Commonwealth Places (Application of Laws) Act 1970

Understanding the operation of this Act requires a precise dissection of several statutory terms defined in section 3 and deployed throughout the operative provisions.

The first foundational concept is a "Commonwealth place". This is defined as a place (excluding the seat of government) with respect to which the Parliament, by virtue of section 52 of the Constitution, has exclusive power to make laws. This encompasses land acquired by the Commonwealth for public purposes, such as defence bases, federal airports, post offices, and administrative offices. The status of the land is determined strictly by federal acquisition, meaning that if the Commonwealth sells or transfers the land, it ceases to be a Commonwealth place, triggering the transitional provisions of section 19.

The second core concept is "the applied provisions". This term refers to the dynamic body of State laws that are translated into federal law by section 4(1). Rather than freezing State laws at the time of the Act's passage in 1970, the statute incorporates them dynamically: "as in force at a time... in and in relation to each place". This means that when a State parliament amends a local law, that amendment is instantly reflected in the federal applied provisions for Commonwealth places within that State, subject to any federal regulations to the contrary under section 4(6).

The third concept is an "authority of a State". Under section 3, this is defined broadly to include the Governor, a Minister, a member of the Executive Council, a State court, a member of a State court, any body created by or under State law, and any officer or employee of the State or such a body. This expansive definition ensures that every level of the State's administrative and judicial apparatus can be recruited to administer the applied provisions, effectively acting as federal agents for the purposes of the Commonwealth places.

The fourth concept is "the laws of a State". This encompasses both written and unwritten laws, including common law and equity, as well as any administrative instruments made or having effect under those laws. It explicitly excludes laws of the Commonwealth. This distinction is critical because the Act's primary function is to transform these State-sourced rules into federal law "according to their tenor" (section 4(1)), meaning they must be interpreted and applied in the same manner as they would be under State law, despite their transformation into federal statutes.

Finally, the Act recognizes "designated State airports" and "relevant Crimes Act provisions". Introduced by later amendments, a designated State airport (section 3) is a Commonwealth place airport prescribed by the regulations. For these sites, the Act permits a carve-out under section 5(3A), allowing the Australian Federal Police to exercise specific federal powers under the Crimes Act 1914 rather than relying solely on the applied State police powers.

The Commonwealth Places (Application of Laws) Act 1970 directly affects any individual or commercial entity operating on, or traversing, land owned by the Commonwealth. This includes commercial tenants at federal airports, private contractors executing works on military bases, operators of retail outlets on federal land, and employees working within federal administrative precincts. For these private actors, the Act determines which regulatory, criminal, and civil standards govern their daily operations, safety protocols, contractual disputes, and licensing requirements.

The Act also profoundly affects State and federal law enforcement agencies. State police officers are routinely required to enforce laws within Commonwealth places. Because ordinary State police powers do not apply of their own force on federal land, this Act provides the statutory bridge. It empowers State officers to exercise their powers under the applied provisions as if they were enforcing State law, but they do so under a federal constitutional mandate. Conversely, under section 5(3A), members of the Australian Federal Police and special members are affected when operating at "designated State airports", where they must navigate a blended regime of applied State laws and specific federal investigative powers under the Crimes Act 1914.

Furthermore, the Act impacts the judiciary and the legal profession. State courts are directly affected because they are invested with federal jurisdiction under section 7 to hear civil and criminal matters arising within Commonwealth places. Practising lawyers representing clients in disputes arising on federal land must recognise that they are not pleading a State action; they are pleading a federal action based on an applied State provision. This shift changes the source of judicial power, the avenues of appeal, and the applicable constitutional constraints, particularly regarding the separation of powers and the right to a jury trial.

Finally, State Treasury and financial authorities are affected by the financial administration provisions. Section 20 requires the Commonwealth to return to the States any revenue collected under the applied provisions (such as fines or licensing fees), ensuring that the financial position of the State is not degraded merely because the activity occurred on federal land. Under section 21, these funds are shielded from being classified as "other CRF money" under the Public Governance, Performance and Accountability Act 2013, allowing State authorities to retain and manage them directly.

The Act creates a series of unique statutory duties and rights that differ from standard state or federal laws.

For State courts and judicial officers, section 7 imposes a duty by investing them with federal jurisdiction to hear and determine matters arising under the applied provisions. This investment of jurisdiction is subject to strict conditions set out in section 8. Notably, under section 8(1)(a), any decision made by a State court exercising this invested federal jurisdiction is not subject to appeal to Her Majesty in Council (the Privy Council), a restriction that historically protected the integrity of the Australian judicial hierarchy and now reinforces the finality of Australian appellate structures.

Under section 12(1), a procedural duty is imposed on litigants and prosecutors: all civil and criminal proceedings under the applied provisions must be instituted and conducted in the same manner as though they were proceedings under the corresponding State law. This includes the duty to follow State rules of evidence, pleading templates, and criminal procedures. However, this is subject to a vital constitutional right preserved by section 12(3): the trial on indictment of any offence against an applied provision must be by jury. This ensures compliance with section 80 of the Constitution, establishing a non-waivable right to a jury trial for indictable applied offences, even if the underlying State law would have permitted a summary trial or a bench trial.

For administrative authorities, section 4(12) creates a power (which functions as a duty when invoked by citizens) allowing State authorities to perform acts required under State law, even in the absence of a formal executive arrangement under section 6. This prevents administrative paralysis by ensuring that licences, permits, and regulatory approvals can still be processed by State agencies on federal land.

The Act also establishes defensive rights for individuals facing prosecution. Section 13 grants a right of non-objection if a defendant is charged with both an offence under an applied provision and a corresponding State law, ensuring that technical defects in the indictment regarding the exact geographic boundary of the offence do not derail the proceedings. Section 14 and section 15 provide rights of procedural continuity. If a court or an appellate tribunal discovers mid-proceedings that a crime or civil dispute actually occurred in a Commonwealth place (meaning the State charge is constitutionally void), the proceedings must be continued or dealt with on appeal as if they had been initiated under the applied provisions from the outset, saving litigants from having their cases dismissed on technical jurisdictional grounds.

Because the Act does not contain a bespoke schedule of offenses or penalty rates, the substantive penalties for breaches of the applied provisions are drawn entirely from the corresponding State laws. Under section 4(11), any reference in the applied provisions to a conviction, punishment, penalty, or forfeiture is deemed to include a reference to those same consequences as they would exist under the corresponding State law. Thus, if a person commits an assault or violates a workplace safety regulation at a federal airport, the applicable maximum term of imprisonment or financial penalty is dictated by the relevant State Act, but the conviction is entered as a federal conviction.

The enforcement mechanism relies on a complex delegation of authority. Section 6(2) allows the Governor-General to enter into formal arrangements with the Governor of a State to facilitate the performance of duties and functions by State authorities under the applied provisions. These arrangements, which must be published in the Gazette under section 6(6), act as the administrative backbone for day-to-day policing and regulatory enforcement.

Where no arrangement is in force, section 4(12) operates as a fallback enforcement authorization, empowering State officers to enforce the applied provisions. However, the prosecution of these offenses remains subject to federal oversight. Under section 5(4), the Commonwealth Director of Public Prosecutions (DPP) retains the right to intervene or institute proceedings under the applied provisions, although this power is restricted to instances where the proceedings were initiated by federal officers, federal authorities, or the DPP itself.

A major shift in enforcement applies to "designated State airports" under section 5(3A). In these specific Commonwealth places, the standard exclusion of federal policing laws is lifted. Members of the Australian Federal Police and special members are permitted to use "relevant Crimes Act provisions", which include:

• Part IAA (search warrants, arrest powers, and information gathering);
• Section 9 (seizure and condemnation of forfeitable goods);
• Section 13 (institution of proceedings);
• Section 15 (remand and discharge of defendants); and
• Part ID (forensic procedures).

Outside of these designated airports, State police enforcing applied provisions must rely strictly on the applied State police powers and are explicitly exempted from federal policing procedures. For example, under section 5(2A), Part IC of the Crimes Act 1914 (Cth), which dictates detention times and questioning rights for federal suspects, does not apply to State police officers investigating applied offences.

The Commonwealth Places (Application of Laws) Act 1970 operates as a highly specialized statutory filter, selectively switching off standard federal laws and substituting State-based equivalents to maintain the regulatory illusion of a single, unified legal system.

First, it explicitly overrides the default federal interpretive framework. Section 5(1) states that the Acts Interpretation Act 1901 (Cth) does not apply to the applied provisions. Instead, the court must interpret the applied provisions using the relevant State's interpretation legislation. This ensures that terms within the applied provisions retain their local, State-sanctioned meanings.

Second, the Act systematically excludes major portions of the federal criminal law apparatus to prevent them from clashing with the applied State criminal codes. Under section 5(2), the following provisions of the Crimes Act 1914 (Cth) are declared inapplicable to the applied provisions:

• Section 4A (corporate criminal responsibility);
• Section 4AA (ancillary liability);
• Section 4AB (state/territory penalty units);
• Section 4B (pecuniary penalties);
• Sections 4D to 4K (including rules on summary offenses, dual liability, and joint trials); and
• Section 6 (accessory after the fact).

Crucially, section 5(2B) completely excludes the operation of Chapter 2 of the Commonwealth Criminal Code. This means that the codification of general principles of criminal responsibility (such as intention, recklessness, and physical and fault elements) does not apply to offenses prosecuted under the applied provisions. Instead, the court must apply the common law of criminal responsibility or the relevant State Criminal Code (such as those in Queensland or Western Australia) to determine guilt.

Third, the Act modifies the operation of the Judiciary Act 1903 (Cth). Under section 8(2), the standard provisions of the Judiciary Act that invest State courts with federal jurisdiction (specifically sections 39 and 68) do not apply to the applied provisions. This Act acts as its own self-contained source of invested jurisdiction. To prevent constitutional litigation from clogging the High Court, section 8(4) dictates that sections 38A and 40A of the Judiciary Act (which require the automatic removal of constitutional matters to the High Court) do not apply merely because a case involves the application or interpretation of section 52 of the Constitution in relation to a Commonwealth place. Furthermore, section 8(6) excludes sections 72 to 76 of the Judiciary Act, which govern the reservation of points of law and appeals in federal criminal trials.

Fourth, the Act is subordinate to the Commonwealth Places (Mirror Taxes) Act 1998 (Cth). Section 4(1A) clarifies that if a State tax law has been applied as a federal law under the Mirror Taxes Act, it is excluded from application under this Act. This prevents double taxation and ensures that the highly complex administrative arrangements required for federal mirror taxes are kept separate from general regulatory and criminal laws.

Fifth, the Act interacts with the Public Governance, Performance and Accountability Act 2013 (Cth). Section 21 dictates that despite subsection 105(2) of that Act, any money received by a State authority under the applied provisions is not to be treated as "other CRF [Consolidated Revenue Fund] money" of the Commonwealth. This statutory exemption allows State departments to keep fines, licensing fees, and levies collected on federal land without violating federal financial governance frameworks.

The Commonwealth Places (Application of Laws) Act 1970 (Act No. 121 of 1970) was assented to on 11 November 1970 and came into effect across all Australian States on 30 November 1970 via a Proclamation published in the Gazette (gaz 1970, p. 7941). Since its inception, the Act has undergone several waves of structural amendments to align it with evolving federal criminal justice, land acquisition, and financial management frameworks.

The first major cleanup occurred via the Statute Law Revision Act 1973 (Act No. 216 of 1973), which modernized archaic terminology and updated cross-references in sections 15 and 16. This was followed by the Statute Law (Miscellaneous Amendments) Act (No. 2) 1982 (Act No. 80 of 1982), which amended the Schedule to update the list of inapplicable federal provisions as the Commonwealth began centralizing its criminal law procedures.

With the creation of the Commonwealth Director of Public Prosecutions, the Director of Public Prosecutions (Consequential Amendments) Act 1983 (Act No. 114 of 1983) inserted section 5(4) and amended the Schedule. This amendment preserved the Commonwealth DPP's ultimate authority over prosecutions occurring under federal law, while carving out a practical space for State prosecutors to handle routine matters under the applied provisions without constant federal sign-off.

The late 1980s and early 1990s saw rapid adjustments to federal policing and criminal law. The Statute Law (Miscellaneous Provisions) Act (No. 2) 1986 (Act No. 168 of 1986) and the Law and Justice Legislation Amendment Act 1988 (Act No. 120 of 1988) refined the exclusion of the Crimes Act 1914, ensuring that new federal suspect-rights protections did not inadvertently apply to State police operating on federal land. The Lands Acquisition (Repeal and Consequential Provisions) Act 1989 (Act No. 21 of 1989) amended section 17 to link the definition of an "authorized person" (for issuing land ownership certificates) to delegations under section 139 of the newly enacted Lands Acquisition Act 1989.

In 1998, two major shifts occurred. The Commonwealth Places (Consequential Amendments) Act 1998 (Act No. 23 of 1998) inserted section 4(1A) to establish the carve-out for the newly established Commonwealth Places (Mirror Taxes) Act 1998, shielding the national mirror-tax regime from general applied-provisions rules. Concurrently, the Crimes Amendment (Forensic Procedures) Act 1998 (Act No. 96 of 1998) updated the Schedule to exclude the newly enacted forensic procedure rules in Part ID of the Crimes Act 1914, ensuring State forensic laws applied on federal territory.

The consolidation of the Commonwealth Criminal Code led to the Criminal Code Amendment (Theft, Fraud, Bribery and Related Offences) Act 2000 (Act No. 137 of 2000) and the Law and Justice Legislation Amendment (Application of Criminal Code) Act 2001 (Act No. 24 of 2001), which inserted section 5(2B), explicitly shielding the applied provisions from the default application of Chapter 2 of the Criminal Code.

In 2011, the Aviation Crimes and Policing Legislation Amendment Act 2011 (Act No. 1 of 2011) introduced the "designated State airport" concept. It amended section 3, added section 5(3A), and modified the heading of section 5. This amendment reflected growing national security concerns, allowing the AFP to deploy its specific federal search, arrest, and forensic powers at major airports (which are Commonwealth places) rather than relying on State-equivalent police powers.

Finally, the Public Governance, Performance and Accountability (Consequential and Transitional Provisions) Act 2014 (Act No. 62 of 2014) amended section 21 and its heading to replace references to the repealed Financial Management and Accountability Act 1997 with references to the new Public Governance, Performance and Accountability Act 2013, maintaining the financial autonomy of State agencies collecting federal fees under the Act. The text was last updated for minor statutory terminology by the Statute Update Act 2016 (Act No. 61, 2016).

While the text of the Commonwealth Places (Application of Laws) Act 1970 does not explicitly name judicial decisions, the statute itself acts as a procedural roadmap designed to manage, pre-empt, and resolve intense litigation concerning constitutional boundaries.

The primary litigation risk arises from disputes over where a physical act occurred. If a criminal offence or a civil wrong occurs precisely on the boundary of a Commonwealth place (for instance, on a road dividing state land from a federal airport or a military base), a defendant may challenge the jurisdiction of the prosecuting authority. They might argue that they were charged under State law, but because the act occurred inside a Commonwealth place, the State law was constitutionally inapplicable under section 52 of the Constitution.

The Act manages this specific litigation strategy through several procedural rules:

• Evidentiary Certificates (Section 17): To prevent prolonged disputes over land titles, the Act provides that a certificate in writing by an authorized person (a delegate under section 139 of the Lands Acquisition Act 1989) as to the ownership of land on a specified date is prima facie evidence of the matters stated. In litigation, this shifts the burden of proof to the defendant to prove that the site was not a Commonwealth place.
• Charging Errors (Section 13): If a prosecutor is uncertain of the boundary, they may charge the defendant with both the State offence and the corresponding federal applied-provision offence. Section 13 explicitly strips the defendant of the right to object to the indictment on the ground that two offences have been charged.
• Procedural Continuation (Section 14): If, during a trial under State law, it is proven that the land was actually a Commonwealth place (rendering the State law inapplicable), the litigation does not collapse. The court must continue the trial as if the defendant had been charged under the corresponding applied provision from the beginning.
• Appellate Salvage (Section 15): If the jurisdictional error is only discovered on appeal, the appellate court is instructed to treat the entire trial as if it had been brought under the applied provisions and to deal with the appeal accordingly, salvaging the conviction or civil judgment.

Furthermore, section 16 restricts the appellate jurisdiction of the High Court. If a litigant attempts to appeal a judgment from a state or federal court on a ground that involves the operation or interpretation of section 52 of the Constitution in relation to a Commonwealth place, they cannot do so as of right. They must obtain special leave from the High Court. This statutory barrier protects the High Court from being inundated with minor geographic boundary disputes dressed up as constitutional test cases.

For legal practitioners, corporate compliance officers, and commercial operators, the Commonwealth Places (Application of Laws) Act 1970 contains several significant "gotchas" that can easily compromise litigation or invalidate corporate procedures if overlooked.

The first major trap is the complete exclusion of the Acts Interpretation Act 1901 (Cth) (section 5(1)). Practitioners accustomed to interpreting federal statutes using standard federal rules (such as those governing the calculation of time, the definition of "person", or the use of extrinsic materials) will err if they apply those rules to an applied provision. Because State interpretation laws apply instead, the exact same words in an applied provision may have a different legal meaning than they do in an adjacent federal Act.

The second trap is the disapplication of Chapter 2 of the Commonwealth Criminal Code (section 5(2B)). If a client is charged with a federal offence under an applied provision, a defence counsel cannot rely on the default federal principles of criminal responsibility (such as the federal definition of recklessness or corporate culture provisions). Instead, they must apply the state-specific common law or state criminal code. This means a corporate defendant's liability for an accident on a federal airport tarmac will be assessed under a completely different standard of criminal attribution than a similar accident on a state-owned road, even though both are prosecuted in federal jurisdiction.

The third trap is the fluidity of land status governed by section 19. If the Commonwealth sells a piece of land to a private developer, that land instantly ceases to be a Commonwealth place. At that exact millisecond, the federal applied provisions cease to operate, and ordinary State laws resume their direct force. Section 19 contains complex transitional rules to preserve accrued rights and liabilities. However, corporate entities must realize that a compliance manual drafted for a tenant on federal land may become legally obsolete the moment the Commonwealth divests itself of the underlying real estate.

The fourth trap is the jury trial mandate under section 12(3). Many modern State regulatory and criminal systems allow for summary hearings or judge-only trials for medium-tier offenses to save time and expense. However, because these state laws are applied as federal laws, they are subject to section 80 of the Constitution. Section 12(3) explicitly mandates that any trial on indictment under the applied provisions must be by jury. Practitioners cannot consent to a judge-only trial on indictment, which can significantly alter litigation costs, duration, and trial strategies.

The fifth trap is the geographic limitation of state powers under sections 4(13) and 4(14). While these sections validate the exercise of powers across boundaries (allowing a state officer to exercise powers inside a Commonwealth place for an act done outside it, and vice versa), they require precise geographic mapping. If a State police officer exercises a power on federal land without realizing they are relying on an applied provision that has been modified or switched off by federal regulations (under section 4(6)), their actions, including searches and arrests, may be declared unlawful.

To ensure compliance with this complex legal regime, commercial entities, legal advisors, and regulatory officers must adopt a systematic, place-based compliance strategy.

Step 1: Conduct a Geographic and Jurisdictional Audit

Identify every physical location where your organisation operates. Determine if any of these sites are situated on land owned by the Commonwealth (such as leased premises inside federal airport boundaries, maritime ports on federal land, or research facilities).

• If in doubt, request a formal confirmation of land ownership from the relevant federal department.
• In the event of active or threatened litigation, formally request a certificate as to the ownership of the land under section 17 from an authorized delegate of the Lands Acquisition Act 1989 to establish a clear evidentiary baseline.

Step 2: Apply the Correct Statutory Lens

When analyzing legal rights, liabilities, or compliance obligations for activities occurring within a Commonwealth place, do not search for a federal Act. Instead:

1. Identify the corresponding State law that governs the activity outside the Commonwealth place (e.g., the State’s work health and safety Act, environmental protection Act, or summary offences Act).
2. Treat this State Act as if it has been enacted by the Commonwealth Parliament as an "applied provision".
3. Ensure that your legal analysis completely ignores the Commonwealth Acts Interpretation Act 1901 and Chapter 2 of the Commonwealth Criminal Code.
4. Apply the relevant State's interpretation Act and the State's criminal responsibility rules (common law or State Criminal Code) to interpret the applied provision.

Step 3: Check for Federal Modifications and Carve-outs

Do not assume that the State law applies in its absolute purity.

• Check the regulations made under section 4(6) of the Act to determine if the Commonwealth has modified or completely switched off the application of specific State provisions within that particular Commonwealth place.
• Ensure that any tax-related issues are analyzed under the Commonwealth Places (Mirror Taxes) Act 1998 rather than this Act.

Step 4: Validate Administrative Actions

If your business relies on licences, permits, or approvals issued by a State authority for operations on federal land:

• Confirm whether there is a formal section 6 arrangement in place between the Governor-General and the Governor of the relevant State.
• If no such arrangement is published in the Gazette, verify that the State authority has exercised its powers under the fallback authorization provided by section 4(12) of the Act.
• Ensure that any payments made to State authorities under these applied provisions are processed in accordance with section 21, verifying that they do not require federal PGPA Act processing.

Step 5: Draft Contracts and Instruments with Applied Provisions in Mind

When drafting leases, employment agreements, or commercial contracts for operations within a Commonwealth place, ensure that references to governing law are legally precise. Under section 11, any reference in an instrument to a State law that is inapplicable due to section 52 of the Constitution will be read as a reference to the corresponding federal applied provision. However, to avoid ambiguity, contract drafters should explicitly state that the contract is governed by the laws of the relevant State, including those laws as they apply as laws of the Commonwealth under the Commonwealth Places (Application of Laws) Act 1970.
