Commonwealth Places (Administration of Laws) Act 1970

Commonwealth place is defined in section 3 by reference to section 52 of the Commonwealth Constitution: a place (not being the seat of government) over which the Commonwealth Parliament has exclusive legislative power. Classic examples include defence establishments, airports, post offices and other Commonwealth-owned land. The definition is territorial and constitutional, not functional. Whether a particular parcel of land is a Commonwealth place is a question of fact and law, and the Act provides for certificates as to ownership (section 13) to be used as evidence in proceedings.

The applied provisions are the provisions of Victorian laws that the Commonwealth Act picks up and applies as Commonwealth law within Commonwealth places. The Commonwealth Act does not create new federal law; it adopts existing state laws and treats them as federal for the purpose of that place. The state Act refers to these as "the applied provisions". The relationship is symbiotic: the Commonwealth Act supplies the federal statutory basis for the application, and the state Act supplies the administrative and procedural infrastructure.

Authority is broadly defined in section 3 to include the Governor, a Minister, a member of the Executive Council, a state court, a person holding office as a member of a state court, a body created by or under state law, and any officer or employee of the State or of such a body. This covers almost every conceivable state actor. The breadth means that any state official who would normally administer a law can continue to administer that law when it is operating as an applied provision, without needing a fresh statutory appointment.

Laws of the State includes all written and unwritten laws in force in Victoria, including instruments made under those laws, but expressly excludes Commonwealth laws. This ensures that the applied provisions are the state laws as they exist from time to time, not some frozen snapshot. If Victoria amends its criminal code, those amendments automatically flow through to the applied provisions in Commonwealth places, unless the Commonwealth Act provides otherwise.

Arrangements (section 4) are a key concept: the Governor may make an arrangement with the Governor-General for state authorities to exercise or perform powers under the applied provisions. This allows for flexible, bilateral agreements on which body will handle which function. The section also permits arrangements on any matter necessary to give effect to the Commonwealth Act. Arrangements can be varied or revoked. This is a coordination mechanism that avoids the need for detailed federal legislation on every administrative detail.

The Act primarily affects two groups: state authorities and persons within Commonwealth places in Victoria.

State authorities - courts, police officers, regulatory inspectors, licensing bodies, and local government officers where they act under state law - gain the statutory power to act under the applied provisions. For example, a Victorian police officer who would normally enforce the Victorian Summary Offences Act can enforce that Act as an applied provision within a Commonwealth place. Without section 5, the officer might be acting without authority because the place is constitutionally subject to exclusive Commonwealth legislative power, and the officer's state warrant only extends to state law enforcement in state territory. The Act bridges that gap.

Persons present in or dealing with Commonwealth places are affected because the substantive law that applies to them in that place is the same state law that applies elsewhere in Victoria, but it operates as Commonwealth law. That distinction matters for jurisdictional questions: an offence committed in a Commonwealth place is an offence against a Commonwealth law (the applied provision), even though the text of the law is identical to the state provision. This affects which court hears the matter, which appeal path applies, and whether double jeopardy protection arises under the Commonwealth or state system.

The Act also affects anyone who owns land that may be a Commonwealth place, because certificates as to ownership (section 13) can be used in proceedings to establish whether a place is a Commonwealth place. This imposes an evidentiary burden on the party challenging such a certificate. Additionally, persons who have been charged under the wrong law benefit from sections 11 and 12, which allow proceedings to continue under the correct law rather than being dismissed on technical jurisdictional grounds.

Finally, the transitional provisions in section 14 affect anyone with existing rights or obligations when the status of a place changes. If a defence base is decommissioned and ceases to be a Commonwealth place, the Act ensures that contracts, leases, licences and other legal relationships continue under state law without disruption.

The Act imposes few duties directly. Its main effect is to confer powers and create procedural rights and protections. The key duties are:

Duty to comply with arrangements (section 4): Once an arrangement is made, state authorities are expected to act in accordance with it. There is no penalty for non-compliance in this Act, but an authority that disregards an arrangement may act without the legal cover that the arrangement provides.

Duty to avoid double punishment (section 8): A person who has been punished under the applied provisions for an offence cannot be punished again under the corresponding state law. This protects against double jeopardy, but it is asymmetric: the Act does not expressly prohibit punishment under the applied provisions after state law punishment. However, the Commonwealth Act likely has mirror provisions that cover that direction, and section 8 of the state Act only deals with the scenario where the applied provisions have already been used.

Rights of persons charged: Under section 11, if a person is charged with an offence under a provision believed to be part of the applied provisions, but the court finds the provision is not an applied provision (for example, because the place is not a Commonwealth place), and a state law corresponds to that provision, the proceedings continue as if the person had been charged under state law. This prevents acquittal on a technicality. Similarly, section 12 applies this rule to appeals: the appellate court must treat the appeal as if it had been brought under the corresponding state law. These sections operate in favour of the accused in the sense that they avoid the need for a fresh charge, but they also ensure that the state can proceed with prosecution regardless of jurisdictional uncertainty.

Rights of persons with existing interests: Section 14(1) protects rights, privileges, obligations and liabilities that accrued under state law when a place becomes a Commonwealth place. For example, if a person had a lease from the State over land that later becomes a Commonwealth place, the lease is not invalidated. The savings provision also preserves legal proceedings and penalties. This is a due process safeguard.

Right to rely on certificates: A party to proceedings can produce a certificate under section 13 as evidence of ownership of land, which may be decisive on the question of whether a place is a Commonwealth place. The certificate is prima facie evidence; the opposing party may rebut it. This reduces the cost and complexity of proving land title in jurisdictional disputes.

The Commonwealth Places (Administration of Laws) Act 1970 does not itself create offences or penalties. Penalties arise under the substantive laws that are picked up as applied provisions. For example, if the Victorian Road Safety Act is applied as a Commonwealth provision in a Commonwealth place such as an airport, the penalties for speeding or drink-driving under that Act apply. The state Act's enforcement role is indirect: it ensures that Victorian authorities can enforce those penalties.

Section 8(2) expands the meaning of references in state laws to conviction, punishment, penalty or forfeiture to include those under the corresponding applied provisions. This is important for laws that impose cumulative consequences, such as automatic licence suspension upon conviction for certain offences. Without this deeming, a conviction under the applied provisions might not trigger the state administrative consequence. The section ensures that the state penalty regime operates seamlessly regardless of which jurisdictional label attaches to the conviction.

Enforcement mechanisms are those available to the state authority under the relevant state law. For instance, if a Victorian environmental protection officer issues a clean-up notice under an applied provision, that notice can be enforced in the same way as if it were issued under state law, because section 7 deems the act to have been done under the law of the State where the act could have been done under state law anyway. This validation provision effectively cures any jurisdictional defect in the officer's actions, provided the officer had the substantive power under state law.

The double jeopardy provision in section 8(1) is a prohibition on further punishment. If a person has already been punished under the applied provisions, the state cannot punish them again for the same act under the corresponding state law. This is enforceable by the person raising it as a defence in any subsequent state prosecution. Conversely, if the state punishes first, the Commonwealth Act's equivalent provision would prevent punishment under the applied provisions.

The Act exists solely to support the Commonwealth Places (Application of Laws) Act 1970 (Cth). The Commonwealth Act is the primary instrument; the state Act is ancillary. Section 3 defines "the Commonwealth Act" and "the applied provisions" with reference to the Commonwealth Act. Section 4(2) explicitly permits arrangements for any matter necessary to give effect to the Commonwealth Act. Without the Commonwealth Act, the state Act would have no work to do.

The state Act interacts with all Victorian laws that are capable of being applied as applied provisions. Since "laws of the State" includes all written and unwritten laws (section 3), the interaction is potentially comprehensive. However, the Commonwealth Act may exclude certain state laws from being applied, or may apply them with modifications. The state Act does not override those exclusions; it merely facilitates administration where the Commonwealth Act has applied a state law.

Section 5 provides that an Authority may act under the Commonwealth Act "notwithstanding the provisions of any law of the State". This means that a state law that would otherwise restrict an authority's ability to act for a federal purpose is overridden. For example, if a state Act requires a warrant to be issued by a state magistrate for entry onto premises, that requirement may be displaced if the applied provisions (as federal law) have a different regime. But this override only operates to the extent necessary to allow the authority to exercise federal functions; the state law remains in effect for state purposes.

Section 6 coordinates causes of action: if an act gives rise to a cause of action under both state law and the applied provisions, and the cause of action under the applied provisions is extinguished, the state cause of action is also extinguished. This prevents double recovery and ensures that limitation periods and releases under the applied provisions are mirrored in state law. It is a form of claim preclusion.

The savings provision in section 14 interacts with the general law of statutory interpretation and with the Commonwealth Act. Subsection (1) saves the operation of state law for past matters when a place becomes a Commonwealth place. Subsection (2) and (3) ensure continuity when a place ceases to be a Commonwealth place, deeming state laws to apply from that moment and deeming appointments and circumstances under the applied provisions to continue under state law. This avoids the need for fresh administrative acts.

Section 13 interacts with the law of evidence: certificates are admissible as evidence in proceedings under the law of the State. The certificate does not conclusively prove ownership; it is rebuttable. The section defines "authorised person" by reference to section 17 of the Commonwealth Act, so the federal definition controls.

The Act received two amendments after its commencement on 1 February 1971.

The Commonwealth Places (Administration of Laws) Act 1971 (No. 8156/1971), assented to on 19 October 1971 and commencing on the same day, amended section 4(1) by inserting the words "for or in relation to" in two places. The amendment broadened the scope of the Governor's power to make arrangements. Before the amendment, section 4(1) referred to provision being made for the exercise or performance of a power, duty or function. The amendment made clear that arrangements could also cover provision "for or in relation to" the exercise or performance of such functions. This was a minor but clarifying textual change.

The Commonwealth Places (Administration of Laws) Act 1974 (No. 8592/1974), assented to and commencing on 6 November 1974, repealed section 15. The repealed section is not reproduced in the version provided; the endnote records only that it was repealed. The content of section 15 is unknown from the source, but its repeal removed a provision that presumably had become obsolete or was superseded by other legislation. The repeal was clean, with no savings provision in the amending Act.

The Act has not been amended since 1974. Version No. 012 incorporates amendments as at 16 August 2012, meaning the text has been static for nearly four decades. This stability suggests the Act functions adequately and has not required policy changes. The Commonwealth Places (Application of Laws) Act 1970 (Cth) itself was repealed and replaced by the Commonwealth Places (Application of Laws) Act 1998 (Cth) and later by the Commonwealth Places (Application of Laws) Act 2018 (Cth). However, the Victorian Act continues to refer to "the Commonwealth Act" as defined in section 3, which includes that Act as amended. Thus the Victorian Act is not tied to the original 1970 Commonwealth Act; it is dynamic and can accommodate future federal amendments without further state legislative changes. This design reduces the need for amendment.

The source text does not mention any litigation history. However, given the Act's procedural nature, it is likely that it has been considered in cases where the jurisdictional status of a Commonwealth place was disputed, or where a defendant challenged the authority of a state official to act within a Commonwealth place. The Act's validation provision (section 7) and its continuance provisions (sections 11 and 12) are the kind of provisions that are invoked in criminal appeals to cure technical defects. Courts interpreting the Act would need to construe "commonwealth place" and "applied provisions" in conjunction with the Commonwealth Act, and deal with the evidentiary weight of certificates under section 13.

Because the Act does not create substantive rights or liabilities, it is unlikely to be the subject of standalone constitutional challenge. Nevertheless, it sits within an area of federal constitutional law involving the interplay between sections 52 and 122 of the Constitution and the Commonwealth's power over places acquired by the Commonwealth. Any litigation would typically involve the Commonwealth Act as the primary statute, with the state Act being relevant to questions of state authority.

Practitioners should be aware that the Act's provisions have remained unchanged for decades, and the judicial interpretation of analogous provisions in other states' mirror legislation may be persuasive in Victoria. The High Court of Australia has considered the Commonwealth Places (Application of Laws) Act in several cases, and those decisions would influence the construction of the Victorian Act. However, without a specific case cited in the source, this deep dive cannot name any.

Several less obvious features of the Act can trap practitioners.

Asymmetric double jeopardy protection: Section 8(1) only bars punishment under state law if the offender has already been punished under the applied provisions. It does not expressly prevent punishment under the applied provisions if the offender has already been punished under state law. The Commonwealth Act's corresponding provision (section 11) presumably covers that situation, but the gap means that a person could theoretically be punished twice if the prosecutions proceed in the wrong order and the federal double jeopardy provision is not engaged. Practitioners should check the Commonwealth Act carefully.

Validation of acts (section 7) is retrospective but limited: If an authority purported to act under the applied provisions but had no power under those provisions, section 7 deems the act to have been done under state law, provided the authority could have done that act under state law. This is a powerful cure. However, it only applies if the act "could have been done" under state law. If the authority lacked power under both federal and state law, the validation does not operate. Also, the validation does not apply to acts that were invalid for reasons other than jurisdictional error, such as procedural unfairness.

Automatic application of state laws when a place ceases to be a Commonwealth place (section 14(2)): The Act says state laws apply "as if those laws had come into operation at that particular time". This means that the state laws apply prospectively from the moment the place ceases to be a Commonwealth place. But it does not give retrospective operation to state laws for the period when the place was a Commonwealth place. Any acts done during the Commonwealth period are governed by the applied provisions. Confusion can arise if the state law has been amended in the interim.

Deemed continuity under section 14(3): When a place ceases to be a Commonwealth place, all persons, things and circumstances created under the applied provisions are deemed to continue under the laws of the State with the same status, operation and effect. This is broad language that could cover licences, permits, appointments of trustees, and even statutory bodies. However, the deeming only applies "under and subject to the laws of the State". If the relevant state law has since been repealed or does not provide for such appointments, the continuity may be broken. The provision is a safety net, not an absolute guarantee.

Form of instruments (section 9): If an instrument refers to a provision as part of the applied provisions, but that provision does not actually have effect in relation to the act, matter or thing (because, for example, the place is not a Commonwealth place), the reference is read as a reference to the corresponding state law. This is a statutory interpretation rule that can salvage contracts, notices and other documents that accidentally misstate the governing law. But it only operates where there is a corresponding state provision; if no correspondence exists, the instrument may be void.

Objection not allowable where two offences charged (section 10): In proceedings where both an offence against state law and an offence against the applied provisions are alleged, a party cannot object solely on the ground that two offences are alleged. This prevents technical demurrers. However, the section does not prevent other objections, such as duplicity or improper joinder under general procedural law.

Compliance with the Commonwealth Places (Administration of Laws) Act 1970 primarily concerns state authorities rather than private individuals. For a state authority, the key steps are:

1. Identify whether a place is a Commonwealth place. Before exercising a power under the applied provisions, an authority should verify the status of the land. Section 13 certificates can be obtained from the Commonwealth or state land titles office. If doubt remains, the authority may rely on section 7 validation as a fallback, but it is prudent to act under the correct law from the outset.

2. Confirm that an arrangement under section 4 is in place, or that the authority is otherwise empowered under the Commonwealth Act. Section 5 allows authorities to act under the Commonwealth Act generally, but arrangements provide a clearer framework. Authorities should check whether an arrangement covers the specific function and place.

3. When issuing charges, consider both the applied provisions and the corresponding state law. If a charge is laid under the applied provisions and the place is later found not to be a Commonwealth place, section 11 allows continuance under state law. However, the authority should ensure it has the power to lay charges under both regimes. The charging document should be drafted to refer to the correct law, but section 9 provides a statutory correction mechanism if the reference is wrong.

4. Record-keeping for transitional events. If a place becomes or ceases to be a Commonwealth place, the responsible state department should document the timing and ensure that relevant licences, permits, appointments and legal proceedings are transferred according to section 14. For example, if a lease was granted under state law and the land becomes a Commonwealth place, the lessee's rights are preserved under section 14(1). The authority should communicate with the lessee to confirm continuity.

5. Avoid double punishment. When prosecuting an offence that could be both a state and an applied provision offence, the authority should check whether the person has already been punished under the other regime. Section 8(1) only prevents punishment under state law after applied provision punishment; but as a matter of policy, the authority should coordinate with Commonwealth prosecutors to avoid successive punishment.

For private individuals, compliance is passive: they should be aware that the law in a Commonwealth place is the same as the surrounding state law, but mistakes in charging documents can be cured. If charged under the applied provisions, they should check whether the place is indeed a Commonwealth place; if not, they may apply for the charge to be continued under state law (section 11). If they have been punished under the applied provisions and later face state charges for the same conduct, they can raise the double jeopardy bar in section 8(1). Conversely, if punished under state law first, they must rely on the Commonwealth Act's equivalent provision for protection.

Legal practitioners advising clients should obtain a certificate under section 13 if the status of the place is in issue. They should also review any arrangements under section 4 that may be relevant to their client's dealings with a state authority. The Act's long period without amendment means that case law interpreting it is likely sparse, but the parallel federal and state schemes are well traversed in higher courts.
