Consumer Goods (Aquatic Toys) Safety Standard 2020

The instrument organises its regulatory content around a handful of tightly defined concepts that determine scope and the applicable technical obligations.

• Aquatic toy, defined in s 5: The legal product category is defined by two functional characteristics: it must be designed to bear the mass of a child under 14, and it must be designed for play in shallow water. The definition expressly covers inflatable and non-inflatable designs and includes examples in the note (inflatable novelty shapes, small inflatable boats intended for shallow water, unattached rings) that clarify the intended subject matter of the standard (s 5).
• Australian/New Zealand Standard and International Standard, defined in s 5: These definitions fix the external technical texts incorporated by reference. The Australian/New Zealand Standard is AS/NZS ISO 8124.1:2019 and the International Standard is ISO 8124‑1:2018, both as in force at the time this instrument commences. The instrument does not reproduce clause 4.20 itself; it requires compliance with that clause as published in the respective standards (s 5; ss 10-11).
• Transitional period, defined in s 5: A 24-month window beginning on the day the instrument commences is provided to phase in the new requirements. During that period the supplier may comply with either the new Part 3 requirements or the prior 2009 standard (s 7(1)). Section 7(2) expressly repeals the transitional provision at the end of that period.
• Clause 4.20 and Annex B.2.6: Clause 4.20 (contained in the incorporated standards) is the substantive clause the instrument requires suppliers to meet; Annex B.2.6 is the specific annex text that is modified by the instrument. The instrument makes only one textual modification to Annex B.2.6 in both the Australian/New Zealand and International Standard variants: the advisory "should carry" is replaced with the mandatory "shall carry" (ss 10(2), 11(2)). The practical effect is to convert a recommended warning requirement in the standard into a mandatory one for regulated aquatic toys.
• Warning formatting requirements (s 12): Over and above compliance with clause 4.20 and the modified Annex B.2.6, the instrument prescribes that the warning on an aquatic toy must be in English, clearly legible, clearly visible and indelible (s 12). These are phrased as conjunctive mandatory conditions: all four must be satisfied.

Administrative notes and cross-references are present in the instrument. The note to s 10 and s 11 identifies how the referenced standards could be obtained or viewed (SAI Global and ISO websites, and the ACCC can make a copy available subject to licensing conditions), and the short note to s 9 points to s 108 of the ACL for the regulator’s ability to require a supplier to nominate which set of requirements (Australian/New Zealand Standard or International Standard) is being followed.

Mechanically, the instrument is a classic safety standard instrument that (1) declares product scope; (2) adopts external technical standards by reference; (3) makes a narrow textual change to convert recommended warning language to a requirement; (4) imposes mandatory minimum formatting for warnings; and (5) stages in the change via a 24‑month transitional period during which the prior standard remains an alternative compliance path (s 7).

The instrument declares its subject matter as "aquatic toys" (s 6(1) and s 5 definition). The practical parties affected are those that design, manufacture, import, supply or place aquatic toys into the market that meet that definition, although the instrument does not itself enumerate the list of regulated market roles (for example, it does not say "suppliers must" within the instrument text); the ACL framework under which this instrument is made delivers obligations and enforcement against market participants. The instrument’s note referencing s 108 of the ACL directly contemplates the regulator engaging with "a supplier of aquatic toys" (note to s 9). Thus, in practice, the following classes of market actors are directly implicated by the instrument as it is written:

• Manufacturers and designers of aquatic toys, because the technical requirements (clause 4.20 of the adopted standards as modified) and the warning-formatting rules will affect design choices, materials and applied labelling (ss 10-12).
• Importers and distributors who bring aquatic toys into the Australian market, because they are the nodes through which non‑compliant products would be placed onto the market; the ACL enforcement regime applies to these actors and the instrument requires compliance with the safety standard for the product (ss 3, 6, 8-9).
• Retailers and wholesalers who supply aquatic toys to consumers, as they will need to ensure the products they offer meet the applicable requirements post-transitional period (s 8) and during the transitional period if they elect to rely on the new Part 3 instead of the 2009 standard (s 7(1)).
• Compliance, testing and certification services, because complying with clause 4.20 and the modified Annex B.2.6 will typically require technical testing, conformity assessment and labelling verification against the referenced standard texts (s 10-11; note to ss 10-11 on how to obtain the standards).

Products that are not affected are expressly listed in s 6(2): beach balls, surfboards, bodyboards, kickboards, inflatable air beds, and inflatable boats that are not toys or that are designed for use in deep water. This means suppliers of those excluded products do not need to comply with this aquatic-toys safety standard, but the exclusion turns on the product’s design, size and intended use (s 6(2)(f)) and so the classification question may involve an assessment of the product’s design intent and sizing.

The transitional provision (s 7) affects the immediate compliance decisions of those market actors by offering a two-year choice between the new Part 3 requirements and the prior 2009 standard. After the transitional period (s 8) the choice ends and all aquatic toys must meet the Part 3 requirements.

The instrument makes no express statement about consumer rights or remedies within its text; those remain within the ACL and other consumer-protection instruments. The instrument does, however, place concrete obligations on the physical product , compliance with clause 4.20 as modified and with warning-formatting rules , and therefore those actors responsible for the physical characteristics and labelling of aquatic toys bear the compliance burden on the ground (ss 9-12).

The instrument itself imposes substantive product requirements and labelling requirements; it does not set out procedural duties (such as registration or certification) or specify administrative rights in detail. The key obligations and operational points drawn from the instrument are:

• Product compliance obligation: After the transitional period ends, an aquatic toy must comply with the requirements in Part 3 (s 8). Part 3 makes compliance contingent on two elements: (1) compliance with clause 4.20 of either the Australian/New Zealand Standard or the International Standard, as affected by Annex B.2.6 modified to replace "should carry" with "shall carry" (ss 9-11); and (2) compliance with the warning-formatting requirements in s 12. Section 9 sets this out as a conjunctive test for compliance: paragraph (a) the clause 4.20 requirement via either standard; paragraph (b) the s 12 formatting requirement.
• Transitional compliance option: For 24 months after commencement, an aquatic toy may comply either with Part 3 or with the prior Consumer Product Safety Standard for Flotation Toys and Aquatic Toys (Consumer Protection Notice No 2 of 2009), as in force immediately before that transitional section commences (s 7(1)). This creates a temporary parallel compliance route through the older standard.
• Warning content and mandatory wording: The instrument’s specific textual intervention converts an advisory formulation in Annex B.2.6 of the adopted standards into a mandatory obligation by substituting "shall carry" for "should carry" (ss 10(2), 11(2)). Because clause 4.20 and Annex B.2.6 are incorporated by reference, suppliers must align the warnings on the toy with the now-mandatory language and any placement/content rules in clause 4.20 and the annex.
• Warning formatting duty: Independently of the content required by clause 4.20/Annex B.2.6, s 12 requires the warning to be in English, clearly legible, clearly visible and indelible. These are conjunctive conditions: the warning must satisfy all four elements. The instrument therefore imposes minimum labelling-format duties on every aquatic toy.
• Administrative engagement right of the regulator: The instrument notes that on request by the regulator, a supplier may be required to nominate which of the two standards (Australian/New Zealand or International) it relies on under paragraph 9(a) (note to s 9, referring to s 108 of the ACL). That indicates a regulator-facing administrative duty for suppliers to identify their chosen compliance route when asked.
• Authority and enforcement context: The instrument is made under s 104(1) of the ACL (s 3). The instrument itself does not specify penalties or enforcement measures; those arise from the ACL and the broader consumer-law enforcement regime. The instrument therefore operates within the ACL’s statutory remediation and enforcement architecture rather than creating new standalone sanctions.

Rights are implicit rather than enumerated. Suppliers have the right to choose between complying with the Australian/New Zealand Standard or the International Standard for clause 4.20 (subject to the regulator’s right to require nomination), and, during the transitional period, the right to rely on the earlier 2009 standard (s 7(1)). The instrument does not create procedural appeal rights, certification rules, or registries; those issues are handled by the ACL regime and by the practices of regulators enforcing safety standards.

In practical terms, the duties that will be operative for supply chains are: ensure technical conformity with clause 4.20 as published in the relevant standard text (with the Annex B.2.6 modification), ensure labelling warnings are in English, legible, visible and indelible, and be prepared to identify the chosen compliance route if the regulator requests clarification under the ACL (note to s 9).

The instrument itself contains no standalone penalty provisions. It is expressly made under subsection 104(1) of the Australian Consumer Law (s 3), which locates it within the ACL regulatory and enforcement framework. Consequently, enforcement activity, sanctions and civil remedies for contravening the safety standard will be those provided for in the ACL as it applies to safety standards, rather than penalties set out inside this instrument.

What the instrument does supply relevant to enforcement is:

• Declarative obligations: The instrument creates mandatory product and labelling obligations (ss 8-12). These obligations are enforceable because the instrument is a safety standard under the ACL (s 3). The instrument therefore generates contravention-based enforcement potential under the ACL regime for failure to comply with the standard.
• Regulator’s administrative power to request supplier nomination: The note to s 9 identifies that, on request by the regulator, a supplier may be required to nominate whether it is complying with the Australian/New Zealand Standard or the International Standard (note to s 9, referring to s 108 of the ACL). That is an administrative compliance tool: the regulator can require evidence of which technical route is being relied on.
• Repeal of predecessor instrument: Schedule 1 repeals the 2009 flotation‑toys instrument. Schedule 1 therefore removes the alternative legal instrument that previously set out safety requirements. During the transitional period, however, the 2009 instrument remains an allowed compliance route by express transitional provision (s 7(1)). After transitional, the 2009 instrument is not an applicable standard (s 7(2); Schedule 1).

Because the instrument does not recite the ACL enforcement powers, this note does not attempt to list particular penalties or enforcement measures that may be applied under the ACL. The central enforcement implication to draw from the instrument itself is that non‑compliance with the instrument’s mandatory technical and labelling requirements (ss 9-12) will be actionable under the ACL regime because the instrument is a safety standard made under that law (s 3). Parties engaging with aquatic toys should therefore assume regulatory enforcement interest in technical conformity, label content and label formatting, and should expect to respond to regulator requests for evidence on the chosen compliance route where requested (note to s 9).

This instrument is an ACL safety standard instrument and therefore interacts primarily with the Australian Consumer Law and the Competition and Consumer Act 2010 through the ACL’s incorporation as Schedule 2 to that Act (s 3, note). Key interaction points arising from the instrument’s text are:

• Embedding within the ACL framework: The instrument is made under subsection 104(1) of the ACL (s 3). That means the instrument’s mandatory requirements become part of the regulatory matrix governed by the ACL. Enforcement, civil remedies and prosecutorial options for breach are exercised under the ACL framework rather than through novel sanctioning powers created by this instrument (s 3).
• Interaction with the prior safety standard: Schedule 1 repeals the Consumer Product Safety Standard for Flotation Toys and Aquatic Toys (Consumer Protection Notice No 2 of 2009). The transitional provision in s 7 allows suppliers to rely on either the 2009 standard or the new Part 3 during the 24‑month transitional period, after which only the Part 3 requirements apply (s 7(1)-(2); s 8). That staging point interacts with contractual and inventory management decisions for manufacturers, importers and retailers who may hold stock compliant with the 2009 standard and who must plan for full compliance with Part 3 when the transitional period ends.
• Incorporation by reference to external standards and licensing conditions: The instrument adopts clause 4.20 of AS/NZS ISO 8124.1:2019 and ISO 8124‑1:2018 as the substantive technical requirement (s 5 definition; ss 10-11). The instrument does not reproduce the text of clause 4.20; it therefore requires market participants to obtain or access the standards to determine the full technical obligations. The instrument’s notes point to the relevant vendors (SAI Global and ISO websites) and to the Australian Competition and Consumer Commission’s capacity to make a copy available for viewing in its offices subject to licensing conditions (notes to s 5 and to ss 10-11). This creates an interaction between the safety standard and intellectual property/licensing arrangements for standards documents.
• Regulator information powers under the ACL: The instrument’s note to s 9 references s 108 of the ACL as the legal basis for a regulator requiring a supplier to nominate which standard option is being relied upon. That indicates an interplay with ACL administrative powers to obtain supplier information for compliance verification, including the potential for ACL-specified notices or directions to produce information.
• Product classification and exclusions: The instrument’s exclusions in s 6(2) mean that similar goods regulated under different safety or industry-specific laws (for example, surfboards or inflatable boats designed for deep water) fall outside this instrument. Market participants must therefore consider the correct legal classification of goods to determine which safety regime applies. The instrument’s text makes the exclusion depend on design, size and intended use for inflatable boats (s 6(2)(f).
• No modification of consumer statutory rights stated: The instrument does not purport to alter consumers’ general rights under the ACL (for example, consumer guarantees), nor does it create private enforcement causes of action separate from those already available under the ACL. It functions as a technical mandatory safety standard within the ACL architecture.

To summarise the concrete interactions evident from the instrument text: it becomes an enforceable technical standard within the ACL; it replaces an earlier safety standard while providing a transitional parallel compliance route for 24 months; it imports external standard text by reference (creating dependence on standards vendors and possible viewing restrictions); and it ties into ACL administrative powers for regulator information-gathering. The instrument does not purport to displace or restate the ACL’s broader enforcement and remedy provisions, which remain the avenue for regulatory or civil action if the standard is breached.

The instrument itself contains information about its commencement and about which instruments it amends or repeals, but it does not record any subsequent amendments within the text provided.

What the instrument records about its own origin and formal changes is:

• Commencement mechanics: Section 2 contains a commencement table specifying that "the whole of this instrument" commences "the day after this instrument is registered." The table’s column 3 includes an informational date (shown as 12 June 2020 in the table as published) but the instrument expressly states that any information in column 3 is not part of the instrument (s 2(1)-(2)). Therefore the operative commencement rule in the instrument is the "day after registration" rule in the table (s 2).
• Repeal of the prior instrument: Schedule 1 repeals the entire prior Consumer Product Safety Standard for Flotation Toys and Aquatic Toys (Consumer Protection Notice No 2 of 2009) (Schedule 1). This is a structural amendment of the body of safety standards applicable in the jurisdiction, with the prior instrument removed from the statute book. However, the transitional provision (s 7(1)) preserves the ability to comply with the 2009 standard during the 24‑month transitional period; s 7(2) then repeals that transitional section at the end of the period.
• No further amendments recorded: The provided text contains no schedules amending other instruments beyond the scheduled repeal, and contains no later amendment entries. It therefore records only the original making and the repeal of the 2009 instrument in Schedule 1.

If an interested party needs to know whether the instrument has been amended after its original making, they must consult the consolidated or updated federal legislation register or the Federal Register of Legislation. The instrument’s own commencement table warns that column 3 information is not part of the instrument and may be edited in published versions (s 2(2)); therefore the authoritative operative terms are those set out in the provisions themselves rather than the column 3 informational entry.

In short, within its own text the instrument establishes the starting point, imports specified standards as in force at the time of commencement, and repeals the earlier flotation-toys instrument, while providing a 24‑month transitional window. No post‑enactment amendments are recorded in the instrument text provided here.

The instrument text contains no litigation history. It does not cite judicial decisions, and there are no references to cases, tribunal determinations or precedent in the instrument. The only legal references are to statutory provisions in the ACL (subsection 104(1) and s 108 as referenced in a note) and to the external standards incorporated by reference.

Because the instrument itself is a regulatory standard, any litigation arising from it would typically appear in:

• regulatory enforcement actions under the ACL where a regulator alleges non‑compliance with this safety standard; or
• civil litigation where a claimant seeks damages for consumer harm and alleges that a product violated an applicable safety standard (depending on how courts treat non‑compliance with a safety standard as relevant evidence of fault or breach of statutory obligations under the ACL).

None of those actions are mentioned in the instrument text. Therefore there is no litigation history to report from the instrument itself.

Practically, users of this instrument who need to understand judicial interpretation or enforcement precedent must look beyond the instrument to decisions under the ACL that involve safety standards, and to any specific enforcement matters the regulator has pursued that reference this particular instrument. Those materials are not contained in the instrument text provided here.

Several practical pitfalls and points of ambiguity arise from the instrument’s wording and structure that market actors should note and plan for:

• Incorporation by reference without text: The instrument requires compliance with clause 4.20 of AS/NZS ISO 8124.1:2019 or ISO 8124‑1:2018 but does not reproduce clause 4.20 (s 5 definitions; ss 10-11). To determine the full technical obligations, a supplier must obtain the relevant standards text. The instrument’s notes state that the standards were available for purchase from SAI Global or ISO and could be viewed at an ACCC office subject to licensing conditions (notes to s 5 and to ss 10-11). Do not assume the full content of clause 4.20 from this instrument alone; you must consult the standard.
• Narrow textual change with substantive effect: The instrument’s modification of Annex B.2.6 , substituting "shall carry" for "should carry" , changes an advisory formulation into a mandatory one (ss 10(2), 11(2)). That single-word swap may have meaningful compliance implications for warnings that were previously recommended rather than required. Companies relying on the advisory status of the annex in the standard will need to update labelling practice to meet the mandatory wording.
• Warning formatting conjunctives: Section 12 requires that the warning be in English, clearly legible, clearly visible and indelible. All four are required. That combination may create issues for small toys where space is constrained; manufacturers need to ensure the warning meets the legibility and visibility tests in practice (s 12).
• Scope and exclusion line-drawing: The definition of "aquatic toy" is functional (designed to bear the mass of a child under 14 and for play in shallow water) and the exclusions in s 6(2) create boundary questions. For example, whether an inflatable boat is a "toy" intended for shallow water or a craft intended for deeper water turns on size, design and intended use (s 6(2)(f)). Suppliers should document product design intent and target use to justify classification.
• Transitional-period choice: During the 24-month transitional period suppliers may comply with either this instrument’s Part 3 or the prior 2009 standard (s 7(1)). This dual route could tempt suppliers to keep older stock that only meets the 2009 standard; they must plan for the point when the transitional period ends and the 2009 route is no longer available (s 7(2), s 8).
• Regulator request for nomination: The instrument’s note to s 9 states a regulator can ask a supplier to nominate which standard option under paragraph 9(a) is chosen (note to s 9 referring to s 108 of the ACL). A supplier must therefore be prepared to evidence which standard it relies on and how the product satisfies clause 4.20 and the modified annex.
• Licensing conditions for standard access: The notes indicate that view-only access to the standards at the ACCC’s offices is subject to licensing conditions (notes to s 5 and to ss 10-11). Users should not assume free, unrestricted public access to the full text of adopted standards; budgeting for standards procurement or arranging viewing appointments may be necessary.
• No express certification mechanism or labelling specification beyond the general formatting requirements: The instrument sets out required features for warnings (s 12) but does not specify exact font sizes, colours, pictograms, or placement rules beyond what clause 4.20 and the modified annex prescribe. Those details reside in the standards and must be followed to ensure compliance.
• Column 3 information caution: The commencement table in s 2 includes column 3 information that the instrument cautions is not part of the instrument (s 2(2)). Do not treat informational entries in the commencement table as operative law.

These "gotchas" are not speculative policy critiques; they are practical, source-grounded compliance and classification risks that arise from the instrument’s drafting choices (incorporation by reference, a single-word modification converting "should" to "shall", conjunctive formatting requirements, and transitional dual-compliance paths). Each creates a discrete compliance step suppliers must manage.

To achieve legally defensible compliance with the Consumer Goods (Aquatic Toys) Safety Standard 2020, a supplier (manufacturer, importer, distributor or retailer) should follow a documented, source-grounded process that addresses the instrument’s definitional scope, technical obligations, labelling rules and the transitional pathway.

1. Confirm product classification under the instrument:

   • Apply the statutory definition in s 5: determine whether the item is designed to bear the mass of a child under 14 and intended for play in shallow water. Document the design parameters, target age group and intended use so classification can be evidenced. Consult the examples in the note to s 5 if borderline.
   • Check the exclusions in s 6(2): if the item is a beach ball, surfboard, bodyboard, kickboard, inflatable air bed, or an inflatable boat intended for deep water, this safety standard does not apply.

2. Determine the applicable technical route:

   • During the transitional period, decide whether to rely on the prior 2009 standard (Consumer Protection Notice No 2 of 2009) or on the new Part 3 requirements (s 7(1)). Maintain records showing the chosen compliance path for each product batch placed on the market during the transitional window.
   • After the transitional period, ensure full compliance with Part 3; the 2009 standard will no longer be an option (s 8).

3. Obtain and apply the referenced standard text:

   • Acquire or arrange viewing access to AS/NZS ISO 8124.1:2019 or ISO 8124‑1:2018, as applicable (s 5 definitions; notes to ss 10-11). Clause 4.20 of the chosen standard is the operative technical clause.
   • Identify all requirements in clause 4.20 relevant to the product’s design, materials, dimensions and warning content and placement. Because the instrument does not reproduce clause 4.20, the standards text is the definitive specification.

4. Implement the required modification to Annex B.2.6:

   • Where Annex B.2.6 of the chosen standard uses the phrase "should carry," treat the corresponding obligation as mandatory because the instrument replaces "should carry" with "shall carry" (ss 10(2), 11(2)). Ensure the product warning carries the content and placement required by that annex as a binding obligation.

5. Meet the warning-formatting requirements in s 12:

   • Ensure the warning is in English, clearly legible, clearly visible and indelible. That means choose materials and printing methods that resist fading and abrasion, select font sizes and contrast that are legible at normal viewing distance, and place the warning where it will be visible in ordinary use (s 12).
   • Where the standard’s clause 4.20 or Annex B.2.6 specify additional pictograms, sequence or wording, ensure those requirements are implemented together with the s 12 formatting duties.

6. Retain documentary evidence:

   • Keep technical test reports, design records, label proofs, production samples and statements of conformity that show compliance with clause 4.20 (and the modified Annex B.2.6) and with s 12 formatting rules.
   • During the transitional period and thereafter, be prepared to respond to a regulator request to nominate which standard variant is relied upon (note to s 9 referring to s 108 of the ACL). Retain the information that demonstrates the product’s compliance route.

7. Inventory management and product transition:

   • If holding stock compliant only with the 2009 standard, decide whether to sell remaining stock during the transitional period relying on the 2009 route or to transition inventory to meet Part 3 earlier. Plan for the end of the transitional period so that products placed on the market after that date comply with Part 3 (s 7(1)-(2); s 8).

8. Quality assurance and supplier control:

   • If using contract manufacturers or overseas suppliers, include contractual obligations requiring adherence to clause 4.20 and to the modified Annex B.2.6, and require pre-shipment inspection or testing that verifies warning legibility, visibility and indelibility per s 12.
   • Ensure incoming goods inspections check for the presence and durability of the required warnings and for any specified safety features under clause 4.20.

9. Engage testing and certification providers:

   • Arrange testing against clause 4.20 with accredited testing bodies and obtain reports that document compliance. Because the instrument incorporates external standards, test methods and acceptance criteria in those standards should be used.

10. Monitor regulatory interaction:

    • Be ready to respond to regulator information requests under the ACL (note to s 9). Keep contact records and compliance dossiers so the supplier can quickly nominate the chosen standard and present supporting evidence if requested.

This compliance pathway is constrained to the obligations established in the instrument: compliance with clause 4.20 of the adopted standard (with Annex B.2.6 modified to require that certain warnings "shall carry") and compliance with the English, legible, visible and indelible warning-formatting requirements (ss 9-12). It does not attempt to restate or replace the testing, enforcement and evidentiary detail that may be required by the ACL in practice; suppliers should assume that the ACL enforcement regime will require documentary proof of conformity where queried, and that the instrument’s incorporation by reference makes the external standard texts the definitive technical specification.
