40 Obligation to notify – person for whom work carried out (1) The person for whom construction work is to be carried out must give notice to the Board about the work in an approved form before the work starts. (2) Subsection (1) does not apply if: (a) no levy is imposed on the work because of section 32(1); or (b) the work or the person is exempt by the Regulations for this section. (3) A person who contravenes subsection (1) is guilty of an offence.
