Community Justice Centre Act 2005

The Act organises three principal concepts: mediation as a service model, a hybrid adjudication route linked to the CCSP Act, and an advisory/oversight Council that sets operational Guidelines.

1. Mediation services and structure: The Centre exists to provide mediation services (s 8(a)). A mediator is either the Director or persons engaged under s 10. Mediators must hold prescribed qualifications (s 10(3)). Mediation sessions are defined expansively to include arranging, conducting and follow‑up activities (s 5 definition of mediation session). The rules aim for low formality and expedition (s 15(7)). Parties must apply in an approved form (s 13(2)-(3)); the Director has decision-making power to accept or refuse (s 13(3)). Participation is voluntary and non‑binding, except for any agreement the parties reach (s 16).

2. Confidentiality, inadmissibility and privilege: The Act shields mediation communications from admissibility in proceedings and defamation claims in a way that mirrors judicial‑style protection. Section 34 makes statements, documents and records created for a mediation session inadmissible as evidence in proceedings where evidence is taken on oath. Section 35 treats a mediation session and documents produced in it as if they were a judicial proceeding or proceeding document for defamation privilege. Section 36 creates broad secrecy obligations for certain officeholders (Director, mediators, Centre employees, Council and Committee members), with specific exceptions (administration of the Act, required by law, protection of persons/property, consented disclosure, and prescribed persons) and criminal penalties for breaches (s 36(3)-(4)). Section 37 allows the Director to require parties to sign confidentiality agreements and makes breach an offence with the same maximum penalty (s 37(3)).

3. Integration with CCSP Act adjudication: The Act deliberately links the Centre into the CCSP Act adjudication regime. Definitions in Part 4 adopt CCSP terms (s 18(2)). The Director is “taken to be” a prescribed appointer (s 19), but the Director may only act where specified thresholds and fee payment conditions are met (s 20(2)). The lodgment fee is prescribed in the Act as $500 unless Regulations alter it (s 20(3)). The Director may appoint a person who is not a registered adjudicator provided the person has suitable qualifications and experience and the dispute is appropriate (s 20(4)-(5)), and that person is treated as a registered adjudicator for CCSP Act purposes (s 20(5)). The Act constrains the monetary reach of adjudicators under s 22 by forbidding determinations that would produce a total payable/returned security equal to or exceeding an amount prescribed by regulation (s 22(1)).

Supporting concepts:

• Governance and oversight: The Community Justice Consultative Council (Council) is a statutory body of seven ministerially appointed members (s 24). The Council makes Guidelines that the Director must have regard to (ss 9(4)(a), 26). The Minister can direct the Council on the exercise of powers but not on the content of Council reports or actions on complaints (s 28).

• Delegation and staffing: The Director may delegate powers except those arising from Part 4 (s 11(1)). Mediators are public sector employees or engaged on CEO-approved terms (s 10(2)), and the Director is required to be a public sector employee (s 9(3)).

• Procedural and administrative machinery: CEO approves forms (s 31), the CEO must conduct a statutory review within five years (s 32), annual reporting is required (s 39), and Regulations may fill in procedural and appointment details (s 40).

These concepts establish a mediation-focused agency with mandated confidentiality, ministerially appointed oversight and a constrained role in commercial adjudication under the CCSP Act.

Primary actors:

• Parties to disputes: Any two or more persons in disagreement on a matter are "parties" and may apply for mediation services (s 6(1)-(2); s 13(1)). Parties seeking adjudication under the CCSP Act may also involve the Centre where statutory thresholds and lodgment payment requirements are met (s 20).

• Mediators and Centre employees: The Director (s 9) and mediators engaged under s 10 are affected by the Act’s duties, qualifications requirement (s 10(3)), delegation rules (s 11) and secrecy/confidentiality obligations (ss 33-37). Centre employees who are not mediators are defined and specifically included for assistance functions (s 9(5)(b)).

• The Director and CEO: The Director is the operational head, appointed by the CEO and required to be a public sector employee (s 9(2)-(3)). The Director has discretion to accept or refuse mediation applications (s 13(3)), to direct mediators (s 15(1)(b)), to require confidentiality agreements (s 37(1)), and to act as a prescribed appointer under the CCSP Act in defined circumstances (ss 19-20).

• Minister and the Community Justice Consultative Council: The Minister appoints the Council members (s 24(2)) and may direct the Council (s 28) except in relation to the content of reports or complaint actions. The Council (s 24) sets Guidelines (s 25(a)) which the Director must have regard to (s 9(4)(a)), deals with complaints (s 25(b), s 27) and may make reports and recommendations to the Minister (s 25(c)).

• Construction industry parties: Builders, contractors, subcontractors and suppliers who use the CCSP Act adjudication pathway can be affected because the Centre is available as a statutorily recognised appointer under limited conditions (Part 4, ss 18-23). The Act imposes a lodgment fee requirement and a cap on the monetary quantum that the Director may accept for adjudication (s 20(2), s 22(1)).

• Courts, tribunals and other bodies: The Act excludes mediation-generated statements, documents and records from admissibility as evidence in “any proceedings before a court, tribunal or any other body that has the power to take evidence on oath” (s 34). However, secrecy obligations have defined exceptions, and the Centre’s adjudication role imports some CCSP Act publication obligations (s 20(5) note).

Secondary actors and affected interests:

• Legal advisers and representatives: The Act restricts participation in sessions to parties and certain nominated support persons unless the Director permits others (s 15(5)-(6)). Party representation rules for bodies corporate are narrowly drawn (s 17). Advisers will need to navigate confidentiality agreements (s 37) and secrecy obligations on Centre officers (s 36).

• Administrative and regulatory actors: The CEO, as approval authority for forms (s 31) and the officer required to undertake the 5‑year review (s 32), and the Administrator by regulation-making power (s 40), must carry out administrative tasks and produce reviews and annual reports (s 39).

• The Crown and public sector entities: The Act expressly binds the Crown (s 4), and s 38 permits persons already employed or engaged under other Acts to be appointed to roles under this Act despite existing limitations.

Who pays and who decides:

• Who pays: The Act does not specify a fee for mediation; it does specify a lodgment fee for CCSP adjudication (s 20(3)), which is to be shared equally by parties to the adjudication unless the adjudicator orders otherwise (s 21(1)-(2)). Criminal penalties for specified breaches (use of name, secrecy, confidentiality agreement breach) are expressed in penalty units (ss 12, 36, 37).

• Who decides: The Director decides whether to accept an application for mediation (s 13(3)) and acts as the Centre’s executive. The Council decides Guidelines (s 26). The Minister appoints Council members and can direct the Council (s 24(2), s 28). For CCSP adjudications, the Director appoints adjudicators and may appoint non‑registered adjudicators where the Director is satisfied of their qualifications (s 20(4)).

Geographical and subject-matter reach:

• The Act applies in the Northern Territory and, to the extent of legislative competence, binds the Crown (s 4). Subject matter is broad as to disputes (s 6 definition), but the specific adjudication mechanics apply only to payment disputes under the CCSP Act (Part 4). The Guidelines can shape the scope of services (s 26).

This section sets out the statutory duties imposed on actors and the statutory rights available to parties, constrained to what the Act provides.

Key duties

• Director’s duties: The Director must be appointed by the CEO and be a public sector employee (s 9(2)-(3)). The Director must exercise powers and perform functions for purposes of the Centre with regard to the Guidelines (s 9(4)(a)). The Director also must exercise functions arising under the CCSP Act as provided by Part 4 (s 9(4)(b)). The Director may delegate powers or functions (except those under Part 4) in writing to mediators or Centre employees (s 11(1)-(2)).

• Mediator duties: Mediators must hold prescribed qualifications (s 10(3)) and must have regard to the Guidelines when conducting sessions (s 15(2)). Mediators must not adjudicate or arbitrate disputes in a mediation session (s 15(4)), and must conduct sessions with as little formality and technicality and as much expedition as possible (s 15(7)).

• Secrecy and confidentiality duties for officers: Section 36 imposes a statutory duty on the Director, mediators, Centre employees, Council and Committee members not to record, disclose, publish or produce information obtained in exercising powers or performing functions under this Act, subject to enumerated exceptions (s 36(2)-(3)). Breach attracts criminal liability (maximum 400 penalty units or two years imprisonment) (s 36(4)). Section 37 gives the Director power to require parties to sign confidentiality agreements prohibiting recording, disclosure and publication, with the same criminal penalties for contravention (s 37(1)-(3)).

• Council duties: The Council must make Guidelines consistent with the Act (s 26(1)), notify the making of Guidelines by Gazette and inform Minister, CEO and Director (s 26(3)-(4)), and consider complaints about service delivery (s 27).

• Procedural duties for adjudications: Where a party serves a written application under s 28 of the CCSP Act on the Director, the Director must carry out the actions in s 30(1)(a)-(c) of the CCSP Act within five working days if conditions are satisfied (s 20(1)-(2)). The Director must not act if conditions are not met (s 20(7)(a)).

Key rights

• Parties’ rights to apply for mediation: Parties to a dispute may apply to the Director to provide mediation services, in the approved form (s 13(1)-(3)). If the Director accepts the application, mediation services may be provided (s 13(4)).

• Voluntariness and withdrawal rights: The attendance of a party at a mediation session is voluntary and a party may withdraw at any time (s 16(1)-(2)). Except for agreements reached in a session, the session does not affect rights or create obligations that bind a party (s 16(3)).

• Representation rights: A body corporate party may be represented by an officer if it is a corporation as defined in s 57A of the Corporations Act 2001, otherwise by a person nominated by the body corporate (s 17(1)). The Director may impose requirements for representatives and may disqualify persons from being a representative if they contravene those requirements (s 17(2)).

• Right to complaint and review: A party who received mediation services may complain to the Council about the manner in which services were provided (s 27(1)). The Council can review, recommend Director action, or amend Guidelines in response (s 27(4)).

• Adjudication rights under CCSP linkage: Where the Act’s conditions are satisfied (s 20(2)), a party has the right to have the Director carry out appointer actions under the CCSP Act (s 20). Parties to an adjudication are liable to pay an equal share of the lodgment fee but may seek redistribution through the adjudicator (s 21(1)-(2)).

Limitations and constraints

• Director discretion: The Director’s acceptance of mediation applications is conditional on having regard to Guidelines (s 13(3), s 9(4)(a)). The Director may terminate services at any time (s 14).

• Limit on participation and legal representation: A non-party cannot participate in a session except with permission of the Director (s 15(5)). The Act does not grant an automatic right to legal counsel to be present; that is a matter for the Director’s permission or the Guidelines.

• Limits on adjudicator power: An adjudicator must not make a determination that would produce a total payable/returned security equal to or exceeding an amount prescribed by regulation (s 22(1)), thus capping the monetary exposure in adjudications under this Part.

• Exclusions from secrecy: The secrecy obligations do not apply to powers or functions under the CCSP Act arising from Part 4 (s 36(5)), which allows CCSP Act publication or disclosure obligations to operate.

Administrative duties and reporting

• CEO review and reporting: The CEO must conduct a review within five years of commencement covering the Act, Centre and Council and must prepare a report and give it to the Minister, who must table it (s 32).

• Annual reporting: The CEO must prepare an annual report on operation of the Act for each financial year and give it to the Minister within three months after the end of the year (s 39).

These duties and rights structure how mediations are offered and controlled, the confidentiality regime that protects mediation communications, and the narrow gateway through which the Centre engages with construction payment adjudication.

The Act sets out a mix of civil and criminal consequences, administrative enforcement mechanics, and process‑level enforcement through adjudication and Council oversight.

Criminal penalties and penalty units

• Use of the Centre’s name: Section 12(2) prohibits use of the words "Community Justice Centre" in the name of an organisation other than the Centre, with a maximum penalty of 100 penalty units.

• Secrecy breaches: Section 36(4) makes contravention of the general secrecy obligations an offence punishable by a maximum penalty of 400 penalty units or imprisonment for 2 years. The secrecy obligations extend to recording, disclosing, publishing or producing information obtained in exercising a power or performing a function under the Act (s 36(2)). Section 36(3) lists exceptions.

• Confidentiality agreement breach: If the Director requires a confidentiality agreement, breach of that agreement is an offence with the same maximum penalty as secrecy breaches (400 penalty units or 2 years imprisonment) (s 37(3)).

Criminality vs. administrative supervision

• Protection from liability for good faith acts: Section 33 provides that the Director, mediators, Centre employees, Council members and Committee members are not civilly or criminally liable for acts or omissions done in good faith in exercise or purported exercise of powers or functions under the Act. That protection, however, does not extinguish any liability the Territory would have had apart from s 33(2).

• Enforcement of confidentiality and secrecy: The Act imposes criminal enforcement for unauthorised disclosure or recording by specified officeholders. The Director may also impose confidentiality agreements on parties and criminal penalties apply for non-party breach of such agreements, giving the Director administrative leverage over participants.

Adjudication enforcement mechanisms

• Lodgment fee and payment reallocation: For adjudications under Part 4, each party is liable for an equal share of the lodgment fee (s 21(1)). If one party pays more than their equal share, the adjudicator may decide another party must pay to equalise the shares (s 21(2)). If the adjudicator makes such an order, the adjudicator must include the payable date and parts of the CCSP Act (Part 3 Division 4 and 5) apply to the decision as if it were a determination of an appointed adjudicator (s 21(3)), thereby importing CCSP Act enforcement mechanics.

• Adjudicator monetary cap and limitation on costs orders: Section 22(1) prevents adjudicators making determinations that would result in total amounts payable and securities returned equalling or exceeding an amount prescribed by regulation. Section 23 modifies cost consequences by disapplying s 46 of the CCSP Act for adjudications arising under this Part (s 23(1)), and by excluding application of s 55 of the CCSP Act to the Director and adjudicator (s 23(2)). Those disapplications alter who can recover costs, and limit cost awards against the Director and adjudicator.

Complaint handling and oversight

• Council complaint process: Parties may complain to the Council about the manner in which mediation services were provided (s 27(1)). The Council may review the complaint, recommend Director action, or amend Guidelines (s 27(4)). The Council has delegated powers and may establish committees to exercise functions (s 29-30). The Minister may give directions to the Council except on content of Council reports and actions taken regarding complaints (s 28).

Regulatory and reporting enforcement

• Regulations and forms: The Administrator may make Regulations for matters necessary or convenient to carry out the Act (s 40), and the CEO may approve operational forms (s 31). The CEO must conduct a statutory review within five years and provide a report to the Minister, who must table it (s 32). The CEO must also prepare annual reports for tabling (s 39). These mechanisms create administrative enforcement through oversight and review.

Interaction between secrecy, evidence rules and CCSP obligations

• Evidence exclusion and defamation privilege: Section 34 renders mediation statements, documents and records inadmissible in proceedings before bodies with power to take evidence on oath. Section 35 extends defamation privilege to mediation sessions and session documents as if they were judicial proceedings. These protections reduce legal exposure for parties and mediators, but do not necessarily immunise against statutory disclosure requirements where an exception applies.

• Secrecy exceptions and CCSP transparency: The secrecy provisions exclude disclosure that is "required by another law" (s 36(3)(c)), and, importantly, s 36(5) specifies that secrecy duties do not cover powers or functions arising from Part 4 (the CCSP linkage). That carve-out aligns with the CCSP Act’s own publication and enforcement obligations and ensures that adjudication outputs required to be public under the CCSP Act are not insulated by s 36.

Enforcement focus and limits

• The Act emphasises administrative control and confidentiality, criminalising certain breaches by officials and parties, while offering statutory immunity for good-faith exercise of powers. It creates internal oversight via the Council complaints process and public accountability through required reports and the CEO review. For adjudication, the Act retains CCSP Act enforcement pathways where it imports CCSP processes, but it narrows cost recovery possibilities and imposes specific monetary and procedural thresholds.

The Act deliberately cross-references and modifies the operation of the Construction Contracts (Security of Payments) Act 2004 (CCSP Act) and intersects with general administrative, defamation and criminal law frameworks. The interaction points are explicit in the text.

Direct incorporation and modification of the CCSP Act

• Definitions and shared terminology: Part 4 imports defined terms from the CCSP Act for use in the Act’s adjudication provisions (s 18(2)). Terms like adjudicator, adjudication, construction contract, payment claim and payment dispute are given the same meaning as in the CCSP Act for Part 4 purposes.

• Director as prescribed appointer: Section 19 makes the CCSP Act operate as if the Director were a prescribed appointer, subject to the conditions and modifications in Part 4.

• Conditions and thresholds: Section 20 modifies how the Director acts as appointer: the Director must carry out the s 30(1)(a)-(c) actions of the CCSP Act within five working days only when the payment claim amount is below an amount prescribed by regulation and the lodgment fee is paid (s 20(2)). If these conditions are not met, the Director must not act and CCSP Act s 30(2) and (3) apply (s 20(7)). This supplies a statutory gateway into the CCSP scheme for matters that meet a monetary threshold and fee condition.

• Appointment of non-registered adjudicators: Section 20(4) permits the Director to appoint a person who is not a registered adjudicator if satisfied of relevant qualifications and that the dispute may be adjudicated by that person. Section 20(5) makes the CCSP Act operate as if such person were a registered adjudicator; the note to s 20(5) points out that registrars must make a decision or report available under CCSP s 54.

• Cost and power limitations: Section 22 places a cap on adjudicator determinations by reference to a regulation-prescribed amount, prohibiting awards that would result in the total of the amount to be paid and the security to be returned equalling or exceeding that amount (s 22(1)). Section 23 disapplies CCSP s 46 for adjudications arising under this Part and excludes s 55 of the CCSP Act from operating against the Director and adjudicator (s 23(1)-(2)). Those adjustments restrict cost-shifting and exposure compared with the CCSP Act's general operation.

Secrecy, admissibility and defamation law

• Evidence exclusion: Section 34 renders mediation statements, documents and records inadmissible as evidence in proceedings before courts, tribunals or other bodies that take evidence on oath. This modifies evidentiary availability alongside ordinary laws of evidence.

• Defamation privilege: Section 35 declares that mediation sessions and documents have the same privileged status for defamation purposes as judicial proceedings and proceeding documents. This intersects with the Territory defamation statutes and common-law privilege doctrines by equating mediator‑generated content with judicial proceedings for privilege purposes.

• Statutory disclosure exceptions: Section 36(3) recognises that secrecy obligations yield to other legal obligations by allowing disclosure "required by another law". Section 36(5) clarifies that secrecy obligations under s 36 do not apply to powers or functions arising from Part 4 (ie CCSP functions), preserving CCSP Act transparency or publication rules where applicable.

Administrative and public sector law

• Public sector employment: The Director and mediators must be public sector employees or engaged on CEO-approved conditions (ss 9(3), 10(2)), and s 38 expressly allows appointments despite restrictions in other Acts on employment or engagement. Section 24(5) excludes application of the Public Sector Employment and Management Act 1993 to Council member appointments.

• Forms, regulations and review: The CEO approves forms (s 31), the Administrator can make Regulations for matters consistent with the Act (s 40), and the CEO must conduct a statutory review within five years (s 32) and prepare annual reports (s 39). These provisions align the Centre’s operation with Territory administrative machinery.

Transitional and savings interplay

• Savings provision: Section 41 preserves mediations commenced before the Act for or by the earlier departmental Community Justice Centre, allowing them to continue and not be affected by the Act even where participants or procedures did not comply with the Act (s 41(2)-(3)). That provision ensures continuity of pre-existing processes.

Limits on interaction and carve-outs

• Part 4 carve-out from delegation and secrecy rules: Delegation under s 11 excludes delegation of Part 4 powers, and secrecy s 36(5) excludes CCSP Part 4 functions from the secrecy obligations. These carve-outs keep adjudication under the CCSP Act more aligned with that Act’s governance and transparency requirements rather than the Centre’s secrecy regime.

What the Act does not do (by omission)

• The Act does not itself specify charging arrangements for mediation services (no mediation fee regime in the text), meaning fees, if any, must come from regulations or administrative practice. The only explicit monetary amount is the lodgment fee for CCSP adjudication, set at $500 unless the Regulations prescribe another amount (s 20(3)).

• The Act does not set out the content of Guidelines; the Council is given broad power to make them (s 26). The Act also does not specify the precise prescribed qualifications for mediators (s 10(3)), which are left to subordinate instruments.

Consequences for legal practice and procurement

• Where a payment dispute is to be adjudicated under the CCSP Act, parties and advisers must be alert to the Centre’s thresholds, lodgment fee requirement and the altered cost regime when the Centre is the appointer (ss 20-23). The Act’s confidentiality and secrecy frameworks require parties to structure evidence-gathering and legal strategies to account for inadmissibility and restricted disclosure in mediation, but also to note the carve-out for CCSP adjudication material (s 36(5)).

Overall, the Act interfaces closely with the CCSP Act for construction payment matters, creates a mediation environment with statutory confidentiality and privilege protections, and is embedded in Territory administrative law via CEO, Minister and Regulations functions.

• The 2019 amendments explicitly altered the operation of Part 4 to align the Centre’s role with changes to the CCSP Act, including monetary thresholds, limitations on adjudicator awards, and the Director’s capacity to appoint adjudicators (ss 20-22 as amended by No. 27, 2019).

Where to check for further updates

• The Act’s Endnotes provide the reprint position as at 3 February 2020; users should consult the Territory Government’s legislation website and the Gazette for any amendments or regulations made after that date, including the Regulations that can prescribe amounts and detail Guidelines or prescribed qualifications referenced in the Act (ss 20(3), 10(3), 26, 40).

This summary is drawn from the Act’s Endnotes and the List of Amendments appended to the reprint; it does not assert any legislative changes beyond those recorded there.

The reprinted Act text provided does not contain or cite any case law, judicial decisions, or adjudication reports arising from operation of the Centre or from disputes under the CCSP Act as conducted by the Centre. The Act itself includes notes that some decisions made by adjudicators, including persons appointed under s 20(4) to act as adjudicators, fall to be made available under the CCSP Act (s 20(5) note referring to CCSP s 54), which implies that adjudication determinations would be publicly inspectable under the CCSP framework. However, the reprint does not reproduce any judicial or tribunal decisions, nor does it list litigation that has interpreted provisions of this Act.

What the Act text does record relevant to legal outcomes

• Publication requirement note: The note to s 20(5) records an example consequence of treating a person appointed under s 20(4) as a registered adjudicator for CCSP Act purposes: the Registrar under the CCSP Act must make available for public inspection the result or a report of a decision under s 54 of the CCSP Act. That indicates CCSP Act publication obligations apply to determinations made under the Act’s Part 4.

• No named authorities: The reprint contains no judicial authorities or citations to reported decisions involving the Centre, the Director’s exercise of discretion under s 13, Council Guidelines, secrecy provisions of s 36, or enforcement of confidentiality agreements under s 37.

Implications for practitioners researching litigation

• Absence of litigation in the reprint does not mean there is none. Practitioners seeking judicial or arbitral interpretation of any part of this Act or of CCSP adjudications conducted via the Centre must search case law, tribunal decisions and adjudication determinations published under the CCSP Act (as indicated by s 20(5) note and CCSP s 54), and adjudication registries. Given the Act’s linkage to the CCSP Act, adjudication determinations should be searchable through the CCSP Act’s public registers and any Registrar functions required by that Act.

• Confidentiality and admissibility: Because the Act makes mediation-generated materials inadmissible (s 34) and imposes secrecy obligations on officeholders (s 36) with specific exceptions, litigation history may be limited by the statutory non‑admissibility of mediation communications. However, exceptions in s 36(3) and the carve-out in s 36(5) for CCSP Part 4 functions indicate that not all information is insulated from disclosure or publication; adjudication outcomes required by the CCSP Act will be available and have been treated as public for CCSP Act purposes.

Recommended searches for litigation and adjudication outcomes

• Search CCSP Act adjudication registries and the Registrar’s public inspection facilities for adjudication reports and decisions referenced in s 20(5).

• Search Northern Territory court and tribunal databases for any cases involving a breach of the Act’s secrecy (s 36), confidentiality agreement prosecutions (s 37), or disputes about the Director’s exercise of discretion in accepting or terminating mediation (ss 13-14).

• Review any Council reports or CEO review reports (s 32) which might discuss adjudication outcomes or legal challenges.

In short, the reprint itself records no litigation history. The Act’s links to the CCSP Act and the Registrar’s publication duties mean adjudication decisions are potentially publicly available; locating them requires searches beyond the statutory text provided.

This section flags specific provisions and interactions in the Act that commonly create operational, compliance or legal pitfalls. Each "gotcha" is grounded in the statutory text.

1. Confidentiality and criminal penalties for recording and disclosure (s 36; s 37)

• The Act criminalises unauthorised recording, disclosure, publication or production of information obtained by Centre officers while exercising powers or functions under the Act, with a maximum penalty of 400 penalty units or 2 years imprisonment (s 36(2)-(4)). The Director may require parties to sign confidentiality agreements and a breach by a party is itself an offence with the same maximum penalty (s 37(1)-(4)). Practical implication: participants, support persons, advisers and Centre staff must be especially cautious about recordings and disclosure. The Director can permit recordings or disclosure, and the Commissioned exceptions in s 36(3) (eg required by another law, consent, or protection of persons/property) are narrow and should be relied on only with legal advice.

2. Broad secrecy for officers does not cover CCSP functions (s 36(5))

• The secrecy obligations in s 36 explicitly exclude powers or functions arising under the CCSP Act as given effect by Part 4 (s 36(5)). That means adjudication processes and outputs required by the CCSP Act (including publication duties under CCSP s 54) are not insulated by s 36. Confusion can arise if parties assume all Centre activities are secret; they are not. Adjudication material subject to CCSP Act publication or inspection remains accessible.

3. No statutory mediation fee regime in the Act

• The Act sets a lodgment fee for adjudication under the CCSP linkage (s 20(3)), but it does not provide for fees for mediation services. If the Centre intends to charge for mediation, that arrangement would need to be established administratively or by regulation. Absence of statutory fees can have resource and demand-management implications.

4. Director acceptance is discretionary and Guidelines‑dependent (ss 9(4)(a), 13(3), 26)

• The Director must have regard to Guidelines when deciding whether to accept an application for mediation (s 13(3) read with s 9(4)(a)). The Council determines Guidelines (s 26). Because Guidelines are matters of policy (subject to Gazette notification, s 26(3)) they shape access to services. Parties may apply but acceptance is not guaranteed; the Director’s discretion and the opaqueness of Guidelines (unless published) may produce unpredictability for potential users.

5. Limited participation and legal representation is controlled by the Director (s 15(5)-(6), s 17)

• Non-parties may not participate in a session except with permission (s 15(5)). Support persons may be permitted (s 15(6)). For bodies corporate, representatives are limited to officers or a nominated person and the Director may disqualify a representative under specified requirements (s 17). Practitioners must verify permitted presence for counsel or experts before attending and ensure any representative meets Director requirements.

6. Adjudication thresholds and fee timing create a narrow operational window (s 20(2))

• For the Director to carry out CCSP s 30(1)(a)-(c) actions, the payment claim amount must be less than an amount prescribed by regulation and lodgment fee must be paid to the Director within five working days after service of the application (s 20(2)). Parties that miss the five working day lodgment fee payment or exceed the prescribed monetary threshold will disqualify the Director from acting and the CCSP Act’s alternative appointer procedures will apply (s 20(7)). Practitioners must treat the five working day window and monetary threshold as hard deadlines.

7. Potential for unequal cost allocation and limited cost recovery (s 21; s 23)

• Section 21 makes each party initially liable for an equal share of the lodgment fee and allows the adjudicator to reallocate shares if one party paid more than their share (s 21(1)-(2)). Section 23 disapplies certain CCSP cost sections (s 46 and s 55) in relation to adjudications under this Part, limiting traditional cost-shifting outcomes. Advise clients that standard CCSP cost recovery rules may be altered for adjudications processed via the Centre.

8. Delegation exclusions for Part 4 and Director appointment constraints (s 11; s 9)

• The Director may delegate most powers in writing to mediators or Centre employees, but not powers arising from Part 4 (s 11(1)). The Director must be a public sector employee (s 9(3)). The combination means the Director retains direct control over CCSP adjudication functions and cannot simply delegate adjudication appointments or decisions under Part 4, centralising those responsibilities.

9. Use of the name "Community Justice Centre" is restricted (s 12)

• Section 12 prohibits other organisations using the words "Community Justice Centre" in their name, with a 100 penalty unit maximum. This is a less-obvious compliance risk for NGOs and community groups when choosing names.

10. Evidence inadmissibility does not prevent parties from making agreements enforceable outside mediation (s 16(3))

• Mediation is non‑binding and non‑preclusive of rights, except as to agreements reached in a session (s 16(3)). Parties should ensure that any settlement they wish to be enforceable is formalised in a binding instrument outside the mediation if required.

11. The Council’s role and Ministerial directions

• The Council makes Guidelines and deals with complaints (s 25), but the Minister may direct the Council about the exercise of powers except about the content of Council reports or actions on complaints (s 28). This creates potential for ministerial influence in policy direction while protecting the Council’s reporting independence.

12. Criminal sanctions extend to parties and officers

• The Act’s secrecy and confidentiality provisions create risk for both officers and parties. Parties must be warned about criminal exposure under s 37 if they sign a confidentiality agreement. Centre officers must also observe secrecy obligations or face criminal sanction (s 36).

For practitioners, these "gotchas" translate into operational checklists: verify lodgment fee timing and thresholds for CCSP adjudication; confirm mediation confidentiality terms and whether the Director will permit counsel or recordings; ensure settlements are properly documented; advise clients on limited cost recovery under the Centre pathway; and flag the criminal exposure for unauthorised disclosure.

This section provides a pragmatic compliance checklist and operational steps tied to specific statutory provisions for parties, mediators, Centre officers, the Director, the Council and the CEO.

For parties seeking mediation

1. Application format and process (s 13(1)-(3)):

• Use the approved form. The Act requires applications for mediation be made in an approved form (s 13(2)). The CEO has authority to approve forms (s 31). Check the Centre’s published forms before applying.

2. Understand voluntariness and termination rights (s 16; s 14):

• Attendance is voluntary and may be withdrawn at any time (s 16(1)-(2)). A party can terminate mediation services at any time (s 14(a)). Do not assume that attending will create binding obligations unless a settlement agreement is reached and formalised (s 16(3)).

3. Expect to sign a confidentiality agreement if required (s 37):

• The Director may require parties to sign a confidentiality agreement before mediation (s 37(1)). The agreement must specify non‑recording, non‑disclosure and non‑publication (s 37(2)), and breach is a criminal offence (s 37(3)). Obtain legal advice before signing and retain a copy.

4. Participation and representation rules (ss 15(5)-(6), 17):

• Non‑parties need the Director’s permission to participate (s 15(5)). Support persons may be allowed (s 15(6)). Bodies corporate must follow s 17 for representation. Seek the Director’s pre‑authorisation for counsel, experts or support persons.

5. Evidence and recording (ss 34, 36, 37):

• Do not record or intend to use mediation statements in later proceedings; mediation communications are inadmissible under s 34 and subject to secrecy provisions (s 36). If you need records, seek the Director’s permission under s 37(4) or rely on a lawful exception in s 36(3).

For parties seeking CCSP adjudication via the Centre

1. Check monetary threshold and lodgment fee (s 20(2)-(3)):

• Confirm the payment claim amount is less than the amount prescribed by regulation (s 20(2)(a)). Pay the lodgment fee to the Director within five working days after serving the written application under s 28 of the CCSP Act (s 20(2)(b)). The Act sets the lodgment fee at $500 unless Regulations prescribe another amount (s 20(3)).

2. Time sensitivity and contingency planning (s 20(7)):

• If the fee is not paid within five working days or the claim exceeds the prescribed amount, the Director must not act and CCSP Act provisions for other appointers apply (s 20(7)). Ensure finance and delivery systems are in place to meet the five working day window.

3. Expect limited cost recovery (s 23):

• Be aware that s 46 of the CCSP Act does not apply for adjudications under this Part (s 23(1)), and s 55 will not apply to the Director or adjudicator (s 23(2)). Advise clients on the altered cost risks and the potential for the adjudicator to allocate the lodgment fee under s 21.

For mediators, Centre employees and the Director

1. Qualifications and employment status (ss 9(3), 10(2)-(3)):

• Mediators must hold prescribed qualifications (s 10(3)). Mediators and the Director must be public sector employees or engaged on CEO-approved terms (s 9(3), s 10(2)(a)-(b)). Ensure HR compliance and confirm prescribed qualifications are documented.

2. Do not adjudicate within a mediation session (s 15(4)):

• Mediators must not adjudicate or arbitrate during mediation sessions; maintain separation of roles and properly document where mediation ends and any separate adjudication process begins.

3. Observe secrecy and confidentiality obligations (ss 33-37):

• Officers should record only information permitted by s 36(3). Avoid unauthorised recording, disclosure, publication or production of information obtained in the exercise of powers or functions under the Act (s 36(2)). Ensure staff understand criminal penalties and exceptions (s 36(3)-(4)). Use confidentiality agreements appropriately (s 37), and document Director consents for permitted disclosures (s 37(4)).

4. Apply Guidelines and Director’s directions (ss 9(4)(a), 15(1)(b), 26):

• Have and use the Council’s Guidelines and follow the Director’s directions in conducting sessions (s 15(1)(b)). Maintain a compliance register mapping Guidelines to practice.

For the Council and the Minister

1. Draft, publish and notify Guidelines (s 26):

• The Council must make Guidelines consistent with the Act and must notify their making by Gazette and to the Minister, CEO and Director before they take effect (s 26(1), (3)-(5)). Ensure administrative publishing steps are completed prior to implementation.

2. Process complaints and record remedial recommendations (s 27):

• Establish procedures to receive complaints from parties about mediation conduct, review matters, recommend Director action, and revise Guidelines as required (s 27(4)). Keep records and ensure implementation of recommendations where adopted.

For the CEO and administrative officers

1. Approve forms and conduct statutory review (ss 31, 32):

• Ensure approved forms are in place for applications (s 13(2), s 31). Conduct the statutory review within five years of commencement, prepare the review report and give it to the Minister for tabling (s 32). Implement findings as appropriate.

2. Prepare annual report (s 39):

• Prepare and deliver annual reports to the Minister within three months after the end of each financial year and ensure tabling within six sitting days (s 39(1)-(3)).

Cross-cutting compliance controls

1. Training and policies:

• Implement training for mediators and Centre staff on confidentiality, permitted disclosures, evidence inadmissibility, and the difference between mediation and adjudication roles. Ensure policy documents reflect s 36 exceptions.

2. Document management:

• Create a document and records protocol that distinguishes mediation session material (subject to s 34 inadmissibility and s 36 secrecy) from CCSP adjudication material (which is not covered by s 36 per s 36(5) and which may be subject to CCSP Act publication obligations).

3. Financial controls:

• For CCSP adjudication applications, establish a reliable mechanism for receipt and accounting of lodgment fees (s 20(3)), with timestamping to evidence payment within the five working day window (s 20(2)(b)). Establish billing and cost recovery processes aligned with s 21.

4. Governance and audit:

• Maintain audit trails for Director decisions to accept or refuse mediation (s 13(3)), terminations (s 14), delegation records (s 11(2)), and decisions to appoint adjudicators (s 20(4)). Use the Council’s Guidelines as the baseline for auditable decision-making.

5. Legal review and regulatory alignment:

• Before relying on an exception to secrecy or before disclosing mediation material, obtain legal advice on applicability of s 36(3) exceptions and other statutory obligations. Monitor Regulations made under s 40 for prescribed amounts and qualifications referenced in the Act.

By following the steps above, using approved forms, observing confidentiality protocols, meeting lodgment fee and timing requirements for CCSP adjudication, and keeping rigorous records of decisions, consents and approvals, actors can reduce litigation and criminal risk and align operational practice with statutory obligations.
