52 Costs of horticulture produce assessors

(1) If a horticulture produce assessor is appointed under clause 49 in relation to a matter arising under a horticulture produce agreement, the parties to the agreement must pay half of the assessor’s costs arising out of the appointment, unless the parties agree otherwise. (2) If a mediator, as part of a mediation under Part 5, appoints a horticulture produce assessor, each of the parties to the mediation must pay half of the assessor’s costs arising out of that appointment, unless the parties agree otherwise.
