Consumer Goods (Elastic luggage straps) Safety Standard 2017

The instrument rests on a small number of tightly specified legal and technical concepts. Those concepts determine coverage, the precise obligation, permitted transitional compliance, and what is repealed.

• Elastic luggage strap, defined: An "elastic luggage strap" is an elastic strap or cord, or two or more elastic straps or cords permanently joined, that has a hook, buckle or other fastening device at each extremity and is designed to be used for securing luggage or other objects. The definition expressly excludes an elasticised cargo net and an elasticised strap specifically made for securing a vehicle jack or toolkit within a vehicle (s 5). The definition therefore captures single and multiple-strand elastic straps intended for luggage- or object-securing, provided they have fastening devices at each end.

• Mandatory warning content: Section 8(1) prescribes the exact words that must appear on each strap (as fixed, permanent label, or stamped directly): "WARNING: Rebounding hooks cause blindness. Place hooks with care. Keep face and body out of rebound path. DO NOT overstretch. DO NOT use when strap has visible signs of wear or damage." The instrument therefore mandates not only the presence of a warning but the exact substantive message. The text highlights the hazard of "rebounding hooks" and prescribes behavioural instructions and a damage-warn clause.

• Presentation specifications: Section 8(2) defines the typographic and colour presentation. It requires upper-case black letters not less than 5 millimetres in height for "WARNING" and "DO NOT" on a yellow background; the rest of the words must be in upper and lower case as shown in s 8(1), with any upper-case letters of not less than 5 millimetres height, again on yellow; and the label must be "conspicuously displayed". Those are precise constraints that govern legibility, conspicuity and colour contrast.

• Transitional compliance: Sections 6 and 9 create a two-stage compliance regime. From commencement to 30 June 2019 inclusive, an elastic luggage strap must meet either s 8 or comply with the older standard referenced (Regulation 11C(3) of the Trade Practices (Consumer Product Safety Standards) Regulations 1979) as it stood immediately before this instrument commenced (s 6(1); s 9(1)). The instrument expressly repeals that 1979 Regulation in Schedule 1. From 1 July 2019 forward, s 7 requires compliance with s 8 only. The transitional provision itself is time-limited and is repealed at the start of 1 July 2019 (s 6(2); s 9(2)).

• Repeal: Schedule 1 repeals Regulation 11C of the 1979 Regulations. The instrument includes notes explaining continuity of the earlier standard as a safety standard carried forward into the Australian Consumer Law regime (Schedule notes and notes to s 9).

The instrument therefore focuses on a labelling/warning remedy rather than mandating particular engineering or construction specifications for straps. The defined product scope, the mandatory text and the detailed presentation rules are the primary legal levers the instrument uses.

The instrument affects persons and entities in the supply chain for elastic luggage straps as defined in s 5. That will include manufacturers, importers, distributors, wholesalers and retailers who supply elastic luggage straps within Australia that meet the definition.

• Manufacturers and importers: They are the primary decision-makers for product design and labelling. Because the requirement is to affix the prescribed warning "each" to the strap (s 8(1)), manufacturers and importers who place straps on the Australian market must ensure the label is fixed securely and permanently to the strap or that the warning is stamped directly on the strap. Manufacturers will need to incorporate the warning into the manufacturing or packaging process before supply, or ensure imported products bear the required label and format. If a product is produced overseas and imported, importers must verify that the labelling on each supplied strap conforms to s 8(1)-(2).

• Distributors, wholesalers and retailers: These intermediaries will face compliance risk if they supply products that do not carry the mandated warning in the mandated format and conspicuously displayed. During the transitional window (commencement until 1 July 2019), suppliers may rely on compliance with the older standard as set out in s 9(1). After 1 July 2019, the only permitted compliance route is s 8.

• Consumers: The instrument mandates the presence of a prescribed warning message intended to inform end users about the hazard: "Rebounding hooks cause blindness" and further behavioural cautions (s 8(1)). The instrument does not itself impose obligations on consumers, but consumers are the intended recipients of the warning.

• Excluded product makers and suppliers: Producers and suppliers of elasticised cargo nets and elasticised straps for securing vehicle jacks or toolkits are outside the instrument's scope due to the express exclusions in s 5(c)-(d). Suppliers of those excluded products are not required by this instrument to carry the prescribed warning.

• Regulators and the Minister: The instrument was made by the Minister for Small Business (front matter) under s 104(1) of the Australian Consumer Law (s 3). The instrument does not itself set out which regulator will enforce the standard or specify penalties in this text. The instrument does, however, identify the legal authority under which it was made.

Who directly pays the costs: the supply-side actors pay for compliance. That includes costs of adding or revising permanent labels, stamp tooling if stamping the strap directly, rework or destruction of non-compliant inventory, and updating product specifications and supplier contracts. The instrument's transitional provision allocates some relief by permitting reliance on the older Regulation 11C(3) until 1 July 2019 (s 6(1); s 9(1)), potentially reducing immediate turnover costs for existing stock that already complies with the older standard.

Duties:

• Duty to provide the prescribed warning: For every elastic luggage strap, the duty is to "each have fixed securely and permanently to, or stamped on, a label or notice" the exact warning text set out in s 8(1). The duty is product-specific, applying "each" strap, not simply to packaging or to a leaflet.

• Duty on presentation: The warning must meet the typographic and colour specifications in s 8(2). Specifically, the words "WARNING" and "DO NOT" must be in upper case black letters at least 5 millimetres in height on a yellow background. The remaining words must appear in upper and lower case letters as shown in s 8(1), with any upper case letters not less than 5 millimetres in height on a yellow background. The label or notice must be "conspicuously displayed" (s 8(2)(a)-(c)).

• Duty to comply with transitional option prior to 1 July 2019: Until 1 July 2019, suppliers have the alternate duty to comply with the older standard set by Regulation 11C(3) of the Trade Practices (Consumer Product Safety Standards) Regulations 1979, as that regulation existed immediately before the commencement of this instrument (s 6(1); s 9(1)). That is, the duty is to meet s 8 or the older Reg 11C(3).

Rights:

• Right to rely on transitional standard: Between commencement and 1 July 2019, suppliers may supply elastic luggage straps that comply with Regulation 11C(3) as it stood immediately before this instrument commenced rather than the new s 8 requirement (s 6(1); s 9(1)). The instrument thereby gives a limited right to use the older compliance pathway until the transition cut-off.

• Right to certainty in content and presentation: The instrument prescribes the exact wording and presentation, which reduces compliance discretion for suppliers about what a compliant warning should say and look like (s 8). That is operationally a right to know the required label content and appearance rather than to choose alternative warning language or styles.

• Scope-limiting right for excluded items: Entities supplying excluded products, namely elasticised cargo nets and elasticised straps made to secure a vehicle jack or toolkit, have the right not to be covered by this instrument because of the explicit exclusions in the definition in s 5(c)-(d).

Operational implications of duties and rights:

• The obligation is to the product itself; the label must be fixed to the strap or stamped on it. A supplier who only places a sticker on retail packaging while the strap itself lacks the required label would not satisfy the duty as worded, since s 8 requires the label to be on the strap (s 8(1)).

• The instrument creates precise presentation obligations that limit discretion and, thereby, reduce ambiguity but increase mechanical compliance costs. The requirement that letters be at least 5 millimetres in height and on a yellow background gives a measurable compliance target but also creates a practical constraint for small straps.

• The instrument gives a short-term compliance choice until 1 July 2019, after which the duty consolidates to the s 8 regimen (s 7).

The instrument itself does not state sanctions, remedies, or enforcement rights in its text. It identifies the enabling provision under the Australian Consumer Law (s 3), but it does not reproduce enforcement mechanisms in this instrument.

The instrument does not specify penalties, inspectors, or step-by-step enforcement mechanisms within its own text. It is made under subsection 104(1) of the Australian Consumer Law (s 3), but the instrument itself contains no provisions that create fines, offences, or civil penalty regimes, nor does it appoint an enforcement authority or set out processes for recalls or notices.

Practical enforcement pathway implied by the instrument:

• The instrument operates as a mandatory safety standard: s 6 and s 7 state an elastic luggage strap "must meet the requirements" set out in s 8 (or s 9 in the transitional window). That "must" imposes an obligation on suppliers of the defined product. The instrument thus creates mandatory product requirements rather than voluntary guidance.

• The text leaves enforcement mechanics to the broader legal framework under which the instrument was made. The instrument identifies the legal authority as s 104(1) of the Australian Consumer Law (s 3), and it records the removal of the earlier Regulation 11C via Schedule 1. The instrument itself, however, does not set out penalties or enforcement steps.

Consequences of absence of penalty provisions in the instrument:

• The lack of internal penalty text in the instrument means readers must look outside this instrument to find the specific enforcement mechanisms, penalties and authorities that attach to a failure to comply. This instrument does not state who will issue compliance notices, who will conduct inspections, nor what specific sanctions apply for non-compliance. It does, however, establish the substantive standard against which compliance would be measured.

• Because the instrument prescribes mandatory wording and presentation requirements, a regulator enforcing consumer product safety standards under relevant Commonwealth, State or Territory law would measure compliance against the textual and presentation requirements set out in s 8. The instrument gives clear, objective requirements that an enforcing agency could apply.

Transitional enforcement considerations:

• Between commencement and 1 July 2019, enforcement should take into account the instrument’s transitional rule permitting compliance with Regulation 11C(3) as it stood immediately before this instrument commenced (s 6(1); s 9(1)). After 1 July 2019, enforcement would be against s 8 alone (s 7).

Because this instrument makes precise, objective requirements, it reduces uncertainty about what constitutes non-compliance, but it does not itself provide the sanctions or enforcement mechanisms. Users seeking to know penalties or enforcement processes should therefore consult the Australian Consumer Law and the regulatory arrangements under which safety standards made under s 104(1) are enforced, but those are not set out in this instrument.

This instrument situates itself within the safety-standard framework established by the Australian Consumer Law by explicitly stating it is made under subsection 104(1) of that Law (s 3). It also expressly deals with continuity from an earlier federal regulation.

• Relationship to the Australian Consumer Law: The instrument records its legal base (s 3) in subsection 104(1) of the Australian Consumer Law. The instrument does not reproduce other provisions of the Australian Consumer Law, nor does it state enforcement or penalty mechanisms. The instrument therefore functions as a product-specific safety standard made under the s 104(1) rule-making power, and its substantive obligations should be understood as being created pursuant to that authority.

• Continuity with the Trade Practices-era standard: The instrument provides for transitional compliance by reference to Regulation 11C(3) of the Trade Practices (Consumer Product Safety Standards) Regulations 1979 as the regulation stood immediately before this instrument commenced (s 9(1)). The instrument also includes a Schedule that repeals Regulation 11C in the 1979 Regulations (Schedule 1). The instrument contains an explanatory note that the earlier Regulation could in 2017 be viewed on the Federal Register of Legislation and that, by prior statutory transitional arrangements in 2010, the 1979 Regulation had continued in force as if it were a safety standard made under section 104 of the Australian Consumer Law (notes in s 9 and Schedule 1). In operational terms, the instrument replaces the old Regulation 11C with the new s 8 standard, with a limited transitional window.

• Exclusions to scope and other statutory regimes: The instrument’s definition of elastic luggage strap in s 5 includes express exclusions for elasticised cargo nets and straps specifically made for securing vehicle jacks or toolkits. Those exclusions limit the instrument’s interaction with products that might otherwise be similar. The instrument does not address how it interacts with other product-specific safety standards or industry standards beyond the cited Regulation 11C continuity note.

• Absence of internal enforcement clauses: Because this instrument does not set out enforcement or penalty provisions, its enforceability depends on the enforcement provisions in the Australian Consumer Law and any designated enforcement agencies under that broader legal framework. The instrument’s interaction with recall powers, administrative sanctions, or civil penalty remedies is not specified in its text. Readers should note that the instrument supplies substantive compliance criteria but does not re-state the enforcement architecture.

• Repeal mechanics: Schedule 1 actively repeals Regulation 11C of the 1979 Regulations. The instrument therefore consolidates the product standard framework for elastic luggage straps under the Australian Consumer Law by removing the older regulation and replacing it with the present wording and presentation mandates, with the one transitional phase built into ss 6 and 9.

In sum, the instrument is a product-specific safety standard made under the Australian Consumer Law. It supersedes the earlier Trade Practices-era Regulation 11C (with transitional allowance), and it leaves enforcement mechanics to the broader legislative and regulatory architecture rather than reproducing them in the instrument.

The instrument itself contains limited amendment and timing provisions, which should be read closely for transitional and repeal effects.

• Date and commencement: The instrument is dated 31 March 2017 in the heading and the front matter records the Minister for Small Business as the maker. It commences on the day after registration on the Federal Register of Legislation (s 2).

• Transitional regime and staged repeal: Sections 6 and 9 create a staged compliance regime. Section 6 provides that before 1 July 2019 an elastic luggage strap must meet the requirements set out in s 8 or s 9; s 6(2) explicitly states that section 6 is repealed at the start of 1 July 2019. Section 9 allows compliance with Regulation 11C(3) of the Trade Practices (Consumer Product Safety Standards) Regulations 1979 if a strap does not comply with s 8; s 9(2) states that section 9 is repealed at the start of 1 July 2019. Section 7 fixes the post-1 July 2019 rule that the strap must meet s 8.

• Repeal of earlier Regulation 11C: Schedule 1 effects the repeal of Regulation 11C of the Trade Practices (Consumer Product Safety Standards) Regulations 1979. The schedule explicitly sets out the repeal of Regulation 11C. The instrument contains notes explaining prior continuity arrangements that carried the 1979 regulation forward into the Australian Consumer Law regime prior to this instrument.

• No later amendments in the supplied text: The document supplied contains no other entries in its Schedule for amendment or addition. The instrument sets out its own staged repeal points and the standalone repeal of the older Regulation 11C. There are no subsequent amendment entries or alternative text suggested in the instrument itself.

Practical reading of amendment mechanics:

• Suppliers who brought stock into Australia prior to 1 July 2019 could rely on compliance with Regulation 11C(3) as it stood immediately prior to this instrument commencing, because s 6(1) and s 9(1) permit compliance with that earlier standard until the start of 1 July 2019. After that date, the s 8 requirements alone govern.

• The instrument’s Schedule removes the earlier regulation from the statute book. The instrument therefore completes a statutory migration from the old Trade Practices-era regulation to a new safety standard drafted under the Australian Consumer Law, with a short transitional window.

• The instrument itself is silent on subsequent amendments made after its commencement. This instrument records only the changes enacted within its text: the new mandatory specification, its transition, and the repeal of Regulation 11C.

Any party tracking regulatory change should monitor the Federal Register of Legislation and any later instruments that amend or repeal this 2017 standard, because the present text does not purport to be amended further in the supplied document.

The supplied instrument does not record any litigation history. It contains no references to judicial decisions, administrative determinations, or challenges arising under the instrument. The text names no cases. The document’s notes refer only to prior statutory continuity and the availability of the earlier Regulation 11C on the Federal Register of Legislation (s 9 note 1), and to the 2010 amendment that continued the 1979 Regulation as a safety standard (s 9 note 2). Those notes are statutory-history notes, not judicial history.

What the absence of litigation references implies for users:

• The instrument itself is a regulatory text and generally such texts do not include litigation histories. The absence of cases in the instrument should not be read as evidence that no enforcement action or legal challenges have occurred since commencement; it only means that the instrument as supplied does not document any litigation.

• Practitioners seeking litigation history must consult case law databases, tribunal records and regulator enforcement records. The instrument does not supply those materials and does not name decisions to consult.

• The instrument’s precision in mandating warning text and format makes it straightforward to identify non-compliant products on a textual and presentational basis, which could reduce litigation complexity in an enforcement or civil suit context. However, the instrument does not itself identify the civil or criminal causes of action or remedies that arise from non-compliance. Those would be located in the Australian Consumer Law and any enforcement instruments that operate in conjunction with it.

Because the instrument names no cases and sets out no litigation trend or precedent, any discussion of actual disputes arising from this standard lies outside the text supplied here and would require external legal research.

This instrument is short and precise, but the precision itself creates several practical compliance and interpretation pitfalls. The following are concrete operational "gotchas" drawn from the instrument’s wording and structure.

1. Location of the label: Section 8(1) requires that an elastic luggage strap "must each have fixed securely and permanently to, or stamped on, a label or notice" containing the prescribed wording. The requirement is on the strap itself, not merely on packaging or on a separate instruction leaflet. Suppliers relying on warnings on outer packaging, hang-tags that are removable, or sales-point signage may still be non-compliant if the strap itself does not bear the required, permanent label or stamped notice.

2. The phrase "fixed securely and permanently to, or stamped on, a label or notice": The wording could be read in different ways. A literal reading requires either (a) the warning to be fixed securely and permanently to the strap (for example, by being permanently stitched or moulded in), or (b) the warning to be stamped onto the strap. Placing a removable adhesive sticker that can fall off or be removed by the consumer is unlikely to meet the "fixed securely and permanently" test. Suppliers should avoid ambiguous affixation methods.

3. Minimum type size and colour constraints on small straps: Section 8(2) demands that the words "WARNING" and "DO NOT" be in upper case black letters not less than 5 millimetres in height on a yellow background, and that any upper case letters elsewhere be not less than 5 millimetres in height on a yellow background. For narrow or small straps it may be physically difficult to accommodate 5 millimetre letter heights and a yellow field. This can create a compliance problem for small products where there is insufficient surface area to print the label as specified.

4. Definition captures multiple configurations: The definition of elastic luggage strap (s 5) includes "two or more elastic straps or cords permanently joined" and a fastening device at each extremity. That means multi-strand straps that are joined permanently are captured, and so the labeling requirement applies to each such strap. Manufacturers of composite straps cannot assume that small joined elements are outside scope.

5. Exclusions are narrow: The instrument expressly excludes an elasticised cargo net and straps specifically made to secure a vehicle jack or toolkit (s 5(c)-(d)). Other vehicle-related straps, or straps sold for multiple uses, may still be captured. Suppliers whose product has multiple marketed uses should verify whether their strap falls within the definition.

6. "Conspicuously displayed" is not defined: The requirement that the label be "conspicuously displayed" (s 8(2)(c)) introduces interpretive uncertainty about placement and visibility in actual use. For example, a label located on an internal seam that becomes obscured when the strap is in use may not be "conspicuous". The instrument does not define conspicuousness, so enforcement bodies will need to apply a reasonableness standard.

7. Transition reliance must be evidenced: Between commencement and 1 July 2019, compliance could instead be via the older Regulation 11C(3) (s 6(1); s 9(1)). A supplier relying on that transitional route should retain documentary evidence that the product complied with the older standard as it stood immediately before this instrument commenced. The instrument references that older regulation "as that Regulation was in force immediately before the commencement of this instrument" (s 9(1)). Without documentary proof, a supplier risks regulatory challenge.

8. No internal enforcement text: Because the instrument does not state penalties or enforcement procedures, suppliers may mistakenly assume non-compliance carries no sanction. The instrument nevertheless creates mandatory obligations. Non-compliance consequences will arise under the wider legal framework; the instrument does not insulate suppliers from enforcement action.

9. Exact wording requirement: The instrument prescribes an exact warning sentence. Any deviation in wording, punctuation or sequencing from s 8(1) may be challenged as non-compliant. For example, omitting "Rebounding hooks cause blindness" or changing "DO NOT overstretch" to "Do not overstretch" in a way that alters the uppercase/lowercase and size requirements could be non-compliant.

10. Multiple straps and "each" obligation: The duty is to have the warning on "each" elastic luggage strap (s 8(1)). A multi-pack containing several straps where only one strap is labelled could fail the "each" requirement. Suppliers should ensure labelling on every strap unit intended for sale.

Careful reading of the text, conservative implementation of the affixation and type-size requirements, and documentation of compliance choices during the transitional period are the practical mitigations for these "gotchas".

The instrument sets simple but specific requirements. Compliance steps should therefore be concrete, documented and oriented to the text of ss 8(1)-(2) and the transitional rules in ss 6 and 9.

1. Identify covered products using the definition in s 5.

• Review your product catalogue against the definition in s 5 to confirm which items qualify as an "elastic luggage strap". Include single straps, multi-straps permanently joined, and any straps with hooks, buckles or fastening devices at both ends used to secure luggage or other objects.

• Exclude explicitly covered exceptions: do not treat elasticised cargo nets or straps manufactured specifically to secure vehicle jacks or toolkits as covered items (s 5(c)-(d)). Document the basis for any exclusion claim.

2. Decide whether the transitional standard applies.

• If supplying straps between commencement and 30 June 2019, determine whether the product complies with s 8 or Regulation 11C(3) as it stood immediately prior to the instrument’s commencement (s 6(1); s 9(1)). If relying on the older standard, obtain and retain contemporaneous evidence of compliance with Reg 11C(3) as in force immediately before commencement.

• From 1 July 2019 onward, plan for strict compliance with s 8 only (s 7).

3. Implement the precise label content and presentation.

• Ensure the label on each strap reproduces the exact warning wording in s 8(1): "WARNING: Rebounding hooks cause blindness. Place hooks with care. Keep face and body out of rebound path. DO NOT overstretch. DO NOT use when strap has visible signs of wear or damage."

• Apply the typographic and colour rules from s 8(2). Specifically:

  • "WARNING" and "DO NOT" must be in upper case black letters not less than 5 millimetres in height on a yellow background.
  • The remaining words must be in upper and lower case letters as shown in s 8(1), with any upper-case letters not less than 5 millimetres in height on a yellow background.
  • Ensure the label is "conspicuously displayed".

• If physical constraints on small straps make a 5 millimetre type height impractical, consider design solutions that preserve compliance such as larger label tabs permanently attached to the strap, stamping the warning on a non-moving portion of the strap where the 5 mm height is achievable, or moulding the label into a buckle housing if that satisfies the "fixed securely and permanently" requirement.

4. Choose durable attachment methods.

• Avoid removable stickers or hang-tags that can be peeled off. Use permanent attachment methods: stitching permanent fabric labels, heat-sealed or moulded labels, permanent stamping or embossing of the text on the strap, or any other method that demonstrably results in the warning being "fixed securely and permanently to" the strap or stamped on it (s 8(1)).

• If stamping directly, ensure the stamp process achieves the required legibility, letter size, and colour contrasts on a yellow field where required.

5. Verify conspicuity and legibility.

• Test final products for legibility under typical lighting conditions and when the strap is in expected use positions. The label must be "conspicuously displayed" (s 8(2)(c)). Document the decision on placement and record test results.

6. Update product specifications, supplier contracts and import documentation.

• Amend product specifications, technical drawings and procurement documents to require the exact warning and presentation. For imported products, update purchase contracts and supplier confirmations to require the label or stamping as a pre-condition of shipment.

• If relying on stamped labels from overseas manufacturers, require photographic pre-shipment evidence and hold testing samples.

7. Manage existing inventory and stock.

• For stock brought in or produced before 1 July 2019, determine whether the older Regulation 11C(3) coverage applies and document that reliance. If not, consider relabelling or reworking stock where possible to avoid disposal.

• Maintain records showing when transitions were made, how compliance was achieved, and any decisions to rework or destroy non-compliant inventory.

8. Operational compliance controls.

• Introduce a pre-shipment or pre-sale compliance checklist that includes verification of the exact text, letter height measurement, colour contrast, affixation permanence and conspicuity.

• Train staff in quality control to spot non-compliant labels and to quarantine non-compliant items pending rework or removal.

9. Retain documentary evidence of compliance.

• Keep samples, photographs, production specifications, supplier confirmations and quality control logs. For transitional-period products relying on the older Reg 11C(3), retain the contemporaneous regulatory text and documentary proof of compliance.

10. Be cautious on product variants and subcontracted manufacturing.

• If straps are produced under private label or by contract manufacturers, ensure agreements assign responsibility for compliance and include warranties about conformity with s 8.

The instrument is narrowly focused on labelling and presentation. Therefore, compliance is primarily a matter of product marking, documentation and supply-chain control rather than substantive re-engineering. However practical constraints, especially on small straps, mean suppliers should plan label layout, production processes and supply contracts in advance to avoid non-compliance.
