44 Offences
(1) A person shall not: (a) fail to attend before the Ombudsman; (b) refuse or fail to be sworn or make an affirmation; (ba) refuse or fail to furnish information; or (c) refuse or fail to answer a question or produce a document or record; when so required in pursuance of this Part.
Penalty: Imprisonment for 6 months.
(1A) Subsection (1) does not apply if the person has a reasonable excuse.
Note: A defendant bears an evidential burden in relation to the matter in subsection (1A) (see subsection 13.3(3) of the Criminal Code).
(3) A reference in this section to the Ombudsman includes a reference to a Deputy Ombudsman.
