#### 137 Notice by association to owner or occupier 137 Notice by association to owner or occupier > > (1) An association may give a notice, in a form approved by the Secretary, to the owner or occupier of a lot in the scheme requiring the owner or occupier to comply with a specified by-law if the association is satisfied that the owner or occupier has contravened the by-law. > > > (2) The notice must contain a copy of the specified by-law. > > > (3) If a notice given to a person relates to a breach by the person of a condition of an association property rights by-law or a failure to pay an amount under an association property rights by-law— > > > > > (a) the person ceases to be entitled to use the restricted property until the notice is complied with or, whether the notice is complied with or not, if the management statement is amended to remove the person’s right to use the property, and > > > > > (b) the person is not entitled to vote on a motion to amend the management statement in so far as it relates to the restricted property.
