Consumer Goods (Basketball Rings and Backboards) Safety Standard 2017

Scope and definitions: The instrument applies to basketball rings and backboards "of a kind likely to be used for domestic use" and expressly excludes toy basketball rings and backboards for toy rings (s 6(1)-(2); s 5). It defines "portable basketball system" as a ring, backboard and a portable support structure including pole and base (s 5). It also defines the "transitional period" as the 12 months starting on the day the instrument commences (s 5).

Two compliance regimes, sequential: During the transitional period a supplier may meet either the new requirements in Division 2 or the earlier requirements in the 2005 Regulations (ss 7(1), 15(1)). At the end of the transitional period the alternative route expires and only Division 2 remains effective (ss 7(2), 8, 15(2)).

Warnings and instructions as the substantive substantive controls: The instrument imposes three linked requirements: a written warning that accompanies the ring or backboard (s 10), a graphical warning symbol that accompanies the ring or backboard (s 11), and a permanent front-of-backboard warning (s 13). The instrument prescribes exact wording for those warnings, specific typography and colour requirements, and minimum dimensions (ss 10-13). It also prescribes how those warnings must physically accompany the product depending on packaging status (s 12).

Installation information as a safety control: For rings and backboards not supplied as part of a portable system, the instrument requires a label, tag or manual that details the supporting structure to which the product must be fixed, the hardware to be used, a strong warning against fixing to brickwork, and advice to consult a structural engineer if there is any doubt about safety or stability (ss 9(3), 14). That instruction requirement is explicitly inapplicable to products supplied as part of portable basketball systems (s 9(3); s 14 note).

Technical detail obligations: The instrument prescribes measurable attributes: the word "WARNING" in the accompanying written warning must be at least 15 millimetres high; other words in that warning must be at least 10 millimetres high; the letters must be upper‑case and red on white background (s 10(2)). The permanent front‑of‑backboard warning must be upper‑case and at least 10 millimetres high (s 13(2)). The warning symbol must have an outer circle diameter of at least 120 millimetres and red lines at least 5 millimetres wide, the human figure in the symbol must be entirely black and the ring/backboard in the symbol must be outlined in black (s 11(2)).

Regulatory housekeeping: The instrument expressly repeals the 2005 Regulations in full (Schedule 1). It also contains the general Schedule mechanism that instruments listed in the Schedules are amended or repealed as set out (s 4). The instrument notes that it is made under the Australian Consumer Law and references the linkage to Schedule 2 of the Competition and Consumer Act 2010 (s 3 note).

Suppliers and manufacturers: Any person who manufactures, imports, supplies or sells basketball rings and backboards likely to be used for domestic use will be directly affected because the instrument imposes mandatory labelling, marking and instruction requirements that must accompany such goods (s 6(1); ss 9-14). The instrument does not use the terms "manufacturer", "importer" or "supplier" within the substantive provisions; however the requirement that the goods "be accompanied" by warnings and instructions means the economic actors who place the goods into the supply chain (manufacturers, importers, wholesalers and retailers) must ensure compliance.

Retailers and distributors: Retailers and distributors offering packaged or unpackaged basketball rings and backboards for sale will carry responsibilities under the practical obligations about where warnings and symbols must be marked , on the package, on a label fixed to the package, on the product, on a label fixed to the product, or on a conspicuous tag attached to the product (s 12). The instrument’s packaging rules create specific duties tied to the state of the good at point of sale.

Consumers: Consumers purchasing domestic basketball rings and backboards will be affected indirectly because the instrument mandates the presence of specific warnings, symbols and instructions that must be accessible at point of sale and after installation. Those mandated messages (for example, the permanent warning on the front of the backboard and the installation instructions that warn against fixing to brickwork) are designed to influence consumer behaviour and the installation choices that consumers or installers make (ss 9, 13-14).

Installers and tradespeople: Persons who install basketball rings and backboards , whether consumers, installers, or contractors , will be affected by the specified content of installation instructions. The instrument requires instructions to specify supporting structures and hardware and to include a strong warning against fixing to brickwork, plus advice to consult a structural engineer if there is doubt (s 14). That changes the informational environment for installers and may shift liability considerations in practice because the instructions specify safe installation practices.

Manufacturers of portable systems: The instrument creates a narrow carve‑out for portable basketball systems: they are defined (s 5) and the requirement for installation instructions does not apply to rings or backboards supplied as part of a portable basketball system (s 9(3) and the note to s 14). Therefore manufacturers of complete portable systems have a narrower set of obligations: they must still provide the written warning and warning symbol per ss 9-12 and the permanent marking for backboards per s 13, but not the installation instruction requirement of s 14.

Toy manufacturers and suppliers: The instrument explicitly excludes toy basketball rings and their backboards from its application (s 6(2); s 5). Suppliers of toys therefore are not captured by the instrument’s labelling, marking and instruction requirements.

Regulators and enforcement agencies: The instrument itself does not set out enforcement mechanisms or specify which regulator will enforce it. It does, however, note that it is made under the Australian Consumer Law (s 3), linking it to the national consumer protection framework. The practical effect is that agencies that enforce the Australian Consumer Law and product safety standards will be the likely enforcers, but the instrument does not itself name or empower any particular agency.

Duties to provide specified warnings and instructions: The central duties are located in Division 2. Section 9(1) requires that a basketball ring or backboard be accompanied by both a written warning (described in s 10) and a warning symbol (described in s 11), and that these accompany the product in the manner described in s 12. Section 9(2) requires a backboard to have a permanent warning (s 13) permanently marked in a conspicuous place on the front of the backboard or on a label fixed there. Section 9(3) requires installation instructions (s 14) in the form of a label, tag or manual unless the ring or backboard is supplied as part of a portable basketball system.

Prescriptive content, size, colour and placement obligations: The instrument prescribes exact text for the written warnings (s 10(1): the words “WARNING: IMPROPER INSTALLATION OR SWINGING ON THE RING MAY CAUSE SERIOUS INJURY OR DEATH”) and for the permanent front‑of‑backboard warning (s 13(1): the words “WARNING: SWINGING ON THE RING MAY CAUSE SERIOUS INJURY OR DEATH”). It prescribes letter case, colour and minimum heights for letters (s 10(2), s 13(2)). The warning symbol is prescribed visually and by minimum dimensions and colours (s 11(1)-(2)). The instrument also prescribes the methods by which the warnings and symbol must accompany the product depending on whether it is packaged (s 12(1)) or unpackaged (s 12(2)).

Instruction content obligations: Section 14 sets out four substantive content items that the installation instructions must include: details of the supporting structure for fixing the ring/backboard; details of the hardware to be used; a strong warning against fixing to brickwork; and advice to consult a structural engineer if there is doubt about safety or stability. These are mandatory for items that are not supplied as portable basketball systems (s 9(3)).

Transitional compliance choice: During the transitional period a supplier has the right to choose to comply either with Division 2 or with the 2005 Regulations as they existed immediately before commencement (ss 7(1), 15(1)). This gives suppliers temporary flexibility to rely on the older standard while transitioning product lines, labelling processes or inventory. That right expires at the end of the transitional period (ss 7(2), 15(2)).

Repeal and amendment mechanics: Section 4 provides that each instrument specified in a Schedule is amended or repealed as set out in that Schedule. Schedule 1 repeals the 2005 Regulations in full (Schedule 1, item 1). The instrument therefore replaces the earlier safety standard for these goods once the transitional period ends.

Absence of internal sanctioning provisions: The instrument does not itself set out civil or criminal penalties, specific recall procedures, mandatory reporting obligations, or administrative enforcement processes. Its authority is declared (s 3), which identifies the broader legal mechanism under which penalties and enforcement may be applied, but the instrument’s text contains no express penalty regime.

Rights, as expressed in the instrument: The text grants a time-limited choice to operators during the transitional period (ss 7(1), 15(1)). Beyond that, the instrument’s rights framework is not elaborated; it focuses on duties the goods must meet. Any procedural rights (for example contesting enforcement action) are not set out in this instrument and, if relevant, would be found in the broader Australian Consumer Law and associated regulations, which are referenced but not reproduced in this instrument (s 3 note).

No penalties or enforcement mechanisms are detailed in the instrument itself. The instrument makes clear it is made under subsection 104(1) of the Australian Consumer Law (s 3). That establishes the legal authority for the safety standard but the instrument does not include statutory penalties, enforcement procedures, recall powers, or administrative processes within its text.

Consequently, the instrument leaves enforcement and sanctioning to the surrounding statutory and administrative framework that gives the standard force. The instrument’s notes reference that the Australian Consumer Law is Schedule 2 to the Competition and Consumer Act 2010 (s 3 note), but it does not reproduce or summarise provisions that impose penalties for breaches of a safety standard. The instrument also does not identify which government agency will act as regulator, which government office will administer recalls or monitors, or what record‑keeping obligations suppliers must retain. These matters are therefore subject to the broader legal architecture under the Australian Consumer Law and associated enforcement protocols, none of which are set out in this text.

Practical enforcement implications for businesses emerge from that silence. Failure to meet the prescriptive content, dimensions or placement requirements in Division 2 (ss 9-14) would render a product non‑compliant with this safety standard. The legal consequence of non‑compliance , for example an infringement notice, civil penalty, product recall, or injunction , is not specified here. Instead, such consequences would depend on the enforcement powers and procedures available under the Australian Consumer Law and related instruments, which provide the enforcement tools that would be applied in cases of non‑compliance.

Because the instrument prescribes measurable technical features (letter heights, colours, symbol diameters and line widths, and specific wording), enforcement will depend on inspection and measurement against those objective criteria. The instrument creates a compliance expectation that is verifiable by measurement and observation (see ss 10-13, s 12 for placement), which shapes how an enforcement agency could establish contravention in practical terms even though the instrument does not set the sanctions.

Transitional enforcement note: During the transitional period, s 7(1) allows compliance with either Division 2 or the 2005 Regulations (s 15(1)). Enforcement agencies would need to be able to test which standard a supplier relied upon during the transitional period. Section 7(2) and s 15(2) indicate that the transitional route expires after 12 months, after which only Division 2 compliance is relevant (s 8).

Legal authority connection: The instrument is expressly made under subsection 104(1) of the Australian Consumer Law (s 3). The instrument’s note clarifies that the reference to the Australian Consumer Law is to Schedule 2 to the Competition and Consumer Act 2010 as it applies across the Commonwealth, States and Territories (s 3 note). That note references section 140K of the Competition and Consumer Act 2010 and corresponding state and territory provisions, thereby tying the instrument into the national legal framework for consumer law and product safety.

Replacement of the 2005 Regulations: The instrument repeals the Trade Practices (Consumer Product Safety Standard) (Basketball Rings and Backboards) Regulations 2005 in full (Schedule 1, item 1). It also provides a temporary grandfathering mechanism: during the defined transitional period a supplier may comply with either Division 2 or with the 2005 Regulations as they stood immediately before commencement (s 15(1)). That transitional interoperability creates a temporal interface between the two instruments; after the transitional period the 2005 Regulations are fully superseded for practical purposes by Division 2 (ss 7(2), 8, 15(2)).

Interaction through application scope: The instrument defines its application to goods "likely to be used for domestic use" and excludes toy basketball rings (s 6). This delimitation interacts with other regulatory regimes that may apply to toys, sporting equipment used in institutional settings, workplace safety, building codes, or Australian Standards. The instrument does not itself cross‑reference workplace health and safety laws, building codes or consumer guarantee provisions; those intersections will be operationally relevant but are not specified in the text. For example, the installation instructions required by s 14 that advise consulting a structural engineer may interact in practice with local building rules or installer licensing regimes, but the instrument does not purport to alter those regimes.

Procedural and evidentiary interaction: Because the instrument prescribes specific, objective features (wording, letter heights, colours, symbol diameters and line widths), it is straightforward to test compliance by measurement and inspection. That practical clarity shapes how evidence would be gathered under the broader enforcement regime (for example product inspection reports), but the instrument itself does not set evidentiary procedures or standards of proof.

No internal conflict resolution or duplication rules: The instrument does not provide rules for resolving conflicts with other safety standards, voluntary Australian Standards, or labelling laws. Where other laws or standards impose different obligations, the legal effect would be determined by the hierarchy and operation of those other instruments and statutes, not by this instrument’s text.

Transitional administrative interaction: The instrument’s Schedule 1 note explains that under an earlier amendment (cited in the note) the 2005 Regulations continued in force from 1 January 2011 as if they were a safety standard made under section 104 of the Australian Consumer Law. The current instrument continues that trajectory by repealing the 2005 Regulations and substituting a new safety standard with a transitional bridge (ss 4, Schedule 1, s 15).

Instrument date and commencement: The instrument is dated 14 December 2017 and was made by the Minister for Small Business (front matter). Section 2 provides that it commences on the day after registration on the Federal Register of Legislation.

Repeal of predecessor instrument: Schedule 1 repeals the Trade Practices (Consumer Product Safety Standard) (Basketball Rings and Backboards) Regulations 2005 in full (Schedule 1, item 1). The instrument contains an explanatory note in Schedule 1 that under item 4 of Schedule 7 to the Trade Practices Amendment (Australian Consumer Law) Act (No. 2) 2010, the 2005 Regulations continued in force from 1 January 2011 as if they were a safety standard made under section 104 of the Australian Consumer Law. The current instrument therefore replaces those 2005 Regulations.

Transitional mechanism as temporary amendment path: Sections 7 and 15 create a 12‑month transitional period (defined in s 5) during which Division 2 or the 2005 Regulations may be relied upon for compliance (s 7(1), s 15(1)). Section 7(2) and s 15(2) expressly provide for expiry of the transitional arrangements at the end of that period. These are temporal, self‑contained amendment/transition provisions rather than incremental amendments to the law over time; they govern which text applies in the 12 months following commencement.

No subsequent amendments recorded in this instrument: The instrument text as provided contains no later amendments, variations, or schedules beyond the repeal of the 2005 Regulations and the transitional provisions. There are no amendment dates, modification notes or later variations included in the text supplied. Any subsequent amendments or updates would need to be sought in the Federal Register of Legislation or later instruments; they are not present here.

Interpretive notes and cross‑references: Section 4 provides a general mechanism for how Schedules operate, stating that each instrument specified in a Schedule is amended or repealed as set out in the applicable item and that any other item takes effect according to its terms. That is the instrument’s own mechanics for implementing the repeal in Schedule 1. Apart from that, the instrument contains standard commencement, authority and definitions provisions (ss 1-6) that set the context for the specific substantive rules that follow.

The instrument as provided contains no litigation history. It does not name any cases, indicate any judgments that have interpreted it, nor summarise any disputes, prosecutions or enforcement actions taken under it. The text includes only statutory material: the standard itself, the definitions, the transitional provisions and the repeal of the 2005 Regulations.

Where litigation or enforcement has occurred or an interpretation by a court has been made will not be indicated in this instrument’s text. Any party seeking authoritative judicial interpretation or precedent-building decisions would need to consult court databases, tribunal decisions or enforcement agency records outside this instrument. The instrument does not refer to administrative determinations, infringement notices, civil penalty proceedings, or recall decisions.

For practitioners advising clients: because the instrument contains prescriptive, measurable requirements, questions that could produce litigation would typically concern whether the physical warnings and instructions meet the letter of the provisions (for example whether type size, colour, or placement meet the specified minima), whether a particular product is within the instrument’s scope (likely to be used for domestic use; toy exclusions; portable system carve‑outs), and whether transitional compliance applied during the first 12 months. Those are factual and legal questions that would need to be tested against the text (ss 5-15) and, where appropriate, the broader Australian Consumer Law enforcement provisions, none of which are reproduced here.

Scope misclassification: The instrument applies only to basketball rings and backboards "of a kind likely to be used for domestic use" and excludes toy basketball rings (s 6(1)-(2), s 5). A supplier who misclassifies a product as a toy to avoid compliance risks non‑compliance. Similarly, products nominally intended for institutional, commercial or sports facility use could still fall into scope if they are "likely" to be used domestically; there is no de minimis threshold in the instrument for occasional domestic use. The text does not define "likely to be used for domestic use" further, so classification disputes could arise on that factual basis.

Portable system exception trap: The instrument defines "portable basketball system" (s 5) and exempts rings or backboards supplied as part of such systems from the installation instruction requirement (s 9(3) and s 14 note). However, portable systems are not exempt from the written warning, warning symbol or permanent marking requirements (ss 9-13). A supplier who assumes the portable system exclusion extends to other labelling obligations will fall short of compliance.

Two different mandatory wordings: The instrument requires two distinct English warnings with different wording and placements. The accompanying written warning must consist of the words “WARNING: IMPROPER INSTALLATION OR SWINGING ON THE RING MAY CAUSE SERIOUS INJURY OR DEATH” (s 10(1)). The permanent front-of-backboard warning must consist of the words “WARNING: SWINGING ON THE RING MAY CAUSE SERIOUS INJURY OR DEATH” (s 13(1)). The difference is the omission of "IMPROPER INSTALLATION OR" in the permanent marking. Using the wrong wording in either place would constitute non‑compliance because the instrument prescribes exact text.

Typographical and colour precision: The instrument specifies exact typographic and colour requirements. For the accompanying written warning the letters must be upper‑case and red on a white background and the word "WARNING" must have letters at least 15 mm high while the other words must be at least 10 mm high (s 10(2)). The permanent warning must be upper‑case and at least 10 mm high (s 13(2)). The warning symbol must have an outer circle diameter of at least 120 mm and red lines at least 5 mm wide, with the human figure entirely black and the ring and backboard outlined in black (s 11(2)). Small deviations in actual production, print colour tolerances, or scaling in trade dress could therefore breach the prescriptive measurements.

Packaging vs unpackaged placement confusion: Section 12 sets different placement options depending on whether the product is packaged (s 12(1)) or not packaged (s 12(2)). Suppliers must be careful to follow the correct subsection. For packaged products the warning and symbol must be on the package or on a label fixed in a conspicuous place on the package (s 12(1)(a)-(b)). For unpackaged products they must be on the product, on a label fixed to the product, or on a conspicuous tag attached to the product (s 12(2)(a)-(c)). A product that is temporarily unpackaged at point of sale (for example from bulk stock) could be mislabelled if packaging‑state assumptions are wrong.

Permanent marking location constraint: The permanent warning must be on the front of the backboard or on a label fixed in such a place (s 9(2), s 13(1)). Suppliers that place permanent warnings only on the rear of a backboard, or only on packaging, will not meet the permanent front‑of‑backboard requirement.

Instruction content strictures and brickwork warning: The installation instructions must include a "strong" warning against fixing to brickwork (s 14(c)). The instrument’s choice of the adjective "strongly" indicates an intensity requirement, but does not define its form or phrasing. Practically, that means suppliers should use unambiguous, prominent wording and formatting rather than a mild cautionary note, to avoid a challenge that the warning was not "strong" as required.

Transitional reliance logistics: During the transitional period a supplier can comply with either Division 2 or the 2005 Regulations (s 15(1)). That requires suppliers to know precisely what the 2005 Regulations required and to retain documentation demonstrating which route they took for any batch that left the supply chain during the transitional period. Failure to keep records could make it difficult to defend a compliance position in a dispute.

Language and localisation assumptions: The instrument specifies English wording (the exact phrases) but does not explicitly address translations. Where products are sold in languages other than English, the instrument does not prescribe whether translations are required or whether an English-language warning suffices. The safe course is to include the exact English wording mandated and consider translations to reduce liability and ensure consumer comprehension, but the instrument itself does not mandate language variants.

No internal enforcement specifics: The instrument does not set out who enforces it, the procedure for recalls, or administrative sanctions (see Penalties and enforcement). Suppliers should not assume the absence of internal sanctioning details means the standard is unenforceable; the instrument operates in the broader statutory framework of the Australian Consumer Law (s 3), and enforcement practices will follow that framework outside the instrument.

Measurement and production tolerances: The instrument’s numerical requirements (e.g. letter heights, circle diameter, line widths) do not specify measurement tolerance margins. Suppliers should adopt conservative production tolerances that ensure compliance even after manufacturing variability, wear and environmental factors affect labels and markings over time.

Step 0 , Scope assessment: Confirm whether the product is captured. Verify that the basketball ring or backboard is "of a kind likely to be used for domestic use" and is not a toy basketball ring (s 6(1)-(2); s 5). If the product forms part of a portable basketball system, treat it as a portable system for the limited exemptions provided (s 5; s 9(3)).

Step 1 , Wording and labelling content: Prepare the exact mandatory texts. For the accompanying written warning, use the precise words: “WARNING: IMPROPER INSTALLATION OR SWINGING ON THE RING MAY CAUSE SERIOUS INJURY OR DEATH” (s 10(1)). For the permanent front‑of‑backboard warning, use the precise words: “WARNING: SWINGING ON THE RING MAY CAUSE SERIOUS INJURY OR DEATH” (s 13(1)). Do not substitute synonyms or additional qualifiers in place of the mandated phrasing.

Step 2 , Typography, colour and size specifications: Implement the prescribed typography and colour. For the accompanying written warning ensure letters are upper‑case and red on a white background, with the letters of "WARNING" at least 15 mm high and the letters of the other words at least 10 mm high (s 10(2)). For the permanent front‑of‑backboard warning ensure letters are upper‑case and at least 10 mm high (s 13(2)). For the warning symbol ensure the outer circle diameter is at least 120 mm, the circle and diagonal line are red lines at least 5 mm wide, the human figure is entirely black and the basketball ring and backboard are outlined in black (s 11(2)). Adopt production tolerances that ensure the finished product meets these minima under measurement.

Step 3 , Warning symbol reproduction: Use the prescribed warning symbol form (s 11(1)). Reproduce the figure with the precise colour and dimension requirements of s 11(2). If using artwork files or die plates, scale and proof against the minimum 120 mm outer diameter and the minimum 5 mm line weight, and verify colour matching to red and black in production proofs.

Step 4 , Placement depending on packaging state: Apply the warnings in the way required by s 12. If the product is packaged, mark the warning and symbol in a conspicuous place on the package or on a label fixed to such a place (s 12(1)). If the product is not packaged, mark the warning and symbol in a conspicuous place on the ring or backboard, or on a label fixed in such a place, or on a conspicuous tag attached to the ring or backboard (s 12(2)). Ensure the permanent warning required by s 13 is on the front of the backboard itself or on a label fixed in that location (s 9(2), s 13(1)).

Step 5 , Installation instructions: If the product is not supplied as part of a portable basketball system, prepare a label, tag or manual that includes the four required elements: details of the supporting structure to which the ring or backboard is to be fixed; details of the hardware to be used; a strong warning against fixing to brickwork; and advice to consult a structural engineer if there is any doubt about safety or stability (ss 9(3), 14). Ensure the brickwork warning is prominent and unambiguous to meet the "strongly warn" instruction in s 14(c).

Step 6 , Portable systems: If the product is a portable basketball system, installation instruction obligations do not apply (s 9(3); s 14 note). Nevertheless ensure the other warning and marking requirements remain in place (ss 9-13).

Step 7 , Transitional period planning: If the instrument is within its transitional period (the 12 months from commencement, s 5), you may elect to comply with Division 2 or with the 2005 Regulations as in force immediately before commencement (s 15(1)). If choosing to rely on the 2005 Regulations during the transitional period, retain documentation showing that route, including versions of labelling and declarations, because the right to take that route expires at the end of the transitional period (ss 7(1), 7(2), 15(2)).

Step 8 , Quality control and record keeping: Implement quality control checks to verify that warnings meet the specified letter heights, colours, and symbol dimensions. Keep production proofs, label die files, packaging proofs, and samples for batches sold, together with the date of manufacture and distributions records. These records will support a compliance position if an enforcement agency questions conformity with the instrument.

Step 9 , Supply chain communication: Communicate requirements to contract manufacturers, overseas suppliers and packagers. Provide artwork files with explicit measurements and tolerances and require signoffs on proofs. Ensure retailers understand placement obligations depending on whether goods are sold packaged or unpackaged.

Step 10 , Consumer information and translations: Although the instrument specifies English wording, consider including the mandated English text plus translations in any other languages used in the target market to aid comprehension. The instrument does not require translations, but providing them reduces consumer risk and may be prudent from a consumer safety and reputational perspective.

Step 11 , Legal review and enforcement linkage: Because the instrument does not itself prescribe penalties or enforcement processes, seek legal advice about the broader Australian Consumer Law enforcement consequences of non‑compliance in your jurisdiction (s 3). Confirm whether additional national, state or territory requirements apply (for example building codes or workplace safety rules) that may intersect with installation instructions or liability.

Step 12 , Update product documentation and manuals: Ensure user manuals, warranty statements and product webpages reflect the mandated warnings and instructions as presented on the product and packaging. Do not rely on web notices in lieu of the mandated physical markings; the instrument requires the warnings to accompany the product by placement on package, product, fixed label or conspicuous tag depending on packaging state (s 12).

Step 13 , Monitor for changes: The instrument repealed the 2005 Regulations (Schedule 1) and contains a transitional period. After the transitional period ends, continue to monitor the Federal Register of Legislation and relevant enforcement agencies for any further amendments or interpretive guidance. The instrument itself records no subsequent amendments; any change will be made by later instruments, which should be checked.

Following these steps will align production, packaging and sales practices with the specific prescriptive requirements in ss 9-14 and the transitional rules in ss 7 and 15.
