240 Undertakings by persons contravening code
(1) Where it appears to the Commissioner that a person has carried on
business in contravention of a code of practice applicable to the
person, the Commissioner may request the person to execute
within a specified time a deed in terms approved by the
Commissioner under which the person gives undertakings as to:
(a) discontinuance of the conduct; and
(b) future compliance with the code of practice; and
(c) the action the person will take to rectify the consequences of
the contravention;
or any of those matters.
(2) A person who fails to observe an undertaking given in a deed
executed under subsection (1) is guilty of an offence.
