Commonwealth Scholarships Guidelines Amendment (Research) 2021

The instrument centres on the following insurer-net mechanical concepts, all added to or modifying the Commonwealth Scholarships Guidelines (Research) 2017.

Weighted HDR student completions (WSC)

• The instrument changes the reference point for WSC so that the applicable weighting schedule depends on the Grant Year: paragraph 1.4.10 applies for Grant Years prior to 2024, and paragraph 1.4.12 applies for 2024 and future Grant Years (Schedule 1, item 2). The WSC is the metric used to determine grant amounts payable to eligible scholarship providers under Part 2‑4 of the Higher Education Support Act 2003 (see paragraph 1.4.10(1) and paragraph 1.4.12(1)).

Research internship and eligible research internship

• The instrument inserts two linked definitions. The general term research internship is defined to mean "a position with a research end‑user where a student has undertaken R&D related to their HDR" and states that it can be paid or unpaid and may be part of enrolment or undertaken during an HDR suspension (Schedule 1, item 1). Eligible research internship is defined by cross-reference to paragraph 1.4.13, which supplies the substantive eligibility criteria (Schedule 1, item 1 and paragraph 1.4.13).

Weighting dimensions for HDR completions

• For pre‑2024 grant years, weightings are a function of: Indigenous status, HDR level, and HDR cost type (paragraph 1.4.10(2) and table in paragraph 1.4.10(3)). The table in paragraph 1.4.10(3) sets out weights such as 4.70 for non‑Indigenous high‑cost Research Doctorate completions and 9.40 for Indigenous equivalents.

• For 2024 and future grant years, an additional dimension is added: whether the Research Doctorate student completed an eligible research internship (paragraph 1.4.12(2)). The new weighting table in paragraph 1.4.12(4) adds higher weights for Research Doctorate completions where the internship requirement is met (for example, high‑cost Research Doctorate non‑Indigenous weights increase from 4.70 to 6.70 when the internship requirement is met).

Eligible research internship requirements (paragraph 1.4.13)

• Core statutory conditions that must all be met for the internship to be "eligible" for weighting:
  • It must be undertaken by a Research Doctorate student (1.4.13(1)(a)).
  • The internship must be a minimum of three calendar months in duration (1.4.13(1)(b)).
  • The internship must include 60 full‑time equivalent days of engagement in R&D activities undertaken by the student (1.4.13(1)(c)).
  • The internship must be related to the student's Research Doctorate area of research (1.4.13(1)(d)).
• Written agreement requirements: the higher education provider (HEP), the student and the research end‑user must agree in writing to the R&D activities and duration (1.4.13(2)). The written agreement must be made within specified timeframes: within 18 months of commencement for full‑time students, within 36 months for part‑time students (1.4.13(3)).
• Full‑time equivalent day definition: the instrument uses the industry’s standard working day hours where available, otherwise a default of 7.6 hours (1.4.13(4)).
• Commencement and completion dates are defined by the first and last days the student engages in R&D activities that count toward the full‑time equivalent days (1.4.13(5)).
• Internship modes: the internship may be on‑site with a research end‑user, on‑campus or online, and may be part‑time or full‑time (1.4.13(6)).
• The instrument clarifies that the internship weighting can be applied even if the student continues engagement with the research end‑user after meeting the minimum requirements (paragraph 1.4.12(3)).

Temporal scope and sequencing

• Although the extra weighting applies for grant years 2024 and later (paragraph 1.4.12(1)), the instrument limits the internship weighting to Research Doctorate student completions on or after 1 January 2022 (paragraph 1.4.12(5)(a)), and only where the internship requirements are met prior to the student completing the doctorate (paragraph 1.4.12(5)(c)). The weighting is only applied once per Research Doctorate completion (paragraph 1.4.12(5)(b)).

Reporting dependency

• The instrument explicitly ties the application of the weightings to HDR student completions reported in the Higher Education Student Data Collection (HESDC) (paragraph 1.4.10(2) and paragraph 1.4.12(2)). That reporting data drives the weighted student completions that determine grant amounts.

Minor drafting amendment

• Item 5 in Schedule 1 replaces a phrase in subparagraph 1.6.45(11) but the text to be omitted and substituted is identical in the instrument as supplied, suggesting a typographical or formatting amendment with no substantive change (Schedule 1, item 5).

Primary financial effects fall on eligible scholarship providers and higher education providers (HEPs) who administer scholarships tied to HDR (higher degree by research) students, because the instrument changes the grant‑calculation metric used to determine amounts paid under Part 2‑4 of the Higher Education Support Act 2003 (paragraph 5). The instrument expressly links grant amounts to weighted HDR student completions reported in the HESDC (paragraphs 1.4.10(1)-(2) and 1.4.12(1)-(2)). The groups directly affected include:

• Eligible scholarship providers and HEPs: HEPs will be the entities that receive altered grant payments because WSCs are aggregated at the provider level (see paragraph 1.4.10(3) and 1.4.12(4)). Providers that facilitate eligible research internships for Research Doctorate students meeting the specified rules can expect a higher weighted completion per eligible completion from 2024 grant years onwards, subject to the reporting and eligibility conditions in paragraphs 1.4.12 and 1.4.13 and the application provision in paragraph 5.

• Research Doctorate students: the instrument creates an explicit incentive for Research Doctorate students to undertake an internship meeting the defined criteria because their successful completion, if recorded and reported in HESDC, increases the financial weight assigned to their completion via the HEP’s grant calculation (paragraph 1.4.12(4) and (5)). The student’s obligations include participating in the defined R&D activities and entering into a written agreement with the HEP and research end‑user (paragraph 1.4.13(2)).

• Research end‑users: the term research end‑user appears as the entity with which the student undertakes R&D in a research internship and is a party to the required written agreement (paragraph 1.4.13(2)). Research end‑users that host students will need to enter into written agreements and support students in meeting the quantitative engagement requirements (60 FTE days and minimum duration).

• Indigenous students: the weighting tables retain a separate higher multiplier for Indigenous students in both pre‑2024 and 2024+ schedules (paragraphs 1.4.10(3) and 1.4.12(4)), meaning providers’ grant outcomes will continue to be sensitive to the Indigenous status of completing students. The instrument does not change Indigenous status definitions in the text supplied; it retains the existing multiplicative treatment.

• Administrators and data-reporting bodies: entities responsible for HESDC reporting are affected because the weightings apply to HDR student completions "reported in the HESDC" (paragraphs 1.4.10(2) and 1.4.12(2)). HEP internal compliance and reporting units will be responsible for recording the necessary internship data and ensuring it is correctly reflected in the HESDC feed that informs grant calculations.

• Scholarship policy and finance teams within HEPs: they must operationalise the new definitions, ensure written agreements meet timing and content constraints (paragraph 1.4.13(2)-(3)), determine and document commencement/completion as per 1.4.13(5), calculate FTE days using industry standard hours or 7.6 hours (1.4.13(4)), and ensure the internship is completed prior to doctoral completion and on or after 1 January 2022 where the extra weighting is sought (paragraph 1.4.12(5)).

• Students on suspension: because the research internship definition allows internships to be undertaken during an HDR period of suspension (Schedule 1, item 1), students on approved suspension may still participate, subject to meeting the requirements in paragraph 1.4.13.

Who is not affected or only indirectly affected

• Research Masters completions do not receive an internship-related weight; the 2024+ table marks the internship column as N/A for Research Masters (paragraph 1.4.12(4)). Therefore, Research Masters students and their providers will not directly benefit from the internship weighting.

• Grants outside Part 2‑4 of HESA are unaffected, because the application clause restricts the amendments to grants payable under Part 2‑4 on and from commencement (paragraph 5).

• The instrument does not itself create new criminal offences or civil penalties; it changes grant-calculation mechanics. Enforcement and any penalties for misreporting are governed by the existing HESA framework and the HESDC reporting rules outside this instrument.

The amendments impose documentary and timing duties on higher education providers, students and research end‑users, and confer a conditional right on eligible scholarship providers to receive higher grant weightings when specific criteria are met and properly reported.

Documentary duty: written agreement

• Paragraph 1.4.13(2) requires that the HEP, the student and the research end‑user agree in writing to both the R&D activities to be undertaken and the duration of the internship. That is a precondition for the internship to be "eligible" under paragraph 1.4.13. The written agreement must be produced within the timeframes specified in paragraph 1.4.13(3) (within 18 months from commencement for full‑time students, and within 36 months for part‑time students).

Timing duty: when the written agreement must be made

• Paragraph 1.4.13(3) conditions the written agreement on being entered into within 18 months of commencement for full‑time students and 36 months for part‑time students. This is not a discretionary guideline; it is a stated requirement for eligibility.

Engagement duty: minimum duration and engagement quantum

• Paragraph 1.4.13(1)(b)-(c) requires the internship to be a minimum of three calendar months and to "include 60 full-time equivalent days of engagement in R&D activities". Those two elements are conjunctive requirements.

Definitions duty: determination of FTE day

• Paragraph 1.4.13(4) defines a full‑time equivalent day as either "the number of hours in a standard working day for the industry associated with the research end‑user" or, if there is no standard working day, 7.6 hours. This gives a specific approach to convert hours into days for the 60‑day requirement.

Commencement/completion reporting duty

• Paragraph 1.4.13(5) sets the rules for determining the commencement and completion dates of an eligible research internship for reporting purposes: commencement is the first day the student engages in R&D activities that count toward the FTE days; conclusion is the last day the student engages in R&D activities that count toward the FTE days with the same research end‑user. HEPs must apply these rules when certifying that the internship requirements were met prior to completion of the doctorate (paragraph 1.4.12(5)(c)).

Temporal limitation on application of weighting

• Paragraph 1.4.12(5) provides three limits: the internship weighting only applies to Research Doctorate completions on or after 1 January 2022; it applies only once per doctorate; and it applies only where the internship requirements were met prior to completion. HEPs and students must align internships and reporting to these temporal constraints.

Reporting duty to HESDC

• Paragraphs 1.4.10(2) and 1.4.12(2) make clear that the weightings apply to HDR student completions reported in the HESDC. HEPs therefore have a duty to ensure relevant data about completions and internships are correctly reported in the HESDC in the form used to calculate grant entitlements.

Rights: entitlement to higher weighting and resultant grant

• Where the conditions are met and reported, an eligible scholarship provider has a right (in the sense of an entitlement under the grant calculation rules) to receive the higher weighting for that completion for the calculation of grant amounts in 2024 and future Grant Years (paragraph 1.4.12(4)-(5)). The right is conditional on factual compliance with the eligibility criteria and reporting requirements.

Interaction with existing cost-type and Indigenous multipliers

• The new internship-related weighting is additive to the existing dimensions of Indigenous status and HDR cost-type as set out in paragraph 1.4.12(4); the table layers the internship variable on top of the existing multipliers rather than replacing them.

No new penalty regime in the instrument

• The instrument does not create express penalties, sanctions, or compliance offences within the text supplied. Any enforcement or recovery of grants paid in error, or other sanctions for misreporting HESDC data, would arise under the Higher Education Support Act 2003 and associated grant conditions and data‑reporting rules rather than from this instrument itself. The instrument prescribes the eligibility and reporting mechanics that will determine grant calculations.

Administrative and evidentiary duties

• Implicitly, HEPs must retain and be able to produce the written agreements and other records required to establish that the student met the 60 FTE day and duration requirements prior to completion and that the agreement timing rules were satisfied. The instrument supplies the criteria; evidence and documentation will be the mechanism through which the HEP demonstrates entitlement to the weighting to the agency that administers the grants.

This instrument is an amending legislative instrument that alters how grants are calculated under the Commonwealth Scholarships Guidelines (Research) 2017. The instrument itself does not create new criminal offences or administrative penalty provisions; it prescribes eligibility criteria and reporting links that feed into grant determinations. Enforcement consequences therefore arise indirectly via the grant funding regime under the Higher Education Support Act 2003 and the HESDC reporting system referenced in the Guidelines.

What the instrument does specify with respect to enforcement mechanisms

• The instrument ties weightings to HDR completions "reported in the HESDC" (paragraphs 1.4.10(2) and 1.4.12(2)). That reporting nexus means that the integrity of HESDC reporting will be central to enforcement in practice. If HESDC data triggers a higher WSC for a provider, the payments that follow are based on that data.

Absence of express sanctions in this instrument

• There are no provisions in the supplied text creating express financial penalties, clawback provisions, or administrative fines specific to misclassification or misreporting of internships. Any sanction, adjustment or recovery of funds would be a function of the HESA grant administration framework, determinations, and program-specific compliance processes external to the amending instrument. The instrument relies on the underlying Act and the Guidelines' reporting architecture for practical enforcement.

Likely practical enforcement levers (as indicated by the text)

• Data verification and audit: because the instrument predicates weighting on HESDC reporting and on written agreements and quantifiable measures (60 full‑time equivalent days; minimum three calendar months), administrative authorities responsible for grants will be able to check whether a provider's claimed eligible research internships meet the textual requirements in paragraphs 1.4.12 and 1.4.13. The written agreement requirement (1.4.13(2)) is an evidentiary lever.

• Grant calculations and payment adjustments: payments under Part 2‑4 are determined by the weighted HDR completions. If the data supporting those weighted completions are later found to be incorrect, the agency responsible for administering the grants may adjust payments. The instrument itself is silent on the mechanics of adjustment and recovery, but the grant framework in HESA provides those administrative mechanisms.

Areas of potential contention for enforcement and dispute

• Determination of when the 60 full‑time equivalent days have been met, particularly where part‑time arrangements or non‑standard working days apply (see paragraph 1.4.13(4) and (6)), may be a factual dispute that can lead to audit findings and adjustments.

• The timing rules that require the written agreement to be made within 18 or 36 months of the student's commencement (paragraph 1.4.13(3)) and the requirement that the internship be completed prior to doctoral completion (paragraph 1.4.12(5)(c)) create discrete points at which compliance can be assessed.

• The instrument’s reliance on HESDC reporting makes the integrity of reporting channels a critical enforcement point. Discrepancy between provider records and HESDC entries would be the factual basis for any enforcement action.

What is missing from the instrument’s text on penalties

• The text does not detail administrative processes for verification, the timelines for audits, notice periods for corrections, or procedural rights for providers to contest a recoupment or decision. Those are matters left to the HESA grant administration environment and any grant program rules or guidelines that govern compliance and dispute resolution.

This instrument is made under section 238‑10 of the Higher Education Support Act 2003 (paragraph 3). By amending the Commonwealth Scholarships Guidelines (Research) 2017, it operates within the regulatory architecture established by HESA and interacts with other elements of that architecture.

Interaction with the Higher Education Support Act 2003

• The instrument’s authority is s 238‑10 HESA (paragraph 3). The amendments apply only in respect of grants payable under Part 2‑4 of HESA on and from commencement (paragraph 5). Consequently, the instrument must be read and applied in the context of the Act’s grant-making powers, conditions, repayment and recovery mechanisms, and compliance and reporting obligations under HESA.

Interaction with the Commonwealth Scholarships Guidelines (Research) 2017

• The instrument directly amends the Guidelines; it replaces paragraph 1.4.10, inserts paragraphs 1.4.12 and 1.4.13, amends the WSC reference in paragraph 1.4.5, and inserts definitions for research internship and eligible research internship (Schedule 1). The Guidelines form part of the rules by which the Department and providers operationalise scholarship grants, so these changes alter provider entitlements under that administrative regime.

Interaction with the Higher Education Student Data Collection (HESDC)

• Paragraphs 1.4.10(2) and 1.4.12(2) tie the application of weightings to “HDR student completions reported in the HESDC”. The HESDC is the National collection used for higher education reporting; its data definitions, reporting formats, validation rules and timeframes are external to this instrument but essential to its operation. The instrument’s effect depends on accurate HESDC reporting and any definitions or metadata in the HESDC that relate to internship fields, completion dates and Indigenous status.

Interaction with Part 1.7 (high‑cost/low‑cost fields of education)

• Both pre‑2024 and 2024+ weightings continue to depend on the cost type of the HDR, with high‑cost and low‑cost fields determined in accordance with fields identified in Part 1.7 (paragraph 1.4.10(4) and paragraph 1.4.12(6)). The instrument therefore relies on Part 1.7 for the definition and classification of high‑cost versus low‑cost completions.

Interaction with scholarship and grant conditions

• The instrument alters the calculation inputs used by the grant system; providers must therefore ensure internal compliance with both these new Guidelines provisions and any scholarship agreements and grant conditions they have with the Commonwealth, which are governed by HESA and any program‑specific terms. Any conflict between these Guidelines and HESA will be resolved by HESA as the primary statute; the Guidelines operate as administrative directions within that statutory framework.

No cross‑reference to a definition of “research end‑user” in the supplied text

• The instrument repeatedly uses the term research end‑user but does not define that term within the supplied amendments. Where that term is defined elsewhere in the Guidelines or in related HESA instruments, that definition will govern. Where no definition exists, the lack of a definition may require providers and administrators to rely on other parts of the HES or Departmental guidance to interpret the term for reporting and eligibility.

Interaction with reporting and audit regimes

• Because the weightings depend on HESDC reporting, the instrument intersects with the broader administrative and audit regime that governs grant payments under HESA. Those existing regimes set out obligations for record-keeping, audit, and potentially recovery of funds paid in error. The instrument itself does not specify those mechanisms, but it operates within that pre-existing framework.

Effect on internal HEP contractual arrangements

• The written agreement requirement (paragraph 1.4.13(2)) necessarily interacts with internal contracting, secondment and placement arrangements between HEPs and third parties. Such contractual arrangements must be structured to meet the written agreement and timing requirements set out in the Guidelines.

Instrument identification and date

• The instrument is titled Commonwealth Scholarships Guidelines Amendment (Research) 2021 and is dated 10 December 2021 (front page). It is made by the Minister for Employment, Workforce, Skills, Small and Family Business (Stuart Robert) (front page).

Authority and commencement

• The instrument is made under section 238‑10 of the Higher Education Support Act 2003 (paragraph 3). It commences on the day after it is registered, as set out in paragraph 2(1) (the commencement table states "The whole of this instrument" commences "The day after this instrument is registered"). Paragraph 2(2) notes that information in column 3 of the commencement table is not part of the instrument.

Scope of application

• Paragraph 5 limits the application of the amendments to grants payable under Part 2‑4 of HESA on and from commencement: "The amendments made by this instrument only apply in respect of grants payable under Part 2‑4 of the Higher Education Support Act 2003 on and from commencement."

Specific textual amendments to the Guidelines (Schedule 1)

• Schedule 1 amends the Commonwealth Scholarships Guidelines (Research) 2017. The specific items inserted or repealed are:
  • Item 1: Inserts two definitions into the existing list (eligible research internship; research internship). The eligible research internship definition refers to paragraph 1.4.13 for requirements; the research internship definition is a standalone definitional entry (Schedule 1, item 1).
  • Item 2: Repeals the previous definition of WSC in paragraph 1.4.5 and substitutes a new definition that directs WSC to paragraph 1.4.10 for pre‑2024 and to paragraph 1.4.12 for 2024 and future grant years (Schedule 1, item 2).
  • Item 3: Repeals paragraph 1.4.10 and substitutes a new paragraph 1.4.10 dealing with weightings for HDR completions for grant years prior to 2024 with a specific weighting table (Schedule 1, item 3).
  • Item 4: Inserts paragraph 1.4.12 (weightings for 2024 and future grant years, including internship dimension) and paragraph 1.4.13 (requirements of an eligible research internship) after the new paragraph 1.4.10 (Schedule 1, item 4).
  • Item 5: Repeals and substitutes a textual element in subparagraph 1.6.45(11) but the omitted and substituted text appears identical in the supplied instrument (Schedule 1, item 5) suggesting a formatting or typographical correction.

Temporal carve-outs and retroactivity

• Paragraph 1.4.12(5) places temporal constraints on the internship-related weighting: (a) it applies only to Research Doctorate completions on or after 1 January 2022; (b) it applies only once per Research Doctorate completion; and (c) the internship requirements must have been met prior to the student completing their Research Doctorate. In effect, although the weighting applies to 2024 and future grant years when calculating provider entitlements, the internship itself must be completed on or after 1 January 2022 and before the doctorate completion in order to be eligible for the weighting.

No other amendment history is provided in the supplied text

• The instrument provides the changes it makes to the Guidelines as at the date of the instrument. The instrument itself is the authorising amendment; the supplied text contains no prior amendment history, transitional provisions beyond paragraph 1.4.12(5) or subsequent modifications.

The instrument as supplied contains no cases, judicial decisions, or references to litigation. It is an amending statutory instrument and does not itself record any litigation history. The document does not name any court decisions, tribunals, or disputes that have interpreted these particular provisions.

Potential sources of dispute implicit in the text

• Although no litigation history is recorded, the text contains several factual and definitional elements that are natural candidates for administrative review or dispute in the context of grant payments:
  • Whether a written agreement satisfies paragraph 1.4.13(2) could be disputed by a provider and the administering agency if the agreement lacks specificity on R&D activities or duration.
  • Whether a student has completed "60 full‑time equivalent days of engagement in R&D activities" could give rise to factual disputes, particularly where part‑time arrangements or irregular working patterns are involved. Paragraph 1.4.13(4) attempts to reduce ambiguity by defining a full‑time equivalent day by reference to industry standard hours or a 7.6 hour default, but disputes may nonetheless arise about whether particular hours count as R&D engagement.
  • Determination of the internship commencement and completion dates under paragraph 1.4.13(5) could be contested if multiple engagements with different research end‑users or intermittent activities occur.
  • The requirement in paragraph 1.4.13(3) that the written agreement be made within 18 months for full‑time students and 36 months for part‑time students establishes a temporal test that could be a point of contention if a provider cannot show the written agreement was executed within those windows.
  • The instrument’s reliance on HESDC reporting as the factual basis for weighted completions may lead to disputes about whether the HESDC data correctly reflected internship participation or the timing requirements, especially where HEP records and HESDC entries diverge.

No recorded judicial interpretation in the instrument

• Because the instrument is an administrative amendment, a provider or student disputing an administrative decision (for example, a decision to withhold a higher weighting or to recover funds) would likely pursue internal review mechanisms and, if refused, could seek merits review or judicial review in accordance with the Administrative Decisions (Judicial Review) Act or other applicable regimes. The supplied instrument does not discuss such avenues or record any case law.

Practical note for risk assessment

• Although no litigation history is given, the elements above are the specific factual touchpoints at which an audit or compliance review could identify potential overclaiming or error. Those would be the likely loci for any contested decisions under the grant administration apparatus.

This instrument contains precise definitions and timing rules that generate potential traps for higher education providers, students and research end‑users. Below are specific "gotchas" grounded in the instrument's text that recipients and administrators should watch for.

Timing windows for the written agreement

• The written agreement required by paragraph 1.4.13(2) must be made within 18 months of commencement for full‑time students and within 36 months for part‑time students (paragraph 1.4.13(3)). If a provider or student waits until late in candidature to formalise an internship, the agreement may fall outside these windows and the internship would not be an "eligible research internship" for weighting purposes even if the student later completes the required days and duration.

Minimum duration and FTE days are conjunctive

• Paragraph 1.4.13(1)(b)-(c) requires both a minimum of three calendar months and 60 full‑time equivalent days. Meeting one metric but not the other does not qualify the internship. For example, a compact but intensive engagement of 60 FTE days completed in under three calendar months (say, by exceeding industry standard hours each day) would not meet the minimum duration requirement because the instrument requires both.

Definition of a full‑time equivalent day can change the calculus

• Paragraph 1.4.13(4) defines a full‑time equivalent day as either the industry standard working day or 7.6 hours where no standard exists. Because the number of hours per day used to convert hours to "days" may vary by industry, the same number of hours overall may convert to fewer or more "days" depending on the chosen standard. Providers must identify and document the industry standard working day where it exists, or apply the 7.6‑hour default, and ensure documentation matches HESDC reporting.

Part‑time internships can be eligible but require careful tracking

• The instrument allows internships to be part‑time (paragraph 1.4.13(6)(b)). Providers must therefore be careful to aggregate part‑time hours into full‑time equivalent days and to show the minimum duration and 60 FTE days were satisfied. Spreading 60 FTE days over a long period risks running afoul of the "minimum of three calendar months" requirement if other elements of the timing rules are not properly managed.

Commencement and conclusion are activity‑based, not contract date‑based

• Paragraph 1.4.13(5) specifies that the internship commences on the first day the student engages in R&D activities that count toward the FTE days, and concludes on the last day they engage in such activities with the same research end‑user. This means that a contractual start date alone is not determinative; actual activity records are relevant. Gaps in activity, multiple placements, or changes of research end‑user complicate counting.

Requirement that internship be completed prior to doctorate completion

• Paragraph 1.4.12(5)(c) requires the internship requirements to have been met before the student completes their Research Doctorate. If a student completes the doctorate and only thereafter meets the 60 FTE days, the extra weighting does not apply even if the internship occurred during candidature.

Retroactive eligibility and the 2022 date

• The internship-related weighting applies for 2024 and future Grant Years (paragraph 1.4.12(1)), but paragraph 1.4.12(5)(a) limits the internship weighting to completions on or after 1 January 2022. Providers must therefore be aware that internships completed before 1 January 2022 are not eligible for the new weighting even though the instrument’s amendments take effect after registration.

Only one weighting per Research Doctorate completion

• Paragraph 1.4.12(5)(b) establishes that the internship weighting applies only once per Research Doctorate completion. Providers cannot claim multiple internship-related weightings for the same doctorate completion.

Research Masters are excluded from internship weighting

• The 2024+ weighting table explicitly marks Research Masters as N/A for the internship column (paragraph 1.4.12(4)). Providers must not attempt to apply the internship weighting to masters completions; doing so would be inconsistent with the Guidelines.

Ambiguity around "research end‑user"

• The instrument repeatedly requires the internship be with a "research end‑user" but the supplied text does not define that term. If no definition exists elsewhere in the Guidelines, providers will need to seek departmental guidance on what entities qualify as research end‑users for the purposes of forming the written agreement and demonstrating eligibility. This can lead to uncertainty and potential dispute during audits.

Reliance on HESDC reporting may create mismatch risk

• The instrument bases weightings on HESDC‑reported completions (paragraphs 1.4.10(2) and 1.4.12(2)). Providers must ensure timely and accurate HESDC reporting, and make sure the HESDC data fields capture the internship elements required by paragraph 1.4.13. Discrepancies between provider records and HESDC entries risk funding adjustment.

Possible administrative burden for providers

• Implementing processes to identify eligible internships, produce the written agreements within the timing windows, calculate FTE days and convert hours into days, and collate and retain evidence for audit will impose administrative costs. The instrument does not provide transitional funding for these costs; providers will need to absorb implementation overhead.

No express record‑retention period specified

• While the instrument requires written agreements and defines the metrics to be met, it does not state how long HEPs must retain documents or the form of documentary proof required for audit. Providers should assume existing grant audit rules will apply and adopt conservative document-retention practices.

Clerical substitution in 1.6.45(11)

• Schedule 1, item 5 replaces the phrase "research internships" with "research internships" in subparagraph 1.6.45(11) , an identical substitution in the supplied text. This is likely a typographical correction and not substantive, but administrators reviewing versions of the Guidelines should ensure consistency in the consolidated text.

This section sets out concrete, source‑grounded steps for higher education providers, scholarship administrators, research end‑users and students to operationalise the instrument’s requirements and to support accurate HESDC reporting so providers can claim the extra weighting where appropriate.

1. Understand the applicable grant years and temporal constraints

• Verify that the extra weighting applies only from the 2024 Grant Year onward for grant calculations (paragraph 1.4.12(1)), but that the internship itself must be completed on or after 1 January 2022 and prior to the student completing the Research Doctorate (paragraph 1.4.12(5)(a) and (c)). Ensure internal policies track these dates.

2. Update internal policy and process documents

• Amend scholarship and HDR completion administration procedures to incorporate the definitions of research internship and eligible research internship (Schedule 1, item 1 and paragraph 1.4.13). Document the university’s internal rules on how it will treat industry standard working days for different industries (paragraph 1.4.13(4)).

3. Create and standardise the written agreement template

• Draft a written agreement template that satisfies paragraph 1.4.13(2): it must record the R&D activities the student will undertake and the duration of the internship. The agreement should also capture the research end‑user identity, the student's HDR area of research and a clear statement that the student’s activities are R&D related to the HDR. Ensure procedures require the agreement to be signed within the timing windows set out in paragraph 1.4.13(3).

4. Time the written agreement correctly

• For full‑time HDR students, ensure the agreement is executed within 18 months of the student’s Research Doctorate commencement; for part‑time HDR students, within 36 months (paragraph 1.4.13(3)). Monitor commencement dates in the student’s record system to trigger agreement creation.

5. Record and verify commencement and completion dates

• Apply paragraph 1.4.13(5) when logging the internship start and end dates: commencement is the first day the student engages in qualifying R&D activities that count toward FTE days; conclusion is the last such day with the same research end‑user. Maintain timesheets or activity logs that document the R&D engagement dates.

6. Calculate full‑time equivalent days consistently

• Use the industry standard working day hours for the research end‑user where such a standard exists; otherwise apply the 7.6‑hour default in paragraph 1.4.13(4). Convert logged hours into FTE days using the documented standard and keep calculations and underlying logs to support audit.

7. Ensure minimum duration is met

• The internship must be at least three calendar months in duration (paragraph 1.4.13(1)(b)). Plan internship timetables so both duration and 60 FTE days requirements are met in the internship period, remembering that part‑time work may elongate the calendar duration but still needs to meet the three‑month minimum and the 60 FTE day total.

8. Ensure the internship is related to the HDR research area

• Paragraph 1.4.13(1)(d) requires the internship to be related to the student’s Research Doctorate area of research. The written agreement should explicitly describe the nexus to the HDR research area to avoid later dispute.

9. Document mode and nature of engagement

• Paragraph 1.4.13(6) allows on‑site, on‑campus or online internships, and part‑time or full‑time arrangements. The written agreement should identify the mode and expected weekly commitment and how hours will be logged. For online or hybrid internships, define how active engagement and R&D outputs will be evidenced.

10. Coordinate with research end‑users

• Ensure research end‑users understand the reporting and documentation needs (signed agreement, timesheets or activity logs, declarations) because their records may be used to verify the student’s engagement during audits.

11. Update HESDC reporting processes

• Ensure that the HESDC submissions capture the necessary data about HDR completions and any internship metadata required by the Department’s reporting schema. Confirm whether HESDC data items are available for internship status; if not, coordinate with the Department to understand how internship evidence should be retained and produced.

12. Ensure Indigenous status and cost-type classification are correct

• Verify that Indigenous status for students is correctly recorded in student records and the HESDC in order to apply the multiplier set out in paragraph 1.4.12(4). Ensure HDRs are correctly allocated to high‑cost or low‑cost fields of education per Part 1.7, because that classification interacts with the internship weighting (paragraph 1.4.12(6)).

13. Retain documentary evidence for audits

• Maintain the written agreement, timesheets or activity logs, correspondence with the research end‑user, HDR supervision notes linking internship activities to the research topic, and HESDC reporting extracts that show the completion. Although the instrument does not state a retention period, conservative long-term retention consistent with existing grant audit practices is prudent.

14. Train administrative and supervisory staff

• Brief scholarship officers, HDR supervisors and placement coordinators on the new rules, timing windows and documentation requirements so that internships are properly structured and evidence is captured in real time.

15. Perform pre‑claim internal checks

• Before HESDC submission periods, run internal compliance checks to confirm that any claimed eligible research internship met all requirements: written agreement within the timing window, minimum duration of three calendar months, 60 FTE days converted using the correct industry standard or 7.6 hours default, and completion prior to the doctorate completion date (paragraphs 1.4.13 and 1.4.12(5)).

16. Seek departmental clarification where ambiguity exists

• If ambiguity arises about whether an entity qualifies as a research end‑user or how to treat non‑standard working days in a particular industry, seek departmental guidance. The instrument uses terms that may be defined elsewhere in the Guidelines or in Departmental guidance; clarifying these points early reduces audit risk.

17. Do not attempt to apply the internship weighting to masters

• The 2024+ table indicates the internship weighting is N/A for Research Masters (paragraph 1.4.12(4)). Providers must not claim the internship weighting for master’s completions.

18. Manage expectations of students and partners

• Make clear to students and research end‑users that the extra weighting benefits the provider’s grant calculation
