42Notice of the happening of an affecting event

#### 42 Notice of the happening of an affecting event (1) A notice under section 10.40 or 10.43 of the Act of the happening of an affecting event must: (a) be in accordance with Form 4 in Schedule 3; and (b) in the case of a notice under section 10.40 of the Act—be given to the Registrar as soon as practicable after a party to the conference becomes aware of the event; and (c) in the case of a notice under section 10.43 of the Act—be given to the Registrar within 30 days after a party to the conference agreement becomes aware of the event. (2) The following particulars are specified for the purposes of Form 4: (a) the date of the happening of the event; (b) whether subparagraph 10.40(1)(b)(i) or (ii) applies to the event; (c) details of the happening of the event; (d) the effect of the event on the operation of the agreement; (e) for an outwards conference agreement—the effect of the event on the provision of outwards liner cargo shipping services; (f) for an inwards conference agreement—the effect of the event on the provision of inwards liner cargo shipping services.
