96 Consequences of incurring demerit points—applicant for
issue or renewal of licence
(1) This section applies to a licensee if—
(a) the licensee applies to the registrar for a licence (including the
renewal of a licence) for a construction occupation; and
(b) the licensee has incurred 15 or more demerit points for the
construction occupation within the previous 3 years.
(2) The registrar may refuse the licensee’s application and serve a notice
of licence disqualification on the licensee under section 98.
(3) The registrar may only take action under subsection (2) if satisfied
that the public would be at risk if the licensee were allowed to provide
the construction services authorised by the licence.
