#### 37 Public authority’s priority if owner insolvent 37 Public authority’s priority if owner insolvent > If a public authority carries out (otherwise than as an appropriate person) the requirements of an order under this Part in respect of land disclaimed (by a liquidator or trustee in bankruptcy) as onerous property in the course of proceedings for winding up or bankruptcy, the public authority may recover the cost of carrying out the order together with a reasonable commercial rate of interest and all associated administrative or other costs and expenses so incurred in priority to any holder of a security over the land. > > **s 37:** Subst 2008 No 111, Sch 1 \[9\].
