39 Prohibition on release from liability etc.
(1) A franchisor must not enter into a franchise agreement that requires a franchisee to sign: (a) a general release of the franchisor from liability towards the franchisee; or (b) a waiver of any verbal or written representation made by the franchisor.
Civil penalty: 600 penalty units.
(2) However, subsection (1) does not prevent a franchisee from settling a claim against the franchisor after entering into a franchise agreement.
