### 43 Temporary exemption from pecuniary penalties
> > (1) A person is not liable to a pecuniary penalty under the Code for conduct that happens within 2 years after the day on which the [Competition Policy Reform Act 1995](/view/html/inforce/2026-04-12/act-9999-999) of the Commonwealth received the Royal Assent.

> > (2) If the commencement of provisions of this Act is postponed under [section 2](#GS2@EN) , the period of 2 years mentioned in this section is extended by the same number of days.
