Control of Naval Waters Regulation 2015

The Regulation relies on a small set of core concepts and institutional relationships. Those concepts are mostly defined in the Act (s 5 of the Regulation notes that "exempt vessel", "installation", "naval waters", and "superintendent" are defined in the Act). The Regulation then operationalises those concepts through permissions, notices, distances and express duties.

• Naval waters and foreshore: The Regulation governs "naval waters" and the foreshore of those waters, terms that are defined in the Act and therefore sit upstream of the Regulation (s 5). The superintendent’s powers to prohibit, restrict and direct conduct flow from the nature and use of those waters (ss 7 and 23 require the superintendent be "satisfied" that measures are in the interests of public safety, safety of property, or defence of the Commonwealth).
• Superintendent: The superintendent is the primary decision maker. The superintendent may give notices prohibiting or restricting entry (s 7), give written permissions (ss 9, 13-14, 17, 21-22, 25), place and mark moorings and buoys (s 10), direct removal (s 8), and require removal of structures or moorings and recovery of costs (ss 17(3)-(4), 27(2)-(3)). Delegation to specific Defence ranks is permitted (s 29).
• Permissions and notices: The instrument differentiates between public notices and written permissions. Some prohibitions operate by notice (ss 7, 23), whereas many operative permissions or exceptions require written permission from the superintendent (ss 9(1)-(3), 13(1), 13(3), 14(1), 15(1), 17(1), 25(1)). Notices can be absolute or subject to approval or conditions (ss 7(2), 23(2)). Notices must be given in a manner and time reasonably required for protection of affected persons, taking into account specific factors (ss 7(3), 23(3)).
• Strict liability and reasonable excuse: The instrument explicitly designates many offences as strict liability (for example ss 9(1), 11(1), 12(1), 13(1), 14(1), 15(1), 16(1), 17(1), 18(1), 21(3), 22(3), 25(4), 25(6), 26(1)). The Regulation’s notes repeatedly record that a defendant bears an evidential burden in relation to any claimed "reasonable excuse" (see the cross-reference to Criminal Code s 13.3). For one class of offences (s 7(4) and s 23(4)), strict liability is applied to the existence of notice only (s 7(5) and s 23(5) respectively).
• Defined distances and operational metrics: The instrument sets specific proximity limits: 180 metres (or other distance specified by the superintendent) from a mooring placed under s 10 (s 11(1)), 180 metres to electric cable lines indicated by shore marks (s 18(1)), 100 metres to installations/exempt vessels/other vessels for certain activities (ss 13(1), 14(1)), 30 metres approach limit to installations/exempt vessels (s 15(1)), and a vessel length threshold of 10 metres for certain anchoring restrictions near navigable channels (s 12(1)).
• Powers to place, require and remove moorings and structures: The superintendent may place moorings and other navigational aids (s 10), may require removal of privately laid moorings (s 17(3)), and may cause removal and recover costs if owners do not comply (s 17(4)). The Minister may prohibit construction on foreshores (s 27(1)) and superintendents may cause removal and recover costs (s 27(3)).
• Operational duties of masters and persons: The Regulation places obligations on masters including obtaining permissions, ensuring signals are displayed when carrying dangerous goods (s 26), maintaining crew and watches if required (s 20), facilitating searches (s 28), and complying with directions when anchors hook Commonwealth moorings or cables (s 19).

These core constructs create a permissions-regulation-enforcement model: broad supervisory discretion in the superintendent tailored by numerically specified spatial constraints, mandatory procedures for giving notice, and a network of strict liability offences combined with an evidential burden on defendants to raise a reasonable excuse. The Regulation also builds in Ministerial and inter-governmental references , Ministerial approval is required for charging for making vessels fast to Commonwealth property (s 9(4)), and State/Territory laws are preserved for refuse placement (s 21(5)).

The Regulation identifies particular legal actors and categories who bear rights, duties and potential liabilities. These are explicit or plainly implicit in the text:

• Masters of vessels: The Regulation repeatedly places duties and potential criminal liability on "the master of a vessel" (see ss 9-13, 15-16, 18, 19, 20, 25-26, 28). Masters are the primary regulated actor for anchoring, approaching installations, displaying signals for dangerous cargo, complying with watch and crew requirements, and responding to hooked moorings or cables.
• Owners of moorings and vessels: Owners of privately-laid moorings are responsible for removal on written notice by the superintendent (s 17(3)) and must pay removal costs if the superintendent removes the mooring (s 17(4)). Owners of structures constructed contrary to a Minister's notice must remove them and pay removal costs if the superintendent removes them (s 27(2)-(3)).
• Persons on foot or vehicles onto foreshore: The Regulation covers entry onto foreshore and persons in naval waters (ss 7, 14). Persons who enter or remain within 100 metres of installations or which interfere with installations need written permission (s 14).
• Exempt vessels and installations: Exempt vessels are expressly excluded from the generic definition of "vessel" in the instrument (s 6); however, the Regulation also contains specific proximity restrictions referring to "exempt vessel" (for example ss 11(1)(b), 13(1), 14(1), 15(1)). The Act defines "exempt vessel" and "installation" (s 5 note).
• Superintendents and delegates: Superintendents are empowered to make decisions and give directions (for example ss 7, 10, 17, 21-23). They can delegate to Defence Force officers of specified ranks (s 29). This affects Defence officers who may exercise these powers on behalf of the superintendent.
• Minister and Commonwealth: The Minister retains specific roles, notably approval of charges for making vessels fast to Commonwealth assets (s 9(4)) and the power to prohibit construction on foreshore (s 27(1)). The Commonwealth (through the superintendent and Minister) is placed in the role of decider and enforcer.
• Commercial operators and recreational users: While not named, the operational effect touches any person or business operating vessels, laying moorings, carrying dangerous goods, operating near installations or launching from foreshores. This includes charter operators, commercial shipping, fishing vessels, marina operators, recreational boaters, and maintenance and salvage operators. The Regulation’s specific numerical limits (e.g. 10 metre vessel length threshold in s 12) create differing compliance obligations depending on vessel size.
• State and Territory authorities and third-party owners of infrastructure: Section 21(5) preserves operation of State and Territory laws with respect to refuse placement, meaning operators must consider parallel regulatory regimes. Owners of cables, buoys or other infrastructure on or under naval waters are affected by s 19’s rules about hooked moorings and s 18’s marking requirement for cables.

Who pays: the instrument envisages that private actors will bear direct costs in several scenarios , civil removal costs for non‑compliant moorings or structures (ss 17(4) and 27(3)), potential penalty unit fines for offences, and charges for making vessels fast to Commonwealth property if the Minister approves such charges (s 9(4)). Who decides: the superintendent (and delegates), and in limited respects the Minister, make the substantive permission and charging decisions. What changes behaviour: masters must seek written permissions in many circumstances, avoid specified distances, display signals for dangerous cargo, and comply with superintendent directions or face strict liability offences and potential costs.

The Regulation creates discrete duties, discretionary rights vested in the superintendent and the Minister, and limited responsibilities for Defence delegates. The key duties and rights, with section references, are:

Duties on masters and persons

• Comply with notices restricting entry into naval waters or onto foreshores, when the superintendent has given a notice under s 7. Non‑compliance coupled with recklessness triggers an offence (s 7(4)-(5)).
• Obtain and comply with permission before making vessels fast to Commonwealth forts, moorings, buoys or other Commonwealth property, with strict liability for breaches (s 9(1)-(6)). Permissions may be conditioned and can attract charges subject to Ministerial approval (s 9(3)-(4)).
• Keep clear distances: do not anchor within the specified distance (generally 180 metres unless otherwise specified) from a mooring placed under s 10, and do not anchor within 180 metres of electric cables marked on shore (ss 11(1), 18(1)). Do not dredge, loiter or anchor within 100 metres of an installation/exempt vessel/other vessel without written permission (s 13(1)). Do not approach within 30 metres of an installation or exempt vessel unless on Commonwealth business or with written permission (s 15(1)). These are expressed as strict liability offences in most cases.
• Keep a sufficient number of crew and a watch where required by written notice from the superintendent (s 20).
• Display safety signals when carrying dangerous cargo: a large red flag or burgee between sunrise and sunset; a red light visible in clear weather for at least 3 kilometres between sunset and sunrise (s 26(1)).
• Notify and follow superintendent directions when a vessel’s anchor or other object hooks Commonwealth moorings, buoys or cables (s 19).
• Facilitate search and inspection by the superintendent or persons acting on behalf of the superintendent (s 28).
• Not deposit refuse or other specified material in or near naval waters unless permitted (s 21(1)-(3)). The section preserves State/Territory laws (s 21(5)).

Rights and discretions of the superintendent and Minister

• The superintendent may prohibit or restrict entry by notice for public safety, property safety or Commonwealth defence (s 7(1)-(3)). Notices can be absolute or conditional (s 7(2)).
• The superintendent may give, withhold or condition written permissions for a wide variety of activities (e.g. anchoring near installations, laying moorings, cleaning vessels, entry of vessels with dangerous cargo) and may cancel or vary permissions (s 13(1)-(3), s 22(1)-(3), s 25(1)-(3)). The superintendent can also place moorings and buoys (s 10).
• The superintendent may remove persons who contravene notices (s 8), require removal of privately-laid moorings and recover removal costs (s 17(3)-(4)), cause removal of prohibited foreshore constructions and recover costs (s 27(3)), and give directions about cleaning vessels (s 22).
• The Minister may approve terms and conditions that include imposition of charges for making vessels fast to Commonwealth property (s 9(4)) and may prohibit construction in or on the foreshore of naval waters (s 27(1)).

Enforcement mechanics and evidential framework

• Many offences are strict liability. Where a "reasonable excuse" is relied upon, the Regulation’s notes state that the defendant bears an evidential burden within the meaning of Criminal Code s 13.3 (referred to in the Regulation’s multiple notes). For offences in s 7(4) and s 23(4), strict liability applies to the existence of a notice (s 7(5) and s 23(5)). Penalties are expressed in penalty units (e.g. 5 or 10 penalty units for specified breaches). The Regulation does not convert penalty units to dollar amounts; that conversion is governed elsewhere.

Operationally significant features

• Permissions may be subject to conditions, including place and manner (e.g. cleaning, s 22(2); dangerous cargo conditions, s 25(2)). Permissions can be cancelled or varied (s 25(3)), which creates ongoing compliance monitoring needs for those relying on permissions.
• The superintendent holds operational control, but the Minister retains statutory roles (charges approval and construction prohibitions). Delegation to specified Defence ranks is explicitly permitted (s 29), allowing operational delivery by Defence officers.

These duties and rights create a permissions-first environment for activities in naval waters. The structure shifts decision rights to the superintendent, places operational compliance obligations on vessel masters and owners, and couples that with enforcement levers including strict liability offences, penalties and cost-recovery mechanisms for removals.

The Regulation sets out criminal offences, removal and cost-recovery powers, and administrative instruments of control. The enforcement architecture has several components.

Criminal offences: strict liability and recklessness

• Many specific contraventions are expressed as strict liability offences. Examples include:
  • Making a vessel fast to Commonwealth property without permission (s 9(1): 5 penalty units).
  • Anchoring/mooring within restricted distances from Commonwealth moorings (s 11(1): 10 penalty units).
  • Anchoring near navigable channels for vessels over 10 metres or leaving vessels unattended (s 12(1): 10 penalty units).
  • Dredging, loitering or anchoring within 100 metres of an installation without written permission (s 13(1): 10 penalty units).
  • Person entering or remaining within 100 metres of an installation without written permission (s 14(1): 5 penalty units).
  • Approaching within 30 metres of an installation without permission (s 15(1): 5 penalty units).
  • Laying a mooring without written permission (s 17(1): 10 penalty units).
  • Anchoring within 180 metres of electric cable lines indicated on shore (s 18(1): 5 penalty units).
  • Depositing material in or near naval waters other than in accordance with permission (s 21(3): 10 penalty units).
  • Cleaning a vessel in naval waters without permission (s 22(3): 10 penalty units).
  • Carrying explosives or dangerous goods into naval waters contrary to written permission (s 25(4): 10 penalty units).
  • Failure to display the prescribed signals when carrying dangerous cargo (s 26(1): 5 penalty units).
• For some offences tied to a notice (for example s 7(4) and s 23(4)), the Regulation treats the giving of the notice as a strict liability element (ss 7(5), 23(5)). The substantive fault element for those offences is recklessness as to non-compliance with the notice (s 7(4)(d), s 23(4)(d)).

Evidential burden and "reasonable excuse"

• Notes to multiple offence provisions state: "A defendant bears an evidential burden in relation to the matter in this subsection (see section 13.3 of the Criminal Code)". That appears after clauses that exclude operation of the offence if the defendant "has a reasonable excuse" (see e.g. ss 9(2), 9(6), 11(2), 12(2), 13(2), 14(2), 15(2), 16(2), 17(2), 18(2), 21(4), 22(4), 25(5), 25(7), 26(2)). The practical effect is that, while many offences are strict liability, a defendant must raise evidence to support a reasonable excuse; the Regulation points to the Criminal Code for the evidential standard.

Removal and cost recovery powers

• The superintendent may remove persons who contravene notices or whose entry contravenes notices (s 8).
• The superintendent may place moorings and buoys for naval ships and military operations (s 10).
• Where a private mooring has been laid without permission, the superintendent can require its removal in writing, and if not removed, the superintendent may remove it and require the owner to pay the cost of removal (s 17(3)-(4)).
• Where the Minister has prohibited a foreshore construction and a person constructs such a structure, the person must remove it (s 27(2)). If they fail to do so, the superintendent may remove it and the person must pay the cost (s 27(3)).

Searches, inspections and operational supervision

• The Regulation obliges masters to facilitate searches and inspections by the superintendent or persons acting on the superintendent’s behalf (s 28).
• The superintendent may direct how hooked anchors or objects are to be cleared and requires immediate notice to the superintendent when a hooking occurs (s 19).

Administrative flexibility and termination of permissions

• Permissions given by the superintendent for dangerous goods entry may be cancelled, or their conditions varied, at any time (s 25(3)). Permissions for cleaning vessels may be conditional (s 22(2)), as may permissions for placement of material (s 21(2)).

Penalties expressed as penalty units

• Penalties throughout the Regulation are expressed as numbers of "penalty units" (usually 5 or 10 units). The Regulation does not itself convert penalty units to monetary values; that conversion is governed elsewhere in Commonwealth law. Practitioners must therefore identify the current value of a penalty unit at the time of any enforcement action.

Enforcement actors and delegation

• The superintendent may delegate powers to Defence Force officers of ranks specified (Lieutenant‑Commander, Major or Squadron‑Leader) in writing (s 29). That creates an operational enforcement channel within Defence.

The enforcement architecture is therefore a mix of criminal sanctions (largely strict liability with a statutory nod to "reasonable excuse" and an evidential burden), administrative removal and cost recovery, and operational supervisory powers exercised by the superintendent or their delegates. The Regulation explicitly gives the superintendent broad discretionary authorities to issue prohibitions, permissions and conditions, and to direct and enforce compliance.

The Regulation situates itself within the Act and makes explicit connections to a small number of other legal instruments and frameworks. The interaction points to consider when applying the Regulation are:

Statutory source and upstream definitions

• Authority: The Regulation is made under the Control of Naval Waters Act 1918 (s 3). Core terminology such as "exempt vessel", "installation", "naval waters", and "superintendent" are defined in the Act, and the Regulation notes those definitions (s 5). Any legal interpretation of those terms in application will require reference to the Act.

Criminal Code evidential rules

• The Regulation repeatedly refers by note to section 13.3 of the Criminal Code in relation to the evidential burden that attaches to a defendant who relies on a "reasonable excuse" defence in the face of a strict liability offence (notes after many subsections). This imports the Criminal Code’s evidentiary allocation framework into prosecutions under the Regulation, meaning that practitioners must consult the Criminal Code to understand burdens in prosecutions for these offences.

State and Territory laws

• Section 21(5) expressly states that "Nothing in this section affects the operation of a law of a State or Territory" with respect to placement of material (refuse, ballast, etc). This preserves concurrent operation, at least in that area. The Regulation does not otherwise explicitly preserve or displace State or Territory law, but given the subject matter (foreshores, navigation) there will be practical overlaps with State port, environmental, and local government regulations; practitioners must analyse specific State law intersections, particularly for works, constructions, and environmental releases.

Ministerial and Defence administrative frameworks

• Ministerial role: The Minister’s approval is specifically required before the superintendent can make charges for making a vessel fast to Commonwealth property (s 9(4)). The Minister also has power to prohibit construction in or on naval foreshores (s 27(1)), referencing s 5 of the Act. Those Ministerial touches indicate a limited but important supervisory role by the executive.
• Delegation and Defence Force ranks: The superintendent may delegate to specific Defence ranks (s 29). This embeds the Defence Force within the day-to-day regulatory deployment of powers under the Regulation and links the Regulation operationally to Defence administrative practices and chain of command.

Maritime and navigational law

• The Regulation creates location and navigational constraints (anchoring distances, mooring placements, channel use) that will sit alongside other maritime and port instruments. The Regulation does not expressly repeal or amend Commonwealth maritime safety rules in other statutes, so operators will need to ensure compliance with overlapping Commonwealth and State maritime rules (for example navigation safety or marine pollution laws), and consider potential duplication or conflict.

Environmental and resource laws

• The Regulation addresses refuse placement and vessel cleaning, but s 21(5) preserves State/Territory laws. Environmental obligations under other Commonwealth statutes are not mentioned; accordingly, operators must remain alert to parallel environmental duties (for example pollution laws) which may independently apply.

Property and civil recovery

• The Regulation expressly creates private cost-recovery obligations against mooring owners and building constructors where the superintendent removes the object (ss 17(4) and 27(3)). These are statutory debt obligations enforceable under Commonwealth administrative law and debt recovery mechanisms, distinct from criminal penalties.

Constitutional and federal overlaps

• The Regulation does not address constitutional limits or migration of State powers, but because it relies on the Act for authority and intersects with State law in at least one explicitly preserved area (s 21(5)), constitutional questions could arise in particular contexts. The Regulation should therefore be read with attention to the Act’s geographic and subject-matter framing.

In sum, the Regulation directly imports the Act’s definitions and authorities, invokes Criminal Code evidential rules for prosecutions, preserves at least some State/Territory regulatory operation (refuse), and embeds the Defence Force and Minister into operational implementation. Practitioners must therefore consider a small but significant network of other legal materials , the Act for definitions and authority; the Criminal Code for evidential and burden rules; relevant State and Territory laws for environmental/foreshore regulation; and Defence administrative instruments for delegation and operationalisation.

The Regulation contains an explicit amendment history within its text and the accompanying Schedule. The key amendment history points recorded in the instrument are:

• Repeal of earlier instrument: Schedule 1 of the Regulation repeals the entire Control of Naval Waters Regulations 1922. The Schedule records "The whole of the Regulations" is repealed. This is a mechanical replacement: the 2015 Regulation supersedes the 1922 Regulations in full (Schedule 1,Repeals).
• Commencement: The instrument commences the day after registration (s 2). The document displays the formal executive instruments and signatures with the date 26 March 2015 (the Administrator signed and the instrument is made by the Minister for Defence).
• Authority and continuity: The Regulation is expressly made under the Control of Naval Waters Act 1918 (s 3). Section 4 provides that each instrument specified in a Schedule is amended or repealed as set out, and that any other Schedule item has effect according to its terms; only Schedule 1 appears and that repeals the 1922 Regulations.
• Textual stability: The Regulation as presented contains no express amendments subsequent to registration. The instrument itself is a standalone replacement instrument; there are no internal amendment clauses within the text modifying previously existing provisions other than the Schedule repealing the 1922 Regulations.

What this means in practice

• The 2015 instrument is a consolidating and updating instrument that replaces an earlier regulatory framework (1922 Regulations). The Regulation sets out the substantive control regime as of its commencement and does not include transitional or savings provisions within the text provided. Practitioners should therefore verify whether any transitional arrangements, if needed for existing moorings, permissions, or structures, were implemented elsewhere (for example by administrative practice or other instruments), because the Regulation itself does not record such transitional clauses.
• The Regulation contains internal cross-references and notes that incorporate external law (for example, reference to the Criminal Code evidential rules). Any later amendments either to the Regulation, to the Act or to the Criminal Code will affect operation; the Regulation text as provided should be read against the contemporaneous versions of those instruments as at commencement.

Records in the instrument

• The instrument is identified as Select Legislative Instrument No. 27, 2015, includes signatures by the Administrator and the Minister for Defence and a date, and states that it is made with the advice of the Federal Executive Council. These formalities mark the Regulation’s place in the legislative record.

Absent from the Regulation are descriptions of prior administrative practice, transitional provisions or subsequent amendments. The Schedule’s sole function in the text supplied is to repeal the 1922 Regulations. If practitioners require the amendment timeline post-2015 (for example, later variations to the Regulation), they will need to consult the legislative register for any subsequent instruments amending this Regulation or the Act.

The Regulation itself does not record judicial or tribunal decisions. The text contains no references to cases, no judicial interpretations, and no recorded litigation history. From the instrument alone, the litigation history is therefore:

• No cases named or cited in the Regulation.
• No mention of judicial review decisions, appellate interpretations, or enforcement precedents in the instrument.

Practical implications and likely litigation contours

• Although the Regulation does not record litigation, several discrete legal issues are plausibly susceptible to litigation once the Regulation is applied in practice. The Regulation’s text directs attention to potential judicial disputes that practitioners should anticipate and monitor, but any reference to particular litigated matters requires consultation of external case law and enforcement records beyond the Regulation text.

Potential litigation themes evident from the text:

• Strict liability and reasonable excuse: The instrument makes many offences strict liability but repeatedly notes that a defendant must bear an evidential burden to establish a "reasonable excuse" (notes referencing Criminal Code s 13.3). Legal disputes are likely to arise about what constitutes a reasonable excuse in particular operational contexts (for example, emergencies at sea, navigation exigencies, or conflicting instructions) and about the evidential threshold required to discharge the defendant’s evidential burden. The Regulation flags these evidential questions but does not resolve substantive standards.
• Procedural adequacy of notices: Sections 7 and 23 require the superintendent to "cause a notice ... to be given to such person or persons, in such manner, at such time and in such place as is reasonably required for the protection of the public, or any person who may be affected ..." Litigation could address whether the notice-giving process was adequate in particular circumstances (for example, a sudden operation where notice was limited in time or communicated narrowly). The Regulation prescribes the factors to be considered (ss 7(3), 23(3)), creating a textual standard that a court could review for reasonableness or procedural fairness.
• Delegation limits: Section 29 permits delegation to specified Defence ranks. Litigation could explore the scope and limits of delegations, especially concerning whether particular acts were properly delegated or whether delegates exceeded their statutory powers.
• Cost recovery and property rights: Recovery of removal costs for moorings or structures (ss 17(4), 27(3)) could give rise to civil actions or challenges concerning calculation of costs, notice adequacy, or potential contest between private property rights and statutory obligations.
• Overlap with State/Territory law: Section 21(5) preserves State/Territory law for refuse placement. Disputes may arise over concurrent jurisdiction, regulatory inconsistency, or which instrument controls where both regimes apply.
• Interaction with other Commonwealth laws: The Regulation references the Criminal Code for evidential burdens. Litigation could emerge about how the Regulation sits with other Commonwealth maritime or environmental statutes where enforcement regimes overlap.

Absent cases in the instrument means that practitioners must consult enforcement records, tribunal decisions, and reported judgments to identify how courts or agencies have applied the Regulation in practice. The Regulation’s specific numeric limits, strict liability architecture, and procedural notice requirements create fertile ground for litigation about evidential burdens, reasonableness, and administrative process , but any concrete litigation history must be sourced from external repositories, which this instrument does not supply.

The Regulation contains several provisions and drafting features that create practical compliance traps or points of legal risk for vessel masters, owners and operators. These "gotchas" are derived directly from the text and should be attended to by practitioners advising clients operating in or adjacent to naval waters.

1. Strict liability carries evidential burden for "reasonable excuse"

• Many offences are strict liability (for example ss 9(1), 11(1), 13(1), 17(1), 21(3), 22(3), 25(4)-(6), 26(1)). The Regulation’s notes repeatedly state that a defendant bears an evidential burden to prove a "reasonable excuse" (see notes referencing Criminal Code s 13.3). Practically, this means the defence of reasonable excuse must be raised with some evidence at trial; the defendant cannot merely assert it without evidence. That evidential burden is not further delineated in the Regulation itself.

2. Notice element treated as strict liability in some offences

• For the s 7 and s 23 notice‑based offences the Regulation makes strict liability apply to the existence of the notice element (s 7(5), s 23(5)). The substantive mental element is recklessness as to non‑compliance with the notice (ss 7(4)(d), 23(4)(d)). This hybrid approach means an accused cannot avoid liability by contesting whether a notice was given unless they establish the contrary evidentially.

3. Written permission versus superintendent notice

• Several prohibitions permit "written permission" while others may operate by notice. Written permissions are required for close‑approach activities (ss 13(1), 14(1), 15(1), 17(1), 25(1)). Permissions can be subject to conditions and can be cancelled or varied (s 25(3)). Operators relying on oral assurance or informal approvals risk liability if they lack the superintendent’s written permission.

4. Numerical distance requirements are absolute unless superintendent specifies otherwise

• Distance limits are expressed in precise metres (e.g. 30 m, 100 m, 180 m) (ss 11(1), 13(1), 15(1), 18(1)). For moorings placed under s 10 the superintendent can specify a different distance (s 11(1)(a) allows the superintendent to specify another distance). Practitioners should not rely on imprecise or customary understandings of distance; compliance requires attention to current notices and superintendent specifications.

5. Ministerial approval for charging is required

• The superintendent may impose a charge for making a vessel fast to Commonwealth property but only "subject to the approval of the Minister" (s 9(4)). That creates a two‑actor process for charges: operational permission from the superintendent and political/administrative approval from the Minister.

6. Removal and cost recovery risk

• If the superintendent directs removal of a mooring or structure and the owner does not comply, the superintendent may remove it and the owner must pay the cost (ss 17(4), 27(3)). Owners exposed to such directions should be prepared for potentially significant recovery claims and have documentary proof of any permissions or communications.

7. Cancellation and variation of permissions

• Permissions, especially for dangerous goods (s 25(3)), may be cancelled or varied at any time. A permit does not guarantee ongoing authority; operations relying on permissions must include contingency planning for sudden revocation or variation.

8. Search and inspection facilitation duty is broadly phrased

• The master "must do all that is possible" to facilitate search or inspection by the superintendent or persons acting for the superintendent (s 28). The phrase is broadly framed and may be interpreted expansively in enforcement contexts.

9. Hooked anchors and immediate notification

• Where an anchor hooks Commonwealth moorings or cables, the master "must not unhook" but must notify the superintendent "as soon as practicable" and comply with directions for clearing (s 19). The prohibition on unhooking could impose operational delays and create safety trade-offs; practitioners should prepare standard operating procedures for such events.

10. Preservation of State/Territory laws for refuse but potential overlaps elsewhere

• Section 21(5) preserves State/Territory laws for refuse placement, but the Regulation otherwise creates obligations that may overlap with State port and environmental laws. Operators should check local legal regimes for additional or differing requirements.

11. Vessel length threshold triggers different rules

• Section 12(1) applies only to vessels more than 10 metres in overall length. Operators of vessels near that threshold must know their vessel’s official overall length as it determines whether the s 12 provisions (anchoring near navigable channels) apply.

12. Penalties expressed in penalty units (conversion risk)

• Penalties are stated as 5 or 10 penalty units. The cash value of a penalty unit changes over time under separate legislation. Operators may therefore underestimate financial exposure if they do not verify the current penalty unit value.

13. Exempt vessel exclusion in definition of "vessel"

• Section 6 excludes "exempt vessels" from the generic reference to "vessel" for most of the instrument (except where "exempt vessel" is specifically referenced). Because the Act defines "exempt vessel", operators should verify whether their vessel is an exempt vessel, as that alters which provisions apply.

To manage these gotchas, operators should maintain records of permissions, notices and communications with superintendents, keep updated on notices and distances, have clear procedures for hooked anchors and inspections, and ensure insurance and contingency arrangements for revocation and cost recovery events.

Compliance with the Regulation requires a mixture of procedural, operational and documentary steps. Below are practical, text‑grounded measures that vessel masters, owners, and organisations operating in or near naval waters should implement to reduce legal and operational risk. Each recommended step ties back to the Regulation’s operative sections.

1. Know the definitions upstream in the Act (s 5)

• Confirm whether your vessel is an "exempt vessel", identify whether locations fall within "naval waters" and establish who the relevant "superintendent" is for the area concerned. The Regulation relies on definitions in the Act (s 5), so compliance begins with determining whether the Act classifies your activity or vessel as covered.

2. Monitor superintendent notices and secure written permissions where required (ss 7, 9, 13-15, 17, 21-23, 25)

• Before operating in or near naval waters, check for notices under s 7 (entry restrictions) and s 23 (speed/directions). For activities that require written permission (e.g. anchoring near installations, approaching within 30 m, laying moorings, cleaning vessels, entering with dangerous cargo), obtain and retain the superintendent’s written permission. Permissions can be conditional and may be cancelled or varied (s 25(3)); keep a current record and track expiry or variation notices.

3. Observe specified distances and vessel-size thresholds (ss 11-16, 18)

• Operationally implement and rehearse compliance with the specific distances: generally keep 180 m from moorings placed under s 10 and from electric cables marked on shore (ss 11(1), 18(1)); keep 100 m from installations/exempt vessels for anchoring/dredging/loitering unless you have written permission (s 13(1)); avoid approaching within 30 m of an installation unless on Commonwealth business or with written permission (s 15(1)). For navigable channels, vessels over 10 m must not anchor or be left without a ship-keeper in or near navigable channels (s 12(1)).

4. Prepare operational procedures for searches, inspections and hooked anchors (ss 19, 28)

• Train masters to notify the superintendent "as soon as practicable" if anchors or objects hook Commonwealth moorings or cables, and to refrain from unhooking until directed (s 19). Establish protocols to "do all that is possible" to facilitate searches and inspections (s 28): have identification and vessel documents available, ensure access to vessel sections, and nominate crew to assist.

5. Manage permissions for dangerous cargo (ss 25-26)

• If carrying explosives or other dangerous goods, always obtain written permission before entering naval waters (s 25(1)). Ensure compliance with conditions of permission including berthing and discharge instructions (s 25(2)). Display the required signals when carrying or loading/unloading dangerous goods: a large red flag or burgee between sunrise and sunset, and a red light visible in clear weather for at least 3 km between sunset and sunrise (s 26(1)). Be prepared for permissions to be cancelled or varied at any time (s 25(3)).

6. Implement crew and watch arrangements (s 20)

• If the superintendent requires it in writing, ensure sufficient crew numbers and at least one person on deck on watch at all times (s 20). Keep written logs and duty rosters to demonstrate compliance with superintendent notices.

7. Manage moorings and buoy interactions (ss 10-11, 17, 19)

• Do not make a vessel fast to Commonwealth moorings, forts or buoys without permission (s 9(1)). Confirm whether the superintendent has placed moorings under s 10 and whether there are specified distances from those moorings. Owners contemplating laying moorings must seek written permission (s 17(1)) and be ready to remove moorings on written notice and pay removal costs if the superintendent removes them (s 17(3)-(4)). Keep records of mooring locations and permissions.

8. Avoid unauthorised foreshore construction (s 27)

• Obtain necessary approvals before constructing jetties, wharves, or buildings on naval foreshores; a Minister may prohibit such construction by written notice (s 27(1)). If a Ministerial prohibition exists, do not construct; avoid incurring statutory removal and cost obligations (s 27(2)-(3)).

9. Maintain environmental and refuse compliance (s 21)

• Do not deposit material in or near naval waters unless you have a superintendent’s permission under s 21(1). Note that s 21(5) preserves State/Territory laws, so ensure you meet any relevant State environmental or waste laws too.

10. Prepare documentary evidence to meet evidential burden for "reasonable excuse"

• If an incident occurs that may otherwise attract strict liability exposure, assemble contemporaneous evidence to support a reasonable excuse (for example, navigation logs, distress calls, engine failure reports, communications with authorities). The Regulation’s notes point to the Criminal Code’s evidential burdens; without evidence, a defendant may not discharge the evidential obligation.

11. Keep sight of administrative charge regimes and Ministerial approvals (s 9(4))

• If your operations involve making a vessel fast to Commonwealth property, enquire about any charges and whether Ministerial approval for charging exists or may be sought (s 9(4)). Record any conditions and receipts.

12. Maintain insurance, contingency and cost-recovery planning

• Because the superintendent may recover removal costs and criminal penalties are expressed in penalty units, ensure adequate insurance coverage and financial provision for potential removal costs and fines. Keep contacts for legal and marine salvage assistance.

13. Establish communications and notification protocols

• Create processes for monitoring superintendent notices, reporting hooking incidents, responding to removal or construction notices, and co‑ordinating with State/Territory authorities where overlapping regulation exists (s 21(5)).

14. Chain of command awareness for enforcement

• Be aware the superintendent may delegate to Defence Force officers of specified ranks (s 29). Ensure crew are trained to recognise authorised officers and to follow lawful directions from delegates.

Documentation checklist to keep onboard and in operations files

• Copies of any written permissions from the superintendent.
• Current notices posted by the superintendent or Defence.
• Vessel registration and proof of vessel overall length.
• Crew rosters and watch logs for periods when superintendent required watches.
• Communications logs (VHF, radio, mail) evidencing notice receipt.
• Incident reports for hooked anchors, inspections, detentions.
• Insurance and salvage contact details.

Following these steps aligns operational practice with the Regulation’s core obligations and reduces exposure to strict liability offences, cost recovery and enforcement interventions. Practitioners should also maintain awareness of the Act’s definitions and Criminal Code evidential rules referenced in the Regulation.
