Consumer Goods (Bean Bags) Safety Standard 2014

The standard rests on a small set of tightly defined concepts that determine what products and behaviours are regulated. Those definitions determine who must take action and what technical features are required.

Bean bag and bean bag cover. The standard defines “bean bag” as “a cushion or similar item which consists of a bag or cover enclosing bean bag filling and which contains an opening through which bean bag filling can be accessed” (s 7(1)). “Bean bag cover” is defined as “a bag or cover capable of being filled with bean bag filling and which, if filled with bean bag filling, would constitute a bean bag and includes a bag or cover intended as a separate inner lining for a bean bag” (s 7(2)). That definition expressly includes separate inner linings marketed as such, bringing replacement covers and inner linings within the standard’s reach.

Bean bag filling. “Bean bag filling” is defined as pellets or small particles of polystyrene or other similar synthetic material used to fill a bean bag (s 6). The wording ties the regulated filling materials to small particles or pellets of polystyrene or “other similar synthetic material”, focusing the hazard on swallowable/inhalable particulates rather than on loose fibre or non-particulate fillings.

Slide-fastener and child resistant slide-fastener. The standard provides functional definitions for fastenings. A “slide-fastener” is a conventional zipper-like device comprising two sets of teeth and a sliding piece that interlocks and releases the teeth by movement between them (s 6). A “child resistant slide-fastener” must satisfy two functional elements: (a) the sliding piece has no tag, handle or other object attached that would facilitate moving the sliding piece; and (b) the slide-fastener incorporates a locking mechanism that prevents the sliding piece opening the fastener unless a wholly separate device is used to disengage the locking mechanism and act as a handle (s 6). The definition is performance- and design-focused rather than referencing a specific test standard.

Warning message requirements. The standard prescribes the exact warning text that must be fixed to every bean bag, bean bag cover and retail package containing bean bag filling (s 8(1)). It further mandates typographical and colour requirements: the word “WARNING” in upper case red letters of not less than 5 millimetres on a white background; the remaining words in upper and lower case letters as shown, with upper case letters not less than 5 millimetres in height and the words “not a safe” in bold font; and the label must be conspicuously displayed (s 8(2)). The text required is precise and must be reproduced verbatim.

Scope by access opening. The child-resistance obligation applies to “every opening through which bean bag filling can be inserted or removed” (s 9(1)). That phrase defines the technical locus of the requirement: any aperture that provides access to the filling must have the child-resistant fastener.

Temporal scope and transitional treatment. The standard creates a period during which products compliant with the prior standard as at 1 January 2011 are treated as compliant with this standard where supplied between commencement and 30 June 2016 (s 2(2)), with the prior standard revoked on 1 January 2016 (s 4). Thus temporal concepts determine when products must meet the new definitions and technical requirements.

Statutory foundation. The standard is made under ACL s 104(1) (s 3), and the Note at s 5 explicitly directs readers to ACL s 106 for the legal requirement to comply with safety standards.

These core concepts are the operational vocabulary for compliance: whether an item is a “bean bag” or a “bean bag cover”, whether an opening allows access to “bean bag filling”, whether a fastener satisfies the definition of “child resistant slide-fastener”, and whether the prescribed warning label has been applied in the specified form.

The instrument targets the parties in the supply chain responsible for placing bean bags, bean bag covers and bean bag filling packages on the market in Australia. The standard itself does not use the word “supplier”, but the obligations attach to the products and their supply; by operation of the Australian Consumer Law framework referenced at s 3 and the Note to s 5, compliance becomes a requirement on those who make these products available to consumers.

Manufacturers and designers. Entities that design and manufacture bean bags, bean bag covers and pre-packaged bean bag filling must ensure product designs incorporate the required features. That means specifying a child-resistant slide-fastener on every opening through which filling could be inserted or removed (s 9(1)), and ensuring that any fastener meets the definition of a child-resistant slide-fastener (s 6). Manufacturers must also produce and fix the prescribed warning label to the product or stamp it on the product (s 8(1)).

Importers. Parties importing bean bags, separate covers intended to be filled, and packages of bean bag filling for sale in Australia are within the scope because the requirements are attached to products supplied into the Australian market. An imported bean bag or cover that lacks the warning label or child-resistant fastener would not meet the standard.

Retailers and distributors. Retailers who supply bean bags, bean bag covers and retail packages containing bean bag filling must not supply products that fail to bear the required warning or that lack the child-resistant fastener on every filling access opening (s 8(1); s 9(1)). Retailers supplying packages of filling must ensure the retail package carries the specified warning (s 8(1)).

Suppliers of replacement or inner-lining covers. The definition of “bean bag cover” expressly includes bags or covers intended as separate inner linings (s 7(2)). Sellers of replacement covers or inner linings therefore must comply if the cover could be filled with bean bag filling and thus would constitute a bean bag.

Consumers are indirectly affected by the standard’s product-level requirements, but the legal duties fall on those who put products into the chain of commerce rather than on end-users.

Transitional-settled suppliers. Suppliers who were compliant with the earlier standard as at 1 January 2011 have a protected window: if they supply a bean bag or cover during the period from the commencement date of the amendment to 30 June 2016 and the item complied with the existing standard on 1 January 2011, the item is deemed to comply with this standard (s 2(2)). That saves affected suppliers from immediate redesign for the transitional period, but only up to 30 June 2016.

State and Commonwealth enforcement bodies. Although not detailed in the instrument, the standard is made under the ACL (s 3) and the Note in s 5 directs readers to s 106 of the ACL for the legal obligation to comply with safety standards; enforcement would therefore proceed through the ACL enforcement mechanisms (see s 5 note). The instrument itself does not name enforcement agencies, nor does it specify administrative processes or sanctions.

In short, manufacturers, importers, distributors and retailers of bean bags, bean bag covers (including inner linings) and retail packages of bean bag filling must change product design, labelling and packaging practices to align with the standard. The transitional deeming provision applies to a subset of suppliers who complied with the prior standard as at 1 January 2011.

The standard creates a short list of precise duties on products and supplies, and it grants a narrowly framed transitional right. The duties are functionally specified without reliance on external test standards.

Labelling duty. Duty: every bean bag, bean bag cover and retail package containing bean bag filling must have fixed securely to it, or stamped on it, a warning label stating the exact text set out in s 8(1): “WARNING: Children can suffocate if bean bag filling is swallowed or inhaled. Do not let children climb inside this bean bag. A bean bag is not a safe sleeping surface for an infant under 12 months of age” (s 8(1)). Formatting and display requirements are part of the duty: “WARNING” must be upper case, red letters, not less than 5 millimetres on a white background; the remaining words must be shown in upper and lower case letters as in s 8(1), with upper case letters not less than 5 millimetres and the words “not a safe” in bold; the label must be conspicuously displayed (s 8(2)). The duty specifies both substance and form.

Fastener duty. Duty: every bean bag and bean bag cover must have a child-resistant slide-fastener fitted to every opening through which bean bag filling can be inserted or removed (s 9(1)). The child-resistant slide-fastener is itself defined; the definition requires absence of tags or handles on the sliding piece and the inclusion of a locking mechanism that prevents opening unless a wholly separate device is used to disengage the lock and act as a handle (s 6). The duty therefore has both a placement requirement and a design-performance requirement.

Prohibition on facilitating objects. Duty: a bean bag or bean bag cover “shall not be supplied with any tag, handle or other object which could facilitate the movement of the child-resistant slide-fastener sliding piece” (s 9(2)). That duty reaches beyond the sliding piece itself and forbids accessory items that would defeat the child-resistant function.

Definition-based duties. Duties also flow from the definitional provisions. For example, a “bean bag cover” includes a separate inner lining (s 7(2)); if that cover is supplied separately, the duties in s 8 and s 9 apply to it because it “is capable of being filled” and thus would constitute a bean bag if filled.

Transitional right (deeming). Right: suppliers who supply a bean bag or bean bag cover between the commencement date of the amendment and 30 June 2016, and whose product complied with the safety standard made on 1 January 2011 by reason of Item 4 of Schedule 7 of the Trade Practices Amendment (Australian Consumer Law) Act (No.2) 2010, are “taken to comply” with the requirements of this standard (s 2(2)). That is a time-limited compliance right that avoids immediate mandatory redesign for those particular suppliers until 30 June 2016.

Reference to ACL obligations. The instrument does not itself create the civil or criminal penalties; the Note to s 5 directs readers to section 106 of the Australian Consumer Law for the statutory duty to comply with safety standards. That contextualises the duties here as elements of the broader ACL obligations.

No explicit exemptions or certification processes are set out in the text. The duties are product-focused and specify design and labelling requirements; rights are limited to the transitional deeming provision. The instrument leaves the enforcement pathway and potential sanctions to the ACL framework referenced in the Note to s 5.

The bean bags safety standard itself does not specify penalties, enforcement procedures or administrative processes. It is a standard made under the Australian Consumer Law and the instrument’s Note to s 5 explicitly points readers to section 106 of the Australian Consumer Law for the legal requirement to comply with safety standards. The statutory enforcement apparatus (including civil penalties, injunctions and recall powers) exists in the ACL and related provisions of the Competition and Consumer Act 2010, but this instrument confines itself to prescribing product requirements and does not repeat or set out the sanctions.

What the instrument does establish for enforcement purposes:

• A precise, text‑based obligation. The warning message content and format are set out verbatim in s 8(1)-(2). The exactness of the required words and typography means enforcement will be framed against a clear textual standard for labels and warnings.

• A functional, design-based obligation. The child-resistant slide-fastener is defined by its features (no attached tag/handle and a locking mechanism requiring a separate device to disengage) (s 6). Enforcement will therefore assess conformity of fastening designs to that functional definition.

• A scope for temporal enforcement. The transitional deeming in s 2(2) creates a temporal exception that enforcement agencies must apply when determining compliance for supplies during the specified window. After 30 June 2016, that deeming disappears and all products must meet the 2014 standard.

Limitations on what can be said from this instrument alone:

• No penalty magnitudes. The instrument does not list pecuniary penalties, imprisonment or administrative fine amounts. It does not create new enforcement powers.

• No recall or notice procedures. The standard does not set out mandatory recall protocols or the administrative processes by which a non-compliant product would be ordered off-market. Those powers, if exercised, would derive from the ACL or other statutory instruments rather than this safety standard text.

• Enforcement discretion and measurement. The labelling requirement includes a “conspicuously displayed” qualifier and minimum type heights; assessing what is conspicuous and whether a label has been “fixed securely” will involve administrative discretion and product-level judgement by enforcing bodies under the ACL framework.

Practical consequence: enforcement actions concerning breaches of this standard would be mounted under the ACL enforcement mechanisms referenced in s 5. Agencies enforcing consumer product safety will map the product features and labels against the textual/functional mandates in s 8 and s 9 to determine non-compliance. This instrument provides the substantive yardstick but not the procedural or sanctioning machinery.

This safety standard operates as a subordinate instrument within the Australian Consumer Law and the broader Competition and Consumer Act 2010 framework. The instrument expressly states it is made under section 104(1) of the Australian Consumer Law (s 3), and the Note to s 5 directs readers to section 106 of the Australian Consumer Law for the obligation to comply with safety standards. Therefore, the standard is not a freestanding penalty instrument; its legal force and enforceability flow through ACL provisions and the competition and consumer regime.

Overlap with earlier Trade Practices standards. The standard references and interacts with earlier law. The instrument revokes the bean bag safety standard that was made under section 104(1) of the Australian Consumer Law on 1 January 2011 by reason of Item 4 of Schedule 7 of the Trade Practices Amendment (Australian Consumer Law) Act (No.2) 2010 (s 4). The instrument notes that the requirements revoked were the same as those previously prescribed as the consumer product safety standard for bean bags for the purposes of section 65C of the Trade Practices Act 1974 and that those requirements were contained in Regulation 11 of the Trade Practices (Consumer Product Safety Standards) Regulations 1979 (s 4 note and footnote). This creates continuity for regulated parties: the 2014 standard replaces and replicates the earlier requirements while setting transition dates.

Transitional interplay and dual regimes. The standard provides for a specific transitional interaction: between commencement and 30 June 2016, suppliers may rely either on compliance with the new 2014 standard or on having complied with the existing 2011 standard as at 1 January 2011 (s 2(2) and s 2 note). That means, for that period, two regimes are in practical effect and both can be relied upon to demonstrate compliance. The revocation date (1 January 2016) and the transition cutoff (30 June 2016) are distinct, creating a limited overlap where the earlier standard was revoked but the deeming provision allowed continued supply under the old standard until the transition cutoff (see s 2(2) and s 4).

Where to look for enforcement and sanctions. The safety standard itself does not set out the ACL enforcement provisions. For penalties, recall powers, injunctions, product bans and enforcement process, parties must consult the Australian Consumer Law and the Competition and Consumer Act 2010. The Note to s 5 is an explicit signpost to that connection. That means that any regulatory action for non-compliance will typically rely on the ACL’s substantive and procedural tools rather than on provisions within this safety standard.

No linkage to other product standards or testing procedures. The instrument does not incorporate external test methodologies, laboratory standards or certification requirements by reference. It sets textual and design specifications (warning wording and slide-fastener features) rather than referencing, for example, Australian Standards or international test methods. Accordingly, compliance assessment will be by inspection against the textual and definitional elements in the standard rather than against an external test document incorporated by reference.

In summary, the standard sits within the ACL statutory architecture, replaces and continues requirements embodied in older Trade Practices regulations, provides a temporary dual-regime transition, and defers sanctions and enforcement procedure to the ACL and the Competition and Consumer Act 2010.

The compilation information at the head of the instrument and the legislative history table supply the amendment and registration timeline. Key facts from the instrument are:

• Original registration. The Consumer Goods (Bean Bags) Safety Standard 2014 was registered on the Federal Register of Legislative Instruments on 26 November 2014 (F2014L01587) (legislation history table).

• Commencement date. The instrument records a commencement date of 14 July 2015 (legislation history table). Section 2(1) ties commencement specifically to the registration of the Consumer Goods (Bean Bags) Safety Standard Amendment 2015 on the Federal Register of Legislative Instruments; the Amendment 2015 was registered on 14 July 2015 (F2015L01146).

• Amendment 2015. The Consumer Goods (Bean Bags) Safety Standard Amendment 2015 (F2015L01146) is recorded as being registered on 14 July 2015 and is responsible for amending provisions including s 2, s 6 and s 9 (Amendment history table). The compilation note at the head of the instrument states the compilation was prepared on 21 October 2015, incorporating amendments up to the 2015 Amendment which came into force on 14 July 2015.

• Revocation of prior standard. Section 4 records that the safety standard for bean bags made under section 104(1) of the Australian Consumer Law on 1 January 2016 (the earlier standard) is revoked. The instrument’s notes clarify that the revoked requirements were the same as those which were prescribed as the consumer product safety standard for bean bags for the purposes of section 65C of the Trade Practices Act 1974, and that those requirements were contained in Regulation 11 of the Trade Practices (Consumer Product Safety Standards) Regulations 1979.

• Table of affected provisions. The Amendment history table indicates that s 2, s 6 and s 9 were amended by F2015L01146. The instrument does not include tracked textual changes in-line, but the table identifies which clauses were altered by the 2015 amendment.

• Transitional timing. Section 2(2) and the accompanying note create the transitional arrangement covering supplies from the commencement date of the Amendment 2015 to 30 June 2016, during which suppliers compliant with the prior standard on 1 January 2011 are taken to comply with the 2014 standard.

The instrument’s compilation and accompanying tables are the only amendment record provided in the text. They show a limited amendment history: an original 2014 standard and a 2015 amendment registered 14 July 2015 that amended specific sections (s 2, s 6, s 9), together with the revocation of the earlier standard effective 1 January 2016 and a transitional deeming provision through 30 June 2016.

The safety standard as presented contains no litigation history, and it does not reference any judicial decisions or administrative determinations. The instrument itself is a legislative/regulatory instrument and the text does not name any cases or past enforcement actions. The only cross-references are to statutory provisions and to prior regulations (for example, the Trade Practices-era regulations in Regulation 11 and the ACL sections), but no court rulings or tribunal decisions are cited.

Implications of the absence of litigation history in the instrument:

• Lack of precedent within the text. Because the instrument contains no cases or enforcement decisions, there is no internal guidance in the standard as to how an enforcement agency or a court has interpreted the wording “conspicuously displayed”, “fixed securely”, or what constitutes a compliant child-resistant slide-fastener in practice.

• Enforcement outcomes will rely on ACL jurisprudence. Any legal challenge to enforcement action based on this standard would be decided under the ACL’s enforcement procedures and interpretive approaches. The instrument points to section 106 of the ACL in its Note (s 5 note), so litigation would arise as part of ACL enforcement actions, but those cases are not included in this instrument.

• Interpretive questions likely to attract litigation. Because the standard contains functional and qualitative terms rather than prescriptive test methods (for example, the child-resistant slide-fastener is defined in terms of design features rather than by a test protocol), disputes may arise about whether a particular fastener meets the definition. Similarly, issues about what is “conspicuously displayed” or whether a warning has been “fixed securely” could be litigated in an enforcement context. The instrument does not resolve these interpretive questions.

• Transitional disputes. The transitional deeming in s 2(2) could give rise to disputes about whether a product did indeed comply with the earlier standard “on 1 January 2011”, particularly where records are incomplete. The instrument does not specify evidentiary requirements.

Because the published instrument contains no litigation record, practitioners should expect that legal questions arising under it will be resolved through ACL enforcement actions and subsequent case law rather than by reference to precedent contained in the standard itself. The absence of litigation history in the instrument indicates a need to consult enforcement decisions and court records outside this document to find interpretive guidance.

The text-based and functional nature of the requirements creates a number of practical pitfalls and compliance traps for manufacturers, importers and sellers. These potential “gotchas” arise from definitions, precise textual requirements, transitional rules and the absence of external test standards.

Exact wording of the warning. The warning wording is specified verbatim in s 8(1). Deviations in punctuation, order of clauses, or omission of any sentence could be treated as non-compliant. The label must be either fixed securely to the product or stamped on it (s 8(1)), and the formatting requirements are explicit: “WARNING” must be red, upper case, at least 5 mm; the rest of the words must include upper case letters of at least 5 mm where shown, and the phrase “not a safe” must be in bold (s 8(2)). A common packaging or labelling practice , substituting synonymous phrasing, changing type weights, or placing the label on a removable tag , risks non-compliance.

Conspicuous display is subjective. The standard requires that the label be “conspicuously displayed” (s 8(2)). That term is inherently discretionary. Enforcement officers will have to judge conspicuousness in the field. Practitioners should note the lack of further prescription on placement (for example, no minimum contrast beyond the white background) or minimum area of the label beyond type heights, leaving room for enforcement discretion.

Scope of the “bean bag cover” definition. The definition includes inner linings sold separately (s 7(2)). A supplier marketing an inner lining or replacement cover might assume they are outside the standard if they sell the cover empty; the instrument treats a cover that could be filled as within scope. Failure to recognise that point could lead to unintentionally supplying an uncovered product that is non-compliant with labelling and fastener requirements.

Every access opening. The child-resistance requirement applies to “every opening through which bean bag filling can be inserted or removed” (s 9(1)). That means multiple access points on a single product must each meet the child-resistant fastener requirement. Designers using secondary access flaps, hidden zips, or service openings need to ensure each such aperture is fitted with the specified fastener.

Definition of child-resistant slide-fastener. The fastener definition is functional: the sliding piece must have no attached tag, handle or other object that would facilitate movement and must incorporate a locking mechanism requiring a wholly separate device to disengage (s 6). Common zipper pulls and tabs are therefore likely incompatible. Suppliers using standard zipper pulls must change to a locking mechanism meeting the definition. The instrument does not specify acceptable locking designs or test procedures, so meeting the definition may require demonstrable design features or engineering evidence.

Prohibition on supplied tags or handles. Section 9(2) prohibits supplying a bean bag or cover with any tag, handle or other object which could facilitate movement of the sliding piece. That reaches beyond the fastener to packaging or accessory items. For example, a product supplied with a small tool, pull tab or hang tag that could be used to open the zipper would risk contravening s 9(2).

Transitional deeming complexity. The deeming in s 2(2) applies only if the bean bag or cover “complies with the safety standard for bean bags made under section 104(1) ... on 1 January 2011 by reason of Item 4 of Schedule 7” , that is, compliance must have existed at that earlier date. Suppliers without documentary proof that their product complied with the 2011 standard as at 1 January 2011 may not be able to rely on the deeming. The instrument provides no evidentiary standard for demonstrating historical compliance.

No external test methods or certification. The instrument does not reference Australian Standards, ISO methods, or lab test criteria. Compliance is determined by inspection against text and functional definitions rather than by certified testing. While that simplifies technical conformity in one sense, it creates uncertainty about the burden of proof: product designers must show that the locking mechanism “prevents the sliding piece opening” unless a separate device is used, but the instrument supplies no measurement standard for that claim.

Retail packages of filling included. The warning duty expressly extends to retail packages containing bean bag filling (s 8(1)). Suppliers of filling in retail quantities must affix the exact warning, even if the filling is sold separately from a cover. Some filling suppliers may not have anticipated this requirement.

No guidance on remedies or corrective action. The standard does not prescribe recall, corrective notices, or remedial steps for non-compliance; those are left to the ACL enforcement apparatus. Suppliers uncertain about compliance cannot look to the standard for a specified corrective mechanism.

In sum, the “gotchas” are: literalism in the required warning text and typography; subjectivity in “conspicuously displayed”; inclusion of replacement covers and linings; every access opening requiring compliant fasteners; removal of common zipper pulls and accessories; evidentiary burdens under the transitional deeming; and the absence of standardised test methods or a prescribed remediation pathway. Those features create a compliance environment in which precise labelling, considered hardware design, and careful documentation are necessary.

Compliance requires a narrow set of design, labelling and documentation actions that map directly to the textual and definitional obligations in the standard. Below is a practical checklist, tied to the specific provisions of the instrument.

1. Confirm product classification (s 7). Determine whether the item is a “bean bag” or “bean bag cover” as defined in s 7. If the product is a bag or cover that can be filled with bean bag filling, or is an inner lining intended as a separate item, treat it as within scope (s 7(1)-(2)). If the product contains openings that could allow filling insertion or removal, plan to comply with the child-resistance duty (s 9(1)).

2. Apply the exact warning text and required format (s 8(1)-(2)). Affix a warning label to every bean bag, bean bag cover and retail package containing bean bag filling. Use the exact wording at s 8(1). Ensure the word “WARNING” is upper case, red, and not less than 5 mm in height on a white background. Ensure the remaining words match the case and font requirements in s 8(2), with the words “not a safe” in bold. Place the label so it is conspicuous on the product; confirm whether the product will display the label to consumers at point of sale. The label may be fixed securely or stamped on the product (s 8(1)).

3. Fit child-resistant slide-fasteners to every access opening (s 9(1); s 6). For every opening through which filling can be inserted or removed, install a slide-fastener that meets the child-resistant definition in s 6. The fastener must have no tag, handle or other object attached to the sliding piece that would facilitate movement (s 6(a)). The fastener must incorporate a locking mechanism that prevents opening unless a wholly separate device is used to disengage the locking mechanism and serve as a handle (s 6(b)). Review standard zipper components and replace standard pull tabs with a compliant locking mechanism.

4. Do not supply facilitating tags or accessories (s 9(2)). Do not supply the bean bag, cover or any accessory with tags, handles or other objects that could facilitate movement of the sliding piece. This includes removable pull tabs, small tools, hang tags or packaging elements that could be used to open the fastener.

5. Apply the label requirements to retail filling packages (s 8(1)). If supplying retail packages of bean bag filling (pellets or small polystyrene particles), affix the prescribed warning label to the package as required by s 8(1).

6. Retain records, particularly if relying on the transitional deeming (s 2(2)). If you assert the transitional deeming (that your product complied with the earlier standard on 1 January 2011 and was supplied between commencement and 30 June 2016), assemble documentary evidence demonstrating compliance with the earlier 2011 standard at that date. The instrument does not set out evidentiary rules, so contemporaneous records, specifications and test documentation from 2011 will be relevant.

7. Design verification and internal testing. Because the standard defines the child-resistant fastener functionally rather than by reference to a specific test method, document design specifications and any internal testing or engineering validation showing the locking mechanism prevents opening without a separate device. Describe how the design lacks any pull or tag on the sliding piece.

8. Review packaging and point-of-sale presentation for conspicuousness (s 8(2)). Ensure the warning is placed where consumers will see it when considering a purchase , front or a prominently visible panel , and not hidden under outer wrapping or in a place likely to be removed before point of sale.

9. Update procurement and supplier contracts. Specify the required label text and fastener requirements in purchase orders and supplier specifications to ensure upstream suppliers deliver compliant covers, zippers and packaging.

10. Watch the timetable. Note the commencement linkage to the Amendment 2015 registration date and the transitional window that applied to supplies up to 30 June 2016 for products compliant with the earlier 2011 standard (s 2(1)-(2)). After 30 June 2016, all supplied products must meet the 2014 standard.

11. Consult the ACL for enforcement consequences. The standard directs readers to the ACL s 106 for the legal obligation to comply with safety standards (s 5 note). For questions about enforcement remedies and sanctions, consult the ACL and the Competition and Consumer Act 2010.

12. Where design judgement is necessary, err towards conservative implementation. Because the standard is literal about label text and the fastener definition is functional without test protocols, choose fastener designs and label placements that clearly satisfy both the no-tag criterion and the locking requirement and that leave no ambiguity about visibility.

Following these steps aligns product design, labelling and supply practices with the statutory text. The emphasis is on reproducing the exact warning wording and typography, fitting every access opening with a fastener that complies with the child-resistant definition, avoiding any accessory that could defeat the fastener, and keeping documentary evidence particularly if relying on transitional provisions.
