Consumer Goods (Miniature Motorbikes) Safety Standard 2019

The central concept is the definition of "miniature motorbike" in section 5. It is a vehicle which resembles a motorcycle but scaled down to about half size, designed for a single person, with seat height no greater than 600 millimetres and major dimensions scaled down in proportion to seat height. This definition uses three criteria: resemblance to a motorcycle, single seat, and dimensional scaling tied to seat height. The seat height is defined as the vertical distance between the undeformed upper surface of the driver's seat and the ground when the vehicle is at unladen mass on level ground. Unladen mass means the mass in running order with all fluids filled (including fuel) and all standard equipment. These definitions are important for determining the scope of the standard. A vehicle with seat height above 600 mm is not a miniature motorbike, regardless of how small it looks. Similarly, a scaled-down vehicle that does not resemble a motorcycle (for instance, a scooter-style mini vehicle or an all-terrain vehicle) might fall outside the definition if it does not "resemble a motorcycle". The "scaled down in proportion to seat height" criterion is ambiguous: it implies that width, length, height, and wheelbase must be proportional to seat height, but no metric is given. That creates interpretive risk for suppliers.

Another key concept is the "old consumer protection notice" (Consumer Protection Notice No. 24 of 2011), which imposed a permanent ban on miniature motorbikes with unsafe design features. The instrument uses this notice as a transitional compliance alternative. During the transitional period (12 months from commencement), a miniature motorbike is taken to comply if it would not have been banned under that notice. That effectively allows suppliers to continue selling products that met the old ban criteria for a further year. The old ban itself is not reproduced in the instrument, so a supplier must consult the 2011 notice to determine compliance. That imposes a research burden. After the transitional period, the old notice is no longer relevant and only the Part 3 requirements apply.

The concept of "speed-limiting device" is central to section 13. It must be fitted, set at time of supply at no more than 16 km/h, and not adjustable without a tool. The term "functioning" appears, meaning the device must actually work. The manual (section 19(2)(a)-(b)) must include instructions for using the device and recommend different speed limits by age. This combination creates a tension: the device is factory-set low but the manufacturer is required to recommend higher speeds for older children. That essentially invites the consumer (or a parent) to adjust the device upward after purchase. The instrument does not ban that adjustment, but it does require the device to be "not capable of adjustment except with the aid of a tool" at the time of supply. That implies that after supply, adjustment is permitted, but the supplier must ensure the tool requirement is in place. The device itself must be "functioning" and set at the prescribed limit at supply. The manual recommendations for higher speeds for children aged 6 to 14 implicitly acknowledge that the 16 km/h limit is conservative, but they also create liability concerns if a parent adjusts to the maximum recommended (20, 30, or 50 km/h) and an injury occurs.

The concept of "motorised recreational device", "motorised scooter", and "power-assisted pedal cycle" are defined by reference to the Motor Vehicle Standards (Road Vehicles) Determination 2017. That determination is not reproduced, so suppliers must cross-reference that instrument to determine whether their product is exempt. The exclusion for vehicles "of a kind that could be registered for road use" is also defined by reference to state/territory road laws. That means that if a miniature motorbike could theoretically be registered (e.g., because it meets certain design standards for road use), it is not subject to this standard at all. This is a significant loophole: a supplier could design a mini bike that complies with road vehicle standards (e.g., having lights, mirrors, compliance plates) and sell it without meeting the Part 3 requirements. In practice, most miniature motorbikes are not designed for road use, but the exclusion creates uncertainty.

The standard directly affects suppliers of miniature motorbikes, including manufacturers, importers, wholesalers, and retailers. "Supply" is defined broadly under the Australian Consumer Law and includes sale, exchange, lease, hire, or hire-purchase. Any person in the chain of distribution who offers to supply or supplies a miniature motorbike in trade or commerce must ensure the product complies. This includes online sellers and clearing-sale operators. Indirectly, consumers who purchase miniature motorbikes are affected: the standard guarantees a minimum safety design and information, but also restricts product choice and may raise prices. Because the standard mandates specific engineering features, suppliers cannot differentiate by omitting those features (e.g., a simpler brake system without a floating calliper, or a throttle that is not self-closing clockwise). The cost of compliance is higher for imported goods, especially low-cost models from Asian factories that may not already meet these specifications. That may reduce the availability of cheap miniature motorbikes.

The exclusions mean that suppliers of certain small vehicles are not affected. For example, suppliers of motorised recreational devices (such as go-karts, golf buggies, or off-road buggies that are not motorcycle-like), motorised scooters, power-assisted pedal cycles, or vehicles that can be registered for road use do not need to comply. Also excluded are miniature motorbikes with a maximum design speed of 30 km/h or less that are not speed-limited by a device. That exclusion covers slow mini bikes that are inherently low-speed due to engine size or other constraints (not a speed limiter). Suppliers of such vehicles can sell them without the prescribed speed limiter, but must be careful to ensure the maximum design speed actually does not exceed 30 km/h. If it can exceed 30 km/h even without a limiter, the exclusion does not apply.

The instrument also affects aftermarket parts suppliers indirectly: while the standard applies to the completed vehicle at the time of supply, replacement parts that affect compliance (e.g., a replacement throttle that is not self-closing) could create liability if they render the vehicle non-compliant when supplied in a modified state. However, the standard is product-based, not component-based. Businesses that modify miniature motorbikes (e.g., for racing) after purchase are not directly regulated, but if they supply the modified bike (e.g., resell it), the modified product must comply at the time of that supply. The transitional period (12 months) gave existing stock a bridge; after that period, all new supply must meet the full standard. Importers must ensure they source compliant models or have them retrofitted. Retailers must check that goods from wholesalers meet the standard and keep compliance records.

The primary duty is on any person who supplies or offers to supply a miniature motorbike in Australia: they must ensure the motorbike complies with all requirements in Part 3 (section 7). This duty is strict in the sense that there is no fault requirement; merely supplying a non-compliant good is a breach of the Australian Consumer Law. The duties are not delegable; a retailer cannot rely on a manufacturer's representation without verification. The specific duties under Part 3 include:

• Composition duties: fit a throttle meeting section 8 (self-closing, hand-operated, clockwise return, mounted on right handlebar). Fit a braking system meeting section 9 (acting on front and rear wheels, floating/sliding calliper unless drum type, automatic distribution of braking effort without adjuster). Fit two foot pegs capable of holding the load in section 10 (manufacturer's maximum carrying capacity or 70 kg). Fit a steering head system with no free play and free movement (section 11). Fit a functioning thumb-operated engine stop device on either handlebar (section 12). Fit a functioning speed-limiting device set at no more than 16 km/h at supply, not adjustable without a tool (section 13).

• Warning duties: attach a swing tag with prescribed warning (section 14 and 16) at time of supply. If packaged, mark packaging with the same warning (section 15). Permanently attach a vehicle warning label (section 17 and 18) with smaller font sizes but same basic content. The swing tag and vehicle label must be in the exact form shown, with specific colour (safety alert symbol black on orange, warning word black on orange, other words contrasting colour) and minimum font heights (10 mm for main warning text on swing tag, 5 mm on vehicle label, 5 mm for lower case on swing tag, 2.5 mm on vehicle label).

• Manual duties: provide a user manual in English (section 19(1)) containing mandatory content: instructions for speed-limiting device, age-based speed recommendations, importance of helmet and protective equipment, adult supervision, adequate training, statement that the motorbike is not a toy, not for carrying passengers, and not for use on public roads (section 19(2)). The manual may include other languages but English must be present.

The supplier has a right during the transitional period to comply by showing the motorbike would not have been banned under the old consumer protection notice (section 7(2)). This right expires automatically at the end of the period. Suppliers also have the right to supply miniature motorbikes that fall within the exclusions (section 6) without complying with Part 3. For example, a mini bike with a maximum design speed of 25 km/h that is not limited by a device is excluded. The supplier must ensure the vehicle genuinely meets the exclusion criteria. The instrument does not grant any right to obtain a waiver or exception. There is no provision for alternative compliance or conformity assessment. The duties are absolute, although enforcement is at the discretion of regulators.

The instrument itself does not prescribe penalties; it is a safety standard made under section 104 of the Australian Consumer Law (ACL). The enforcement and penalty provisions are found in the ACL and the Competition and Consumer Act 2010. Supplying a good that does not comply with a safety standard is a breach of section 106 of the ACL. The penalties for a corporation can be up to the greater of $10 million, three times the benefit obtained, or 10% of annual turnover in the preceding 12 months (ACL s224). For individuals, fines up to $500,000. These are civil penalties. Additionally, the court can issue injunctions, adverse publicity orders, non-punitive orders, and order corrective advertising. The regulator (ACCC or state/territory fair trading bodies) can issue infringement notices for alleged breaches, with fines of about $126,000 for a listed corporation or $25,200 for an individual (amounts indexed). Criminal penalties may also apply for reckless or intentional non-compliance (ACL s106(3)), with fines up to $5 million for bodies corporate.

The regulator can also issue compulsory recall orders or accept voluntary recalls. Non-compliance with a order can lead to additional penalties. The instrument is enforceable from its commencement date. During the transitional period, a supplier who meets the old consumer protection notice can defend a non-compliance allegation by showing compliance with section 7(2). After the transitional period ends, that defence evaporates. The supplier bears the burden of proving compliance. The instrument does not create any new investigatory powers; the ACCC already has powers to require information, enter premises, and seize goods if they suspect a safety standard breach.

There is no private right of action for breach of a safety standard under the ACL. Only the regulator can seek penalties. However, a consumer injured by a non-compliant product could bring a claim for damages under the manufacturer's liability provisions (ACL Part 5-4) or for breach of a consumer guarantee (ACL s54, s55). The fact that a safety standard exists could be used as evidence that a product was unsafe or defective. The absence of specific penalty amounts in the instrument means that the maximum penalties under the ACL apply, which are substantial and intended to deter non-compliance. The economic impact of a penalty or recall can be severe for a small supplier.

The instrument is made under the Australian Consumer Law (ACL), which is Schedule 2 of the Competition and Consumer Act 2010. As a safety standard, it sits within a broader product safety regime that includes bans, mandatory reporting, recalls, and information standards. The ACL applies as a law of the Commonwealth and is applied by each state and territory (through application Acts). Therefore, the standard applies uniformly across Australia. It overrides any previous state/territory product safety requirements that are inconsistent, to the extent of inconsistency (per ACL s137). The old consumer protection notice (No. 24 of 2011) was a Commonwealth notice. This instrument effectively replaces that notice, but the old notice remains relevant for the transitional period.

The instrument defines several types of vehicles by reference to the Motor Vehicle Standards (Road Vehicles) Determination 2017. That determination is made under the Motor Vehicle Standards Act 1989 (now the Road Vehicle Standards Act 2018). If a miniature motorbike is a "motorised recreational device", "motorised scooter", or "power-assisted pedal cycle" as defined in that determination, it is excluded from this standard. However, those vehicles may be subject to other safety requirements under state/territory road transport laws (e.g., registration, helmet requirements, licensing). The exclusion means the supplier of an electric scooter (if it falls under the determination's definition) does not need to comply with the miniature motorbike standard, even if the scooter looks like a small motorcycle. The boundary between a miniature motorbike and a motorised scooter can be unclear; the determination defines a motorised scooter as having a platform for standing and handlebars, and not having a seat position that requires the operator to sit astride. A miniature motorbike requires a seat and resembles a motorcycle. The definition of "motorised recreational device" in the determination includes various off-road vehicles like all-terrain vehicles, which may be excluded.

The exclusion for vehicles "of a kind that could be registered for road use" interacts with state/territory road vehicle standards. If a miniature motorbike could meet Australian Design Rules (ADRs) and be registered, it is not a "miniature motorbike" for the purposes of this standard. That is a significant carve-out: a supplier could design a mini bike that meets ADRs (e.g., with lights, horn, compliance plate) and sell it without the speed limiter, warning labels, and other Part 3 requirements. However, such a bike would then need to comply with the ADRs, which are likely more costly. The instrument therefore creates a regulatory boundary: products that are not road-registrable must comply with this standard; products that are road-registrable (or could be) are exempt. This may inadvertently encourage suppliers to make mini bikes registrable to avoid this standard, but the ADRs impose their own design constraints.

The instrument does not interact with workplace health and safety laws directly, but if a miniature motorbike is used in a workplace (e.g., by a tradesperson), the supplier still must comply. There is no interaction with motor vehicle insurance or licensing requirements; those are state/territory matters. The instrument does not impose any record-keeping requirements under itself, but the ACL requires suppliers to comply with recalls and cooperate with regulators. The instrument also does not affect the operation of the Australian Consumer Law's guarantee provisions regarding acceptable quality (s54) or fitness for purpose (s55). A miniature motorbike that meets the safety standard might still be found to have a defect under those guarantees.

According to the source, the instrument was made on 5 December 2019 and registered on 18 December 2019. The commencement information table in section 2 shows that the whole instrument commenced the day after registration, which was 19 December 2019. The table also states "This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument." This indicates that at the time of the source text, no amendments had been made. The instrument has been in effect since December 2019 without any published amendment. The transitional period ended on 19 December 2020 (12 months after commencement). The instrument does not contain a sunset clause or review date. It remains in force indefinitely unless repealed or amended. The old consumer protection notice (No. 24 of 2011) was arguably subsumed by this instrument; its revocation may have been effected by the instrument or by separate notice, but the instrument itself does not explicitly repeal it. Section 4 says that instruments specified in a Schedule are amended or repealed as set out, but no Schedule is present in the provided text. The instrument appears not to have a Schedule; the table of contents lists "Schedules" but no schedule follows in the text. It is possible that Schedules were intended but omitted, or the instrument originally had no schedule. This is a drafting curiosity. The text provided does not include any schedule, so no repeal is specified. However, the old consumer protection notice is referenced but not repealed. In practice, the new standard supersedes the old ban, but the old notice may technically remain on the register. Any later amendment to this instrument would be published separately. No amendment history appears in the public record up to the date of knowledge cut-off. Suppliers should check the Federal Register of Legislation for updates.

The instrument itself has not been the subject of any reported litigation based on the source text. The text does not mention any cases. As it is a relatively niche safety standard, it may have generated enforcement actions under the ACL, but those would be decided by courts or tribunals under the general provisions rather than the instrument alone. For example, if a supplier was prosecuted for supplying non-compliant miniature motorbikes, the case would be about whether the goods met the standard. Literature on ACCC enforcement indicates that miniature motorbikes have been a concern. The old consumer protection notice (No. 24 of 2011) replaced earlier bans and likely generated compliance action. Under the new standard, the ACCC issued guidance in 2020 about miniature motorbikes. One possible area of litigation could be the interpretation of "scaled down in proportion to seat height". If a vehicle has a seat height of 580 mm but a wheelbase that is unusually short, is it still a miniature motorbike? No case has tested that. Another possible area is the interaction with the road vehicle exclusions: if a supplier claims a bike is registrable but it cannot actually be registered (e.g., because it lacks a VIN), that could be a defence issue. The transitional period may have given rise to disputes about whether a bike would have been banned under the old notice. Without reported cases, the instrument remains judicially untested. This means there is uncertainty about how strictly courts will interpret certain requirements (e.g., what constitutes "permanently attached" for the label, or "scaled down in proportion"). Suppliers should be cautious. The lack of litigation does not mean low enforcement risk; it may mean the standard is being complied with, or that non-compliance has been dealt with via infringement notices without court proceedings.

The instrument contains several traps that could catch a supplier. First, the speed-limiting device requirement at section 13: at the time of supply, the device must be set at no more than 16 km/h and not adjustable without a tool. A supplier might think they can supply the bike with the limiter adjustable by the user (e.g., via a key or switch) and simply set it low. But the requirement is "not capable of adjustment except with the aid of a tool". If the user can easily bypass the tool requirement (e.g., by using a coin or a finger), that could be argued as non-compliance. The tool must be something not commonly available to a child, presumably. The ACCC may take a strict view. Second, the manual recommendations for speed limits by age (20, 30, 50 km/h) are not mandatory for the supplier to enforce, but the manual must state them. This creates a potential liability for the manufacturer if a parent follows the recommendation for a 6-year-old at 20 km/h and the child is injured; the manufacturer's own manual encourages a higher speed than the supply limit. That tension is deliberate but could be exploited in litigation.

Third, the definition of miniature motorbike relies on "major dimensions which are scaled down in proportion to the seat height". What is a "major dimension"? Wheelbase, length, width? There is no further guidance. A supplier importing a mini bike that has a seat height of 500 mm but unusually long wheelbase (not proportional) could argue it is not a miniature motorbike. That is risky. The ACCC might use a qualitative judgment. Fourth, the exclusion for vehicles with a maximum design speed of 30 km/h or less if not limited by a speed-limiting device: if a bike has a governed engine that cannot exceed 30 km/h but could be modified easily, is that a speed-limiting device? The exclusion says "if the vehicle is not limited by a speed-limiting device". So if the bike has a restrictor plate or electronic limiter, it is limited by a device and therefore not excluded. That could catch a supplier who installs a rudimentary governor, expecting the exclusion. Better to have no device and rely on inherent speed capability.

Fifth, the vehicle warning label must be "permanently attached". A sticker that can be peeled off may not be considered permanent. The standard does not define "permanently attached". A riveted plate or engraving might be safer. If a supplier uses a sticker and it falls off, they could be in breach. Sixth, the swing tag warning (section 14) must be attached to the motorbike at the time of supply or offer for supply. If the bike is displayed without the swing tag (e.g., on a shelf), the offer for supply may be non-compliant. Retailers must ensure all display models also have the tag. Seventh, the packaging warning (section 15) applies only if the bike is packaged. If packaged, the warning must be on the packaging. A supplier who packages a bike but does not mark the box could be in breach even if the swing tag is present. Eighth, the user manual must be in English but can include other languages. The manual requirements are prescriptive; missing one required statement (e.g., "state that children must always be supervised by an adult") is a breach. Ninth, the braking system requirement (section 9(b)) for floating/sliding calliper unless drum type: some cheap mini bikes use a simple disc brake without a floating calliper; only drum brakes are exempt. That may require expensive engineering changes. Tenth, the transitional period is only 12 months. A supplier who relied on the old notice and imported a large stock just before the end of the period could not sell after the period ends unless the stock also meets the new Part 3 requirements.

Compliance requires a systematic approach. Step one: determine if the product is a miniature motorbike under section 5. Measure seat height (vertical distance from undeformed seat surface to ground at unladen mass, level ground). If seat height exceeds 600 mm, the standard does not apply (but check other laws). Ensure the vehicle resembles a scaled-down motorcycle, is designed for a single person, and major dimensions are proportionally scaled to seat height. Document these measurements and design rationale.

Step two: check the exclusions in section 6. If the vehicle could be registered for road use under any state/territory law (e.g., because it meets Australian Design Rules), it is excluded. If the vehicle has a maximum design speed of 30 km/h or less and is not fitted with a speed-limiting device, it is excluded. If it is a power-assisted pedal cycle, motorised recreational device, or motorised scooter under the 2017 Determination, it is excluded. Obtain evidence for exclusion (e.g., engineering report on max speed, compliance certificate from road authority, or classification under the Determination). Keep that evidence.

If not excluded, comply with Part 3. For composition (Division 1): fit throttle that is self-closing (returns to idle when released), hand-operated, rotates clockwise to accelerate, mounted on right handlebar. Fit braking system that acts on both wheels; if not drum type, use a floating or sliding calliper that compensates for wear; ensure the system automatically distributes braking effort equally without need for adjuster at calliper. Fit two foot pegs capable of holding static load of either manufacturer's recommended max carrying capacity or 70 kg (if no recommendation). Test load. Fit steering head system with zero free play; when front wheel is raised, steering must move freely from right to left under weight of steering system. Fit a functioning thumb-operated engine stop device on right or left handlebar, clearly visible. Fit a functioning speed-limiting device set at no more than 16 km/h at the time you supply or offer to supply; the device must not be adjustable without a tool. Obtain a tool-specific adjustment method (e.g., special screwdriver, Allen key, or tamper-proof fastener). Document that the device cannot be adjusted by hand.

For warnings (Division 2): create a swing tag with the exact warning statement shown in section 16(1). Ensure safety alert symbol is at least 10 mm high, black on orange. The words "WARNING" and "RISK OF SERIOUS INJURY OR DEATH!" must be in bold uppercase, at least 10 mm high, black on orange. Other words in upper/lower case as shown; uppercase letters at least 10 mm, lowercase at least 5 mm; in a contrasting colour to background (e.g., black on white). Attach tag securely to bike at time of supply. If the bike is packaged, print the same warning on the packaging, with similar sizing and colour requirements (presumably the same dimensions apply but section 16 does not specify different sizes for packaging; it says "the warning must be in the following form" and then gives the size parameters; those apply to both swing tag and packaging warnings as per section 15(1) referencing section 16). So packaging warning must meet the same 10mm/5mm font rules. For the vehicle warning label (section 18): permanently attach a label with the form shown. The label must be clearly visible and legible to the operator. Use a safety alert symbol at least 5 mm high, black on orange. For the words "WARNING" and "RISK OF SERIOUS INJURY OR DEATH!" use bold uppercase at least 5 mm high, black on orange. For other text, uppercase letters at least 5 mm, lowercase at least 2.5 mm, contrasting colour. Ensure the label is durable (e.g., etched, riveted, or adhesive with resistance to removal). Keep a sample label and swing tag for records.

For user manual (Division 3): prepare a manual in English. Include instructions for using the speed-limiting device (how to adjust it, presumably, since the device is set low at supply but the manual should explain operation). Recommend speed limits for child age groups: for ages 6-8, no more than 20 km/h; 8-11, no more than 30 km/h; 12-14, no more than 50 km/h. State the importance of wearing a helmet and protective equipment. State that children must always be supervised by an adult while using the motorbike. State that children must have adequate training before use. State that the motorbike is not a toy. State that it must not be used to carry passengers. State that it is not for use on public roads. The manual may include other languages.

After the transitional period expired, the alternative compliance path (section 7(2)) is no longer available. Suppliers must use the Part 3 requirements. For products already in the supply chain that were compliant under the old notice but not with Part 3, they cannot be supplied after the transitional period. Inventory management is critical. Record keeping: maintain evidence of compliance, including supplier declarations, design specifications, test reports (e.g., brake performance, load capacity of foot pegs, speed limiter calibration, throttle return test). The ACCC may request such evidence. Consider third-party testing to reduce legal risk. For small businesses, the cost of testing and redesign may be significant; a cost-benefit analysis of continuing in this product line may be warranted. Compliance is not self-certifying; a supplier who does not test may still be liable if a product is found non-compliant.
