84 Certain entities not to provide construction services
(a) provides a service (whether as an employee or otherwise) in a
construction occupation or occupation class; and
(i) is not licensed in the occupation or class; or
(ii) if an endorsement on the licence is required for the person
to be authorised to provide the service provided and the
licence does not have that endorsement.
(a) provides a service in a construction occupation or occupation
class; and
(i) is not licensed in the occupation or class; or
(ii) if an endorsement on the licence is required for the
partnership to be authorised to provide the service provided
and the licence does not have that endorsement.
(3) This section does not apply if—
(a) an individual provides the service, whether directly or for an
entity; and
(b) the individual is working under the supervision of a licensee
whose licence authorises the provision of the service; and
(c) the licensee is not required by a condition or endorsement on the
licence to provide the service as an employee or under
supervision; and
(d) a regulation allows the service to be provided by an individual
without a licence if provided under the supervision of a licensee.

(4) Also, this section does not apply to an entity if—
(a) the entity provides an electrical wiring service; and
(b) the entity—
(i) is an exempt regulated utility; or
(ii) provides the service for an exempt regulated utility.

(6) An offence against this section is a strict liability offence.
exempt regulated utility means a regulated utility exempted from the
Electricity Safety Act 1971 by an exemption under that Act,
section 62B.
