#### 51 Notice of decision of planning authority and appeal 51 Notice of decision of planning authority and appeal > > (1) If a planning authority does not approve an amendment of a development contract, the planning authority must give the applicant for the approval a notice stating— > > > > > (a) the grounds for the refusal, and > > > > > (b) the applicant may appeal to the Land and Environment Court against the refusal, and > > > > > (c) the period within which the appeal may be made. > > > (2) The applicant may appeal to the Land and Environment Court against the refusal within 12 months after receiving the notice. > > > (3) However, the Land and Environment Court may, if it considers it appropriate in the circumstances, extend the period for making the appeal. > > > (4) A decision of the Land and Environment Court on appeal is taken to be the final decision of the planning authority and is to be given effect as if it were the decision of the planning authority.
