Consumer Goods (Toppling Furniture) Information Standard 2024

The central concept is “toppling furniture”, defined in section 5 as any item falling into category 1, category 2 or category 3. Category 1 is a “clothes storage unit or bookcase with a height of 686 mm or more”. A clothes storage unit must be designed primarily to store clothes and contain one or more drawers, doors or other extendable elements. Bookcases are not further defined but clearly include open-shelf units. Category 2 is an “entertainment unit” designed primarily to house, support or carry a television. This catches TV stands, media consoles and similar products regardless of height. Category 3 covers hall tables, display cabinets, sideboards and buffets with a height of 686 mm or more. The height threshold of 686 mm (approximately 27 inches) applies only to categories 1 and 3; category 2 has no height minimum, so even a low TV stand could be in scope if it is designed to support a television. The exclusion in subsection 5(2) removes furniture that is designed to be affixed to a wall or structure and cannot be used properly unless so affixed. This is a narrow carve-out: it does not cover furniture that merely comes with wall-anchoring holes but can still be used freestanding. The supplier bears the burden of demonstrating that the furniture falls within the exclusion.

“Warning” is not defined in a single block but its elements are prescribed in each section. All warnings require an alert word (such as DANGER or WARNING) in upper case letters, an internationally recognised safety alert symbol (the triangle with an exclamation mark is common), a pictogram showing a child standing or climbing on the furniture with a cross or strikethrough, and a statement to the effect that children have died from furniture toppling over. Beyond these common elements, the required statements vary by category and by whether the warning is at point of sale (online or in store) or on the furniture/instructions. For example, category 1 in-store warnings (section 8(4)) must say “this furniture type is at high risk of toppling over”, while category 1 online warnings (section 7(4)) do not require that phrase but do require statements about not opening more than one drawer and never placing a television on the furniture. Category 2 warnings focus on securing the television with an anchor device, not the furniture itself. Category 3 warnings require anchoring the furniture but also, inconsistently, require anchoring the television (section 9(6)(c)). Suppliers must carefully match the warning to the precise category and channel.

“Point of sale” includes online supply through an electronic platform (section 7) and retail premises (section 8). An “electronic platform” is defined broadly as a service enabling a business to supply goods to consumers over the internet, whether operated by the business or another party. This covers the supplier’s own website, third-party marketplaces like eBay or Amazon, or any other online channel. For physical stores, the warning can be a hang tag, placard or removable sticker. However, the label required under section 9 must be permanent and durable, and the examples given in the note suggest it should be affixed (e.g., inside a door or drawer) and not removable. The standard distinguishes between temporary point-of-sale warnings and the permanent warning that travels with the furniture to the end user.

The primary duty bearers are persons who “carry on a business that supplies toppling furniture” (sections 7 and 8) or simply “supplies toppling furniture” (sections 9 and 10). “Supply” under the ACL includes manufacture, importation, distribution, retail and wholesale. Therefore the standard captures manufacturers and importers of toppling furniture, domestic furniture retailers (both online and physical), and any business that offers toppling furniture for sale in Australia. It does not apply to private individuals selling their own used furniture, because second-hand goods are excluded (section 6(2)(b)), nor to a consumer who sells an item they already acquired. However, a business that buys second-hand furniture and resells it may still be caught, because the exemption only applies if the item had been acquired by a consumer and is subsequently being supplied or offered for supply. A business that takes trade-ins and resells them is not a “consumer” for this purpose, so the exemption may not protect that activity.

Electronic platforms that merely host third-party sellers are not directly required to display warnings under section 7; the obligation lies with the “person” who carries on the business supplying the furniture. Platforms may, however, become indirectly affected if they impose compliance requirements on sellers or if they are held liable as accessories under ACL enforcement. The standard does not impose duties on consumers.

Small to medium furniture businesses face the highest relative compliance burden. They must redesign labels, update product listings across multiple online channels, ensure in-store signage, and modify assembly instructions. For a small maker of custom bookshelves, producing a permanent durable label compliant with section 9 may require sourcing new label materials and printing processes. The cost per unit may be small for high-volume importers but significant for low-volume producers. The delayed commencement (12 months after registration) allows time to adjust, but the design and procurement lead times for permanent labels and packaging may still be tight.

Consumers are the intended beneficiaries of the information. They are supposed to receive clearer warnings at the point of sale and on the furniture itself, which may influence their purchasing decisions, installation behaviour (anchoring), and ongoing use. However, the standard does not require retailers to provide anchor devices or to demonstrate that consumers understand the warnings. The effectiveness of the standard depends on whether the mandated disclosures actually change consumer behaviour, which is uncertain. Consumers also bear the cost of compliance indirectly through higher prices.

The instrument imposes four principal duties. First, a business that supplies toppling furniture online must include a warning in the product description on the electronic platform (section 7(1)). The warning must contain the common elements plus category-specific statements. The duty applies at the point of “offer for supply” - that is, when the product is listed, not just at checkout. Second, a business that supplies toppling furniture at retail premises must display a warning on or near the furniture (section 8(1)). The instrument gives examples (hang tag, placard, removable sticker) but does not require a specific format so long as the warning is clearly visible, prominent and legible. Third, a supplier must cause a permanent and durable warning label to be affixed to the toppling furniture itself (section 9(1)). The label must be of a type that lasts the lifetime of the product under normal use and must be located where it will be visible when the furniture is empty (e.g., inside a door or drawer). The label includes an additional statement: “This is a permanent label. Do not remove!” (section 9(4)(f), (5)(c), (6)(d)). Fourth, if instructions or assembly instructions are supplied with the furniture, the warning must be included in them (section 10). If no instructions are supplied, this duty does not arise.

The duties are framed as obligations to “cause” the warning to be included or displayed. This language covers situations where the supplier uses a third-party platform, manufacturer or packager. The supplier may rely on others to fulfil the requirement but remains responsible if the warning is missing or non-compliant.

Suppliers have no substantive rights under the instrument itself, but they have the right to know what is required and to plan compliance within the 12-month transition. They also have the right to challenge the validity of the standard through judicial review if they consider it ultra vires the ACL or unreasonable. No private right of action for consumers is created directly, but a consumer who suffers injury due to a missing warning may be able to bring a claim under the ACL for breach of a safety standard (section 106 of the ACL) or under common law negligence, using the non-compliance as evidence of a failure to warn.

The instrument does not create a defence for suppliers who take reasonable precautions; it is a strict liability information standard. However, enforcement discretion by the ACCC may consider efforts to comply.

Contravention of an information standard made under section 134 of the ACL is a breach of the ACL itself. Section 136(1) of the ACL provides that a person must not supply consumer goods that do not comply with an applicable information standard. The maximum civil penalties are set out in section 224 of the ACL. For a body corporate, the maximum penalty is the greater of $10,000,000, three times the value of the benefit obtained from the contravention, or (if the court cannot determine the benefit) 10% of the corporation’s annual turnover during the 12-month period ending at the end of the month in which the contravention occurred. For individuals, the maximum is $500,000. These are penalties for each contravention, not a single fine. A supplier offering multiple non-compliant items online may face multiple contraventions.

The ACCC is the primary enforcement body. It can issue infringement notices (typically $13,320 for a listed corporation per notice), seek court-ordered pecuniary penalties, injunctions, and non-punitive orders such as community service, product recalls, or corrective advertising. The ACCC may also accept enforceable undertakings under section 218 of the ACL. Directors and officers of a corporation may be accessorily liable under section 224(2) if they were knowingly concerned in the contravention.

The instrument does not itself provide a transitional enforcement grace period. While the 12-month commencement delay gives suppliers time to adjust, after the commencement date the standard is in full force. The standard is an information standard, not a safety standard, so contravention does not trigger the automatic recall provisions under Part 3-3 of the ACL, but the ACCC can still seek a recall order if it considers the goods pose a risk of injury.

Enforcement risk is concentrated on large retailers and importers with high public visibility. Small businesses may be less likely to be targeted unless complaints arise, but they are not immune. The standard’s detailed prescription of warning elements reduces ambiguity but increases the chance of technical non-compliance (e.g., using “CAUTION” instead of “DANGER” or “WARNING”, omitting the safety alert symbol, or using a pictogram without a cross). Courts have interpreted information standards strictly; minor deviations may still constitute a contravention.

The instrument is made under subsection 134(1) of the ACL, which is Schedule 2 to the Competition and Consumer Act 2010 (Cth). The ACL applies as a law of the Commonwealth and, through application laws, as a law of each State and Territory. Therefore the standard operates uniformly across Australia, with no state variations. It supplements existing mandatory safety standards, such as the Consumer Goods (Children’s Nightwear and Limited Daywear and Paper Patterns) Safety Standard, but does not replace them. If other mandatory standards require different warnings, both must be complied with. The instrument does not explicitly address overlap with voluntary Australian Standards (e.g., AS/NZS 4741:2014 on furniture stability), but voluntary compliance does not satisfy the mandatory requirements unless it meets the specific warning elements prescribed.

The standard also interacts with state and territory fair trading legislation, which often replicates or references the ACL. Non-compliance may be enforced by state offices of fair trading as well as the ACCC.

No interface with privacy law, competition law, or intellectual property law is apparent from the instrument. However, electronic platforms that are also suppliers under section 7 may need to consider contractual arrangements with third-party sellers regarding who bears responsibility for the warning in product descriptions. The instrument does not create liability for platforms that merely host listings, but platforms that take title to goods or act as the supplier may be directly captured.

The exclusion for furniture “designed to be affixed to a wall or structure and cannot be used properly unless it is so affixed” interacts with building codes and installation standards. If a furniture item is intended to be permanently attached (e.g., wall-mounted shelving), it is exempt from the entire standard. However, the supplier must be able to demonstrate that proper use requires affixing. If the item can be used freestanding, even if it comes with wall-anchoring hardware, the exclusion does not apply.

The instrument does not affect contractual rights between suppliers and consumers. A consumer who suffers injury from toppling furniture may still have a claim for breach of the consumer guarantee of acceptable quality (section 54 ACL) or for failure to warn under common law negligence. Compliance with the information standard would be relevant evidence but not determinative.

The instrument was made on 13 April 2024 and is a new standalone information standard. There are no amendments as of the date of the instrument. The standard replaces no previous instrument; it is the first mandatory information standard for toppling furniture in Australia. The Minister may amend the standard by further legislative instrument under section 134(1) of the ACL. Any future amendment would follow the same legislative process, likely after consultation with the ACCC and industry stakeholders. The commencement table notes that the table will only be updated for later amendments in published versions, but the instrument as originally made consists solely of these provisions.

The 12-month delayed commencement is itself a feature that may influence future amendments. If industry feedback reveals that the warning requirements are impractical (e.g., suppliers cannot source permanent labels within the timeframe), the Minister could extend the transition period or vary the content requirements. Similarly, if the ACCC identifies widespread non-compliance or consumer confusion, amendments could clarify ambiguous terms (e.g., “internationally recognised safety alert symbol”). The instrument does not include a statutory review clause, but administrative pressure may lead to a review within a few years of operation.

As a new instrument not yet in force (commencement is 12 months after registration, likely in April 2025), there is no litigation history. No cases have been decided under this specific standard. However, the legal framework under which it is made has been the subject of judicial consideration. The High Court of Australia has considered the scope of the ACL’s information standard power indirectly in cases concerning product safety standards, but no decision directly addresses the power under section 134. Challenges could arise on grounds of constitutional validity (e.g., whether the instrument is within the Commonwealth’s legislative power under the corporations power or the trade and commerce power), but the instrument is supported by State application laws so such challenges are unlikely to succeed. Another potential challenge is that the requirement for a permanent label affixed to furniture (section 9) interferes with the property rights of suppliers or consumers in a way that is not authorised by the ACL; however, similar requirements exist for other products (e.g., tobacco warning labels) and have been upheld.

Once the standard is in force, enforcement actions by the ACCC are likely to be the first source of litigation. Suppliers may defend on the ground that the warning they displayed substantially complied with the requirements, though the instrument uses mandatory language (“must include”) that leaves little room for de minimis non-compliance. Injunctions against suppliers by the ACCC may be sought to remove non-compliant products from the market. Private litigation by consumers injured by toppling furniture may rely on non-compliance as evidence of a failure to warn, but such cases would be in tort or under the ACL for breach of a safety standard, not directly under this instrument.

Several provisions are easily overlooked or ambiguous. First, the exclusion for furniture “designed to be affixed to a wall or structure and cannot be used properly unless it is so affixed” (section 5(2)) is narrower than it appears. Many modern furniture items come with wall-anchoring kits but can still be used without fixing. If a bookshelf can be used as a freestanding unit, it is not excluded, even if the manufacturer recommends anchoring. The phrase “cannot be used properly” likely means the product is non-functional without being wall-mounted, such as floating shelves or wall-mounted cabinets. Suppliers who argue that their products are exempt because of included anchoring hardware risk non-compliance.

Second, the second-hand exemption in section 6(2)(b) only applies if the item was “acquired by a consumer and is subsequently being supplied or offered for supply”. This does not exempt a business that buys back inventory from consumers or takes trade-ins. If a retailer sells returned furniture as factory seconds, it may still need to comply unless the item is genuinely second-hand from a consumer seller.

Third, the online warning requirement under section 7 applies to the “description of the toppling furniture provided by the platform”. If the supplier uses a third-party platform (e.g., eBay or Etsy), the warning must appear in the product description, not buried in a separate document or pop-up. The platform’s character limits or formatting restrictions may make it difficult to include all required elements (pictogram, alert symbol, lengthy statements). Suppliers must verify that the platform allows images and formatted text, and if not, they may need to use a different channel or find a technical workaround.

Fourth, the permanent label requirement under section 9 uses the word “affixed” and requires that the label is permanent, durable, and lasts the product’s lifetime. The note suggests examples such as inside a door or drawer. For furniture with closed back panels or no internal cavities, complying with the location requirement may be difficult. The label must also be visible when the product is empty, which means it cannot be placed on the underside of a shelf where it would be obscured by items placed on top of it. Suppliers must consider placement during design, which may be impossible for imported flat-pack furniture where assembly determines orientation.

Fifth, the category-specific statements are not identical across sections. For example, section 8(4) (in-store warning for category 1) requires “this furniture type is at high risk of toppling over”, while section 7(4) (online warning for category 1) does not. Section 9(6)(c) (label on category 3) requires “always secure your television with an anchor device”, even though category 3 includes hall tables not designed for televisions. Suppliers must check each combination.

Sixth, the requirement to include warnings in instructions (section 10) only applies if instructions are supplied. A supplier that does not provide assembly instructions or a use manual is not required to create them solely to include the warning. However, most furniture sold unassembled includes instructions, so this is often not an escape.

Compliance should be approached systematically by category and supply channel. First, identify all products that meet the definition of toppling furniture. Measure height precisely: for clothes storage units and bookcases, any unit with a height of 686 mm or more (including the base, excluding adjustable feet?) is caught. For entertainment units, there is no height threshold, so even low media consoles are in scope if designed for a TV. For hall tables, display cabinets, sideboards and buffets, also test the 686 mm threshold. Furniture that is designed to be wall-mounted only and cannot be used properly without being affixed can be excluded, but this should be documented with design specifications.

Second, design the warning content for each category and for each of the four contexts: online listing, in-store display, permanent label, and instructions. Use the exact wording required or “statements to the following effect”. The safest approach is to replicate the prescribed language verbatim. For the common elements: choose an alert word (e.g., WARNING), include the safety alert symbol (ISO 7010-W001 or similar), a pictogram of a child standing/climbing with a strike-through (use the standard AS/NZS 4741 pictogram if available), and the statement “Children have died from furniture toppling over” or equivalent. The category-specific statements should be taken directly from the relevant subsection.

Third, for online listings, ensure the warning is incorporated into the product description field. Check that the electronic platform’s interface supports images (for the pictogram) and formatted text. If the platform restricts content (e.g., no HTML, no images), the supplier may need to use alternative description text that achieves “clearly visible, prominent and legible” status, possibly by using all-caps text for the warning. The warning should be placed near the top of the description, not hidden at the bottom.

Fourth, for in-store displays, choose a format that is “on or near” the furniture. A hang tag or removable sticker is acceptable but must be clearly visible. If using a removable sticker, note that the section 9 label must be a different, permanent label. Do not rely on the same sticker for both purposes unless it meets the permanence requirements of section 9 and is also clearly visible at point of sale.

Fifth, for the permanent label under section 9, select a material that will survive normal use for the product’s expected lifetime. Paper labels are unlikely to qualify; polyester or vinyl labels with permanent adhesive are common. The label must be affixed in a location visible when the furniture is empty, such as the inside of a drawer front or the inside of a cabinet door. For open bookshelves without doors, a label on the underside of a top shelf may be visible when empty, but placement on the side panel might be obscured. Consider the shape and use of the product. The label must include “This is a permanent label. Do not remove!”.

Sixth, for instructions, include the same warning as for the online listing (but with the in-store variant? No - section 10 does not incorporate the “ask staff” or website language; it uses the same statements as the online warning for each category). If instructions are printed, include the pictogram and alert word as part of the assembly diagrams or a dedicated safety page. If instructions are digital only, the warning must still be included.

Seventh, document compliance for each product line, including the design of labels, screenshots of online listings, and copies of instructions. This will be critical in any ACCC investigation. Consider engaging a product safety consultant or label manufacturer with experience in permanent warning labels.

Eighth, monitor the ACCC website for guidance after the standard is registered. The ACCC may publish compliance guides, template warnings, or clarifications on ambiguous requirements such as “internationally recognised safety alert symbol”. Use these as safe harbours where available.
