74A Duties of facilities managers

74A Duties of facilities managers

(1) A facilities manager must not, without reasonable excuse—

(a) fail to act in the best interests of the association, or

(b) breach a duty prescribed by the regulations.

Maximum penalty—

(a) for an individual—100 penalty units, or

(b) otherwise—200 penalty units.

(2) A facilities manager is not required to act in the association’s best interests if it would be——

(a) contrary to this Act or the regulations, or

(b) otherwise unlawful.

(3) The regulations may prescribe additional duties of facilities managers.
