#### 6FA Approval of competitive tender process for construction and operation of a facility—content of application (1) For paragraph 44PA(2)(b) of the Act, this regulation sets out requirements for an application for approval of a tender process, for the construction and operation of a facility that is to be owned by the Commonwealth, State or Territory, as a competitive tender process. (2) The application must state: (a) the contact details of the Commonwealth Minister, or the responsible Minister of a State or Territory, who is the applicant; and (b) details of the proposed facility, including its nature and proposed location; and (c) details of the proposed tender process, including: (i) the minimum requirements which a tender will be required to meet before being considered under the tender process; and (ii) the selection criteria that will be used to select the successful tenderer; and (iii) the date for the calling for tenders; and (iv) the closing date for the submission of tenders; and (v) the date by which the successful tenderer is to be selected; and (vi) the date by which the contract or arrangement resulting from the tender process will be entered into; and (d) the reasons why the tender process satisfies the requirements specified in subsection 44PA(4) of the Act.
