Community Based Sentences (Transfer) Regulations 2023

The Regulations work through a small set of statutory concepts and cross-references. Those concepts are: participating jurisdiction, local register entries (the prescribed details to be recorded), prescribed sentence, and a defined term cross-referenced to the Sentencing Act 1991.

Participating jurisdictions. Regulation 6 prescribes, for the purposes of s 6(2) of the Act, the list of jurisdictions whose community-based sentences are to be treated as transferable into Victoria under the Act. The list is the Australian Capital Territory, New South Wales, Tasmania, Western Australia, South Australia, Queensland, and the Northern Territory (reg 6(a)-(g)). The regulation therefore operationalises the Act’s inter-jurisdictional reach by naming the other domestic jurisdictions that participate.

Prescribed details for entries in the local register. Regulation 7 specifies, for the purposes of s 19 of the Act, the exact fields that the local authority must enter in the local register when registering an interstate sentence in Victoria. These fields fall into two groups: offender identifiers and sentence particulars. Offender identifiers required are given names and surname, aliases (if any), and date of birth (reg 7(a)(i)-(iii)). Sentence particulars required include the name of the sentence type in the participating jurisdiction, the name of the corresponding Victorian community-based sentence, the name of the court that imposed the sentence, the length of the sentence (including each part), dates (imposition, commencement if specified, and first reporting date in the participating jurisdiction), the remaining period to be served in Victoria, any condition attached to the sentence, and any previous registration of the sentence in another participating jurisdiction (reg 7(b)(i)-(x)).

Prescribed sentence. Regulation 8 prescribes that a "drug and alcohol treatment order" is a prescribed sentence for the purposes of s 5(a)(ii) of the Act. Regulation 5 defines "drug and alcohol treatment order" as having the same meaning as in the Sentencing Act 1991, so the substantive legal content of that prescribed sentence is a cross-reference rather than being defined within these Regulations.

Authorising provision, commencement and revocation. The Regulations are made under s 28 of the Act (reg 2), come into force on 24 June 2023 (reg 3), and revoke the prior Community Based Sentences (Transfer) Regulations 2013 and the 2022 amendment (reg 4). The endnotes record the making date and that the instrument will sunset under the Subordinate Legislation Act 1994 after ten years (Endnotes, General information).

Interpretive posture. The Regulations are structured as a typical subordinate instrument that does not attempt to restate or amend the Act, but rather supplies statutory detail that the Act requires be prescribed. The definitions and cross-references (reg 5 and reg 8's referral to the Sentencing Act 1991) indicate that interpretation of some terms will require consulting primary legislation outside this instrument.

These Regulations affect a discrete set of actors and interests, as determined by what the instrument prescribes. The primary operational actor identified by the text is the local authority responsible for maintaining the local register in Victoria; the Regulations supply the precise data fields that this local authority must record for every interstate community-based sentence that is registered in Victoria (reg 1(b); reg 7). The local authority therefore bears the administrative duty and any compliance costs associated with capturing, storing and, where applicable, providing access to the prescribed items.

Offenders whose sentences are transferred or registered in Victoria are affected because the Regulations require certain personal identifiers and sentence particulars to appear in the local register. The list includes given names and surname, aliases if any, and date of birth (reg 7(a)(i)-(iii)), and several sentence-specific data points (reg 7(b)). Those entries create an official local record of the offender and the sentence particulars once registration occurs.

Courts and sentencing authorities in the participating jurisdictions are indirectly affected because the register fields require the recording of the name of the court that imposed the sentence and the type of sentence in the participating jurisdiction (reg 7(b)(i) and (iii)). The court’s identification and sentencing category will be material to registration in Victoria.

Agencies and officials handling transfers between jurisdictions are affected in the sense that the Regulations set the list of participating jurisdictions (reg 6), which constrains which external community-based sentences are captured by the Act’s transfer machinery as implemented by these Regulations. The prescribed list includes seven jurisdictions and thereby defines the inter-jurisdictional net that the Victorian regime recognises administratively.

Information management and compliance units within the local authority or the Department responsible for the register will be affected by the need to map sentence-type nomenclature between jurisdictions: the register must record both the name of the sentence in the participating jurisdiction and the name of the corresponding Victorian community-based sentence (reg 7(b)(i)-(ii)). That mapping task requires knowledge of sentencing frameworks across jurisdictions or inter-agency cooperation.

Organisations and practitioners who advise or represent offenders subject to interstate sentences are affected because the register’s contents will include details pertinent to supervision and compliance, including the period remaining to be served in Victoria, the date the offender first reported in the participating jurisdiction, and any conditions attached to the sentence (reg 7(b)(vii)-(ix)). Access to and accuracy of these register entries will matter in administrative or compliance disputes, though the Regulations themselves do not prescribe access rights.

Finally, because regulation 8 prescribes a drug and alcohol treatment order as a prescribed sentence and regulation 5 ties that term to the Sentencing Act 1991, practitioners and service providers involved in treatment orders will be affected where such orders are the subject of transfer and registration under the Act (reg 8; reg 5).

The Regulations create precise recording duties for the local authority in relation to the registration of interstate sentences under the parent Act. Regulation 7 is the operative provision: it prescribes the specific details that must be entered in the local register for each registered interstate sentence, for the purposes of s 19 of the Act. The duty is therefore to record the prescribed offender identifiers and sentence particulars as set out in reg 7(a) and (b). The Regulations do not themselves set out who the local authority is, the mechanics of how entries are to be made, or time limits for making entries; those particulars will be found in the parent Act’s provisions (the Regulations are expressly made "for the purposes of section 19 of the Act", reg 7).

Regulation 6 imposes no duties but prescribes which jurisdictions fall within the Act’s scheme for the purposes of s 6(2) of the Act. That has the legal effect of determining the pool of external sentences that can be captured by the transfer and registration processes which the Act regulates. Parties and officials should therefore treat sentences from the listed jurisdictions as those that may be registered under the Act as implemented by these Regulations.

Regulation 8 imposes a scope determination: a "drug and alcohol treatment order" is treated as a prescribed sentence for s 5(a)(ii) of the Act. The meaning of that expression is not defined in these Regulations but is given by the Sentencing Act 1991, to which reg 5 cross-refers. Consequently, rights and duties that attach under the Act to "prescribed sentences" will apply to drug and alcohol treatment orders as defined by the Sentencing Act 1991.

The Regulations themselves do not set enforcement mechanisms or penalties. There are no offence provisions, fines, or criminal sanctions contained in the Regulations. Enforcement of the recording duties and consequences of non-compliance will therefore depend upon the Act’s provisions (for example the duties specified in s 19) and other statutory regimes; the Regulations operate by filling the detail that the Act requires rather than by creating separate statutory obligations enforceable under the Regulations themselves.

Rights of the offender in relation to the register, for example rights to access, correction, confidentiality, or challenge, are not specified in these Regulations. The instrument focuses on what must be recorded. Any procedural or substantive rights relating to the register or to the transfer process will derive from the Act or other legislation, not from the Regulations’ text.

Finally, the Regulations remove prior subordinate instruments: regs 4(a)-(b) revoke the 2013 Regulations and the 2022 amendment. That means any duties or fields that previously applied under the revoked instruments are superseded by these Regulations from the commencement date (reg 3), and the local authority and other actors need to follow the new prescribed fields and participating jurisdiction list.

The Regulations do not create new penalties or set out enforcement procedures. A plain reading of the instrument shows no offence provisions, monetary penalties, enforcement mechanisms, or specified sanctions. Regulation 7 prescribes the details to be entered in the local register "for the purposes of section 19 of the Act", which signals that enforcement of the recording obligation, and any associated consequences for failing to record correctly, are to be found in the Act itself rather than in these Regulations. The Regulations therefore perform a definitional and data-prescription role and leave compliance enforcement to the parent Act or other applicable legislation.

Because the Regulations invoke s 28 of the Act as the authorising provision (reg 2), any regulatory force they have depends on the statutory powers and compliance framework in the Act. Where the Act provides for penalties, remedies, or administrative directions, those will be the mechanisms to enforce duties that the Regulations flesh out. The Regulations do not purport to displace or supplement those mechanisms with independent enforcement provisions.

Practically, that means enforcement questions, such as what happens if a local authority fails to enter a prescribed field, whether an offender or third party can compel amendment or access to register entries, and whether inaccurate or incomplete entries attract penalties, must be answered by consulting the Act’s relevant sections (for example s 19, as cited at reg 7) and possibly other relevant statutes governing registers, administrative decisions, or privacy. The Regulations themselves provide no statutory basis for civil or criminal enforcement.

The endnotes also record a statutory sunset under the Subordinate Legislation Act 1994 after ten years (Endnotes, General information). That sunset is a procedural constraint on the lifetime of the instrument and affects enforcement in the sense that the Regulations will, absent further action, cease to have force after the stated sunset date. Any enforcement or compliance regime that relies on the Regulations will therefore need to account for that limited duration or for replacement instruments prior to expiry.

These Regulations operate as subordinate detail under the Community Based Sentences (Transfer) Act 2012, and they expressly cross‑reference and interact with at least two other statutory instruments.

First, the Regulations are made under section 28 of the Community Based Sentences (Transfer) Act 2012 (reg 2). They specify details required by provisions in that Act, for example prescribing the jurisdictions for s 6(2) (reg 6) and the particulars for s 19 (reg 7). The Regulations therefore function as delegated legislation that completes or clarifies the Act’s operational requirements. To understand duties and consequences fully, one must consult the Act alongside these Regulations.

Second, the Regulations import a substantive definition from the Sentencing Act 1991. Regulation 5 states that "drug and alcohol treatment order has the same meaning as in the Sentencing Act 1991", and regulation 8 declares that a drug and alcohol treatment order is a prescribed sentence for the purposes of s 5(a)(ii) of the Act. This means that the substantive contours of the prescribed sentence category depend on the Sentencing Act 1991’s definition and any amendments to that Act. Practitioners must therefore consult the Sentencing Act 1991 to understand which orders fall within the scope of reg 8.

Third, the endnotes cite the Subordinate Legislation Act 1994 in relation to the Regulations’ sunset (Endnotes, General information). The note states the Regulations will sunset ten years after making (on 20 June 2033) "see section 5 of the Subordinate Legislation Act 1994". That interaction is procedural: the Subordinate Legislation Act imposes time limits and oversight mechanisms on subordinate instruments, and this Regulation is subject to those processes.

Fourth, by revoking the prior 2013 Regulations and the 2022 amendment (reg 4), the instrument expressly displaces earlier subordinate rules. Any compliance processes, forms, or administrative practices grounded in those prior regulations should be updated to reflect the new data fields and participating‑jurisdiction list.

Beyond these explicit cross‑references, the Regulations do not themselves mention privacy law, information access regimes, criminal procedure, or registry governance. However, because they impose the content of a statutory register and require personal identifiers, there will be a necessary interface with data protection, public records and information access laws in practice. Those interactions are not addressed within the Regulations and must be managed under the relevant statutes and administrative arrangements that govern registers, records management, and privacy in public administration.

In short, the Regulations are a narrow subordinate instrument whose legal force cannot be understood in isolation; they must be read alongside the parent Act, the Sentencing Act 1991 for definitional content, and applicable procedural or administrative statutes such as the Subordinate Legislation Act 1994.

The Regulations record a concise amendment and revocation history. Regulation 4 revokes two prior instruments: the Community Based Sentences (Transfer) Regulations 2013 and the Community Based Sentences (Transfer) Amendment Regulations 2022. The Explanatory details in the endnotes identify those instruments precisely (Endnotes, Explanatory details 1 and 2). The text shows that the present Regulations were made on 20 June 2023 and came into operation on 24 June 2023 (reg 3; Endnotes, General information). The Version number is 001 and the instrument is S.R. No. 56/2023 as at 24 June 2023.

The Table of Amendments in the endnotes states that there are no amendments made to the Community Based Sentences (Transfer) Regulations 2023 by subsequent statutory rules, subordinate instruments or Acts (Endnotes, Table of Amendments). That means, as of the version provided (24 June 2023), these Regulations have not been amended since their making and only replace the earlier instruments listed in the revocation clause.

Procedural detail relevant to future amendments is noted in the endnotes: the Regulations will sunset ten years after the day of making under the Subordinate Legislation Act 1994 (Endnotes, General information). That imposes a statutory limit on the Regulations’ lifespan absent re‑making or extension under the Subordinate Legislation Act 1994’s procedures. Practitioners should therefore be aware that any long‑term compliance or systems change may need revisiting prior to the sunset date (20 June 2033).

No other amendment entries are contained in the Table of Amendments. Because the instrument cross‑references defined terms in other Acts (for example the Sentencing Act 1991), future amendments to those primary Acts (including redefinition of "drug and alcohol treatment order") will affect the operation of these Regulations without amendment to this subordinate instrument. That interaction is functional rather than recorded as an amendment to the Regulations themselves.

The text supplied contains no report of litigation, judicial interpretation, or case law construing these Regulations. The instrument’s endnotes and explanatory details do not record any judicial consideration or references to litigation. The Table of Amendments records only the absence of subordinate instruments amending these Regulations and makes no mention of legal proceedings.

Because the Regulations took effect on 24 June 2023 and are narrow in scope, prescribing participating jurisdictions, register fields, and a prescribed sentence category, there may be practical disputes that could give rise to litigation (for example disputes over whether a particular field was properly recorded, or whether a particular interstate sentence qualifies under the Act). However, no such cases are reported in the material provided. Any litigated issues about the meaning or application of these Regulations will necessarily be resolved by reference to the parent Act, related statutes (for example the Sentencing Act 1991), and standard principles of statutory interpretation, but no cases are cited or summarised in this instrument.

Users seeking precedents or judicial interpretation should therefore be aware that none is contained here and must search case law and tribunal decisions external to this instrument for any authorities that apply the Regulations or the Act.

The Regulations are short, but they contain a number of concrete items that can produce operational or legal pitfalls if overlooked.

1. Narrow scope but binding detail. The instrument is not a procedural manual. It prescribes the exact register fields required for the purposes of s 19 of the Act (reg 7), but it does not set out process steps, timeframes, responsibilities for verifying accuracy, or data retention policies. That means compliance requires consulting the parent Act for procedural duties and other statutes for records management. Failure to do so can leave practitioners relying on the regulation’s fields but missing procedural obligations in the Act.

2. Cross‑statutory definition gap. Regulation 8 prescribes "drug and alcohol treatment order" as a prescribed sentence, but reg 5 delegates the definition to the Sentencing Act 1991. A practitioner who reads reg 8 in isolation may misidentify which orders qualify. The operative content of what counts as a prescribed sentence is therefore located in another Act. Always check the Sentencing Act 1991’s current text to identify whether a particular order is within the scope of reg 8.

3. Register fields require mapping of nomenclature. Regulation 7(b)(i)-(ii) requires both the name of the sentence type in the participating jurisdiction and the name of the corresponding Victorian community‑based sentence. Different jurisdictions use different terminology and sentence structures. That creates an administrative mapping requirement; the register must record both names. Failure to map accurately may produce ambiguity about equivalence and remaining obligations.

4. Prior registrations must be recorded. Regulation 7(b)(x) requires "details of any previous registration of the sentence in another participating jurisdiction". This anticipates multi‑step transfers or multiple registrations. Where an interstate sentence has been registered elsewhere, registrars must obtain and record prior registration history. Omitting this field could affect supervision or oversight.

5. Participating jurisdictions are expressly listed. Regulation 6 lists which jurisdictions are prescribed for s 6(2). Practitioners should not assume that an unlisted territory or foreign jurisdiction falls within the transfer regime as implemented by these Regulations. The list is the operative roster for the purposes cited. If a sentence originates outside one of the listed jurisdictions, these Regulations do not prescribe it for s 6(2), and the Act’s treatment of such cases must be checked.

6. No penalties in the instrument. The absence of sanctioning or enforcement provisions in these Regulations can be a trap for those who expect subordinate legislation to set out penalties or remedial steps. Any enforcement outcomes for failures in registration, inaccuracies or non‑compliance will arise from the Act or other statutes, not these Regulations.

7. Sunset date. The instrument will sunset ten years after making under the Subordinate Legislation Act 1994 (Endnotes, General information). Systems and compliance processes that are implemented to conform with these Regulations should therefore account for this limited duration and any likely amendment or re‑making before the sunset.

8. Personal data fields. The register fields include personal identifiers (given names, surname, aliases, date of birth), sentence particulars and dates (reg 7). Those entries may intersect with privacy, records management and disclosure regimes. The Regulations do not address confidentiality or access. Administrators should ensure recordkeeping and disclosure practices comply with other applicable law.

9. Revocation of prior instruments. The Regulations revoke the 2013 Regulations and the 2022 amendment (reg 4). Where agencies or practitioners rely on forms, IT systems or practices set under the revoked instruments, those must be updated to reflect the new required fields and the participating jurisdiction list.

10. Dependence on the Act for procedural context. Several operative phrases refer to provisions of the Act (for example "for the purposes of section 19 of the Act" in reg 7 and "for the purposes of section 6(2) of the Act" in reg 6). That linkage means the Regulations do not stand alone and a misunderstanding of the parent Act can produce compliance gaps.

To comply with these Regulations, practitioners and agencies should follow a focused checklist of actions tied to the Regulations’ operative clauses. The following steps are grounded in the instrument’s text and identify the specific items to capture and the documents to consult.

1. Confirm commencement and applicability. These Regulations came into operation on 24 June 2023 (reg 3). Ensure that any registration activity for interstate sentences in Victoria from that date onward follows the prescribed fields. Note that the Regulations revoke the earlier 2013 instrument and its 2022 amendment (reg 4), so any forms or processes based on those prior regulations should be updated.

2. Verify jurisdictional scope. When assessing whether an interstate sentence can be registered under the Act as implemented by these Regulations, verify that the sentence originates in one of the participating jurisdictions listed in reg 6: the Australian Capital Territory; New South Wales; Tasmania; Western Australia; South Australia; Queensland; or the Northern Territory. If the originating jurisdiction is not on that list, do not treat these Regulations as prescribing the sentence under s 6(2) without consulting the Act and any applicable bilateral arrangements.

3. Prepare register data capture to match reg 7. When registering an interstate sentence in the Victorian local register, the local authority must enter the following offender details: given names and surname, aliases if any, and date of birth (reg 7(a)(i)-(iii)). The register must also contain sentence details: the name of the sentence type in the participating jurisdiction, the name of the corresponding Victorian community-based sentence, the court that imposed the sentence, the sentence length (including length of each part), the date the sentence was imposed, the date specified for commencement if any, the date the offender first reported for the sentence in the participating jurisdiction, the remaining period to be served in Victoria, any condition attached to the sentence, and details of any previous registration of the sentence in another participating jurisdiction (reg 7(b)(i)-(x)). Ensure forms, database fields, and internal guidance capture each of these items precisely.

4. Map sentence nomenclature between jurisdictions. Because reg 7 requires recording both the name of the sentence in the participating jurisdiction and the corresponding Victorian community-based sentence (reg 7(b)(i)-(ii)), establish a process to determine equivalence. This may require consulting the sentencing laws of the participating jurisdiction and the Sentencing Act 1991, and documenting the basis for the mapping in each case.

5. Cross‑check prescribed sentence status. If an offender’s order is a "drug and alcohol treatment order", treat it as a prescribed sentence for the purposes of s 5(a)(ii) of the Act by virtue of reg 8. However, because reg 5 ties the meaning of that expression to the Sentencing Act 1991, check the current wording of the Sentencing Act 1991 to confirm whether a particular order is a "drug and alcohol treatment order" for these purposes.

6. Ensure recordkeeping and privacy compliance. The register entries will include personal identifiers and sentence particulars (reg 7). Implement records management and privacy controls consistent with applicable Victorian and Commonwealth privacy and records laws. The Regulations do not specify confidentiality or access rules, so rely on the applicable statutes and internal policies for handling, disclosure and correction requests.

7. Capture prior registration history. Where a sentence has been previously registered in another participating jurisdiction, record the details as required by reg 7(b)(x). Establish channels to obtain documentation or confirmation from the prior registering jurisdiction so that the local register’s entry is complete and accurate.

8. Align internal workflows with statutory provisions. Because the Regulations serve to specify details "for the purposes of section 19 of the Act" (reg 7) and participate in s 6(2) (reg 6), ensure staff responsible for registration understand the relevant provisions of the Act in addition to the Regulations. The Regulations supply data fields; the Act supplies the procedural and legal framework for registration and any consequences of registration.

9. Update IT and form templates. Modify electronic registers, case management systems and paper forms to include each field named in reg 7 and to capture both jurisdictional and Victorian sentence names. Build mandatory field checks for those entries that are necessary to establish a complete registration record.

10. Monitor sunset and revocation consequences. Record the Regulation’s sunset date per the Subordinate Legislation Act 1994 (Endnotes, General information) and plan for review prior to 20 June 2033. Also ensure that any transition from the revoked instruments (reg 4) to these Regulations has been completed and documented.

11. Seek legal clarification where necessary. If there is uncertainty about the effect of a particular field (for example what counts as "length of the sentence" where a sentence has multiple parts), consult the parent Act’s relevant provisions and, if needed, obtain legal advice. The Regulations define the required items but do not resolve ambiguities about how to measure or interpret some entries.

By following these steps and ensuring that data capture and procedural practices are aligned with reg 7 and the cross-references in regs 5 and 8, a local authority and practitioners can meet the recording obligations these Regulations prescribe.
