### 45 Confidentiality > > (1)  Except as otherwise provided by this section, a person who has access to any information contained in the Register must not intentionally disclose or cause the disclosure of that information. > > > > Penalty:  Fine not exceeding 100 penalty units or imprisonment for a term not exceeding 2 years, or both. > > > (2)  A person may only disclose information contained in the Register in one or more of the following cases: > > > > > > (a) in the course of the person's duty; > > > > > > > (b) for the purposes of the investigation of any offences or other offences generally; > > > > > > > (c) as required or authorised by or under this Act or another written law; > > > > > > > (d) for the purpose of proceedings for an offence under this Act; > > > > > > > (e) with the written authority of the Minister or the person to whom the information relates; > > > > > > > (f) in other circumstances prescribed by the regulations. > > > (3)  The prohibition in [subsection (1)](#GS45@Gs1@EN) extends to the giving of evidence or the production of a book, document or record in civil proceedings in a court or tribunal.
