Consumer Goods (Baby Bath Aids) Safety Standard 2017

Definitions and scope: The instrument defines its central terms narrowly. “Baby bath aid” means a device designed to support a baby while the baby is being bathed (section 5). That definition is the fulcrum of the standard; all requirements apply to a “baby bath aid and any packaging in which the baby bath aid is supplied” (see sections 6(1), 7, 8(4)(a), and 9(1)). The “transitional period” is a 12 month period beginning on commencement (section 5). The instrument specifically incorporates an external standard, the US Standard ASTM F1967‑13, defined in section 5 as “US Standard”. The instrument expressly allows for that standard to be “as in force or existing at the time when this instrument commences” (section 5), and modifies specific subclauses of that standard for the purposes of permanence testing (section 8(6)).

Warning statement mechanics: The instrument mandates one specified warning statement text and graphic arrangement (section 8(2)). The statement includes a triangular exclamation graphic, the word “WARNING” and the following lines: “Children have DROWNED while using bath aids. This is NOT a safety device. ALWAYS keep baby within arm’s reach. NEVER leave baby in care of children.” Section 8(3) then fixes minimum typographic dimensions: the word “WARNING” must have letters at least 10 millimetres high; upper case letters other than “WARNING” must be at least 5 millimetres high; lower case letters must be at least 2.5 millimetres high. Section 8(3) also requires clear legibility, minimum triangle side length of 30 millimetres, exclamation mark height of at least 13 millimetres, and colour contrast between the letters/triangles/exclamation marks and the background so the statement is easily read.

Permanence and testing: Permanence is determined by reference to conditioning and durability tests in the US Standard. Section 8(5) states that a warning statement is considered permanently fixed if, when conditioned as per subclause 7.3.1 of the US Standard, it complies with subclause 7.3.3 or 7.3.4 of that standard, as varied by subsection 8(6). Subsection 8(6) replaces certain phrases in those US Standard subclauses to substitute the phrase “warning statement” where the US Standard refers to “nonpaper label” or “warning label”.

Packaging requirements and exception: Section 9 requires that packaging in which a baby bath aid is supplied display the same warning statement, in the same form and meeting the same typographic requirements, and be conspicuous on the packaging. An exception is provided if the packaging is colourless and transparent and the warning is clearly legible through the packaging (section 9(1)(a)-(b)).

Transitional divergence and repeal of prior instrument: During the defined transitional period, goods must meet either the new Division 2 requirements or the older 2005 Regulations, incorporated by reference (section 6(1) and section 10(1)). Division 3 explicitly imports the 2005 Regulations “as in force or existing immediately before the commencement of this instrument” (section 10(1)). Schedule 1 repeals the Trade Practices (Consumer Product Safety Standard) (Baby Bath Aids) Regulations 2005 in full.

Authority and references: The instrument is made under subsection 104(1) of the Australian Consumer Law (section 3). The instrument includes an explanatory note that the reference to the Australian Consumer Law is a reference to Schedule 2 to the Competition and Consumer Act 2010 as it applies as a law of the Commonwealth, States and Territories, “see section 140K of that Act and corresponding provisions of Acts of States and Territories applying that Schedule” (note to section 3). The instrument also contains notes advising where the US Standard and the 2005 Regulations could be obtained or viewed at the time (notes in section 5 and section 10(1)), including that the ACCC can make a copy of the US Standard available for viewing at an office subject to licensing conditions.

Suppliers of baby bath aids: The requirements attach to the product and to the packaging in which the product is supplied. The instrument repeatedly frames obligations as requirements that “a baby bath aid and any packaging in which the baby bath aid is supplied must meet” the specified provisions (sections 6(1), 7, 8(1) and 9(1)). Practically, those obligations will fall on parties in the supply chain who place the product into the Australian market: manufacturers, importers, distributors, wholesalers and retailers who supply baby bath aids. The instrument does not name these classes of persons but imposes mandatory product-level requirements that those who supply the product must ensure are met.

Design and production inputs: Designers, product engineers and packaging suppliers are affected because the instrument prescribes exact wording, graphic arrangement and minimum sizes for type and graphics (section 8(2) and (3)). Label manufacturers and contract packers will be involved in affixing the prescribed warning statement in a manner that withstands the permanence test linked to the US Standard (section 8(5) and (6)). Product testing laboratories and conformity assessment bodies may be engaged to verify that a warning statement is “fixed permanently” by applying the conditioning and durability tests referenced to subclauses 7.3.1, 7.3.3 or 7.3.4 of the US Standard as modified (section 8(5)-(6)). The instrument provides that the US Standard in force at commencement applies (section 5), and a note indicates that it could be purchased from SAI Global or viewed at the ACCC subject to licensing conditions.

Retail and online marketplaces: Retailers, marketplaces and online sellers that advertise or supply baby bath aids in packaging that obscures required warnings, or in non-transparent packaging that does not display the required warning, will need to ensure their supply conforms to the packaging rule (section 9). The instrument’s packaging exception is narrow: it only applies if packaging is colourless and transparent and the warning is clearly legible through it (section 9(1)). As the obligation is product- and packaging-focused, persons who supply the product into commerce bear the practical compliance burden.

Regulatory bodies and standard-holders: The ACCC is referenced in notes as a body that could make the US Standard available for viewing subject to licensing conditions (note to section 5). The instrument also addresses the prior regulatory instrument: the Trade Practices (Consumer Product Safety Standard) (Baby Bath Aids) Regulations 2005 are repealed by Schedule 1, and during the transitional period those 2005 requirements can continue to apply to goods that do not comply with Division 2 (section 10(1)).

Consumers and carers: While consumers are not regulated parties under the instrument, their interests are the object of the mandated warnings. The prescribed warning is intended to be visible when a baby is in the bath aid (section 8(4)(c)). The instrument therefore targets labelling and packaging as the regulatory lever to change information available to carers at point of use and point of purchase.

Who pays and who decides: The instrument places the mechanical obligations on the baby bath aid and its packaging; responsibility to ensure goods meet those obligations will be borne by suppliers who place goods on the market. Decisions about how to meet the requirements , whether by printing the specified warning on the product or attaching an acceptable permanently fixed warning, or by ensuring packaging is transparent and legible through it , are decisions made by manufacturers, importers and packagers. The instrument also delegates technical testing methodology to a named external standard, with a narrow textual variation, meaning laboratories or suppliers must obtain or view the US Standard to carry out the conditioning tests (section 8(5)-(6) and note to section 5).

Statutory duty to the goods: The core duty is product-level: “a baby bath aid must have a warning statement” (section 8(1)). The instrument prescribes the exact form of the statement (section 8(2)), minimum sizes and legibility requirements (section 8(3)), permanence and conspicuous placement requirements (section 8(4)-(5)), and packaging display requirements (section 9). After the transitional period, compliance must be to Division 2 (section 7). During the transitional period, goods must meet Division 2 or the alternative Division 3 (section 6(1)).

Text binding: The exact wording and graphical arrangement in section 8(2) is mandatory subject to the typographic and graphic specifications in 8(3). The instrument does not authorise alternative formulations of the warning text. The warning must include the precise admonitions about drowning risk, the product not being a safety device, keeping the baby within arm’s reach, and never leaving the baby in the care of children (section 8(2)).

Permanence requirement and test method: The duty to affix the warning “permanently” is defined by reference to the US Standard conditioning and label durability tests: when conditioned per subclause 7.3.1, the warning must comply with subclause 7.3.3 or 7.3.4 of ASTMF1967‑13, as modified (section 8(5)-(6)). The instrument thus delegates a technical conformity assessment to a named external standard, while making minor textual replacements in the referenced subclauses to align with the instrument’s terminology.

Packaging duties and narrow exception: Packaging in which the product is supplied must display the warning unless the packaging is colourless and transparent and the warning is clearly legible through it (section 9(1)). Where packaging cannot be made transparent with legible through-pack warnings, the duty is to display the warning on or have it legible through the packaging, meeting the same form and sizing requirements as required on the product (section 9(2)(a)-(d)).

Transitional rights and obligations: During the transitional period, suppliers have the right to supply goods that comply with either the new Division 2 requirements or the older 2005 Regulations as they existed immediately before this instrument’s commencement (section 6(1) and 10(1)). This creates a temporary dual-compliance pathway designed to allow suppliers time to meet the new rules. The instrument’s drafting expressly contemplates that goods not complying with Division 2 can be supplied under the 2005 requirements during that period (section 10(1)).

Authority and reference to ACL: The instrument is made under subsection 104(1) of the Australian Consumer Law (section 3). The instrument’s note explains that the reference to the Australian Consumer Law is to Schedule 2 of the Competition and Consumer Act 2010 as it applies in the Commonwealth, States and Territories, and points to section 140K of that Act and corresponding provisions in state and territory Acts. The instrument itself does not set out sanctions, recall powers or penalties; those mechanisms would sit in the broader ACL framework to which the instrument refers (see section 3 and the explanatory note).

No statutory exemptions or discretion provisions in the instrument: The standard does not include administrative discretion allowing regulators to accept alternative wording or alternative testing methods, other than the transitional allowance for compliance to the 2005 Regulations during the defined 12 month period and the limited textual modifications to the US Standard identified in section 8(6). There is no express provision in the instrument granting the maker of the goods any approval or exemption power.

Obligation timing: The instrument commences the day after registration (section 2). The transitional period, and the availability of the alternate compliance path, lasts for 12 months (section 5 definition of transitional period; section 6(2) and section 10(2) repeal the transitional provisions at the end of that period). After that date, only the Division 2 requirements apply (section 7).

Instrument does not specify penalties: The text of the Consumer Goods (Baby Bath Aids) Safety Standard 2017 itself contains no express civil or criminal penalty provisions, nor does it set out recall procedure or infringement notice amounts. The instrument is a safety standard made under subsection 104(1) of the Australian Consumer Law (section 3), and the instrument’s note explicitly directs readers to the Australian Consumer Law as Schedule 2 to the Competition and Consumer Act 2010 and to section 140K of that Act. The instrument therefore sits within the wider ACL regulatory architecture, but the instrument contains no standalone enforcement provisions.

Enforcement mechanism sits in parent law: Because the instrument is made under the Australian Consumer Law, enforcement (including penalties, recalls, injunctions, or other remedies) would be governed by the Australian Consumer Law and the Competition and Consumer Act 2010 as they apply to safety standards. This instrument does not reproduce or restate those enforcement mechanisms; it merely establishes mandatory product requirements within that statutory framework. The instrument’s authority provision and accompanying note (section 3) are the source text that links this standard to the ACL enforcement machinery.

Regulatory action likely against non-complying goods: The instrument obliges that “a baby bath aid and any packaging in which the baby bath aid is supplied must meet” the specified requirements (sections 6(1) and 7). Where goods do not meet those requirements after the transitional period, they do not comply with this safety standard. The instrument does not itself specify remedies for noncompliant goods, but because it is expressed as a safety standard made under the ACL, regulatory action under the ACL framework would be the route for enforcement. The instrument’s language, however, does not describe any administrative discretion, notice periods, or remedial steps in respect of noncompliance. Users must therefore consult the Australian Consumer Law and the Competition and Consumer Act 2010 for the specific enforcement powers and penalties that may be applied.

Testing and conformity evidence: The instrument’s permanence test is defined by reference to specific subclauses of the US Standard (section 8(5)-(6)). Suppliers who choose to rely on such conditioning and durability tests will likely need to commission or retain records of testing to demonstrate compliance. While the standard does not state an evidentiary regime for enforcement, the naming of an external technical standard creates a clear benchmark that enforcement agencies could use to assess whether a warning is “fixed permanently” as required. The instrument also includes a note that the US Standard could be purchased from SAI Global and that the ACCC can make a copy available for viewing subject to licensing conditions (note to section 5). The need to access and rely on the US Standard for testing may be an operational precondition for suppliers to demonstrate compliance in the event of regulatory scrutiny.

Transitional compliance and enforcement timing: During the 12 month transitional period suppliers may rely on the 2005 Regulations if their goods do not meet Division 2 (sections 6(1) and 10(1)). The instrument expressly repeals those transitional provisions at the end of the transitional period (sections 6(2) and 10(2)). Schedule 1 repeals the 2005 Regulations in full. Because the instrument’s enforcement particulars are not set out, the interaction between the transitional allowance and enforcement under the ACL is left to the broader statutory enforcement regime; this instrument provides the compliance timetable but not the enforcement mechanics.

Made under the Australian Consumer Law: The instrument expressly states that it is made under subsection 104(1) of the Australian Consumer Law (section 3). The instrument includes a note clarifying that the reference to the Australian Consumer Law is a reference to Schedule 2 to the Competition and Consumer Act 2010 as it applies to the Commonwealth, States and Territories, and refers readers to section 140K of that Act and corresponding provisions of state and territory Acts. The instrument therefore functions as a safety standard within the ACL framework rather than a freestanding statute.

Relationship to the Trade Practices 2005 Regulations: The instrument repeals the Trade Practices (Consumer Product Safety Standard) (Baby Bath Aids) Regulations 2005 in full (Schedule 1). It also provides a transitional pathway, under which goods that do not meet the new Division 2 may comply with the 2005 Regulations during the transitional period (section 10(1)). The instrument therefore replaces the 2005 Regulations but allows a 12 month dual-compliance period to minimise immediate disruption.

Notes regarding continuation of the 2005 Regulations: The instrument includes a note referencing item 4 of Schedule 7 to the Trade Practices Amendment (Australian Consumer Law) Act (No. 2) 2010. That note explains that the 2005 Regulations continued in force from 1 January 2011 as if they were a safety standard made under section 104 of the Australian Consumer Law. The instrument therefore records the earlier statutory continuity and then repeals the 2005 Regulations by Schedule 1.

Incorporation and modification of an external standard: The instrument incorporates the US Standard ASTM F1967‑13 by reference for the specific technical purpose of testing whether a warning statement is “fixed permanently” (section 8(5)). It defines “US Standard” in section 5 and states that the US Standard applies “as in force or existing at the time when this instrument commences” (section 5). The instrument then modifies the US Standard for its purposes by textual substitutions in subsection 8(6). The instrument also contains a note about where the US Standard could be obtained or viewed (note to section 5). This incorporation means that compliance may require suppliers to obtain or access the US Standard and to apply specific subclauses of it when demonstrating permanence.

Interaction with labelling and packaging consumer protection rules: While the instrument sets a product-level safety standard for baby bath aids, it does so within the broader labelling and packaging regulatory landscape handled under the ACL and potentially other product-specific regimes. The instrument’s narrow focus on the warning statement and its permanence interacts with any other legal obligations a supplier may have to label, supply information, or make claims about a product. The instrument does not displace other legal duties; it imposes a minimum mandatory labelling requirement specific to baby bath aids.

Jurisdictional effect: The instrument’s note indicates that the Australian Consumer Law is referenced as it applies as a law of the Commonwealth, States and Territories (note to section 3). That locates this safety standard within the national ACL framework and suggests that the standard applies across jurisdictions in Australia according to the operation of the ACL.

Administrative interface and access to standards: The instrument’s notes advise that the US Standard could be purchased from SAI Global and that the ACCC can make a copy available for viewing at one of its offices, subject to licensing conditions (note to section 5). This administrative interaction affects how suppliers obtain the technical tests required by the instrument’s permanence criterion and underlines that the instrument relies on an externally maintained standard for technical detail.

Instrument date and commencement: The instrument is dated 19 October 2017, signed by the Minister for Small Business (front matter). Section 2 provides that the instrument commences on the day after it is registered on the Federal Register of Legislation. No other dates or staged commencements are set out in the text.

Transitional period and repeal of transitional provisions: The instrument establishes a transitional period defined in section 5 as a period of 12 months beginning on the day the instrument commences. Section 6(2) repeals section 6 at the end of that period, and section 10(2) repeals Division 3 at the end of that period. These provisions implement a single, defined transitional timetable rather than multiple staggered commencement dates.

Repeal of the 2005 Regulations: Schedule 1, item 1, repeals the whole of the Trade Practices (Consumer Product Safety Standard) (Baby Bath Aids) Regulations 2005. The instrument also preserves, for the transitional period, the option for goods to comply with the 2005 Regulations (section 10(1)).

References to prior amendments of the 2005 Regulations: The instrument includes a note explaining that under item 4 of Schedule 7 to the Trade Practices Amendment (Australian Consumer Law) Act (No. 2) 2010, the 2005 Regulations continued in force from 1 January 2011 as if they were a safety standard made under section 104 of the Australian Consumer Law. This note provides context on the 2005 Regulations’ legal status prior to their repeal by the present instrument.

No further amendments recorded in the instrument: The text supplied contains no schedules or paragraphs that amend the 2017 instrument itself after its making, and provides no subsequent amendment entries. The instrument makes narrow textual variations to the US Standard only for the purpose of the permanence test (section 8(6)). There is no in-instrument history of prior amendments to the 2017 standard because the instrument as provided is the primary source.

Practical consequence of repeal: The instrument’s repeal of the 2005 Regulations is complete under Schedule 1. The text places effect on that repeal after the transitional period has passed. The instrument does not set out any savings provisions for products supplied before repeal beyond the transitional allowance; the only transitional text expressly provided is that during the 12 month transitional period goods may comply with the 2005 Regulations (section 10(1)). No other transitional modifications or grandfathering clauses are included.

The text of the Consumer Goods (Baby Bath Aids) Safety Standard 2017, as supplied, contains no references to any judicial decisions, tribunal determinations, enforcement actions, or litigation that interpret or apply the instrument. There are also no listed cases or references to disputes arising under this instrument in the document. The instrument contains notes referencing the Australian Consumer Law and the earlier Trade Practices (Consumer Product Safety Standard) (Baby Bath Aids) Regulations 2005; it does not identify any litigation under the 2005 Regulations.

Because this instrument is a safety standard made under the Australian Consumer Law, any enforcement, challenges or litigation relating to noncompliance would be pursued under the ACL and the Competition and Consumer Act 2010. The instrument itself does not record any decisions or proceedings. Users requiring evidence of litigation relating to these requirements must consult external enforcement records, decisions of courts or tribunals, or regulatory databases, none of which are contained in this instrument.

Exact form of the warning is mandatory: Section 8(2) specifies the precise text and graphic arrangement of the warning statement. The instrument does not authorise paraphrase or omission of lines within that text. Suppliers must not rely on approximations or alternative wordings if they intend to meet Division 2. The instrument requires the statement to read as provided: “Children have DROWNED while using bath aids. This is NOT a safety device. ALWAYS keep baby within arm’s reach. NEVER leave baby in care of children.” The presence of formatting, upper case words and the triangular exclamation graphic are essential components.

Minimum typography and graphic dimensions are precise: Section 8(3) prescribes minimum heights for letters and graphic elements: “WARNING” letters at least 10 millimetres high; other upper case letters at least 5 millimetres; lower case letters at least 2.5 millimetres; each side of the triangle at least 30 millimetres; exclamation mark at least 13 millimetres high. These are not recommendations; they are discrete mandatory measurements. A label that fails to meet any one of these specific dimensional requirements does not meet the section 8(3) requirements.

Colour contrast requirement is explicit and qualitative: Section 8(3)(g) requires letters, triangles and exclamation marks to be in a colour that contrasts with the background “to allow for the warning statement to be easily read.” That introduces a qualitative legibility standard in addition to quantitative measurements. Suppliers must ensure colour contrast sufficient for legibility; the instrument does not specify a numeric contrast ratio or standard, so the requirement is functional rather than test-method driven for colour contrast.

Permanence test ties to an external standard and is modified: Section 8(5) makes compliance with permanence contingent on conditioning per subclause 7.3.1 of the US Standard and meeting subclauses 7.3.3 or 7.3.4 as modified by subsection 8(6). Subsection 8(6) replaces the US Standard’s language “A nonpaper label (excluding labels attached by a seam)” with “A warning statement (excluding warning statements attached by a seam)” and replaces the words “A warning label” with “A warning statement”. Suppliers must obtain and inspect the relevant subclauses of ASTM F1967‑13 to understand the conditioning and durability tests referenced. The instrument’s note indicates the US Standard could be purchased from SAI Global and that the ACCC can make a copy available for viewing subject to licensing conditions (note to section 5). The practical gotcha is that compliance requires access to a commercial standard that is not reproduced in the instrument.

Packaging exception narrow and conditional: The packaging exception in section 9(1) is limited to packaging that is “colourless and transparent” and where the warning is “clearly legible through the packaging”. Non-opaque but tinted or partially translucent packaging may not qualify. If a supplier uses any packaging that is not fully colourless and transparent, it must display the warning on the packaging itself in conspicuous placement as required by section 9(2). Where product presentation relies on inner labels or instruction manuals, such labelling might not satisfy section 9 unless it is legible through the packaging.

Visibility requirement when product in use: Section 8(4)(c) requires the warning to be “clearly visible when a baby is in the baby bath aid.” This is a situational requirement. A warning fixed permanently in a place that becomes obscured when the product is in use will not satisfy the standard. Suppliers must consider the occupied configuration of the product when deciding label placement.

Transitional dual-compliance trap: During the transitional period a supplier may choose to comply with the old 2005 Regulations rather than the new Division 2 requirements (section 6(1) and 10(1)). However, after the transitional period only Division 2 applies (section 7). A supplier who relies on the transitional allowance must have a plan to move to Division 2 compliance by the end of the 12 month period. Failure to switch before the end of the transitional period will leave goods noncompliant under this instrument.

No express alternative approvals or dispensations in the instrument: The instrument does not include a mechanism for an administrative approval to accept an alternative warning, nor does it allow an on‑application variation. Other regulatory regimes sometimes provide for exemptions or approvals; this instrument contains none. The only permitted variation is the temporary reliance on the older 2005 Regulations during the transitional period, and the textual adjustments to the US Standard subclauses specified in section 8(6).

Access to the US Standard may be restricted by licensing: The note to section 5 explains that the US Standard could be purchased from SAI Global and that the ACCC may make a copy available for viewing subject to licensing conditions. Suppliers and testing laboratories should budget time to obtain or view the US Standard and plan for any licensing constraints when designing and testing warnings for permanence.

No penalties or enforcement specifics in the instrument: The instrument does not set out penalties, recall processes or enforcement procedures; these reside in the parent Australian Consumer Law and related statutory instruments. Suppliers must therefore be aware that while the instrument sets technical product requirements, enforcement consequences will derive from the broader ACL regime, which is not detailed in this document.

Compliance overview: After the transitional period, every baby bath aid and any packaging in which it is supplied must meet Division 2 (section 7). During the 12 month transitional period defined in section 5, suppliers may choose to comply with Division 2 or with the Trade Practices (Consumer Product Safety Standard) (Baby Bath Aids) Regulations 2005 as they existed immediately prior to commencement (sections 6(1) and 10(1)). Practical compliance steps are therefore: (1) decide whether to adopt Division 2 immediately or to rely on the transitional pathway; (2) if adopting Division 2, implement the specified warning on the product and on packaging in the exact form required; (3) ensure permanence through testing per the US Standard subclauses as modified; (4) document tests and labelling specifications to demonstrate compliance; and (5) transition to Division 2 compliance by the expiry of the transitional period if the transitional path was chosen.

Checklist for product labelling (Division 2):

• Include the exact warning statement text and graphic arrangement set out in section 8(2). Do not paraphrase the mandated lines.
• Ensure the word “WARNING” appears and its letters are at least 10 millimetres high (section 8(3)(a)).
• Ensure other upper case letters in the statement (other than “WARNING”) are at least 5 millimetres high (section 8(3)(b)).
• Ensure lower case letters in the statement are at least 2.5 millimetres high (section 8(3)(c)).
• Ensure all letters are clearly legible (section 8(3)(d)).
• Ensure each side of the triangular graphic is at least 30 millimetres in length and the exclamation mark in the triangle is at least 13 millimetres high (section 8(3)(e)-(f)).
• Use colours for letters, triangles and exclamation marks that contrast with the background so the statement is easily read (section 8(3)(g)).
• Fix the warning statement permanently to the baby bath aid (section 8(4)(a)) and place it conspicuously on the product (section 8(4)(b)). Ensure the warning is clearly visible when a baby is in the aid (section 8(4)(c)).

Permanence testing:

• Obtain and apply the US Standard ASTM F1967‑13 for the purposes of permanence testing as specified in section 8(5). Condition the product and warning in accordance with subclause 7.3.1 of the US Standard, then ensure the warning complies with subclause 7.3.3 or 7.3.4 of that standard, as modified by section 8(6).
• Note the instrument substitutes “warning statement” for the US Standard’s “nonpaper label” and “warning label” phrases in the relevant subclauses (section 8(6)). Ensure test reports reference the exact subclauses used and the textual substitutions made in accordance with section 8(6).
• Factor in time and cost to purchase or access the US Standard. The instrument notes the US Standard could be purchased from SAI Global and that the ACCC can make a copy available for viewing subject to licensing conditions (note to section 5).

Packaging compliance:

• If packaging is not colourless and transparent, ensure the packaging itself displays the warning in the form set out in section 8(2) and meeting the typographic and placement requirements of section 8(3) and 8(4) (section 9(2)).
• If packaging is colourless and transparent, ensure the warning on the product is clearly legible through the packaging before relying on the section 9(1) exception. The exception applies only where the packaging is colourless and transparent and the warning is clearly legible through it (section 9(1)).
• Place the warning conspicuously on the packaging so it is legible and readily seen at the point of purchase (section 9(2)(c)-(d)).

Record-keeping and evidence:

• Maintain documentation showing the wording and dimensions of labels used on both product and packaging, with measurements confirming compliance with section 8(3).
• Retain test reports from laboratories that implemented the conditioning test and durability test per subclause 7.3.1 and subclauses 7.3.3 or 7.3.4 of the US Standard (as varied by section 8(6)). Test reports should specify the version of the US Standard used.
• Keep a record of any decisions to rely on the transitional pathway under section 10(1), including which 2005 Regulations provisions were relied on, and prepare to achieve Division 2 compliance by the end of the transitional period.

Practical label production considerations:

• Ensure label materials and attachment methods can survive conditioning tests. Section 8(5) excludes labels attached by a seam (as modified by section 8(6) substitution), so consider attachment methods that meet the US Standard’s durability criteria.
• Evaluate label placement with the product in use to confirm the warning is visible when a baby is in the aid (section 8(4)(c)). Test in real‑use configurations.
• For small or uniquely shaped products where meeting the minimum letter heights is difficult, examine whether there is sufficient surface area to meet the typographic minimums. If the product cannot accommodate the mandated sizes while satisfying section 8(4)(c) visibility, a packaging‑level warning that is conspicuous and legible may be necessary, subject to section 9 obligations.

Transitional-period strategy:

• If relying on the 2005 Regulations during the transitional period, document reliance and plan product redesign or relabelling activity to meet Division 2 well before the 12 month deadline. The instrument repeals the transitional provisions at the end of the period (sections 6(2) and 10(2)), and after that only Division 2 applies (section 7).
• Use the transitional period to obtain or review the US Standard, commission permanence testing and revise packaging and product labels to ensure compliance with section 8 and section 9.

Regulatory liaison and legal advice:

• Because the instrument is made under the Australian Consumer Law, suppliers should familiarise themselves with ACL enforcement provisions and consider engaging legal or compliance counsel to understand enforcement exposure and documentation best practice. The instrument itself does not spell out enforcement options (section 3 and associated note).
• If there is uncertainty whether a particular product variant falls within the definition of “baby bath aid” in section 5, legal advice should be sought because the definition is the foundation of applicability.

In sum, compliance requires adopting the exact warning text and graphics prescribed, meeting precise typographic and graphic measurements, fixing the warning permanently as tested under the named US Standard with the instrument’s textual variations, and ensuring packaging displays or allows legible viewing of the warning. During the 12 month transitional period there is an alternative pathway via the 2005 Regulations, but suppliers should plan to meet Division 2 on expiry of that period.
