Consumer Goods (Products Containing Button/Coin Batteries) Information Standard 2020

The instrument organises its regulation around a small set of concepts and cross‑references to international standards. Key definitional and structural elements appear in Part 1.

Button/coin battery: Defined in s4 as a small, single cell battery whose diameter is greater than its height. The instrument further distinguishes lithium button/coin battery and non‑lithium button/coin battery (s4). This chemical distinction is material to the content of required warnings; lithium batteries attract a more urgent injury statement in the mandatory text (s8(7)(d), s9(3)(d)).

Consumer goods containing button/coin batteries: A product is within scope if the battery is installed or is to be installed to power the goods, or if the goods are designed to store such batteries (s6(2)). The statutory definition is product‑centric rather than seller‑centric: it captures goods by design and function, not by how they are sold.

Application day and transitional timing: The instrument commenced on 22 December 2020 (s2). It defines application day as the day after the period of 18 months beginning on commencement (s4). The mandatory requirements in Part 2 take effect on and after the application day (s7). The commencement table and definition together create a transition period to allow industry to adapt before mandatory obligations bind.

Exclusions: Section 6(3) identifies discrete exclusions. Goods first supplied to a consumer before application day are outside the instrument (s6(3)(a)). One‑off supplies by a supplier who had themselves acquired the goods as a consumer are excluded (s6(3)(b)). Equipment used in trades, professions or industries that is not intended for sale to the general public and not intended to be used where children are present is excluded (s6(3)(c)). Goods with batteries soldered in place are excluded where they are either (i) audio, video, IT and communications electrical/electronic equipment, or (ii) business and office machines with rated voltage not exceeding 600 volts (s6(3)(d)). The instrument provides examples in notes which aid classification, for instance personal computers and smartphones for (d)(i), and cash registers and calculators for (d)(ii) (s6 notes).

Mandatory information content and placement: The general mandatory rule (s8) requires warnings to include particular content items listed in s8(7). The instrument prescribes different placements depending on whether goods are accompanied by instructions, packaged, or unpackaged (s8(2)-(6)). For packaged goods, the front panel must be marked with an internationally recognised safety alert symbol (s8(3)). For goods accompanied by instructions, the instructions must contain the required warning (s8(2)). For unpackaged goods, a warning attached to the goods is required (s8(5)-(6)).

Lower risk goods regime: Section 9 sets out an alternative pathway for goods assessed as lower risk as a matter of the statutory tests in s9(1), specifically hearing aids, batteries fully enclosed, batteries not intended to be removed by consumers, or battery installation/removal requiring a specialist. Under s9 the instructions must contain a warning that is clearly visible, prominent and legible and which contains the same substantive elements as the general regime (s9(2)-(3)).

Design principles and symbol standards: The instrument incorporates external standards by reference. "Design Principles" is defined as ISO 3864‑2:2016 (s4). The internationally recognised safety alert symbol is described as a suitable example that combines ISO 7010‑W001 and IEC 60417‑6367, and the instrument provides an example image (s5). Warnings required under Part 2 must comply with Annex D clauses D.5 (size and legibility) and D.7 (durability) of the Design Principles (s10), effectively outsourcing detailed technical label specifications to the ISO standard.

Mandatory versus recommended measures: The instrument separates binding obligations (Part 2) from recommendations (Part 3). Part 3 is expressly non‑binding by s11(2). The recommendations mirror the mandatory content but extend those obligations to additional contexts and practices, including marking directly on goods near battery access (s12), front‑of‑pack placement rules for packaging (s13), including warnings in electronic platform product descriptions (s14), including Poisons Information Centre contact details (s15), and advice on safe disposal (s16).

References and accessibility: The instrument acknowledges that the standards it refers to may require purchase and notes that the ACCC can make copies available for viewing subject to licensing conditions (see notes to s4 and s5). This creates an operational dependency on third‑party standards that are not reproduced in the instrument itself.

Taken together, the main concepts form a labelling regime that is precise about content, placement and technical appearance, while leaving certain practices as recommendations. The instrument operationalises risk differentiation by chemistry (lithium v non‑lithium) and by accessibility of the battery (replaceable v fully enclosed), and it ties compliance to international symbol and design standards.

The instrument places requirements and recommendations on persons who supply or manufacture consumer goods that contain button/coin batteries, and on persons who conduct businesses with electronic platforms to supply such goods. The text frames obligations in terms of the goods rather than a narrowly defined actor class, but the practical duties fall on those who have control of goods at the point of supply.

Primary regulated parties

• Suppliers and manufacturers of consumer goods containing button/coin batteries. Part 2 mandatory requirements apply to consumer goods containing such batteries on and after application day (s7). The obligations in s8 and s9 specify where warnings must appear depending on packaging and whether the goods are accompanied by instructions, imposing label and document content obligations that manufacturers, importers, distributors and retailers will need to satisfy.

• Persons who conduct a business with an electronic platform to supply consumer goods with button/coin batteries are explicitly addressed in Part 3 recommendations. Section 14 recommends that such a person should cause a warning to be included in the goods’ description on the platform. Part 3 is non‑binding by s11(2), so the instrument recommends but does not require platform operators or sellers to include warnings in product descriptions.

Who is not covered or is subject to different treatment

• Goods first supplied to a consumer before the application day are outside the instrument (s6(3)(a)). This creates a temporal grandfathering effect that affects resellers of previously supplied goods.

• One‑off supplies by a supplier who had acquired the goods as a consumer are excluded (s6(3)(b)). This targets casual consumer sales and excludes them from the obligation.

• Certain trade and professional equipment not intended for sale to the general public and not intended to be used where children are present is excluded (s6(3)(c)). The instrument exempts professional equipment used in industries where children are not present, narrowing exposure for business‑to‑business equipment.

• Goods with soldered‑in batteries are excluded where they form part of specified categories of electrical and electronic equipment (s6(3)(d) and associated notes). The examples in the notes (personal computers, smartphones, cash registers, calculators) indicate that many higher‑voltage or soldered battery devices are outside the regime.

• Persons who supply goods that do not fall within the statutory definition of consumer goods or goods that do not contain button/coin batteries are obviously unaffected.

Practical accountabilities

• Manufacturers and importers: They will generally control packaging, instructions and product labelling, so compliance costs and design decisions will primarily fall on them.

• Distributors and retailers: They will need to accept or reject goods based on compliance, and will bear responsibility for ensuring that packaged goods have the required front‑of‑pack symbol and that unpackaged goods have attached warnings where required (s8(3)-(6)).

• Online sellers and marketplaces: Although the obligations in Part 3 are recommendations, the instrument specifically targets electronic platform descriptions in s14. Where marketplaces maintain control over product descriptions, platform operators could face reputational and commercial incentives to adopt the recommended practices, even if not mandated.

• Healthcare professionals and specialists: Where battery removal or installation requires a specialist, goods fall within the lower‑risk regime in s9, but the instrument still requires warnings in instructions.

Who makes decisions

• Suppliers and manufacturers decide label content, the presence or absence of instructions, packaging design, and whether a battery is accessible or requires a specialist. Those individual product decisions determine which statutory pathway applies under s8 or s9.

• Standards bodies and licensors of the referenced ISO and IEC standards indirectly influence label design through the Design Principles and symbol definitions referenced in s4 and s5.

• Regulators: The instrument is made under the Australian Consumer Law (s3), so enforcement and compliance oversight will operate within the broader regulatory framework for the ACL. The instrument itself does not set out enforcement penalties or specific enforcement procedures.

Distributional effects

• The direct compliance costs will be concentrated on manufacturers and importers of goods with replaceable button/coin batteries or that are packaged for retail sale, since such goods must meet the full mandatory content and placement rules.

• Retailers and online marketplaces will face transactional compliance tasks (checking supplier compliance, managing product listings), even though the mandatory obligations sit primarily with suppliers and manufacturers.

In short, the instrument places mandatory information duties on the supply chain for consumer goods with button/coin batteries, with exclusions that narrow coverage for certain pre‑existing supplies, professional equipment and soldered‑in battery goods, and with recommendations aimed at platforms and additional warnings that industry may choose to adopt.

This instrument imposes specific duties tied to product form and packaging, while reserving other practices as recommendations. The statutory structure sets out who must do what, in what location, and to what technical standard.

Core mandatory duties (Part 2)

• Compliance timing duty: On and after the application day, consumer goods containing a button/coin battery must comply with the Part 2 requirements that apply to them (s7). The application day is defined in s4 as the day after the period of 18 months beginning on the day the instrument commences, creating a fixed start date for mandatory duties.

• Instruction‑based duty: If consumer goods are accompanied by instructions, those instructions must include a warning about the battery that is clearly visible, prominent and legible and that includes the substance of all matters in s8(7) (s8(2)). The substance matters include an alert word in upper case, an internationally recognised safety alert symbol, a statement that the battery is hazardous and must be kept away from children, chemistry‑specific injury warnings, and advice that medical attention should be sought immediately if ingestion or insertion is suspected (s8(7)).

• Packaging‑based duty: If goods are packaged, the front panel of the packaging must be marked with an internationally recognised safety alert symbol that is clearly visible, prominent and legible (s8(3)). If packaged goods are not accompanied by instructions, a further warning containing the s8(7) matters must be attached to or included with the goods (s8(4)).

• Unpackaged goods duty: If goods are not packaged, a warning containing the s8(7) matters must be attached to the goods (s8(5)). Attachment can be by sticker or tag (s8(6)).

• Lower risk goods duty: Where s9 applies, the instructions must include a clearly visible, prominent and legible warning containing the s9(3) matters, which are substantively the same as s8(7) (s9(2)-(3)). The tests in s9(1) determine whether a product qualifies for the lower risk pathway.

• Design standard duty: Any mandatory warning required under Part 2 must comply with clause D.5 (size and legibility) and clause D.7 (durability) of Annex D of the Design Principles (ISO 3864‑2) (s10). This creates a technical duty of conformity to external standards.

International symbol duty

• The instrument prescribes an internationally recognised safety alert symbol by example, combining ISO 7010‑W001 and IEC 60417‑6367, and provides an image example (s5 and notes). The statutory text requires the presence of an internationally recognised safety alert symbol in mandatory contexts, for example front‑of‑pack markings (s8(3)) and content elements (s8(7)(b), s9(3)(b)).

Non‑binding recommendations (Part 3)

• The instrument expressly states that failing to comply with Part 3 does not constitute a contravention of the instrument (s11(2)). The recommendations cover labelling directly on or near battery access points (s12), packaging warnings and front‑of‑pack placement guidance (s13), warnings in online platform descriptions (s14), inclusion of the Australian Poisons Information Centre contact and advice to contact them immediately (s15), and safe disposal advice (s16).

Rights and interpretive points

• No penalty text in instrument: The instrument does not itself specify civil penalties, offences or enforcement mechanisms. It is made under the ACL (s3), so enforcement would sit within the ACL framework, but the instrument does not create a stand‑alone offence or penalty provision.

• Scope rights: Suppliers who sold goods to consumers before application day are outside the mandatory scheme for those goods (s6(3)(a)). One‑off consumer sellers are exempt (s6(3)(b)). These carve‑outs create rights for sellers of pre‑existing or casual sales not to have to retrofit warnings under this instrument.

• Design standard access: The instrument acknowledges that the Design Principles and the symbol standards may be purchased and that the ACCC can make copies available for viewing subject to licensing conditions (s4 and s5 notes). Practically, complying parties must obtain or view the referenced standards to ensure they are meeting the D.5 and D.7 requirements.

• Placement and content interaction: Whether the front‑of‑pack symbol suffices or whether additional substantive matter must appear on instructions or attached labels depends on whether the goods are accompanied by instructions and whether they are packaged (s8(2)-(5)). Suppliers must therefore exercise product classification decisions to determine which duties apply.

In sum, the instrument sets out specific duties that fall mainly on suppliers and manufacturers regarding warnings and their technical presentation, while offering recommended measures and leaving enforcement details to the overarching Australian Consumer Law framework. Rights are limited to the specified exclusions and the non‑binding status of Part 3.

The instrument itself does not contain express penalty or enforcement provisions. It is made under subsection 134(1) of the Australian Consumer Law (s3), and it notes that the reference to the Australian Consumer Law is to Schedule 2 to the Competition and Consumer Act 2010 as it applies as a law of the Commonwealth, States and Territories (s3 note). Beyond that statutory cross‑reference, the instrument does not specify offences, civil penalties, or enforcement mechanisms within its text.

What the instrument does show about enforcement architecture

• Delegated standards mechanism: The instrument is an information standard made under the Australian Consumer Law power identified in s3. Information standards under the ACL are instruments that create mandatory information obligations; however, the instrument does not incorporate or reproduce the enforcement provisions of the ACL in its text. The ACL itself contains enforcement machinery, but those provisions are not set out in this instrument.

• No internal penalty scheme: There are no clauses in the instrument that prescribe pecuniary penalties, infringement notices, or criminal sanctions. There are also no express powers given to the Australian Competition and Consumer Commission or other regulators within this instrument to conduct audits, impose remedial notices, or require recalls specifically under this instrument.

Operational consequences and enforcement implications

• Enforcement will therefore be dependent on the broader enforcement powers available under the Australian Consumer Law and any relevant state or territory laws that give effect to Schedule 2 of the Competition and Consumer Act 2010. The instrument’s authority note references section 140K and corresponding State and Territory provisions (s3 note), but the detailed powers under those provisions are not reproduced here.

• In practice, compliance actions, civil proceedings or regulatory interventions that rely on contravention of an information standard will need to ground the claim in the ACL and any relevant enforcement provisions that apply to contraventions of information standards. The instrument itself sets the substantive obligations (what must be done) but does not describe the procedural enforcement steps.

Compliance risk and enforcement uncertainty

• Because the instrument omits express penalties, suppliers and advisers will need to map the instrument’s substantive obligations against the enforcement tools available under the ACL. That mapping requires legal analysis beyond this instrument to determine which remedies or sanctions a regulator or private litigant might pursue, and whether administrative notices, injunctive relief, product bans or pecuniary penalties are applicable. The instrument’s text alone does not answer that question.

• The absence of an explicit enforcement section in the instrument increases the importance of cross‑referencing the ACL and engaging with regulators, particularly where suppliers seek clarity about whether a failure to comply with a mandatory requirement in Part 2 will attract enforcement action, which regulator will take responsibility, and what procedural notices or remedial processes will follow.

Evidence and auditability considerations

• The instrument requires warnings to comply with specified international standard clauses for size, legibility and durability (s10). That creates a relatively objective compliance yardstick that regulators can reference. However, because those standards are third‑party documents that must be obtained or viewed under licensing conditions (s4 and s5 notes), proving non‑compliance may turn on technical measurements and expert evidence.

In short, the instrument prescribes substantive obligations and technical standards, but it does not set out penalties or enforcement processes in its own text. Enforcement will therefore depend on the ACL enforcement framework, and suppliers should consult that framework and regulators to understand the practical enforcement risks.

The instrument is expressly made under the Australian Consumer Law and therefore sits within the broader statutory scheme created by Schedule 2 to the Competition and Consumer Act 2010, as applied by States and Territories. The instrument’s own authority clause highlights that linkage (s3 and s3 note). Beyond that explicit connection, the instrument interacts with external standards and with statutory definitions and exclusions that may intersect with other regulatory regimes.

Primary legal relationship

• Australian Consumer Law: The instrument is an information standard made under subsection 134(1) of the ACL, and the authority note directs readers to the ACL as the enabling framework (s3 and s3 note). The content of the instrument must therefore be interpreted and enforced within the legal and administrative environment that applies to the ACL and its Schedule 2 implementation across jurisdictions.

• External standards incorporation: The instrument incorporates and references international standards by name and requires compliance with parts of those standards. For example, "Design Principles" is ISO 3864‑2:2016 (s4), and the internationally recognised safety alert symbol is described by reference to ISO 7010‑W001 and IEC 60417‑6367 (s5). The mandatory warning durability and size requirements are tied to clauses D.5 and D.7 of Annex D of the Design Principles (s10). This creates an interaction between the instrument and private standards bodies and the intellectual property/licensing regimes that govern access to those standards. The instrument notes where these can be purchased and states that the ACCC can make copies available for viewing subject to licensing conditions (s4 and s5 notes).

Potential overlap with other regulatory regimes

• Electrical safety and product standards: The instrument excludes certain goods where batteries are soldered in place if those goods are electrical and electronic equipment within the field of audio, video, information and communication technology or business and office machines with rated voltage not exceeding 600 volts (s6(3)(d)). The notes give examples such as personal computers and smartphones. Those product categories are also subject to other regulatory regimes and standards governing electrical safety, electromagnetic compatibility, and telecommunications. Suppliers will need to manage compliance with multiple overlapping standards and regulatory requirements.

• Poison and health regulations: The instrument recommends including the contact number for the Australian Poisons Information Centre (s15) and recommends advice on seeking immediate medical attention upon suspected ingestion (s8(7)(f), s9(3)(f)). While the instrument itself does not create health regulations, it interfaces with public health advisory infrastructure and may affect responsibilities under state and territory health legislation or public safety guidance.

• Waste disposal and environmental laws: The instrument recommends that goods include advice about safe disposal of button/coin batteries (s16). Battery disposal and recycling are areas regulated by environmental and waste‑management laws and programs. The instrument’s recommendation interacts with those laws by encouraging suppliers to provide disposal information, but it does not mandate any specific disposal practice or create statutory obligations under environmental legislation.

Interpretive consequences and legal certainty

• Standards reliance and accessibility: Because mandatory obligations refer to technical clauses in ISO standards, compliance determinations will require reference to those standards. The instrument’s notes about procurement and ACCC viewing availability (s4 and s5 notes) are relevant to legal certainty and to the practical ability of suppliers and regulators to apply the referenced clauses.

• Temporal effect and transitional scope: The exclusion for goods first supplied before the application day (s6(3)(a)) creates a temporal interface with sales and supply obligations under other laws and existing stock regulations. Sellers need to determine whether particular goods were "first supplied to a consumer" before application day, which may require transactional records and supply chain evidence.

• Consumer law enforcement: Because the instrument is made under the ACL but does not itself set out enforcement mechanisms, the interaction with other enforcement and penalty provisions is significant. Remedies for alleged contraventions of ACL information standards depend on the ACL enforcement framework and on the facts of any case.

In summary, the instrument operates within the ACL framework, incorporates external standards that must be accessed under licensing arrangements, and overlaps practically with electrical product standards, health advisory structures, and environmental disposal regimes. Compliance planning therefore needs to consider multiple statutory and standards interfaces.

The instrument contains an explicit commencement table and a note that the commencement table relates only to the provisions as originally made and will not be amended in this instrument to deal with later amendments (s2 notes). The text provided is the instrument as made and contains no subsequent amendment entries or modification history within its body.

Key points about amendment and variation risk based on the instrument text

• Original making and date of registration: The instrument records that it was made by the Minister and dated 18 December 2020, and that it commenced on 22 December 2020 as noted in the commencement table (front matter, s2 and commencement table).

• Application day timing built into the instrument: The instrument embeds its own delayed application mechanism via the definition of application day as the day after the period of 18 months beginning on the day the instrument commences (s4). This design provides a built‑in time buffer for industry to adapt, and any amendment that alters that timing would need to amend the instrument itself.

• No listed amendments in the instrument: The text as provided contains no amending instruments, schedules or later‑dated variations. The instrument’s commencement table explicitly states that it relates only to the provisions as originally made and will not be amended in this instrument to reflect later amendments (s2 note).

Practical consequences and procedural considerations

• Reliance on external standards that may be updated: The instrument references standards "as in force or existing at the time when this instrument commences" (see definitions for the Australian (Electric Toys) Standard, International (Electric Toys) Standard and Design Principles in s4). That phrasing fixes the referenced editions to those current at commencement, rather than creating an automatic conduit to future versions. Consequently, if an ISO or IEC standard is updated after commencement, the instrument does not automatically adopt the new version. Any change in the binding reference would require amendment to the instrument.

• Amendments must follow the ACL delegated legislation process: Because the instrument is made under the ACL, any changes to the instrument would need to be effected by appropriate ministerial or regulatory procedure consistent with the enabling provision in the ACL and any applicable legislative instruments processes, including registration and publication requirements. The instrument itself does not spell out the amendment process.

• No internal mechanism for staged changes: The instrument does not contain staged compliance steps beyond the single application day deferral, nor does it provide an internal mechanism for regulatory waivers or exceptions. Any substantive change in scope, content, or referenced standards must be implemented by amendment.

• Documentation and version control: The instrument’s note about the commencement table not being amended for later changes (s2 note) signals that printed or online versions of the instrument may contain non‑authoritative editorial columns. Practitioners should rely on registered instruments and the Federal Register of Legislation for authoritative texts and for any amendment notices.

In short, the instrument as presented contains no amendment history. It fixes the applicable editions of referenced standards at commencement and sets a single application day after an 18‑month period. Any subsequent changes to content, scope or referenced standards would require formal amendment of the instrument.

The instrument, as provided, does not include any litigation history. There are no cases cited in the text, and no mention of judicial or administrative proceedings challenging the instrument or decisions made under it. The instrument is a delegated information standard made under the Australian Consumer Law and does not itself annotate any prior or subsequent court decisions.

What the absence of litigation history in the instrument means for practitioners

• No statutory case law recorded in the instrument: Because the instrument does not list litigation, there is no immediate guidance within the instrument as to how courts have interpreted its provisions. Users must therefore rely on statutory text, legislative context and, if any disputes arise, general principles of administrative and consumer law to frame arguments.

• Potential for future litigation: The instrument creates concrete obligations about content, placement and technical specifications. Disputes may arise in future about classification of goods (for example whether a good is "packaged" or "unpackaged", or whether a battery is "fully enclosed" or "intended to be removed or replaced by a consumer"), the adequacy of warnings, compliance with the Design Principles clauses, or the scope of exclusions in s6(3). Those issues would generate litigation or enforcement actions, but none are recorded in the instrument itself.

• Evidence and expert technical proof likely to be material: Enforcement actions or civil proceedings about compliance with s10 (D.5 and D.7 requirements) will likely require technical assessments and expert evidence, since those clauses set out size, legibility and durability requirements that are technical in nature. The instrument’s reliance on external standards means litigation will often involve expert testimony about whether a warning label satisfied the referenced standard.

• Procedural venues and remedies depend on the ACL framework: Because the instrument is made under the ACL (s3), any enforcement litigation that proceeds by regulatory action or private proceedings will be conducted within the procedural and remedial frameworks applicable to contraventions of the ACL. The instrument itself does not set out litigation procedures or remedies.

Practical research steps recommended

• Consult ACL enforcement jurisprudence: Practitioners assessing enforcement risk should review case law and enforcement action under the Australian Consumer Law concerning information standards and labelling obligations, given that this instrument’s enforceability will be framed against the ACL.

• Monitor regulator guidance and enforcement activity: In the absence of litigation guidance within the instrument, regulator guidance, compliance priorities, and public enforcement actions will inform practical interpretation and compliance expectations.

In summary, the instrument contains no internal litigation history. Practitioners should treat the instrument as a set of substantive obligations whose interpretation and enforcement will be shaped by the Australian Consumer Law framework, regulator action, and any future case law.

The instrument contains several practical pitfalls and classification traps that can create compliance surprises. These are concrete areas where suppliers, importers and marketplaces commonly misapply the text or misunderstand which obligations bind.

Definitional and timing traps

• Application day and grandfathering: Goods first supplied to a consumer before application day are excluded (s6(3)(a)). Determining whether a product was "first supplied to a consumer" before the application day may be non‑trivial for importers, distributors and retailers with complex supply chains. Records and invoices will be crucial. If a supplier relies on this exclusion for stock held at application day, proof will be necessary.

• One‑off consumer seller exclusion: The instrument excludes one‑off supplies by suppliers who acquired the goods as a consumer (s6(3)(b)). Sellers who occasionally resell goods they previously bought privately may assume they are excluded; however frequency or the commercial reality of repeated listings could change the classification. The instrument does not define "one‑off" or indicate thresholds; sellers should proceed cautiously and document the non‑commercial nature of such sales.

Product classification pitfalls

• Packaged v unpackaged: The location of the warning obligation depends on whether goods are "packaged" (s8(3)-(4)) or not (s8(5)). Sellers and manufacturers must assess packaging status carefully. For example, products sold loose on a pegboard in a retail store might be treated as unpackaged for the purposes of this instrument and thus require attached warnings. The instrument does not attempt to define every packaging scenario.

• Accompanied by instructions: The presence or absence of instructions drives the compliance pathway (s8(2), s8(4), s9(1)). Some products have digital instructions (electronic manuals or QR codes). The instrument does not specify whether electronic instructions satisfy the "accompanied by instructions" test; suppliers should treat physical instructions as the safer path, or seek regulatory guidance.

• Lower risk goods classification: The lower risk pathway in s9 applies only where the product is accompanied by instructions and meets one or more of the s9(1) criteria (hearing aids, battery fully enclosed, battery not intended to be removed or replaced by a consumer, or specialist installation/removal). Misclassification here can lead to applying a lighter requirement when the general requirement applies. For instance, if a battery is theoretically removable but requires a small screwdriver, is it "not intended to be removed by a consumer"? The instrument provides no interpretive guidance on borderline cases.

Technical and standards pitfalls

• Reliance on third‑party standards: Mandatory compliance with clauses D.5 and D.7 of Annex D of ISO 3864‑2:2016 (s10) requires suppliers to obtain and apply those clauses. Access to the ISO standard usually requires purchase, and the instrument’s notes indicate ACCC viewing may be subject to licensing conditions (s4 note). Firms that assume a generic font size or material durability without consulting D.5 and D.7 risk non‑compliance.

• Symbol accuracy and combination: The instrument specifies a combination of ISO 7010‑W001 and IEC 60417‑6367 as a suitable example of the internationally recognised safety alert symbol (s5). Suppliers using alternative symbols risk failing to meet the instrument’s explicit example. The instrument includes an example image, but does not provide a mandatory template or clear tolerances, which can lead to varied implementations.

Operational pitfalls for online sellers and platforms

• Part 3 recommendations vs mandatory duties: Sections 14 through 16 are recommendations and not enforceable (s11(2)). However, online marketplaces and sellers may face consumer expectations or marketplace policy obligations that mirror the recommendations. Treating Part 3 as non‑binding could still create reputational or commercial risk.

• Electronic instructions and product descriptions: The instrument recommends that persons using electronic platforms include warnings in product descriptions (s14). Sellers relying only on packaging may miss an opportunity to inform online customers. Conversely, sellers who place warnings only in online descriptions must ensure that if the product is also packaged, the mandatory front‑of‑pack requirements (s8(3)) are satisfied.

Label placement and small goods challenges

• Space constraints: Section 12 recognises that space on consumer goods can be limited and gives conditional wording in Part 3 recommendations. However mandatory requirements in Part 2 still require the front panel symbol and possibly attached warnings for small packaged goods (s8(3) and s8(4)). Suppliers of small devices with tiny packaging must ensure that a front panel symbol is still present and that any attached warning is durable and legible.

• Sticker and tag attachment: For unpackaged goods, s8(6) permits stickers or tags. However, stickers might be removed in retail handling or during use, affecting durability requirements in s10 (D.7). Choosing durable materials is therefore critical.

Chemistry‑based message differences

• Lithium v non‑lithium wording: The instrument requires stronger wording for lithium button/coin batteries, stating that they can cause severe or fatal injuries in two hours or less if swallowed or placed inside any part of the body (s8(7)(d), s9(3)(d)). Mislabel‑ling a lithium battery as non‑lithium or vice versa will result in omission of the chemistry‑specific statement and potential non‑compliance. Suppliers must track battery chemistry in their manufacturing and procurement processes.

Interaction with other legal regimes

• Waste and disposal advice: The instrument recommends safe disposal advice (s16), but disposal rules and producer responsibility schemes are governed by separate environmental laws. Relying solely on this instrument’s recommended text will not satisfy obligations under waste management regimes where they apply.

Record keeping and evidence

• Evidence of compliance: Where a regulator requires proof that warnings comply with D.5 and D.7, suppliers must retain design files, proofs of labelling and material specifications. The instrument does not set a record retention period, but the absence of explicit procedural guidance means that maintaining comprehensive proof will reduce risk.

In short, the main gotchas arise from borderline product classifications (packaged/unpackaged, fully enclosed or replaceable battery), application day timing and grandfathering, reliance on third‑party standards and symbol detail, and the chemistry‑specific wording obligations. Firms should document decisions, obtain the referenced standards, and seek clarity for ambiguous product scenarios.

This section provides an operational checklist and a compliance roadmap tied directly to the instrument’s statutory text. It focuses on steps suppliers, manufacturers, importers, retailers and platforms should take to satisfy Part 2 mandatory requirements and to adopt the recommended practices of Part 3.

1. Determine whether the instrument applies to your goods

• Confirm that the product is a "consumer good" containing a button/coin battery as defined in s6(2): the battery must be installed or designed to be installed to power the goods, or the good must be designed to store such batteries.

• Check exclusions in s6(3): verify whether the goods were first supplied to a consumer before application day (s6(3)(a)), whether a supply is a one‑off consumer re‑sale (s6(3)(b)), whether the equipment is trade/professional and not intended for sale to the general public or use where children are present (s6(3)(c)), or whether the battery is soldered in place and the device falls within the specified electrical/electronic categories (s6(3)(d)). Document evidence supporting any exclusion.

2. Identify the applicable compliance pathway

• If the product is accompanied by instructions, the general rule in s8 applies unless the product qualifies for the lower risk pathway in s9. If neither condition applies, map to s8.

• Apply the s9 test if the product is accompanied by instructions and is: a hearing aid; battery fully enclosed; battery not intended to be removed or replaced by a consumer; or battery installation/removal requires a specialist (s9(1)). If any of these apply and instructions are present, s9 applies.

3. Create the required warning content

• Ensure the warning contains the substance of matters in s8(7) or s9(3), as applicable: an alert word in upper case (for example DANGER, WARNING or CAUTION), an internationally recognised safety alert symbol (s5), a statement the battery is hazardous and must be kept away from children, the chemistry‑specific injury statement for lithium or non‑lithium batteries (s8(7)(d)-(e)), and advice to seek immediate medical attention if ingestion or insertion is suspected (s8(7)(f)).

• For lithium button/coin batteries include the exact required message that they can cause severe or fatal injuries in two hours or less if swallowed or placed inside any part of the body (s8(7)(d), s9(3)(d)). Confirm battery chemistry and ensure procurement systems label chemistry correctly.

4. Place and format warnings appropriately

• If goods are accompanied by instructions: include the warning in the instructions, ensuring it is clearly visible, prominent and legible (s8(2)).

• If packaged: mark the front panel with the internationally recognised safety alert symbol that is clearly visible, prominent and legible (s8(3)). If packaged and not accompanied by instructions, attach or include a warning that covers the s8(7) matters (s8(4)).

• If unpackaged: attach a warning to the goods that contains the s8(7) matters, using a sticker or tag as permitted (s8(5)-(6)).

• For lower risk goods (s9): include the warning in the instructions and ensure the same visibility and content standards are met (s9(2)-(3)).

5. Ensure technical compliance with design and durability standards

• Obtain and apply ISO 3864‑2:2016 Design Principles, specifically Annex D clauses D.5 and D.7, which address size, legibility and durability of product safety labels (s10). Acquire the standard or arrange viewing via the ACCC or another licensed library, and document compliance testing or material selection showing adherence to D.5 and D.7.

• Use the internationally recognised safety alert symbol as described in s5. Match the combined symbol elements ISO 7010‑W001 and IEC 60417‑6367, and ensure the symbol reproduction respects design and sizing requirements in the Design Principles.

6. Adopt recommended practices in Part 3 where feasible

• Mark the goods themselves near the battery access point with a durable, legible warning where possible (s12). This is recommended but strongly aligned with consumer safety objectives.

• For packaged goods, follow the guidance in s13 about front‑of‑pack placement of the full message when space permits, or a split placement strategy if space is insufficient.

• For online listings, cause a prominent warning in the product description on electronic platforms (s14). Although recommended, this addresses consumer risk in online shopping contexts and is consistent with market expectations.

• Include contact information for the Australian Poisons Information Centre and advice to contact them immediately if ingestion or insertion is suspected (s15). Include the 24/7 phone number where available.

• Provide clear, prominent guidance on safe disposal of button/coin batteries (s16). Couple this with environmental compliance steps if producer responsibility schemes apply.

7. Document compliance and retention

• Retain evidence: keep design files, proofs, test certificates for label durability, material specifications, photographs of finished products showing label placement, and records of the product classification exercise (packaged/unpackaged, battery accessibility, chemistry). The instrument does not specify record keeping, but evidence will be needed in any enforcement inquiry.

• Version control: document the edition of the standards referenced and the date on which the compliance assessment was made. The instrument fixes the editions "as in force or existing at the time when this instrument commences" (s4 definitions) so record which edition was relied upon.

8. Coordinate supply chain and retail controls

• Communicate mandatory labelling and content obligations to contract manufacturers and importers. Insert contractual warranties and indemnities requiring compliance with s8, s9 and s10.

• For retailers and marketplaces, implement acceptance checks for front‑of‑pack symbols and instruction inclusion. For operators of electronic platforms, decide whether to adopt the Part 3 recommendation in s14, and implement listing templates that include required warning text for relevant SKUs.

9. Seek regulatory guidance for ambiguous cases

• For borderline scenarios such as partially enclosed batteries, electronic instructions, or unusual packaging formats, seek confirmation from the relevant regulator or legal advice. The instrument does not resolve interpretive grey areas like the precise meaning of "intended to be removed or replaced by a consumer".

10. Monitor for updates

• Track any amendments to the instrument or to the referenced standards. The instrument references specific editions of ISO and IEC standards "as in force" at commencement (s4 notes). If standards bodies issue new editions, or if the instrument is amended, ensure product labels and instructions are updated accordingly.

By following this checklist, suppliers can align product labelling, packaging and instructions with the instrument’s mandatory and recommended practices. The critical touchpoints are accurate product classification, chemistry identification, adherence to D.5 and D.7 of the Design Principles, and documentation to demonstrate compliance.
