Consumer Goods (Disposable Cigarette Lighters) Safety Standard 2019

The instrument builds on a small set of defined concepts that determine scope, timing and technical reference points.

Disposable cigarette lighter. The text defines the covered product class as a “disposable cigarette lighter” and sets out three design-based criteria: it must be a flame producing device designed to light cigarettes, cigars and pipes; it must be designed either (i) to be discarded when its fuel is exhausted, (ii) to incorporate a separate container of fuel that is designed to be discarded when empty, or (iii) to be refillable with fuel (s5). The definition then provides a carve-out: where the device is designed to be refillable, it is not treated as a disposable cigarette lighter if it is “a refillable repairable lighter within the meaning of the European Standard” (s5). That cross-reference imports a technical categorisation from the European Standard into the statutory definition.

External technical standards as legal norm. The instrument does not itself set technical tests or design prescriptions. Instead it makes compliance conditional on external technical documents. Two documents are permitted compliance routes: ASTM F400‑10 Standard Consumer Safety Specification for Lighters (referred to in s8(1)(a)) and the European Standard EN 13869:2016 Lighters , Child Safety Requirements For Lighters , Safety Requirements and Test Methods (defined at s5). The instrument freezes the relevant versions to those “as in force or existing at the time when this instrument commences” (definition of European Standard; s8(1)(a)). The instrument then specifies an express statutory variation to clause 3.2 of the European Standard by omitting all words after “five years” (s8(2), s9(2)). That is, the statute modifies the external standard to create the legally applicable technical rule.

Transitional architecture. The instrument establishes a 12 month “transitional period” beginning on the commencement day (s5). During that period, suppliers may choose any of the three compliance routes: the ASTM standard, the European Standard (as varied), or the requirements of the older Trade Practices (Consumer Product Safety Standard) (Disposable Cigarette Lighters) Regulations 1997 (s6(1), s10(1)). At the expiry of the 12 months the “1997 Regulations” route is no longer available; the instrument expressly repeals the 1997 Regulations (Schedule 1) and repeals the transitional permissions (s6(2), s10(2)).

Reference and access notes. The instrument contains notes that identify where the standards could be obtained at the time of instrument making: SAI Global for purchase and the Australian Competition and Consumer Commission for viewing subject to licensing conditions (notes under the definition and under s8). The instrument also records that a permanent ban on toy‑like novelty cigarette lighters exists under subsection 114(1) of the Australian Consumer Law and that this ban was available as Consumer Protection Notice No. 18 of 2011 on the Federal Register of Legislation (note to s5). Finally, the authority for the instrument is subsection 104(1) of the Australian Consumer Law (s3), and the instrument states that the reference to the ACL is to Schedule 2 to the Competition and Consumer Act 2010 “as it applies as a law of the Commonwealth, States and Territories” and points to section 140K of that Act and corresponding provisions (note to s3).

Principles implicit in the instrument. The statute’s design creates two parallel technical pathways, giving suppliers a choice between an American standard and a European standard, and it modifies one element of the European standard. The statute freezes the versions of standards that apply at commencement, and it provides a limited transitional period that temporarily retains the older domestic regulation. Those mechanics determine how compliance will be measured, who must obtain which technical documents, and how older inventories and supply chains can move through a fixed adjustment window.

The instrument’s provisions apply to disposable cigarette lighters as defined in s5. Although the instrument does not explicitly enumerate covered parties, the compliance obligations it imposes , that “a disposable cigarette lighter must comply with” particular standards (s6(1), s7) , are obligations directed at the suppliers or persons responsible for placing such goods into the market. Practically and legally, the set of stakeholders affected is this set.

Manufacturers and designers. Entities that design or manufacture disposable cigarette lighters must ensure product design, materials and safety features meet one of the statutory compliance pathways. If a product is designed to be refillable, manufacturers must determine whether that product meets the European Standard’s definition of a “refillable repairable lighter”; if it does, it will fall outside this instrument’s disposable lighter definition (s5). Manufacturers therefore bear the primary design and certification burden.

Importers. Parties importing disposable lighters for sale into the markets where the ACL applies will need to verify compliance with the applicable standard (s6(1), s7). Because the instrument freezes the version of the referenced standards to those in force at commencement, importers must check compliance against those specific versions (s8(1)(a); definition of European Standard).

Distributors and retailers. Wholesalers, distributors and retailers who supply disposable cigarette lighters in the market will need to ensure their sourced products comply with a permitted pathway. During the transitional period, suppliers may rely upon compliance under the 1997 Regulations as an alternative (s6(1), s10(1)). After transitional expiry, that path ends and continuing supply of products compliant only with the 1997 Regulations would not meet the statutory duty (s7).

Testing and conformity assessment bodies. Independent testing laboratories and conformity assessment services will be engaged to test and certify that a lighter meets ASTM F400‑10 or the European Standard as varied by the instrument (s8, s9). The external standards themselves set the technical tests, and the statute’s modification to clause 3.2 of the European Standard will affect which tests and durations apply to certain elements.

Standard publishers and licensors. The instrument’s notes explicitly refer to SAI Global as a commercial source for the standards and note that the Australian Competition and Consumer Commission may make a copy available for viewing subject to licensing conditions (notes under s5 and s8). That creates a practical transaction cost for suppliers who need a copy of the referenced standard in order to demonstrate conformity.

Consumers. Consumers who purchase disposable cigarette lighters are an indirect affected group. The instrument does not itself create consumer rights or remedies within its text, but it establishes the minimum technical thresholds that products must meet to be placed on the market during and after the transitional period (s6(1), s7). The instrument also records the existing separate permanent ban on toy‑like novelty lighters under subsection 114(1) of the Australian Consumer Law (note to s5).

Government and regulators. Because the instrument is made under subsection 104(1) of the Australian Consumer Law and references the ACL as a law that applies across Commonwealth, States and Territories (s3; note to s3), compliance monitoring and enforcement will fall within the broader ACL regime and its administering agencies. The instrument itself does not set out monitoring processes, but it ties legal compliance to external technical standards that regulators will reference when assessing whether a product “must comply” with the safety standard (s6, s7, s8, s9, s10).

Who pays and who decides. The compliance costs, including design changes, testing, documentation, and the purchase or licensed viewing of the standards, will be borne by manufacturers, importers and suppliers who choose the compliance pathway. The instrument vests decision-making about which pathway to adopt in the supplier, subject to time constraints imposed by the transitional rule. The instrument decides which external technical documents are legally binding, and it decides the precise legal variation to the European Standard clause 3.2 (s8(2), s9(2)).

The instrument creates a short list of statutory duties and leaves certain matters to the referenced standards. Below are the primary duties and the practical rights or options it provides to market participants, grounded in the instrument text.

Principal duty to meet a standard. The recurring statutory duty is framed as a mandatory compliance requirement: “a disposable cigarette lighter must comply with” the specified requirements during the transitional period (s6(1)) and after the transitional period (s7). The duty is not phrased as a record-keeping or labelling requirement in the instrument itself; rather the duty is substantive compliance with one of the technical regimes the instrument prescribes.

Choice of compliance pathways. The instrument gives suppliers a choice between two principal pathways after the transitional period: American-based compliance (ASTM F400‑10) or European-based compliance (European Standard EN 13869:2016 as varied) (s7, s8, s9). During the transitional period suppliers have an additional, time-limited right to comply with the older Trade Practices (Consumer Product Safety Standard) (Disposable Cigarette Lighters) Regulations 1997 (s6(1), s10(1)).

Specific content of duties. The content of the duties is not detailed in the instrument but is instead supplied by the external documents referenced. Compliance with the ASTM standard or the European Standard, as those documents prescribe, is the statutory measure. In the case of any conflict between the unmodified European Standard and the statutory variation, the instrument’s express variation to clause 3.2 operates as the legal rule (s8(2); s9(2)).

Temporal duties. The instrument creates time‑bound duties. During the 12 month transitional period, the broader three-pathway choice is available (s6(1)). After that period the statutory duty narrows to the two external standards (s7). Certain provisions are self-repealing: the transitional duty (s6(1)) is repealed at the end of the transitional period (s6(2)), and the transitional fallback to the 1997 Regulations (s10(1)) is also repealed at the same time (s10(2)). Schedule 1 expressly repeals the 1997 Regulations “the whole of the instrument” (Schedule 1 item 1).

Duties tied to product design features. The statutory definition of disposable cigarette lighter contains design-based criteria, and it also imports a technical exclusion for refillable devices that qualify as “refillable repairable lighter within the meaning of the European Standard” (s5). Suppliers whose products are refillable must ascertain whether the product falls within that exclusion; if it does, the device will not be a disposable cigarette lighter for the purposes of this instrument and the duties in Part 2 will not apply to it.

Documentation and access duties implied by external standards. Although the instrument does not impose explicit documentation requirements, compliance with the referenced standards will normally be demonstrated through testing, reports and technical documentation. The instrument’s notes indicate that the standards could be purchased from SAI Global or viewed at an ACCC office subject to licensing; that fact indicates a practical duty on suppliers to obtain or access the standards in order to determine and demonstrate compliance (notes under s5 and s8).

Rights and options. The main rights conferred by the instrument are options: suppliers can select which technical pathway to meet, they can rely on the 1997 Regulations for a limited period, and where a product is refillable and meets the European Standard’s category of repairable refillable lighter, the product falls outside this regime (s5, s6(1), s7, s10(1)). The instrument also fixes the applicable versions of standards at the time of commencement, permitting suppliers to evaluate their products against those frozen versions rather than future amendments (definition of European Standard; s8(1)(a)).

What the instrument does not do in its text. It does not itself set out penalties, monitoring or enforcement procedures. It does not prescribe labelling, record retention, mandatory declarations or certification steps in the text. It leaves the technical content of compliance to the referenced external standards, except for the single statutory variation to clause 3.2 of the European Standard (s8(2), s9(2)).

The instrument does not contain express penalty provisions or an enforcement regime within its text. The only provision addressing legal authority is that the instrument is made under subsection 104(1) of the Australian Consumer Law (s3). The note to s3 explains that the reference to the ACL is to Schedule 2 to the Competition and Consumer Act 2010 as it applies as a law of the Commonwealth, States and Territories and points to section 140K of that Act and corresponding provisions of Acts of States and Territories applying that Schedule. Those notes describe the statutory pedigree of the instrument but do not themselves specify enforcement mechanics or penalties within the instrument text.

Separate references within the instrument confirm that other parts of the ACL and the pre-existing regulatory framework are relevant background. For example, the note to the definition of disposable cigarette lighter records that a permanent ban on toy‑like novelty cigarette lighters has been imposed under subsection 114(1) of the Australian Consumer Law, and that notice was available as Consumer Protection Notice No. 18 of 2011 (note to s5). That is a statement that a separate statutory prohibition exists; it is not a new penalty or enforcement mechanism created by this instrument.

The instrument does contain timing and repeal mechanics which have enforcement relevance because non-conforming supply will be out of step with the law once the transitional provisions expire. Specifically, the transitional permissions in s6(1) and s10(1) are expressly repealed at the end of the transitional period (s6(2), s10(2)). Schedule 1 repeals the 1997 Regulations in full. Consequently, after the transitional period a party relying solely on the 1997 Regulations would no longer be compliant with the statutory requirement that “a disposable cigarette lighter must comply with” the ASTM or the European Standard as varied (s7).

Because the instrument is made under subsection 104(1) of the ACL, enforcement actions, compliance notices, recalls, or sanctions that are available under the broader ACL framework may be the practical mechanisms by which non-compliance is addressed. The instrument itself, however, does not identify or enact specific enforcement tools, monetary penalties, infringement notices, or civil remedies. Any enforcement, sanction or remedy therefore depends on the regime and processes established elsewhere in the ACL and related legislation and instruments, which are not reproduced or restated in this instrument.

Practical consequence. In substance, the instrument creates obligations measurable against the prescribed standards and specifies the timing of those obligations. The absence of internal penalty clauses means that parties must consult the ACL and its enforcement provisions to understand the concrete consequences of non-compliance; the instrument itself does not supply that detail.

The instrument is explicitly linked to the Australian Consumer Law and to the pre-existing Trade Practices regulations it replaces. The text sets out a layered relationship between the safety standard in this instrument and other legal instruments and external technical documents.

Primary statutory authority. The instrument is made under subsection 104(1) of the Australian Consumer Law (s3). The note to s3 states that the reference to the Australian Consumer Law is to Schedule 2 to the Competition and Consumer Act 2010 as it applies as a law of the Commonwealth, States and Territories, and points to section 140K of that Act and corresponding provisions of Acts of States and Territories applying that Schedule. That situates this instrument within the ACL framework and indicates that the safety standard operates alongside other provisions of the ACL and the Competition and Consumer Act 2010 throughout the jurisdictions where the ACL applies.

Interaction with the 1997 Regulations. Schedule 1 repeals the Trade Practices (Consumer Product Safety Standard) (Disposable Cigarette Lighters) Regulations 1997 in full (Schedule 1 item 1). Notwithstanding the full repeal, the instrument provides a transitional accommodation: during the 12 month transitional period, a disposable cigarette lighter may comply with the requirements of the 1997 Regulations if it does not comply with the ASTM or European pathways (s6(1), s10(1)). The transitional permissions are themselves time‑limited and are expressly repealed at the end of the transitional period (s6(2), s10(2)). The instrument’s Schedule also contains a note describing that the 1997 Regulations had continued in force from 1 January 2011 as if they were a safety standard made under section 104 of the ACL, under item 4 of Schedule 7 to the Trade Practices Amendment (Australian Consumer Law) Act (No. 2) 2010. That note places the 1997 Regulations within the statutory lineage of safety standards under the ACL and records the historical continuity.

External technical documents as incorporated law. The instrument incorporates by reference external technical standards , ASTM F400‑10 and EN 13869:2016 , and makes compliance with those documents a statutory duty (s8(1)(a), s9(1)). It freezes the applicable versions to those “as in force or existing at the time when this instrument commences” (definition of European Standard; s8(1)(a)). The statute also modifies the text of the European Standard by omitting words after “five years” in clause 3.2 (s8(2), s9(2)). This creates a direct legal interaction where statutory text both imports and modifies parts of an external technical standard.

Compliance with other ACL prohibitions. The instrument notes that a permanent ban has already been imposed on toy‑like novelty cigarette lighters under subsection 114(1) of the Australian Consumer Law and cites the consumer protection notice (note to s5). That indicates a separate, pre-existing prohibition which remains in force and with which suppliers must comply alongside this instrument. The instrument does not alter or repeal that ban.

Licensing and access constraints. The instrument’s notes explain that the referenced standards could be purchased from SAI Global and that the ACCC can make copies available for viewing at one of its offices subject to licensing conditions (notes under s5 and s8). Incorporation by reference therefore interacts with private licensing regimes for standards publication and public access mechanisms operated by government agencies. That interaction affects suppliers’ ability to access the technical requirements that are part of the statutory duty.

Territorial application and federal‑state interface. The instrument itself notes the ACL’s application across Commonwealth, States and Territories, and refers to the Competition and Consumer Act 2010 (note to s3). That language indicates that the instrument operates in the same multi-jurisdictional framework as other ACL-based instruments. The instrument does not itself create distinct State or Territory variations.

Net effect. The instrument supplants the old 1997 Regulations, but temporarily allows reliance on them during the transitional window. It binds suppliers to external technical standards as frozen at commencement, and it modifies one clause of the European Standard by statutory text. The interaction with the ACL is foundational since the instrument is made under ACL subsection 104(1); the instrument leaves enforcement and numerous other consumer protection provisions to the broader statutory framework of the ACL and the Competition and Consumer Act 2010.

The instrument itself contains an internal record of making and commencement, and it records the repeal of the earlier 1997 Regulations. The text supplied shows the following chronological and amendment facts contained in the instrument.

Date of making. The instrument is dated 5 February 2019 and signed by Stuart Robert, Assistant Treasurer (instrument header).

Commencement. Section 2 contains a commencement table. It states that “The whole of this instrument” commences the day after this instrument is registered, and records the commencement date as 13 February 2019. The section also contains standard notes that the table refers to the instrument as originally made, and that the table will not be amended to deal with later amendments (s2).

Authority and legal basis. The instrument is made under subsection 104(1) of the Australian Consumer Law (s3). The note to s3 identifies that the ACL is Schedule 2 to the Competition and Consumer Act 2010 as it applies across Commonwealth, States and Territories, and cites section 140K of that Act. That explanation records the legal pedigree for the instrument.

Repeal of the 1997 Regulations. Schedule 1 item 1 repeals the whole of the Trade Practices (Consumer Product Safety Standard) (Disposable Cigarette Lighters) Regulations 1997. The schedule contains a note explaining that under item 4 of Schedule 7 to the Trade Practices Amendment (Australian Consumer Law) Act (No. 2) 2010, the 1997 Regulations had continued in force from 1 January 2011 as if they were a safety standard made under section 104 of the ACL. The 2019 instrument therefore terminates that instrument by express repeal (Schedule 1).

Self‑repealing transitional provisions. The instrument contains internal expiry mechanics. Section 6(2) provides that the s6 transitional duty is “repealed at the end of the last day of the transitional period.” Section 10(2) likewise states that s10 is repealed at the end of the last day of the transitional period. The transitional period is defined as the period of 12 months beginning on the day this instrument commences (s5). Those mechanics mean particular provisions in Part 2 are time-limited and will automatically cease at the end of the transitional window without separate amendment.

No further amendments recorded in the instrument. The instrument’s text as supplied contains no subsequent amendment entries, no schedules adding or altering substantive clauses after commencement, and no notes of any later legislative variation. The commencement table includes a note that it relates only to provisions “as originally made” (s2). Therefore within the document supplied, the amendment history is confined to the making date, the commencement date, the repeal of the 1997 Regulations, and the internal, automatic repeal of the transitional provisions at the end of the 12 month transitional period.

Practical implication. To determine any further amendment history beyond the instrument as made, readers would need to consult up-to-date legislative databases or the Federal Register of Legislation, but that information is not contained in the instrument’s text as supplied.

The instrument as supplied does not include or cite any litigation history. It contains no references to judicial decisions, no footnotes citing court determinations, and no recorded disputes or determinations regarding its interpretation. The notes in the instrument refer to statutory provisions and to external standards and notices, but they do not identify any cases.

Specifically, there are no cases named in the instrument text, and no parts of the instrument assert that any judicial interpretation or precedent governs the variation of the European Standard clause 3.2 or any other provision. The instrument’s legal operation is described in statutory terms and by reference to external standards and prior regulations, but the text is silent about any adjudications or litigation that have arisen from its implementation.

For a practitioner seeking litigation history relevant to these provisions, the instrument itself suggests where disputes would likely arise , interpretation of the variation to clause 3.2, classification of a product as a disposable cigarette lighter or as a “refillable repairable lighter” under the European Standard, and the consequences of supply after the transitional period. Nonetheless, none of that litigation detail is present in the instrument text. Any actual litigation records, case law or tribunal decisions must be sought from judicial databases, regulator published determinations or other sources external to this instrument.

Therefore, on the basis of the supplied text, the instrumental record shows no litigation history; it contains only statutory provisions and notes regarding standards, authority, commencement and repeal.

This instrument presents several concrete implementation and legal interpretation risks that are apparent from the text. These are not value judgements but practical items to check and manage, each grounded in a specific provision.

Version fixation of the standards. The instrument ties compliance to particular editions of external standards “as in force or existing at the time when this instrument commences” (definition of European Standard; s8(1)(a) for ASTM). That means suppliers must determine conformity against those frozen versions rather than subsequent edits. A gotcha here is failing to verify the exact textual form of the European Standard and ASTM F400‑10 as they existed on the commencement date. Because the instrument does not reproduce the standards, parties must obtain the correct historical text. The instrument’s notes say those documents could be purchased from SAI Global or viewed at an ACCC office subject to licensing (notes under s5 and s8). Practically, reliance on a later or earlier variant would be an error.

Statutory variation to clause 3.2 is terse. Sections 8(2) and 9(2) both state that clause 3.2 of the European Standard is varied “by omitting all the words after ‘five years’.” The instrument does not restate what clause 3.2 otherwise contains, nor does it explain the intended legal effect of removing the remainder of that clause. That creates an interpretive risk: readers must retrieve the full original text of clause 3.2 as it existed on commencement, identify the point at which the words “five years” appear, then excise everything after that phrase to determine the operative clause. If clause 3.2 contains enumerated tests or transitional thresholds that rely on the removed text, the statutory excision will alter test durations or obligations in potentially subtle ways. The instrument leaves that detailed interpretive work to users of the standard.

Boundary between disposable and refillable repairable lighter. The definition in s5 excludes from the disposable lighter category any refillable device that is “a refillable repairable lighter within the meaning of the European Standard.” That cross-reference imports a technical category from the European Standard. A supplier of refillable devices must check whether its product falls within that technical category as defined in EN 13869:2016. Misclassifying a product as outside the disposable lighter definition when it is within it, or vice versa, could lead to non-compliance. The instrument does not provide any standalone definition; resolving the question requires consulting the European Standard itself.

Transient reliance on the 1997 Regulations. During the 12 month transitional period suppliers may rely on the 1997 Regulations (s6(1), s10(1)), but after that period those sections are repealed (s6(2), s10(2)) and Schedule 1 repeals the 1997 Regulations in full. A practical gotcha is continued sale of stock that only complies with the 1997 Regulations beyond the transitional cut-off. The statutory duty after the transitional period is explicit: the lighter “must comply with the requirements in section 8 or 9” (s7). Continuing to supply goods compliant only with the 1997 Regulations after the transition ends would not meet the statutory duty.

Access and licensing costs for standards. The notes indicate that the referenced standards could be purchased and that the ACCC can make them available for viewing subject to licensing conditions (notes under s5 and s8). That creates transaction costs and possible confidentiality or access constraints; relying on informal or partial copies of the standard can lead to misinterpretation. Obligation-holders should factor in the cost and logistics of obtaining the exact versions of the standards.

No express procedural or evidential provisions. The instrument requires conformity with external standards but does not specify how compliance must be demonstrated, what documents must be retained, or what labelling, marking or declarations are necessary. That absence can create regulatory friction at inspection or enforcement points: suppliers must proactively assemble test reports and technical files even though the instrument does not prescribe a formal format.

Ambiguity about enforcement consequences in the instrument text. The instrument itself does not set out penalties or enforcement procedures (s3 identifies the ACL authority; notes reference other ACL provisions), so parties must map the compliance breach consequences to the broader ACL enforcement regime. Failing to do so is a risk because the statutory duty exists regardless of the absence of an internal penalty clause.

Potential misreading of “as in force or existing at the time when this instrument commences.” Parties might assume that an updated standard published shortly after commencement is acceptable, but the instrument’s textual command freezes the operative text to what existed at commencement. That detail can create disputes where standards bodies update their texts and suppliers rely on the newer texts without statutory basis.

Record of maker and commencement. The instrument identifies Stuart Robert, Assistant Treasurer, and contains the commencement date (instrument header; s2). Those formalities matter for judicial or administrative challenges that depend on precise statutory maker and date. Misstating or ignoring those formalities could complicate compliance or defence strategies.

In short, the main operational gotchas are: the need to procure the exact historical standard texts, the ambiguous statutory excision of clause 3.2, the classification boundary for refillable devices, the end of the transitional reliance on the 1997 Regulations, and the lack within the instrument of procedural, evidential and penalty specifics that would otherwise clarify compliance obligations.

This section sets out a practical, text‑grounded compliance roadmap that follows the instrument’s mechanics and the defined timelines. It focuses strictly on steps and documents the instrument makes relevant.

1. Confirm product classification under the statutory definition. Start by applying the statutory definition in s5 to each product. Determine whether the device is (a) a flame producing device designed to light cigarettes, cigars and pipes, and (b) designed to be discarded when fuel is exhausted, to incorporate a disposable fuel container, or to be refillable. If the device is refillable, consult the European Standard (EN 13869:2016) as in force at commencement to establish whether the product is a “refillable repairable lighter” for the Standard’s purposes. If it is, the product is not a “disposable cigarette lighter” under s5 and the duties in Part 2 may not apply.

2. Determine the relevant date and transitional status. Note the instrument’s commencement date, recorded as the day after registration and shown as 13 February 2019 (s2). The transitional period is 12 months beginning on commencement day (s5). If you are operating within the transitional period, you may elect compliance under s8 (ASTM), s9 (European Standard as varied), or s10(1) (1997 Regulations). If past the transitional window, compliance must meet s8 or s9 (s7).

3. Obtain the exact operative texts of the referenced standards. The legal standards to which compliance is measured are:

   • ASTM F400‑10 as in force or existing at commencement (s8(1)(a)); and
   • European Standard EN 13869:2016 as in force or existing at commencement (definition of European Standard; s9(1)). Because the instrument freezes the versions to those existing at commencement, procure those exact editions. The instrument’s notes indicate these could be purchased from SAI Global or viewed at an ACCC office subject to licensing conditions (notes under s5 and s8). Ensure you obtain the specific historical texts, not later revisions.

4. Apply the statutory variation to clause 3.2 of the European Standard. Sections 8(2) and 9(2) require that clause 3.2 of EN 13869:2016 be varied “by omitting all the words after ‘five years’.” That requires you to:

   • Read clause 3.2 as it existed at commencement,
   • Identify the words following the phrase “five years,” and
   • Construct the statutory version of clause 3.2 by removing those trailing words so that the clause ends with “five years.” Because the instrument does not restate the clause language, this step is essential for assessing conformity to the European-based route.

5. Select the compliance pathway and undertake testing. Choose whether to comply with ASTM F400‑10 (s8) or the European Standard as varied (s9). Where the product is refillable and not excluded under s5, check whether the ASTM route requires an additional European clause 3.2 test if the product is refillable; s8(1)(b) states that if the disposable cigarette lighter is designed to be refillable with fuel, it must comply with clause 3.2 of the European Standard as affected by s8(2). Arrange independent testing and obtain written test reports that demonstrate conformity with the relevant tests and thresholds contained in the selected standard.

6. Retain documentary evidence. The instrument does not specify documentary formalities, but compliance with external standards will be evidenced by test reports, technical files referencing the exact standard edition, design records and supplier certifications. Maintain those records in a retrievable form, dated, and referencing the specific clauses and the modified clause 3.2 where relevant. Keep copies of the standard editions you relied on, or record the method by which you viewed them via ACCC under licensing.

7. Monitor stock movement through the transitional period. If you supply under the 1997 Regulations during the transitional period, map inventories and sales so that you do not continue to place on the market goods that only comply with the 1997 Regulations after the transitional period expires (s6(2), s10(2), Schedule 1). Update procurement and manufacturing timetables to ensure all newly supplied goods meet s8 or s9 after the transitional window.

8. Check labelling and marketing for other legal requirements. The instrument does not create labelling obligations, but other parts of the ACL or consumer protection law may impose labelling requirements or bans. Note the instrument’s reminder that toy‑like novelty lighters are permanently banned under subsection 114(1) of the ACL (note to s5). Ensure product marketing and appearance do not contravene that separate prohibition.

9. Understand enforcement context. The instrument is made under subsection 104(1) of the ACL (s3). It does not itself specify enforcement or penalties. Consult the broader ACL framework to understand consequences of non-compliance and the administrative processes that might be applied by regulators. Be prepared to present technical records in response to regulator inquiries.

10. Use ACCC access to standards if cost or licensing is an issue. The instrument’s notes indicate the ACCC can make a copy of the standards available for viewing, subject to licensing conditions (notes under s5 and s8). If purchasing the standards from SAI Global is not practicable, schedule an ACCC viewing and document that viewing as part of your compliance file, subject to the terms under which the ACCC makes the standard available.

11. For refillable devices, confirm whether the product is excluded. If your product is refillable, determine whether it is captured by the “refillable repairable lighter” definition in the European Standard as it existed at commencement. If it qualifies as a refillable repairable lighter, it is excluded from the disposable lighter definition and thus from this instrument’s duties (s5). If ambiguous, treat the product as within the disposable lighter definition until you obtain a definitive technical determination or regulatory advice.

12. Seek clarification where clause 3.2 excision is ambiguous. The statutory instruction to omit “all the words after ‘five years’” can create uncertainty about what remains in clause 3.2 and how downstream tests are affected. If the clause excision materially affects test durations, safety thresholds or labelling, seek written clarification from regulators or obtain an expert technical interpretation anchored to the standard text used at commencement.

13. Document version control for future audits. Because the instrument fixes the standard editions to those at commencement, maintain a record showing the exact edition you used, the date obtained, and the means of procurement or viewing. That record is the primary evidence tying your conformity assessment to the legally operative standard.

Following these steps aligns operational practice with the instrument’s textual structure: confirm product classification (s5), choose an authorised compliance route in the relevant time window (s6(1), s7), obtain and apply the exact standard texts and the statutory variation (s8(2), s9(2)), and retain demonstrative documentation. The instrument leaves many enforcement and procedural details to the wider ACL framework and to the external standards themselves, so compliance files should be prepared on the assumption that regulators will require documentary proof of conformity to the frozen versions of the standards and to the statutory variation.
