#### 39 Issue of warrants if charge not laid 39 Issue of warrants if charge not laid > A warrant may be issued under this Part in relation to property whether or not a person has been charged with the relevant serious offence, but an authorised officer shall not issue a warrant under this Part in relation to property where a person has not been charged with the relevant serious offence unless the authorised officer is satisfied— > > > (a) that the property is tainted property, and > > > (b) that it is likely that a person will be charged within 48 hours with the relevant serious offence. > > **s 39:** Am 2002 No 103, Sch 4.12 \[5\].
