74 Confidentiality—Code Mediators

(1) A Code Mediator must not disclose to a large grocery business any information that is reasonably capable of being used to identify a supplier in connection with the performance of any of the Code Mediator’s functions, unless: (a) the supplier has expressly consented to the disclosure; or (b) if the disclosure relates to a complaint the supplier has against the large grocery business—the supplier and the large grocery business have each notified the Code Mediator in accordance with subparagraph 54(5)(d)(i) that they agree to a proposed remedy for dealing with the complaint. (2) A Code Mediator must observe any confidentiality requirements relating to information disclosed or obtained in connection with the performance of any of the Code Mediator’s functions.
