sec.102 When grants under the Family Services Act continue
This section applies to a service provider that, at the commencement, is providing community services with funding received by way of a grant from the department to the service provider under the Family Services Act 1987 . Subject to subsections (3) and (6), the service provider may continue to receive the funding under this Act. Subsection (2) does not apply if the funding was one-off funding. Any conditions to which the grant was subject under the Family Services Act 1987 continue to apply to the funding. If the service provider has, before the commencement, signed an agreement in relation to a grant under the Family Services Act 1987 , that agreement— is taken to be a service agreement under this Act; and is taken to include a show cause process for a breach of the agreement that allows the chief executive to suspend or stop the assistance under the agreement. If the service provider has not signed an agreement in relation to a grant under the Family Services Act 1987 before the commencement, funding must stop 1 year after the commencement unless— the Minister approves assistance under this Act; and a service agreement is signed by the service provider. No compensation is payable to a service provider if assistance to the service provider stops under subsection (6). s 102 prev s 102 om 2010 No. 5 s 73 (sec.102-ssec.1) This section applies to a service provider that, at the commencement, is providing community services with funding received by way of a grant from the department to the service provider under the Family Services Act 1987 .
