Registered medical practitioners are given a statutory route to recommend suspension or cancellation of a contestant’s registration. When a practitioner recommends suspension or cancellation, they must deliver a written statement to the registrar setting out the recommendation, reasons and recommended suspension period where applicable (s 15(1)(b)). The Act (referenced in s 15) sets out how the registrar must act on such recommendations; the Regulation prescribes the reporting format and content that supports enforcement of registration conditions.

• Serious injury and death: The Regulation imposes immediate reporting duties to inspectors and the registrar where a contestant sustains a serious injury or dies at a registered event, with a requisite written statement to follow within 24 hours (s 15(1)(c)). These reporting duties channel incidents into administrative and investigative processes.

Administrative review and tribunal pathways

• Reviewable decisions and ACAT: A Ministerial refusal to approve a lower minimum age for a non-registrable event is a reviewable decision; the Minister must issue a reviewable decision notice and affected authorised controlled sports bodies may apply to the ACT Civil and Administrative Tribunal for review (s 19(4)-(5)). The Regulation notes the requirements for such notices and that reasonable steps should be taken to notify persons whose interests are affected (s 19(4) note 1).

Discretion and enforcement reach

• The Regulation vests administrative discretion in the registrar and authorised bodies. For example, the registrar can waive requirements for a draft draw or list of officials (s 13(1)(c),(d) “unless the registrar has told the applicant a draft draw is not needed”). That discretion shapes where enforcement focus will land operationally: where the registrar imposes a document requirement or issues directions, non-compliance becomes enforceable.

• The role of inspectors is underscored by cross-reference to the Act: inspectors are recipients of immediate reports of serious injuries and have directional authority at events (s 15(2) note), and their appointment and powers are governed by the Act (Act, s 71 referenced in the note).

Practical consequences

• The practical enforcement consequences arise primarily through administrative action (suspension/cancellation recommendations, registrar directions, event approval revocations), immediate incident reporting leading to regulatory responses, and potential criminal liability where an offence against the Regulation engages the Criminal Code principles. Monetary penalties are not enumerated per contravention in the Regulation; however, the Criminal Code and the Legislation Act’s penalty-unit valuation supply the framework for any penalties that may be applied under applicable offence provisions.

The Regulation is an instrument made under the Controlled Sports Act 2019 and it deliberately cross-references and integrates with several other statutory regimes. The primary interactions and legal cross-links are:

• The Controlled Sports Act 2019: The Regulation operates beneath the Act and frequently cites Act sections for application requirements, registration capacities, powers of the registrar, and definitions. Almost every operative provision is framed as “,Act, s X” indicating the Regulation’s role in prescribing particulars under Act powers (for example, ss 5A-5B refer to Act ss 7 and 11; ss 6-12 refer to Act ss 15-31; ss 13-19 refer to Act ss 34-66). The Regulation thus fills in the Act’s detail work: documentary requirements, medical reporting specifics and event-application components.

• The Criminal Code: Offences against the Regulation are regulated by the Criminal Code, chapter 2, which governs criminal responsibility, fault elements, and defences (s 5). This makes the Code’s definitions and general principles applicable when conduct constituting an offence is prosecuted.

• The Legislation Act 2001: The Regulation relies on the Legislation Act for penalty-unit meaning and for editorial republication rules (s 5 notes and republication preface). The republication notes set the monetary value of penalty units as at the republication date.

• Medicines, Poisons and Therapeutic Goods Act 2008: The Regulation’s definition of “prohibited substance” for pre-event medical clearance purposes points directly to that Act (s 22(2)), incorporating the medicinal/substance regime into the medical screening requirements.

• Corresponding laws (interstate Acts): The Regulation prescribes a list of corresponding laws (s 21) which affects cross-jurisdictional recognition and the concept of an “unregulated jurisdiction” in s 11. The corresponding law list includes:

  • Boxing and Martial Arts Act 2000 (SA)
  • Combat Sports Act 1987 (WA)
  • Combat Sports Act 2013 (NSW)
  • Professional Boxing and Combat Sports Act 1985 (Vic) This list establishes which interstate statutory regimes are treated as equivalent for purposes such as recognition of registrars’ records and possibly medical record books (s 15(2)(a)).

• ACT Civil and Administrative Tribunal Act 2008: The Regulation uses the ACAT framework for reviewable decision notices and review rights: refusals by the Minister to approve lower minimum ages for non-registrable events require a reviewable decision notice and provide the authorised controlled sports body with ACAT review rights (s 19(4)-(5)). The Regulation references ACAT’s procedural requirements and forms.

• Repealed/earlier Acts and definitions: The Regulation’s definition of “controlled sports legislation” in s 19(7) references the Boxing Control Act 1993 (repealed) as part of historical context, as well as the Controlled Sports Act 2019 and corresponding laws. This shows the Regulation is intended to bridge the new Act with legacy frameworks.

Operational points of interaction

• Medical records and interstate recognition: The Regulation contemplates medical record books issued either by the registrar or by a registrar under a corresponding law (s 15(2)(a)), which is an explicit mechanism for cross-jurisdictional recognition of medical clearances and histories when contestants compete in other jurisdictions.

• Unregulated jurisdictions: The Regulation defines an “unregulated jurisdiction” as an overseas location or another jurisdiction that does not have a corresponding law (s 11(3)). This definition creates differential reporting duties for contestants (s 11(1)(c)-(2)) and imposes a specific mechanism to feed information back into the ACT regulatory system for incidents occurring outside recognised corresponding-law territories.

• Codes of practice and insurance requirements: The Regulation requires evidence of appropriate insurance “as set out in the code of practice” for event registration (s 13(1)(h)) and requires authorised bodies to comply with conduct requirements set out in the code of practice (s 17(h)). These cross-references mean that the code of practice, which sits outside the Regulation, is an essential operational instrument and will influence what documents organisers must present and the baseline safety and conduct standards.

• Ministerial and tribunal processes: The Regulation integrates administrative law principles by requiring reviewable decision notices where the Minister refuses certain approvals and by pointing to ACAT procedures and forms (s 19(4)-(5)), thereby embedding mechanisms for administrative review and judicial oversight consistent with the broader ACT administrative law architecture.

These cross-references make the Regulation a detailed operational extension of the Act that relies on other statutes and administrative instruments (codes of practice, ACAT forms) to function. Practitioners should note that compliance requires attention to the Act, the Criminal Code, the Medicines, Poisons and Therapeutic Goods Act, the listed corresponding laws and the code of practice referenced throughout the Regulation.

The Regulation’s republished instrument includes amendments up to 13 September 2024. The history recorded in the endnotes identifies the initial making and later amendment:

• Original enactment: Controlled Sports Regulation 2019 SL2019-26 was notified on the legislation register on 23 September 2019. Sections 1 and 2 of the Regulation commenced on 23 September 2019 (Legislation Act, s 75(1)), and the remainder of the Regulation commenced on 11 October 2019 pursuant to the Controlled Sports Act 2019 commencement provisions and s 2 (Endnote 3).

• Subsequent amendment: Controlled Sports Amendment Regulation 2024 (No 1) SL2024-27 was notified on the register on 12 September 2024. Sections 1 and 2 of the amending instrument commenced on 12 September 2024 (Legislation Act, s 75(1)), and the remainder of that amending regulation commenced on 13 September 2024 (Endnote 3). The amendment is recorded in the amendment history (Endnote 4).

Substantive changes recorded in the amendment history include:

• Insertion of a new Part 1A (Important concepts) by SL2024-27 (amendment entry: “pt 1A hdg ins SL2024-27 s 4”).
• Addition of s 5A (Meaning of controlled sport , a four-part exclusion test for staged/choreographed entertainment) and s 5B (Meaning of controlled sports official , capacity of support trainer) by SL2024-27 (entries “s 5A ins SL2024-27 s 4” and “s 5B ins SL2024-27 s 4”).
• A replacement of the Part 3 heading and an amendment to the minimum age for contestants at non-registrable events in s 19 by SL2024-27 (entries “pt 3 hdg sub SL2024-27 s 5” and “s 19 am SL2024-27 s 6”).

The republication notes also identify that editorial changes authorised under the Legislation Act 2001, part 11.3 may have been made in preparing the republication, but editorial changes are not included in the amendment history entries here. The endnotes comment that uncommenced amendments are underlined in the legislation history where applicable; in this republished version the amendments recorded were commenced as noted.

Practitioners should consult the legislative register for the amending instrument SL2024-27 to inspect any legislative notes, explanatory material or transitional arrangements that accompanied the amendment. The amendment history as recorded demonstrates targeted additions: definitional clarifications (Part 1A) and a legislative adjustment to minimum-age settings for non-registrable events.

The republished Regulation contains no entries referencing judicial or tribunal decisions that interpret the Regulation itself. The endnotes and text do not record any litigation history, and no cases are named in the body of the Regulation. The only adjudicative pathway explicitly provided within the Regulation is administrative review to the ACT Civil and Administrative Tribunal (ACAT) in relation to a Ministerial refusal to approve a lower minimum age for a non-registrable event (s 19(4)-(5)). The Regulation specifies the procedural requirement for a reviewable decision notice and that affected entities may apply to ACAT for review; it also notes that, if ACAT provides an approved form, it must be used (s 19(5) note).

Because the Regulation cross-references the Act and other statutes that have been the subject of past litigation in different contexts, any future legal disputes about interpretation of registration requirements, medical reporting duties, the meaning of “controlled sport” (including the new exclusion test in s 5A), or the exercise of Ministerial discretion could generate litigation or tribunal review. However, the Regulation’s text does not cite or summarise any precedent or reported decision.

For practitioners preparing for potential disputes, the relevant procedural and review mechanisms are:

• Ministerial decision-making and reviewable decision notices for age-approval decisions (s 19(4)-(5));
• ACAT review for authorised bodies aggrieved by Ministerial refusals (s 19(5));
• The general application of the Criminal Code for offences (s 5) meaning that any prosecution for an offence against the Regulation would engage chapter 2 principles of the Criminal Code; and
• Administrative law requirements for decision notices and reasonable steps to inform persons whose interests are affected (s 19(4) notes, which reference the ACT Civil and Administrative Tribunal Act 2008, s 67A).

Absent judicial interpretation in the republished law, readers must rely on the text of the Regulation, the Act, and the cross-referenced legislation. Any litigation would likely focus on statutory interpretation questions (for example, scope of the choreographed-entertainment exclusion in s 5A, or the threshold for Ministerial approval of age exceptions in s 19) and on procedural fairness in application of registrar and Ministerial discretion.

The Regulation is prescriptive in places and silent or discretionary in others. Several practical pitfalls and areas for careful attention emerge from the text itself:

1. Photographic evidence requirement without prescribed documents

• The Regulation prescribes that photographic evidence of identity must be provided for individuals and each relevant person for corporations (ss 6-7, 10, 9(a)(i), 12(a)). It does not specify which photographic documents are acceptable (eg, passport, driver licence), leaving the registrar discretion to accept or reject particular forms of photographic evidence. Practitioners should be aware that identity evidence may be challenged if the registrar considers it insufficient.

2. Registrar discretion to waive application components

• The Regulation permits the registrar to tell an applicant that a draft draw or list of officials is not needed for a registrable event (s 13(1)(c),(d)). This discretion can create uncertainty for applicants who may preparing full documentation only to be directed to provide less or, conversely, to provide more. The practical consequence is that applicants should engage with the registrar early to clarify documentary expectations.

3. Insurance references rely on external code of practice

• Evidence of “appropriate insurance” is required as set out in the code of practice (s 13(1)(h)), and authorised bodies must agree to conduct requirements set out in the code (s 17(h)). Because the code is an external document, compliance requires accessing and interpreting the code. The Regulation does not reproduce the code’s content, so organisers must obtain and follow the code to ensure their insurance and conduct arrangements will satisfy the registrar or authorised body.

4. Medical requirements include pregnancy and prohibited substances

• Pre-event medical investigations must include pregnancy checks and investigation for prohibited substances (s 22(1)(vi), (1)(ii) and s 22(2) referencing the Medicines, Poisons and Therapeutic Goods Act 2008). This implicates sensitive personal information and raises practical questions about consent, testing methods, confidentiality and timing. Practitioners should build protocols for obtaining informed consent and handling sensitive results within privacy law constraints.

5. Short timeframes and detailed reporting for out-of-jurisdiction events

• Contestants who compete in unregulated jurisdictions must report detailed information to the registrar not less than 7 days after return to Australia (s 11(2)). The required data is detailed (date/place, controlled sport, weight, injuries, treatment, opponents’ names/weights, rounds, results) (s 11(1)(c)). This is operationally onerous, particularly for overseas contests. Failure to comply may be a breach of registration conditions.

6. Definition of “not a combat sport” requires fact-specific application

• The exclusion for choreographed entertainment is multi-factored and fact-specific (s 5A). Determining whether an event is “carried out solely for entertainment purposes” and whether outcomes are predetermined will require evidence and may be contested. Event organisers should document choreography, fixed outcomes, and lack of official scoring to avoid reclassification as controlled sport.

7. Ministerial discretion on minimum ages creates potential for delay and review

• The Minister can approve lower minimum ages for non-registrable events where authorised bodies are not national sporting organisations (s 19(2)(b)). The Regulation prescribes considerations but does not set objective thresholds (s 19(3)). Where the Minister refuses an application, the decision must be set out in a reviewable decision notice and can be reviewed by ACAT (s 19(4)-(5)). Applicants seeking age exceptions should anticipate procedural timelines, provide robust supporting evidence (rules, safety measures, compliance history, advisory-committee advice), and be prepared for administrative review.

8. Limited list of corresponding laws

• The Regulation prescribes a fixed list of corresponding laws (s 21). If another jurisdiction updates its law or if new interstate laws are enacted, those laws will not be “corresponding” for purposes of the Regulation until added. Participants who compete in states not listed should be prepared for the ACT registrar treating those jurisdictions as “unregulated” for reporting duties (s 11(3)).

9. Medical record book issuance and portability

• A medical record book is to be issued by the registrar or a registrar under a corresponding law (s 15(2)(a)). Where contestants move between jurisdictions, ensuring portability of medical records requires administrative coordination and reliance on corresponding laws being recognised. The Regulation’s reliance on corresponding laws may complicate cross-border recognition when the corresponding-law list is limited.

10. Penalty-unit application but no itemised fines

• The Regulation leaves the substantive penalty architecture to the Criminal Code and the Legislation Act. Practitioners should not expect the Regulation to list discrete monetary fines for specific contraventions; potential penalties must be located in offence provisions that apply to the Regulation and then quantified via penalty units whose values may change over time (s 5; republication notes).

11. “Support trainer” role may create registration-role ambiguity

• The Regulation prescribes a support trainer as a person who is registered as a trainer and supports or acts as a second but is not registered in the capacity of a second (s 5B). This creates a hybrid role whose permissible functions and obligations may require operational clarification at events, particularly where roles overlap or where event rules differentiate between trainers and seconds.

12. Draft draws must include number of rounds per contestant

• The Regulation’s dictionary defines “draw” to include the number of rounds each contestant will intend to compete in (Dictionary). Organisers must therefore prepare draws with round allocations; late changes to rounds may have regulatory implications for event registration.

These “gotchas” flow directly from the Regulation’s text. Parties should document compliance steps, seek early engagement with the registrar and authorised bodies, and ensure medical, insurance and identity processes are fully operationalised to avoid regulatory friction.

Compliance requires aligning documentary procedures, medical practices, event administration and governance with the Regulation’s prescriptions. The following checklist maps specific regulatory requirements to practical actions, citing the relevant sections. Tailor procedures to your role: organiser, contestant, official, medical practitioner, authorised body or registrar.

Identity and registration paperwork

• Individuals (officials and contestants): Obtain and lodge photographic evidence of identity as part of initial applications and renewal applications (ss 6, 10, 9(a)(i), 12(a)). Confirm with the registrar what photographic documents are acceptable (eg passport, driver licence) to avoid rejections.

• Corporations: Collect photographic evidence of identity for each relevant person involved in the corporate registration (s 7). Maintain accurate records for renewals in accordance with the Act and Regulation (s 9(b)).

Renewal applications and new-capacity applications

• On renewal, include photographic evidence, satisfy application requirements per Act sections referenced in the Regulation, and where applying in a new capacity provide evidence of qualifications or experience (s 9(a)(i)-(iii), s 12). Prepare documented evidence of prior registration history if required.

Event registration processes

• Registrable events: Prepare an application that contains the prescribed elements in s 13(1): venue, maximum ticket numbers, a draft draw (unless registrar waives it), list of officials (unless waived), each controlled sport and its rules, statement on exempted light contact combat sports (if applicable), evidence of insurance as per the code of practice, and any specifications for gloves/hand wraps/bandaging.

• Engage the registrar early if you expect to seek a waiver for a draft draw or list of officials (s 13(1)(c),(d)). Keep the draft draw updated and ensure it includes the number of rounds per contestant (Dictionary, draw).

Insurance and code of practice

• Obtain insurance that meets the code of practice requirements and gather documentary proof to place on the event application file (s 13(1)(h)). Review and internalise the code of practice to ensure compliance with conduct requirements referenced in s 17(h).

Non-registrable event approval and notices

• If organising a non-registrable event, secure approval from an authorised controlled sports body only after the body is satisfied of conflict-of-interest absence, stated conditions, and insurance (s 16). Provide the authorised body with evidence of medical fitness for contestants, emergency management procedures, and acceptance of reporting obligations (examples in s 16).

• Prepare the public notice required by s 18 and ensure it contains each required item: event name, authorised body’s name and written approval, each controlled sport, date/time/location, details of person conducting the event, names and capacities of officials, names and ages of contestants, the draw, rules including modified rules for children, and written evidence the event is not registrable.

Medical compliance

• Medical record book: Ensure the contestant has a medical record book issued by the registrar or a registrar under a corresponding law (s 15(2)(a)). Keep the medical record book up to date with pre-event clearances, recommended restrictions and any injury or post-event treatment entries (s 15(1)(a), (c)).

• Pre-event medical clearance: Registered medical practitioners must perform the prescribed investigations for a pre-event medical clearance certificate (s 22(1)) including dehydration testing, alcohol or prohibited-substance testing per the Medicines, Poisons and Therapeutic Goods Act 2008, recent injury checks, illness checks, skin infection checks, and pregnancy checks where relevant.

• Certificate of fitness content: Ensure certificates of fitness contain the prescribed details: current injuries/medical conditions, date last competed, and details of any knockouts, concussions or head traumas since the prior certificate (s 20).

Incident reporting and suspension recommendations

• For serious injuries or deaths at an event, ensure that the registered medical practitioner (or responsible official) notifies any inspector present and the registrar immediately and provides a written statement to the registrar within 24 hours, and records the matter in the medical record book (s 15(1)(c)). If a practitioner recommends suspension or cancellation of registration, forward a written statement to the registrar with the recommendation, reasons and suggested suspension period (s 15(1)(b)).

Contestant reporting obligations

• Contestants who compete in unregulated jurisdictions (overseas or jurisdictions without a corresponding law) must report specified details to the registrar not less than 7 days after returning to Australia or the day of the event for other jurisdictions (s 11(1)(c), (2)). Implement an internal process to collect and lodge this data promptly.

Governance and authorised-body readiness

• If seeking Ministerial declaration as an authorised controlled sports body, prepare and maintain a constitution, board structure documentation, risk-management policies, insurance certificates, communication plans, education and accreditation processes for officials, and medical procedures. Be ready to show compliance with code-of-practice conduct requirements and to provide evidence of your compliance history (s 17, s 19(3)).

• If requesting Ministerial approval for a lower minimum age at a non-registrable event, compile evidence demonstrating how rules, procedures and safeguards appropriate for children are in place: protective equipment, shorter contests, restricted techniques, and evidence of compliance history and advisory-committee advice (s 19(3) and examples).

Inter-jurisdictional planning

• If contestants or officials operate across jurisdictions, map which states’ Acts are listed as corresponding laws (s 21) to understand recognition arrangements. For competitions in jurisdictions not listed, treat them as unregulated for reporting purposes and ensure the contestant provides the required information within the 7-day period (s 11(2)).

Records, privacy and consent

• Build secure processes to manage medical record books and sensitive medical data, including procedures for pregnancy testing and prohibited-substance testing, ensuring privacy, consent and data security practices are in place. Document who has access to medical record books and ensure they are issued and updated as required (s 15(2)(a), s 22).

Administrative engagement and dispute readiness

• Engage early with the registrar on any ambiguous matters (draft-draw waivers, identity-document standards, whether a sport is “not a combat sport” per s 5A). Where the Minister refuses an application to lower the minimum age, be prepared to seek ACAT review and ensure reviewable decision notices are timely and correctly served (s 19(4)-(5)).

Operational timings and checklists

• Medical incident reporting: immediate notification to inspector and registrar; written statement within 24 hours (s 15(1)(c)).
• Unregulated-jurisdiction reporting: submit required information not less than 7 days after return to Australia (s 11(2)(a)) or on the day of the event for another jurisdiction (s 11(2)(b)).
• Renewal submissions: submit photographic evidence and supporting application materials per s 9 and s 12 timelines under the Act.

Document templates and sample files

• Maintain templates for:
  • photographic-identity evidence checklist (list accepted documents agreed with registrar),
  • pre-event medical clearance certificate (including s 22 prescribed investigations),
  • certificate of fitness (s 20 mandated fields),
  • event application form mapped to s 13 required items,
  • non-registrable event notice template matching s 18 content,
  • incident-report template for 24-hour written statements (s 15(1)(c)),
  • sample draft draw including rounds per contestant (Dictionary definition).

Final note

• The Regulation ties many compliance obligations to other instruments (the Act, the code of practice, corresponding laws and the Medicines, Poisons and Therapeutic Goods Act). Effective compliance demands a coordinated administrative system that tracks documentary deadlines, medical record-keeping, insurance and code-of-practice versions, and that maintains auditable files to demonstrate compliance to the registrar, authorised bodies and, if needed, ACAT or enforcement authorities.
