Commonwealth Parole Board (Consequential and Transitional Provisions) Act 2026

The Act rests on a handful of core statutory concepts that restructure who decides, what decisions must be made and when, and what procedural obligations attach to those decisions.

1. Transfer of decision‑making authority to the Commonwealth Parole Board. Across dozens of changes in Schedule 1 the Act replaces references to the Attorney‑General with references to the Commonwealth Parole Board and anchors the meaning of parole order to the new section 19AKD(1) (see Schedule 1 items 1-3 and many later items replacing “Attorney‑General” with “Commonwealth Parole Board”). The Act therefore reframes parole decision‑making as an administrative Board function and ties definitions to the Commonwealth Parole Board Act 2026 (for example, the Chair and the Board are defined by reference to that Act (Schedule 1 item 2)).

2. Mandatory decision timetable and categories. New section 19AKB imposes an express, mandatory rule: before the end of a person’s non‑parole period the Board must either decide to make a parole order, refuse to make one, or defer the decision until a date not later than three months after the non‑parole period (s 19AKB(1)). If the Board fails to decide before the end of the non‑parole period, it must decide as soon as practicable afterwards (s 19AKB(2)). Where a non‑parole period has been fixed for multiple sentences, the relevant end point is the end of the last non‑parole period (s 19AKB(3)).

3. Reconsideration framework. If the Board refuses parole, new section 19AKC requires the Board to reconsider within a statutory reconsideration period (s 19AKC(1)), with the default period being 12 months but permitting the Board, if appropriate, to extend it to up to 24 months (s 19AKC(4)). Subsection 19AKC(2) provides a narrow exception to the reconsideration obligation where, at the end of the 12‑month period, the person has fewer than 30 days remaining on any sentence to which the parole order would relate.

4. Parole order content and timing. Section 19AKD requires that once the Board decides to make a parole order it must make the order as soon as possible and that the order be in writing, specify whether release is subject to supervision and, if supervision is to end before the parole period ends, specify the supervision end date (s 19AKD(1)-(2)). The Board may also, if appropriate, specify an early release date no earlier than 30 days before the end of the non‑parole period (s 19AKD(3)).

5. Notices and procedural fairness. The Board must give written notice of refusals and include a statement of reasons and the effect of the reconsideration provision within 14 days after a refusal (s 19AKF(1)). A deferral also attracts a 14‑day notice obligation stating the reasons for deferral and the date by which the Board must decide (s 19AKF(2)).

6. Pre‑release rescission power and its effects. New Subdivision AA creates a power to rescind parole orders or licences during the relevant pre‑release period where specified conditions are satisfied (s 19APC(1)). The grounds include: serious identifiable risk to community safety that cannot be mitigated by directions or by changing conditions, serious and immediate self‑harm risk not mitigable by directions or conditions, a request by the person, or a substantial change in a matter considered when making the order (s 19APC(1)(a)-(d)). If the Board rescinds, it must notify the person and allow 14 days for written submissions (s 19APD). If the rescission remains in effect because the person does not make submissions or the Board confirms the rescission, it is taken to be a refusal for the purposes of the Act (s 19APE(1)).

7. Interaction with State or Territory sentences. Section 19AKE provides that the Commonwealth Parole Board is not required to decide on parole before the day on which a person is first eligible for release in relation to the last of the State or Territory sentences when that eligibility arises after the federal non‑parole period. It also addresses life sentences for which a non‑parole period has not been fixed (s 19AKE(4)), effectively suspending mandatory decision obligations in those scenarios.

8. Transitional and saving concepts. Schedule 2 ensures that existing parole orders and licences continue in force on and after commencement (item 2), prescribes how pre‑commencement refusals to which notice had not been given must be handled (item 3), preserves rights to seek judicial review of matters that arose under the old Part IB despite repeal (item 4), and carries forward pre‑commencement information into the new definitions of Parole Board information and federal offender information (item 5).

Together these concepts create a regime where an independent Board, constituted under the Commonwealth Parole Board Act 2026, assumes statutory responsibilities for parole decision‑making subject to express procedural timelines, notice obligations and a new power to rescind immediately pre‑release in prescribed circumstances.

The Act primarily affects five groups: persons subject to federal sentences, the Commonwealth Parole Board and its members, correctional authorities and community corrections officers, legal advisers and judicial review applicants, and agencies that hold or supply offender information.

1. Persons subject to federal sentences. All federal offenders whose parole orders, licences, release dates, non‑parole periods and reconsideration timelines fall under Part IB of the Crimes Act 1914 are directly affected. The Board’s obligations to decide before the end of the non‑parole period (s 19AKB(1)) and the procedural rights created by notices (s 19AKF) and the rescission submission period (s 19APD(2)) change who makes decisions that affect release. Those serving State or Territory sentences in addition to federal sentences are also affected by the interaction rule in s 19AKE, which may defer the Board’s duty to decide until State eligibility is reached.

2. Commonwealth Parole Board, Chair and members. The Act expressly refers to the Chair and other members of the Commonwealth Parole Board and ties those roles to appointment provisions in the Commonwealth Parole Board Act 2026 (Schedule 1 item 2). The Act creates mandatory duties for the Board to make decisions and to give notices (ss 19AKB, 19AKF, 19APD), and to exercise a discretionary rescission power with reasoned outcomes (ss 19APC-19APE). The Board is now the central decision maker for parole matters that were formerly cast as Attorney‑General functions.

3. Correctional authorities and community corrections officers. The Act references the ability of directions from a community corrections officer to mitigate risk, by making that mitigation relevant to whether the Board may rescind a parole order under s 19APC(1)(a)(ii) and (b)(ii). Correctional services will also be responsible for operationalising any release date changes, ensuring that written parole orders are held and that release does not occur where the Board has lawfully rescinded a parole order pre‑release.

4. Legal advisers, advocates and the courts. Lawyers and advocates representing people subject to federal parole decisions must adapt practice to the Board framework: new notice timeframes, the submission window after rescission (s 19APD(2)), the reconsideration windows (s 19AKC(4)), and preserved rights to seek judicial review of decisions that arose under the old Act (Schedule 2 item 4). The Federal Court and the Federal Circuit and Family Court (Division 2) remain the fora for ADJR applications related to matters arising under the previous Part IB (Schedule 2 item 4).

5. Information holders and sharing partners. The transitional rules carry pre‑commencement information forward to the new definitions of Parole Board information and federal offender information (Schedule 2 item 5). Agencies that collected information prior to commencement should expect their records to be treated as lawful material for the Board’s functions after commencement. The Commonwealth Parole Board Act 2026’s definition of Parole Board information is directly referenced, so entities must review how their information sharing arrangements align with that Act and with the amendments in the Crimes Act (see Schedule 2 item 5).

In addition, the broader public and victims may be indirectly affected through altered timelines for release and by the Board’s discretion to specify supervised release, supervision end dates, and the possibility of rescission before release. The Act does not create new criminal penalties for stakeholders; rather, it changes decision‑maker identity, process timelines and procedural protections. Existing parole orders and licences made before commencement continue in force under the amended Act, so persons with existing instruments maintain their conditions subject to the same terms (Schedule 2 item 2).

The Act creates explicit statutory duties for the Commonwealth Parole Board and concurrent procedural rights for persons affected by parole decisions. Those duties and rights are concentrated in the new sections inserted into Part IB of the Crimes Act 1914 and the transitional provisions.

Duties of the Commonwealth Parole Board

• Mandatory decision by non‑parole period end. Under s 19AKB(1), the Board must, before the end of the non‑parole period fixed for a person, decide to make a parole order, refuse to make a parole order, or defer the decision until no later than three months after the non‑parole period. If the Board does not make a decision before that end point, s 19AKB(2) requires it to decide as soon as practicable after the end of that period. For multiple sentences, the end of the last non‑parole period is the operative date (s 19AKB(3)).

• Reconsideration obligations. If the Board refuses parole, s 19AKC(1) requires the Board to reconsider within the “reconsideration period,” which is typically 12 months beginning on the day of the refusal, but the Board may, if it considers it appropriate, set a period of more than 12 months but not more than 24 months (s 19AKC(4)). The Board must decide, on reconsideration, to make, to refuse, or to defer (s 19AKC(1)). The Board is not required to reconsider if, at the end of 12 months, the person does not have 30 days or more remaining on any relevant sentence (s 19AKC(2)).

• Duty to make parole orders promptly after deciding to do so. Section 19AKD(1) requires the Board to make the parole order as soon as possible once it has decided to make one. The order must be in writing and specify whether release is subject to supervision and the date supervision ends if earlier than the parole period (s 19AKD(2)).

• Notice and reasons. Where the Board refuses parole, s 19AKF(1) requires a written notice to the person within 14 days after the refusal that informs the person of the refusal, includes a statement of reasons, and sets out the effect of s 19AKC (reconsideration). Where the Board defers a decision, s 19AKF(2) requires a notice within 14 days stating that the Board has deferred, the reasons for the deferral, and the date by which the Board must decide.

• Pre‑release rescission and procedural follow‑up. The Board may rescind a parole order or licence during the person’s relevant pre‑release period where specified grounds are satisfied (s 19APC). If the Board rescinds, s 19APD obliges the Board to notify the person in writing and request a written submission within 14 days explaining why the order should not have been rescinded. The Board must then decide, as soon as practicable after receiving any submission, whether the rescission remains in effect or ceases to be in effect, based on the submission and any other material it considers relevant (s 19APD(4)-(5)). If the rescission remains in effect (because the person does not make submissions or the Board confirms the rescission), the rescission is taken to be a refusal under s 19APE(1).

Rights and protections for persons

• Right to written reasons and notice following refusal. Section 19AKF(1) entitles a person to a written notice of refusal and a statement of reasons within 14 days of the refusal. The notice must also inform the person about the reconsideration mechanism in s 19AKC.

• Right to be notified and to make submissions after rescission. Where the Board rescinds a parole order or licence pre‑release, the person is entitled to receive written notice of the rescission and reasons, and to provide a written submission within 14 days as to why the rescission should not have occurred (s 19APD(2)). The Board must consider the submission and any other relevant material when deciding whether the rescission remains in effect (s 19APD(4)-(5)).

• Reconsideration right after refusal. Following a refusal, a person has a statutory right to have the refusal reconsidered within the reconsideration period set by s 19AKC. The default is 12 months, but the Board may extend to at most 24 months if appropriate (s 19AKC(4)). The Board must give a notice about reconsideration effects in the original refusal notice under s 19AKF(1)(c).

• Preservation of judicial review. Schedule 2 item 4 preserves the right to apply for judicial review under the Administrative Decisions (Judicial Review) Act 1977 for matters that arose under the old Part IB, even though that earlier version of the Act has been repealed. This retains the capacity to seek Federal Court or Federal Circuit Court review of administrative decisions that were in play at commencement.

Other rights and duties of note

• Scope of discretion on early release. Section 19AKD(3) permits the Board, if it considers it appropriate, to specify an early release date no earlier than 30 days before the non‑parole period ends. That is a discretionary power for the Board to shorten custodial time within a prescribed envelope.

• Interaction with State/Territory sentences. Section 19AKE defines circumstances where the Board is not required to decide on federal parole because State or Territory sentences mean the person will not be released earlier. The Board’s duty is suspended until the person is first eligible for release in relation to the last State/Territory sentence when that eligibility comes after the federal non‑parole period.

• Limited express protections against revocation/rescission confusion. Section 19APF clarifies that references to revocation do not include rescission under s 19APC. This matters for how revocation and rescission are invoked administratively and legally within the statutory framework.

The Act therefore combines mandatory timing obligations, procedural notice and reasons obligations, a specific right to make submissions on rescission, and preserved access to judicial review, while giving the Board both mandatory duties and certain discretionary powers such as early release within 30 days and extension of reconsideration periods up to two years.

This Act does not create new criminal offences or specify financial penalties. Its enforcement and compliance mechanisms are administrative and judicial in character rather than punitive criminal sanctions.

Enforcement mechanisms available under the Act

• Administrative performance obligations. The Act imposes clear statutory duties on the Commonwealth Parole Board, such as the duty to decide before the end of the non‑parole period (s 19AKB(1)), the duty to give notices within 14 days after a refusal or deferral (s 19AKF(1)-(2)), and the duty to give a post‑rescission notice and allow 14 days for a submission (s 19APD(2)). These are enforceable as public law duties amenable to judicial review.

• Judicial review preserved. Schedule 2 item 4 preserves the capacity of persons who, immediately before commencement, were entitled to seek relief under the Administrative Decisions (Judicial Review) Act 1977 to apply for orders of review after transition. That item also indicates that, despite repeal of the old Act, individuals may still, subject to the ADJR Act, seek a judicial review of matters that arose under the old Part IB. More generally, decisions of the Board that are administrative decisions will be subject to judicial review under the ADJR Act and to common law review remedies where statutes do not oust such review. The Act itself does not limit those general judicial review avenues.

• Deeming and operational consequences. Certain statutory effects act as enforcement mechanisms by operation of law. For example, if a rescission remains in effect under s 19APD(3) or the Board confirms the rescission under s 19APD(4)(a), the rescission is taken to have been a refusal on that day (s 19APE(1)). That legal deeming converts the administrative act of rescission into the substantive legal consequence of refusal and triggers other statutory consequences attached to refusal, such as reconsideration obligations under s 19AKC.

Limits on delegated rule‑making and powers. Schedule 2 item 6 allows the Minister to make transitional rules, but expressly forbids those rules from creating offences or civil penalties, or from providing powers of arrest, detention, entry, search or seizure, or imposing taxes or appropriating money, or directly amending the text of this Act or the Commonwealth Parole Board Act 2026 (item 6(3)). This constrains the scope of delegated instruments that might otherwise be used to create enforcement instruments.

Practical enforcement pathways

• Administrative review and remedies. Failures to comply with statutory timeframes and notice obligations can be challenged by affected persons through administrative law channels, including applications for review under the ADJR Act. Schedule 2 item 4 specifically preserves the right to apply for ADJR relief in respect of matters that were live under the old Act at commencement.

• Internal administrative remedies. The Board must base its decisions on submissions and material it considers relevant (s 19APD(5)), and it must provide reasons with refusal notices (s 19AKF(1)(b)). These obligations facilitate internal review and complaint handling, including the use of internal appeal or reconsideration mechanisms (for example, the reconsideration mechanism at s 19AKC). The Act does not prescribe an internal appeal beyond the statutory reconsideration obligations, but the obligation to reconsider is itself a statutory internal review mechanism.

What the Act does not do on penalties and enforcement

• No criminal offences or penalties are created. Schedule 2 item 6(3)(a) expressly prevents transitional rules from creating an offence or civil penalty, and nowhere in the amendments is a new criminal penalty introduced for non‑compliance by decision‑makers or officials.

• No new coercive powers. The Act does not grant arrest, detention, search or seizure powers beyond existing law; Schedule 2 item 6(3)(b) prevents transitional rules from prescribing such powers.

In short, the Act relies on administrative duties, statutory timing and notice obligations, and judicial review processes for enforcement. It does not create a new criminal enforcement regime, nor does it provide new coercive powers. The main compliance risk for the Board and agencies is failure to meet statutory timeframes and procedural requirements, exposure to judicial review and the legal consequences of deemed refusals when rescissions remain in effect.

The Act operates as a consequential and transitional instrument that reorganises parole decision‑making within the existing statutory architecture. Its interactions are primarily with the Crimes Act 1914 (the amended Act), the Commonwealth Parole Board Act 2026, the Administrative Decisions (Judicial Review) Act 1977, and State and Territory sentencing regimes.

1. Crimes Act 1914. The Act directly amends numerous provisions in Part IB of the Crimes Act 1914. It repeals the old s 19AL and substitutes new provisions 19AKB to 19APF, replaces references to “Attorney‑General” with “Commonwealth Parole Board” across many sections (Schedule 1 items 4-38), and alters definitions in s 16(1) so that “parole order” is defined by s 19AKD(1) of the amended Act (Schedule 1 item 1). The amended Crimes Act will be the operative statutory setting for federal parole decisions, with the Board as the decision‑maker.

2. Commonwealth Parole Board Act 2026. The Act deliberately cross‑refers to the Commonwealth Parole Board Act 2026 for the establishment and appointment of the Board and the Chair (Schedule 1 item 2). The Act commences immediately after the commencement of Part 2 of the Commonwealth Parole Board Act 2026 (s 2), ensuring the Board exists at the time these consequential amendments take effect. The Act’s definitions and references (for example, what constitutes Parole Board information) are meant to operate with the 2026 Act’s structures (Schedule 2 item 5).

3. Administrative law and judicial review. Schedule 2 item 4 preserves rights to apply for review under the Administrative Decisions (Judicial Review) Act 1977 for matters that arose under the old Part IB immediately before commencement. This indicates an intention not to extinguish or curtail ADJR avenues for decisions made under the previous law. Beyond that explicit saving, decisions of the Board will generally be subject to administrative law principles applicable to statutory decision‑makers, including common law review where applicable, but the Act itself does not alter the general availability of judicial review.

4. State and Territory sentencing laws and release regimes. Section 19AKE governs the interplay between federal parole decisions and concurrent State/Territory sentences. It provides that the Commonwealth Parole Board is not required to decide on a parole order if the person is serving State or Territory sentences and is first eligible for release on the last State/Territory sentence after the federal non‑parole period. It also treats life sentences without fixed non‑parole periods as a ground for not requiring a decision (s 19AKE(4)). Practitioners must therefore consider State/Territory sentencing outcomes and release mechanisms when assessing the Board’s duties.

5. Information sharing and privacy regimes. Schedule 2 item 5 ensures that references to information in the Commonwealth Parole Board Act 2026 and to federal offender information in the amended Crimes Act include information acquired before commencement. This means historical records and material collected pre‑commencement can be treated as Parole Board information and federal offender information. How that interacts with privacy laws, information sharing agreements and record‑keeping obligations will depend on other statutes and protocols that govern disclosure, but the Act expressly broadens the temporal scope of permissible information to include pre‑commencement acquisitions for the Board’s functions.

6. Delegated instruments. The Minister may make transitional rules by legislative instrument under Schedule 2 item 6(1), including rules necessary or convenient for giving effect to the Act (item 6(1)(b)). However, the transitional rules are expressly limited and may not create offences or civil penalties, provide arrest or detention powers, impose taxes or appropriate funds from the Consolidated Revenue Fund, or directly amend the text of the Act or the new Act (item 6(3)). This interaction with delegated legislation is significant because it allows operational detail to be provided by the Executive while preserving certain legislative boundaries.

7. Existing statutory constructs like revocation. The Act distinguishes rescission from revocation by explicit provision (s 19APF). That interacts with existing references elsewhere in Part IB that speak of revocation, so practitioners must treat rescission under the new subdivision as a discrete procedural and substantive mechanism.

Taken together, the Act is a consequential bridge between the Crimes Act’s parole framework and the Commonwealth Parole Board Act 2026, designed to reallocate decision‑making, preserve pre‑commencement material and rights, and constrain delegated transitional rule‑making. It does not, on its face, override State or Territory sentencing law but rather coordinates federal parole decision obligations with the realities of concurrent State/Territory sentences through s 19AKE.

This Act is presented as a single, self‑contained amending and transitional instrument enacted in 2026. The text records the principal amendment mechanics and the dates of parliamentary speech and assent, but does not include a history of prior amendments beyond those effected by this instrument.

Key legislative milestones recorded in the text

• Parliamentary process notes. The Act records the Minister’s second reading speech having been made in the House of Representatives on 8 October 2025 and in the Senate on 27 November 2025 (endnote under Schedule 2). Those are recorded as parliamentary proceedings but are included as notes rather than operative text.

• Assent date. The Act was assented to on 8 April 2026, which is recorded at the head of the instrument.

• Commencement linkage. Under section 2 the Act’s commencement is conditional: the whole of this Act commences immediately after the commencement of Part 2 of the Commonwealth Parole Board Act 2026. The commencement table in s 2 states the Act commences immediately after commencement of Part 2 of that other Act.

Amendments made by this Act (summary)

• Substantial repeal and substitution inside the Crimes Act 1914. The Act repeals section 19AL of the old Crimes Act and substitutes a new set of provisions (19AKB through 19APF). Schedule 1 item 6 explicitly states the repeal and substitution.

• Definition changes. Schedule 1 items 1-3 remove the old definition of “parole order” in s 16(1) and re‑define it by reference to s 19AKD(1). The Schedule also inserts definitions identifying the Chair and the Commonwealth Parole Board by reference to the Commonwealth Parole Board Act 2026.

• Systematic replacement of the Attorney‑General as decision maker. The Schedule replaces “Attorney‑General” with “Commonwealth Parole Board” across numerous provisions (see items 4, 5, 7-38 and others). This is the instrument’s principal structural change.

• New pre‑release rescission regime. Schedule 1 inserts Subdivision AA into Division 5 of Part IB, containing new ss 19APC-19APF, creating the new rescission power and associated procedural obligations.

Transitional provisions and saving clauses

• Saving existing parole orders and licences. Schedule 2 item 2 ensures parole orders and licences made under the old Part IB continue to operate after commencement as if they were parole orders and licences under the amended Act.

• Transitional notice obligations. Schedule 2 item 3 requires the Commonwealth Parole Board to give notice under new s 19AKF if, before commencement, the Attorney‑General had refused parole but had not yet given a notice under the old Act.

• Preservation of judicial review. Schedule 2 item 4 preserves entitlement to apply for ADJR review for matters that arose under the old Act before commencement.

• Transitional information and rules. Schedule 2 items 5 and 6 carry forward pre‑commencement information as part of the Board’s information base and permit the Minister to make transitional rules within stated limits.

No later amendments are recorded in the text. The commencement note emphasises that the table in s 2 relates only to the provisions as originally enacted and will not be amended to reflect later changes. The Act therefore constitutes the 2026 consequential and transitional package giving effect to the Commonwealth Parole Board Act 2026’s shift in institutional design.

The Act text does not cite any case law, judicial decisions, or litigation history. It contains a specific transitional preservation for judicial review rights under the Administrative Decisions (Judicial Review) Act 1977 for persons who, immediately before commencement, were entitled to make an application under that Act in respect of matters arising under Part IB of the old Crimes Act (Schedule 2 item 4). This preserves the capacity for those individuals to pursue review after commencement, subject to the ADJR Act’s requirements.

Practical points from the Act about litigation and review

• Preservation of ADJR rights. Schedule 2 item 4 authorises persons who had standing to seek ADJR remedies immediately before commencement to proceed after transition, despite repeal of the old Part IB. This is an explicit statutory saving provision concerning administrative law remedies.

• Deeming and reviewable decisions. The Act’s deeming of certain rescissions that remain in effect as refusals (s 19APE(1)) creates reviewable administrative decisions with statutory consequences. These deemed refusals will be subject to the ordinary grounds of judicial review applicable to administrative decisions.

• No explicit ouster of judicial review. The Act does not contain privative clauses or other provisions intended to curtail judicial review of Board decisions. The text preserves judicial review rights for pre‑commencement matters and otherwise leaves standard review avenues available.

• Transitional procedural matters that may give rise to claims. Two transitional points may produce litigation or applications: item 3 of Schedule 2 imposes a new duty on the Commonwealth Parole Board to give notices under s 19AKF where the Attorney‑General refused before commencement but had not yet given notice. Failure to comply with that transitional duty could be the subject of review. Second, the breadth of the Board’s discretion to rescind parole under s 19APC and to determine whether risks can be mitigated by directions or by changing conditions is a fact‑sensitive exercise that may be challenged on public law grounds where there is insufficient reasoning, failure to consider material, or breaches of procedural fairness.

Because the text contains no recorded judicial decisions or litigation, practitioners should assume that litigation risk will centre on administrative law challenges to the Board’s exercise of discretion, compliance with statutory timeframes (such as 14‑day notice obligations), and the adequacy of reasons in notices of refusal, deferral or rescission.

The Act introduces several operational, interpretive and timing features that may produce unintended consequences or practical missteps if not carefully managed. The following points are directly grounded in the text and represent specific practical traps to watch for.

1. Rescission before release can become a deemed refusal if the person does not submit within 14 days. Under s 19APD(2) the Board must request a written submission within 14 days after notifying a rescission. If the person does not make a submission within that period, the rescission remains in effect (s 19APD(3)) and is taken to be a refusal on that day (s 19APE(1)). Practitioners should note that a rescission followed by no timely submission converts the Board’s administrative act into a substantive refusal, which then triggers reconsideration timelines and affects release planning.

2. Vague statutory trigger “substantial change” can be litigated or contested. One of the grounds for rescission is that “there has been a substantial change in a matter considered by the Commonwealth Parole Board in making the parole order or licence” (s 19APC(1)(d)). The Act does not define “substantial change”, leaving interpretation to the Board and, potentially, to courts on review. That vagueness may produce disputes about what constitutes substantial change and what evidence suffices.

3. Deferment windows create periods of legal uncertainty for affected persons. The Board may defer deciding whether to make or refuse a parole order until a day not later than three months after the end of the non‑parole period (s 19AKB(1)(c)). Similarly, the Board may defer reconsideration within the reconsideration period (s 19AKC(1)(c)). These deferrals can lead to short post‑period windows during which a person’s release status may remain uncertain, with practical consequences for prison management and parole planning.

4. The Board may specify release up to 30 days early. Section 19AKD(3) permits the Board to specify that the person is released from prison up to 30 days earlier than the end of the non‑parole period if the Board considers that appropriate. That power requires tight operational coordination between the Board, correctional services and community corrections to ensure the person is fit for release and supervision arrangements are in place.

5. Status of existing parole orders and licences is preserved but subject to rescission. Schedule 2 item 2 preserves existing parole orders and licences “as if” they were orders under the amended Act and subject to the same conditions. That means pre‑commencement instruments can be rescinded under the new s 19APC during the relevant pre‑release period. Persons and their advisers may assume continuity of pre‑commencement instruments, but those instruments are still subject to the new rescission power.

6. Interaction with State/Territory sentencing may delay Board decisions. Section 19AKE provides that where a person also serves State/Territory sentences and the person is first eligible for release on the last State/Territory sentence after the federal non‑parole period, the Board is not required to decide on parole until that State/Territory eligibility date. This can create strategic timing complexities where multiple jurisdictions’ release eligibility and concurrency rules interact.

7. Notice timing obligations are strict and short. The Board must give refusal and deferral notices within 14 days (s 19AKF) and post‑rescission notice and a request for submissions within 14 days (s 19APD(2)). Missing those short deadlines may expose the Board to claims for procedural unfairness or statutory breach. Administratively, organisations must ensure timely service of notices and accurate recording of dates to avoid inadvertent non‑compliance.

8. Minister’s transitional rules are broad but expressly limited. Schedule 2 item 6 authorises the Minister to make rules to carry out the Act, including transitional savings, but expressly prevents rules from creating offences, detention powers, taxes, appropriations or directly amending the Act (item 6(3)). Stakeholders should be alert that the delegated instrument power is available to flesh out operational detail, but that the instrument cannot be used to produce new enforcement mechanisms or substantive changes to statutory text.

9. “Parole order” definition shifted to the new provision. The definition in s 16(1) of the Crimes Act has been replaced so that “parole order” is defined by s 19AKD(1) (Schedule 1 item 1). Practitioners must ensure that references to parole orders in other statutory contexts are read in light of the substituted definition and the new content requirements (such as written form and supervision specification).

10. Deeming effects may have immediate custodial consequences. Because s 19APE(1) treats a rescission that remains in effect as a refusal, there is a risk that operational decisions about custody and release may become tied to administrative timings, particularly where rescission notices and submission timelines are not handled promptly.

These practical “gotchas” are directly traceable to statutory text and highlight where close operational and legal attention will be needed to avoid unintended outcomes, ensure timely compliance with notice obligations, and manage interactions across multiple sentencing jurisdictions.

Compliance requires coordinated operational, procedural and legal steps by the Commonwealth Parole Board, correctional services, community corrections officers, legal representatives and information holders. The key compliance tasks are timing, documentation, reasons, submissions handling, coordination with State/Territory authorities, and record‑keeping.

For the Commonwealth Parole Board (and its secretariat)

1. Decision timetable tracking. Implement an automated tracking system that flags the end of each person’s non‑parole period and the last non‑parole period for multiple sentences so the Board meets s 19AKB(1) and (3). The system should trigger reminders well before the end date and record decisions to make, refuse or defer. If a decision is deferred, the system must record the date by which the Board must decide, noting the three‑month outer limit (s 19AKB(1)(c)).

2. Reconsideration calendar. Create a reconsideration register for each refusal that records the date of refusal and calculates the default 12‑month reconsideration deadline and any permitted extension up to 24 months (s 19AKC(4)). If the person has fewer than 30 days on any sentence at the 12‑month mark, note the exception under s 19AKC(2).

3. Notices and reasons. Draft standard templates that fulfil the requirements of s 19AKF for refusals and deferrals, ensuring reasons are sufficiently substantive to meet administrative law standards and explicitly set out the effect of s 19AKC where a refusal is given. Ensure the workflow requires issuance within 14 days.

4. Parole order drafting and recordkeeping. When making a parole order, ensure the order is in writing and includes the elements required by s 19AKD(2): whether release is subject to supervision and, if supervision ends before the parole period, the supervision end date. For early releases under s 19AKD(3), record the Board’s reasons and make sure correctional services are notified in good time.

5. Rescission procedures. Establish clear criteria and evidentiary standards for invoking s 19APC grounds, including documented assessments of whether directions from a community corrections officer or changes to conditions could mitigate risk. Implement a standard practice for the 14‑day rescission submission window (s 19APD(2)), including immediate written notice and a means for receiving and promptly assessing submissions in accordance with s 19APD(4)-(5).

6. Coordination with correctional services and community corrections. Put in place operational protocols for communications with correctional centres and community corrections officers to determine whether directions or changed conditions could mitigate risks invoked under s 19APC(1)(a)(ii) and (b)(ii).

7. Record information management. Given Schedule 2 item 5’s extension to pre‑commencement information, ensure robust data inventories and classification for Parole Board information and federal offender information, and establish lawful disclosure protocols consistent with privacy and record‑keeping regimes.

For correctional services and community corrections officers

1. Early notification processes. Ensure receipt mechanisms for written parole orders and rescission notices are time‑stamped and routed to custody management teams to prevent a person being released contrary to a Board decision.

2. Capability to give directions. Where rescission grounds rely on the inability to mitigate risk through directions, ensure community corrections officers’ operational capacity to issue and record directions is clear, and provide evidence to the Board about the practical effect of any such directions.

3. Supervision readiness for early release. For any release specified under s 19AKD(3) (up to 30 days early), ensure that community supervision arrangements are available and documented in advance to comply with required conditions.

For legal practitioners and advocates

1. Timely response to notices. Advise clients of the short windows in the Act: 14 days to receive a refusal or deferral notice (s 19AKF) and 14 days to respond to a rescission notice with written submissions (s 19APD(2)). If a client receives a rescission notice, counsel should act immediately to prepare a submission within the 14‑day window to avoid the rescission being taken to be a refusal (s 19APE(1)).

2. Reconsideration strategy. Where refused, prepare for statutory reconsideration under s 19AKC. Note the 12‑month default reconsideration period and the Board’s capacity to extend to 24 months. Prepare submissions and medical or other evidence early so that the Board has materials available for reconsideration.

3. Judicial review preparation. For matters that arose under the old Part IB before commencement, be ready to pursue ADJR remedies as Schedule 2 item 4 preserves that pathway. For post‑commencement decisions, be prepared to bring public law challenges if procedural requirements are not met or decisions lack reasons.

For information holders and agencies

1. Records access and disclosure. Ensure policies reflect that pre‑commencement information is captured by the definitions in Schedule 2 item 5; update disclosure and inter‑agency sharing protocols to meet the Board’s information needs while complying with privacy obligations.

2. Transitional rules monitoring. Monitor any legislative instruments made under Schedule 2 item 6 for operational detail. The rules cannot create offences, detention powers or appropriate funding, but may fill procedural gaps and prescribe transitional arrangements.

Cross‑cutting obligations

• Time‑stamped communications and audit trails. All parties should maintain electronic time stamps and audit logs to demonstrate compliance with 14‑day notice obligations, decision dates, receipt of submissions and any directions issued by community corrections officers.

• Training and guidance. The Board and agencies should issue operational guidance and training for staff on the new statutory duties, the meaning of “relevant pre‑release period”, rescission grounds, the 14‑day submission window, and the interaction with State/Territory sentences per s 19AKE.

• Policy documentation. Adopt clear written policies on criteria for rescission under s 19APC, evidence standards for “serious identifiable risk” and “substantial change”, and the use of early release powers under s 19AKD(3). These policies will assist in producing reasons that survive administrative scrutiny.

These compliance measures flow directly from the Act’s statutory text and lay out concrete administrative steps to meet timing, notice, decision‑making, information and coordination obligations.
