306 Civil consequences of breach of breach of section 247
If a pawnbroker's licence or a pawnbroker/second-hand dealer's
licence is not held by a person who acts as a pawnbroker, the other
party to a contract with that person:
(a) is not liable to repay the money lent to him or her or to pay any
interest or any charge in connection with the contract; and
(b) is entitled to recover the goods the subject of the contract; and
(c) if he or she has paid or repaid any amount referred to in
paragraph (a), may recover the amount in a court of
competent jurisdiction as a debt due to him or her by the
person acting as a pawnbroker.
