34 Ownership of horticulture produce
The ownership of the horticulture produce passes from the grower to the merchant: (a) if the price of the produce, or a method or formula to calculate the price, has been agreed to by the merchant and grower before delivery—on delivery of the produce to the merchant; or (b) if paragraph (a) does not apply, and the merchant is to perform a service in relation to the produce—at the time the service is completed; or (c) if paragraphs (a) and (b) do not apply—at the time that the merchant and the grower agree on a price for the produce.
