What it does
This instrument, the Competition and Consumer (Price Inquiry,Child Care) Direction 2022, directs the Commission to conduct a targeted price inquiry into the market for the supply of child care services under the Competition and Consumer Act 2010 (the Act). Mechanically, it does four things.
First, it creates an obligation on the Commission to hold an inquiry into the market for the supply of child care services (section 5(1)). The inquiry is constrained by express exclusions: it must not extend to supplies by a State or Territory authority (s 5(1)(a)), it must not generally review the operation of other Australian laws relating to approved child care services except insofar as necessary to consider the matters listed in section 6 (s 5(1)(b)), and it must not review Commonwealth-funded programs or Commonwealth policies, again except to the extent those policies concern competition and consumer protection or are necessary for consideration of the s 6 matters (s 5(1)(c)). Second, the Direction limits the subject of the inquiry to goods and services that are approved child care services as defined by the Family Assistance legislation (s 5(2)). Third, the inquiry is required to be general in nature and not targeted at the supply of goods and services by a particular person or persons (s 5(3)). Fourth, the Direction prescribes a list of matters the Commission must take into consideration (s 6), sets two interim report dates to the Treasurer (s 7), and fixes the completion date and final report deadline to the Treasurer as 31 December 2023 (s 8).
The Direction adopts a definitional backbone that imports meanings from other statutes: approved child care service (A New Tax System (Family Assistance) (Administration) Act 1999), child care subsidy (A New Tax System (Family Assistance) Act 1999), not-for-profit (Charities Act 2013), and the terms goods, services, price, supply, inquiry and State or Territory authority from subsection 95A(1) of the Act (s 4). The Direction is itself made under the Act (s 3), invoking the Commission’s inquiry powers in ss 95H, 95J and 95K as referenced in s 5 and s 8.
