Commissioner for Kangaroo Island Act 2014

The Act rests on a small set of statutory concepts, defined centrally in the interpretation section (s 3) and used throughout the instrument.

• Commissioner. The person holding or acting in the office of Commissioner for Kangaroo Island (s 3 definition; appointment mechanics in s 6). The Commissioner is declared an agency of the Crown (s 6(2)) and is a senior official under the Public Sector (Honesty and Accountability) Act 1995 (s 12).

• Management plan. A management plan is a document prepared and kept under review by the Commissioner under Part 4 (s 3 definition; duties in s 17). The plan sets out proposals for infrastructure and service delivery, priorities, and consultation strategies (s 17(1)). It requires Governor approval to have force (s 18(1)) and is explicitly characterised as policy that does not by itself affect rights or liabilities (s 18(2)).

• State authority (and responsible Minister). The Act adopts a broad statutory definition for “State authority” (s 3), encompassing offices established by Act, administrative units, councils, assessment panels under the Planning, Development and Infrastructure Act 2016, and any body established for a public purpose under an Act. The definition also allows the regulations to declare additional persons/bodies as authorities or to exclude bodies from the definition. “Responsible Minister” is defined by reference to the administrative arrangements that apply to the authority in question, and likewise may be declared by regulation (s 3).

• Local advisory boards. The Commissioner may establish such boards as the Commissioner thinks fit for the purpose of providing advice, especially on management plans (ss 15-16). The Commissioner appoints members, subject to consultation with Kangaroo Island Council for proposed appointments, and members must have relevant qualifications or experience (s 15).

• Information and contract‑copying powers. The Commissioner may issue written notices to State authorities requiring information for performance of functions (s 9(1)). A State authority must not enter into a contract of a “prescribed kind” unless it has provided a copy of the contract to the Commissioner and allowed at least five business days’ comment time (s 9(2)). Refusal or failure to comply triggers reporting rights (s 9(3)-(4)).

• Consultation and publication. Draft management plans require consultation with relevant local advisory boards, responsible Ministers and prescribed bodies, public notice of inspection and invitation to make written representations, and public availability of representations (s 17(3)-(4)). The Commissioner must make provision for publication and website availability (s 17(6)).

• Non‑binding policy standard with a duty to “endeavour”. Management plans are explicitly non‑binding (s 18(2)), but State authorities are required to “endeavour, as far as practicable, to act consistently with the management plans” (s 18(3)). The word “endeavour” creates a best‑endeavours style obligation rather than a mandatory duty; the Commissioner’s remedy against non‑compliance is reporting, not direct enforcement (s 18(4)-(5)).

• Ministerial direction and oversight. The Minister may give directions to the Commissioner, but must consult the Commissioner first, communicate the direction in writing and include it in the Commissioner’s annual report (s 10).

• Regulatory power. The Governor may make regulations for the Act’s purposes (s 21). The Minister must consult the Kangaroo Island Council and the Commissioner on proposed regulations (s 21(2)). Regulations may, among other things, define which bodies count as State authorities or declare responsible Ministers (s 3/21 interplay).

These concepts combine to create an institutional architecture that centralises responsibility for strategic planning and coordination in a Crown agency with strong procedural transparency and information rights, but with limited coercive powers. The Act therefore emphasises information collection, consultation and political reporting as the levers for change rather than statutory compulsion.

The Act reaches a range of public bodies, local government, private actors interacting with government, residents and businesses on Kangaroo Island, and the State executive.

• The Commissioner and officeholders. The primary direct subject is the Commissioner for Kangaroo Island: a Governor‑appointed officer (s 6) who is an agency of the Crown (s 6(2)). The Commissioner and any acting Commissioner are classified as senior officials under the Public Sector (Honesty and Accountability) Act 1995 (s 12) and are subject to the honesty/accountability regime.

• State authorities. The definition of “State authority” in s 3 is expansive. It includes administrative units, offices created by statute, councils, and assessment panels under the Planning, Development and Infrastructure Act 2016. It also covers incorporated or unincorporated bodies established for a public purpose by an Act or under an Act, and any other person or body declared by regulation. This means most government agencies, statutory authorities, and many public corporations fall within the Act’s scope. Affected State authorities must respond to information notices (s 9(1)) and must provide copies of certain “prescribed” contracts to the Commissioner and allow comment time prior to contracting (s 9(2)).

• Kangaroo Island Council. The council is both specifically referenced and given consultative rights. The Minister must consult with the Kangaroo Island Council before appointing the Commissioner (s 6(3)), and the Commissioner must consult with the Council about appointments to local advisory boards (s 15(3)) and must consult a council directly affected by a proposed management plan including consultation about options for funding potential additional costs (s 17(3)(c)). Where a council refuses to comply with a request for information or contract copying, the Commissioner may report to the Minister responsible for the Local Government Act 1999, who may then take action under s 272 of that Act (s 9(4)).

• Residents and businesses of Kangaroo Island. Management plans are intended to set out proposals for infrastructure and services and strategies for consulting with persons whose cooperation is required (s 17(1)(c)). The Commissioner has a function to provide “appropriate assistance” to residents and businesses in dealing with government agencies (s 8(b)). The statutory public consultation process for management plans requires public notice and invitations to make written representations (s 17(3)(e)), and the Commissioner must make those representations publicly available (s 17(4)) except where made in confidence.

• Ministers and the Premier. Responsible Ministers for State authorities are required consultees for draft plans (s 17(3)(b)(ii)). The Commissioner’s reporting powers allow reporting to responsible Ministers and the Premier where agencies fail to co‑operate (s 9(3), s 18(4)). The Minister may direct the Commissioner, subject to consultation and written notice requirements (s 10). The Minister also must cause the Commissioner’s annual report to be laid before both Houses within a short parliamentary window (s 19(2)).

• Other public bodies and prescribed bodies. The Act requires the Commissioner to seek the views of “prescribed bodies” when a draft plan is approved by the Governor (s 17(3)(b)(ii)). Regulations may specify which bodies these are (s 21). Assessment panels under the Planning, Development and Infrastructure Act 2016 are explicitly included within the State authority definition (s 3), which ties planning processes into the Act’s consultative architecture.

• Private parties contracting with State authorities. Where a State authority is intending to enter into a contract of a “prescribed kind” the authority must provide a copy to the Commissioner and allow at least five business days for comment (s 9(2)). This creates a pause point that may affect contracting timetables for private contractors engaging with the State.

• Parliamentary oversight bodies. Parliament is given a direct role through annual report laydown (s 19(2)) and a statutory review schedule by the Environment, Resources and Development Committee (s 20). The Commissioner may also forward reports to the parliamentary Speakers with a request they be laid before the Houses (s 18(4)(b)).

Who pays and bears administrative burdens is implicit in the Act. The Commissioner will be appointed by the Governor and will be an agency of the Crown (s 6(2)); the use of Public Service staff and facilities is enabled by agreement (s 13). Councils that may incur additional costs as a result of proposed plans are to be consulted about funding options (s 17(3)(c)), but there is no express appropriation or funding mechanism in the Act attaching direct funding obligations to the State for council costs; the financial implications therefore depend on administrative decisions and budgetary arrangements outside the Act. For State authorities, complying with information notices, making contracts available and waiting a 5 business day comment period are concrete administrative costs and potential scheduling constraints.

The Act distributes duties and rights among the Commissioner, State authorities, the Minister, local advisory boards and the public. These are legal and procedural obligations, not positive funding entitlements.

Commissioner duties and rights

• Prepare and review management plans (s 17(1)-(2)). The Commissioner must prepare plans setting out proposals for infrastructure and services, recommended priorities, and strategies for consultation (s 17(1)).
• Consult and seek views before adopting plans (s 17(3)-(5)). The Commissioner must prepare a draft proposal, and if the draft is approved by the Governor must seek views of relevant local advisory boards, responsible Ministers for affected State authorities, prescribed bodies, and affected councils (s 17(3)(b)-(c)). Public notice and opportunities to make written representations are required (s 17(3)(e)).
• Publish and make available plans and amendments, and keep plans under review (s 17(2), (6)). The Commissioner must ensure public inspection availability and post plans on a website (s 17(6)(b)).
• Compel information and contract access from State authorities (s 9(1)-(2)). The Commissioner may require information in writing and specify reasonable timeframes. A State authority must provide copies of prescribed kinds of contracts and permit at least five business days’ comment (s 9(1)-(2)).
• Report non‑cooperation and inconsistency (s 9(3)-(4), s 18(4)). Where a State authority (other than a council) refuses or fails to comply with information or contract requirements, the Commissioner may report to the responsible Minister and Premier and include the matter in the Commissioner’s annual report (s 9(3)). For councils, the Commissioner may report to the Minister responsible for Local Government who may then act under s 272 of the Local Government Act 1999 (s 9(4)). Where a government agency has failed to act consistently with a plan, the Commissioner may report to the Minister and Premier and forward copies to parliamentary Speakers (s 18(4)).
• Non‑delegable reporting power. The power to report under s 18(4) cannot be delegated (s 18(5)).

State authority duties and rights

• Provide requested information to the Commissioner within a reasonable time when served with a written notice (s 9(1)).
• For “prescribed kind” contracts, provide a copy to the Commissioner and allow at least five business days to comment before entering the contract (s 9(2)). The scope of “prescribed kind” depends on regulations; absent regulations the term remains uncertain (s 9(2), s 21).
• Endeavour, as far as practicable, to act consistently with management plans (s 18(3)). This is a best‑endeavours obligation rather than an absolute duty.
• If a State authority refuses or fails to comply with information/contract requirements (other than a council), the Commissioner may report the refusal to the responsible Minister and the Premier and include it in the Commissioner’s annual report (s 9(3)).

Ministerial duties and rights

• Consult with the Kangaroo Island Council and the people of Kangaroo Island in relation to any proposed appointment of the Commissioner (s 6(3)).
• Give directions to the Commissioner, subject to consultation with the Commissioner; directions must be in writing and included in the Commissioner’s annual report (s 10).
• When regulations are proposed under the Act, the Minister must consult with Kangaroo Island Council and the Commissioner (s 21(2)).
• On receiving the Commissioner’s annual report, the Minister must cause it to be laid before both Houses within 12 sitting days (s 19(2)).

Local advisory boards

• Established and appointed by the Commissioner (s 15(1)-(2)), with required consultation with the Kangaroo Island Council on proposed appointments (s 15(3)).
• Members must have qualifications, knowledge or experience relevant to the board’s functions (s 15(4)).
• The board’s function is to provide advice when referred matters by the Commissioner, particularly on management plans (s 16).
• Local advisory board members are covered by the Public Sector (Honesty and Accountability) Act 1995 where that Act would not otherwise apply (s 15(7)).

Public rights and consultation

• The public are entitled to inspect and purchase drafts of management plans where public notice is given of inspection points (s 17(3)(e)).
• Interested persons may make written representations within the period specified in the public notice (s 17(3)(e)) and the Commissioner must make copies of representations available for public inspection except for confidential submissions (s 17(4)).

Confidentiality and disclosure limits

• Information obtained by the Commissioner under s 9 may not be disclosed except for specified purposes, including preparing reports under the Act or where authorised by the State authority or required under another Act (s 9(5)).
• The Commissioner and persons appointed or engaged under the Act must not disclose information contrary to s 9(5); a contravention attracts a maximum penalty of $10,000 (s 9(6) and penalty note).

These duties and rights characterise the Act as establishing a transparent, consultative and information‑oriented role for the Commissioner with limited coercive reach. The “endeavour” duty on State authorities is the principal mechanism for aligning administrative action with the Commissioner’s plans; enforcement is reputational and political via reporting rather than judicially enforceable.

The Act provides a limited set of enforcement mechanisms and one express monetary penalty. Most of the Act’s levers are procedural, reputational and administrative rather than criminal or civil enforcement.

Express penalty

• Disclosure prohibition. Section 9(6) prohibits disclosure of information contrary to the exceptions set out in s 9(5) by the Commissioner and persons appointed or engaged under the Act (including former appointees). The Act specifies a maximum penalty of $10,000 for breaching that non‑disclosure obligation. The statutory structure places confidentiality obligations on the Commissioner and associated personnel and attaches a monetary ceiling for a contravention.

Administrative and political enforcement mechanisms

• Reporting. Where a State authority (other than a council) refuses or fails to comply with a written information notice under s 9(1) or the contract copying requirement in s 9(2), the Commissioner may, after consultation, report the refusal or failure to the responsible Minister and to the Premier and include the matter in the Commissioner’s annual report (s 9(3)). Reporting is therefore the principal remedy for agency non‑cooperation. For councils, refusal or failure that is not remedied can be reported to the Minister responsible for the Local Government Act 1999 and that Minister may take action under s 272 of that Act (s 9(4)); the Act does not define or expand s 272, it merely references the Local Government Act remedy pathway.

• Parliamentary exposure. For failures concerning implementation of management plans, the Commissioner may make a report to the Minister and the Premier and may forward copies to the Speaker of the House of Assembly and the President of the Legislative Council with a request that they be laid before their Houses (s 18(4)(b)). The Commissioner must prepare an annual report and the Minister must cause it to be laid before both Houses within 12 sitting days of receipt (s 19). The Environment, Resources and Development Committee is statutorily required to review the Act’s operation after two years and every four years thereafter (s 20). These provisions place political and parliamentary pressure on agencies that fail to cooperate.

• Ministerial directions to the Commissioner. The Minister may direct the Commissioner subject to consultation and the requirement that directions be in writing and included in the Commissioner’s annual report (s 10). This gives executive control over the Commissioner’s activities but is not an enforcement mechanism against third parties.

Termination and eligibility sanctions for the Commissioner

• The Governor may terminate the Commissioner’s appointment for misconduct, conviction of an imprisonment‑punishable offence, bankruptcy or insolvency proceedings, disqualification from managing corporations under the Corporations Act, mental or physical incapacity, incompetence or neglect of duty (s 7(2)). The Commissioner’s appointment is also terminated upon becoming a member or candidate for State or Commonwealth Parliament or upon sentence to imprisonment (s 7(3)). These provisions govern accountability and remove a Commissioner who is unfit to hold office.

Limits on delegation and non‑delegable powers

• The Commissioner may delegate functions and powers in writing (s 14), but the power under s 18(4) to report failures of co‑operation or frustration of plan implementation is explicitly non‑delegable (s 18(5)), ensuring the Commissioner retains responsibility for public reporting in those circumstances.

No direct judicial enforcement of management plans

• Management plans are expressly stated to be policy expressions and “do not in themselves affect rights or liabilities” (s 18(2)). State authorities are required only to “endeavour, as far as practicable, to act consistently with the management plans” (s 18(3)). This language creates a non‑absolute duty that is not accompanied by a specific civil remedy or criminal sanction in the Act. The Commissioner’s potential responses are administrative and political (reporting), not adjudicative or compensatory.

Regulatory instruments and prescribed matters

• Several operational provisions depend on regulations (e.g. what counts as a “prescribed” contract under s 9(2), who is a State authority or not under s 3, who are the “prescribed bodies” in s 17(3)(b)(ii)). The Governor’s regulation‑making power (s 21) can affect the scope and enforceability of some obligations. The Act requires the Minister to consult the Kangaroo Island Council and the Commissioner about proposed regulations (s 21(2)), which provides a procedural constraint.

In summary, the Act uses penalties narrowly , a $10,000 penalty for unauthorised disclosure by the Commissioner and associated persons , and relies primarily on information powers, consultation obligations and reporting to Ministers, the Premier and Parliament as mechanisms for securing compliance with its objectives. There are no express civil remedies, injunctive powers or financial penalties against State authorities for failing to “endeavour” to act consistently with management plans; instead, enforcement is administrative, political and reputational.

The Act is drafted to operate in conjunction with a range of existing statutes and frameworks; several cross‑references and application rules are embedded in the text.

Supplementary relationship to other Acts

• Section 4 establishes the Act as additional to, and not limiting or derogating from, provisions of any other Act unless a contrary intention appears. That means the Commissioner’s functions and powers are intended to sit alongside existing statutory schemes rather than replace them.

Definitions and cross‑referencing

• The interpretation section (s 3) cross‑references other Acts expressly. “Council” is defined by reference to the Local Government Act 1999. “State authority” incorporates assessment panels appointed or constituted under Part 6 Division 2 of the Planning, Development and Infrastructure Act 2016 (s 3). The “responsible Minister” definition refers to the Minister responsible for the administration of the Act under which an authority is established or for the administrative unit (s 3). These cross‑references tie the Commissioner’s role into planning and local government processes and identify who is required to be consulted.

Public Sector (Honesty and Accountability) Act 1995

• The Commissioner and acting Commissioners are senior officials under the Public Sector (Honesty and Accountability) Act 1995 (s 12). Section 15(7) brings local advisory board members into that regime where it would not otherwise apply, making honesty/accountability requirements applicable to those board members.

Local Government Act 1999

• The Commissioner must consult with the Kangaroo Island Council in relation to appointments (s 6(3)) and local advisory boards (s 15(3)), and must consult with any council directly affected by a management plan and, where proposals have the potential to create additional costs for a council, must consult with the council in relation to funding options (s 17(3)(c)). Where a council refuses or fails to comply with an information or contract requirement, the Commissioner may report to the Minister responsible for the Local Government Act 1999 who may take action under s 272 of that Act (s 9(4)). The Act does not alter or expand the text of s 272; it merely invokes it as the available statutory pathway for addressing council non‑cooperation.

Corporations Act 2001 (Commonwealth)

• One of the termination grounds for the Commissioner is disqualification from managing corporations under the Corporations Act 2001 (s 7(2)(d)). The Act therefore imports corporate law disqualification consequences into eligibility for office.

Planning, Development and Infrastructure Act 2016

• The Act was amended in 2017 to refer expressly to assessment panels under Part 6 Division 2 of the Planning, Development and Infrastructure Act 2016 (s 3). That expands the set of State authorities and planning processes that may be relevant to management plans and ensures that planning panels are within the definition of State authority for the Act’s purposes.

Regulations

• The Governor may make regulations contemplated by or necessary or expedient for the Act (s 21(1)). Regulations can specify persons or bodies to be treated as State authorities or excluded from that definition, and declare responsible Ministers where necessary (see s 3). The Act also anticipates “prescribed bodies” to be consulted on draft plans (s 17(3)(b)(ii)), and “prescribed kind” contracts (s 9(2)) , both of which are matters to be filled out by regulation in practice. The Minister must consult the Kangaroo Island Council and the Commissioner about proposed regulations under the Act (s 21(2)).

Crown immunity and binding the Crown

• The Act binds the Crown in right of the State and in other capacities so far as the State’s legislative power extends (s 5), but the Act expressly says it does not impose criminal liability on the Crown. That means the Commissioner’s powers to require information and to report extend against State bodies, subject to other statutory protections, but not as criminal sanctions on the Crown as such.

Parliamentary processes and oversight

• Annual reports are to be tabled in Parliament within 12 sitting days (s 19(2)) and the Environment, Resources and Development Committee must review the Act’s operation after two years and every four years thereafter (s 20). These parliamentary processes interact with broader oversight frameworks.

Practical consequences of these interactions

• Many operational features of the Act depend on how regulations are framed and on existing statutory duties under other Acts, especially in planning and local government. The Commissioner’s information powers and requirement to be given copies of certain contracts may intersect with confidentiality, procurement law, commercial in confidence arrangements and other sectoral statutory obligations. The Act’s non‑binding policy character for management plans (s 18(2)-(3)) means that where other statutes impose binding duties or priorities, those duties will continue to apply; the Act is supplementary and political/administrative rather than overriding.

The legislative history provided in the Act text records its enactment, commencement dates and a later amendment.

Original enactment and commencement

• The Commissioner for Kangaroo Island Act 2014 (No 15 of 2014) received assent on 6 November 2014. The principal Act commenced on 15 January 2015, as recorded in the legislative history, except that sections 8-10 and 15-19 commenced on 4 June 2015 (Gazette references cited in the legislative history). The staged commencement means key operational parts , the Commissioner’s functions (s 8), Ministerial direction (s 10) and the provisions dealing with local advisory boards and management plans (ss 15-19) , began on 4 June 2015.

2017 amendment

• The Statutes Amendment (Planning, Development and Infrastructure) Act 2017 (No 5 of 2017) amended the Act. The legislative history notes that this 2017 Act received assent on 28 February 2017, and Pt 7 (s 19) of that amendment commenced on 19 March 2021 (Gazette 4.3.2021 p823). The 2017 amendment altered the definitions in s 3 to include references to the Planning, Development and Infrastructure Act 2016 (see entries indicating “responsible Minister” and “State authority” were amended by 5/2017 s 19(1)-(2)). These amendments integrate the Commissioner regime with the revised planning framework introduced by the Planning, Development and Infrastructure Act 2016.

Legislative revision

• Under the Legislation Revision and Publication Act 2002 some technical changes were made; for example, s 2 was omitted under legislation revision and publication on 19 March 2021 (legislative history note). The legislative history table also records the provisions that were amended and the commencement timing of those amendments.

Operational effect of amendment history

• The 2017 amendment tying the Act to the Planning, Development and Infrastructure Act 2016 adds assessment panels under that Act to the State authority definition. This expands the set of planning bodies that the Commissioner may consult or require information from, aligning the Commissioner’s role with the contemporary South Australian planning statute. The staggered commencements in 2015 reflect practical sequencing, where administrative and governance provisions may have been brought into force later.

No other amendments are recorded in the legislative history text supplied. The Act’s legislative history therefore shows the original 2014 enactment with specific commencement sequencing in 2015 and a definitional amendment in 2017 that took effect in 2021 for one element of the amendment. Users needing the precise Gazette references and commencement particulars should consult the cited Gazette entries and the consolidated Act on the South Australian legislation website for up‑to‑date committal of any further changes beyond those recorded in this extract.

The Act text and its legislative history do not list any cases, judicial determinations or reported litigation arising under the Commissioner for Kangaroo Island Act 2014. The legislative history records only enactment, commencement and the 2017 amendment; it does not report judicial activity.

Absent any reported decisions set out in the statute text, there is no statute‑based litigation history to summarise. That absence has two consequences for users:

• No authoritative judicial interpretation. Because the Act’s text is not supplemented here by reported judicial interpretations, the statutory terms , for example “endeavour, as far as practicable, to act consistently with the management plans” (s 18(3)), the meaning of “prescribed kind” of contract for s 9(2), or the circumstances in which the Commissioner’s report under s 18(4) will be exercised , have not been adjudicated in the materials provided. Practitioners should therefore treat the Act’s language as the primary source and anticipate interpretive questions that could be litigated in future.

• Potential dispute themes for future litigation or review. The statutory architecture suggests lines of legal contention that might surface if disputes arise. These include:

  • The legal status and enforceability of management plans: s 18(2) says a plan is an expression of policy and does not itself affect rights or liabilities. Litigation might explore whether particular statutory or contractual obligations are displaced by plan recommendations, or whether an authority’s failure to follow a plan could ground reviewable maladministration when the authority has statutory duties under another Act.
  • The scope of the Commissioner’s information powers: s 9(1) allows written notices to require information. Disputes could arise over the scope of information that must be produced, whether claims of commercial‑in‑confidence are valid, and the interplay between s 9(5) confidentiality limits and other statutory disclosure obligations.
  • The limits of the “endeavour” obligation in s 18(3): courts could be asked whether that duty is judicially enforceable, and if so how to measure “as far as practicable” (but the Act’s language and its procedural reporting remedy point to administrative, rather than coercive, oversight).
  • Contracting pause points: s 9(2) requires a State authority not to enter into a contract of a “prescribed kind” until the Commissioner has had five business days to comment. Litigation could arise if an authority proceeds to contract and the Commissioner alleges procedural contravention, particularly if the contracting party claims detriment.
  • Confidentiality breaches: s 9(6) creates a maximum penalty for unauthorised disclosure by the Commissioner and associated persons. Disputes could centre on what disclosure is “contrary to” s 9(5), and whether other statutory duties (e.g. freedom of information, or mandatory reporting under other Acts) justify disclosure.

Because no litigation is recorded in the supplied materials, interested parties should monitor reported decisions and administrative rulings after this Act’s commencement dates for emerging authorities. Practitioners advising affected bodies should consider pre‑emptive dispute‑management steps: clear internal procedures for responding to information notices, procurement sequencing to accommodate the five business day comment period where relevant, confidentiality protocols aligned with s 9(5)-(6), and careful drafting of planning documents to make explicit where management plan recommendations interact with existing statutory duties.

Several features of the Act produce non‑obvious operational risks, timing constraints and residual uncertainties that advisers and stakeholders should watch.

Governor approval gating and timing

• Draft management plans require Governor approval before the Commissioner may proceed to seek the views mandated in s 17(3)(b)(i). Section 17(3)(b)(i) states that “if the draft is approved by the Governor” the Commissioner must seek the views of relevant local advisory boards and responsible Ministers. This creates a gating step where executive approval is needed before full public and agency consultation can commence. That approval requirement can introduce delay and uncertainty into plan timelines and the sequencing of consultation.

Limited legal force of plans

• Management plans are expressly “an expression of policy” and “do not in themselves affect rights or liabilities” (s 18(2)). Practitioners and stakeholders should not assume that plan recommendations generate enforceable rights or obligations. The statute only requires State authorities to “endeavour, as far as practicable, to act consistently” (s 18(3)). This is a weaker, discretionary standard that may not be judicially enforceable. Expect administrative, reputational and political pressure rather than legal compulsion.

Uncertain scope of contract‑copying requirement

• Section 9(2) requires State authorities not to enter into a contract of a “prescribed kind” unless a copy is provided to the Commissioner with at least five business days to comment. The term “prescribed kind” is not defined in the Act itself and depends on regulations (s 21). Until regulations identify which contracts are covered, agencies and contractors will face uncertainty about whether the five‑day comment requirement applies, which can cause last‑minute delays if the Commissioner asserts coverage and agencies must halt contracting processes.

Confidentiality tensions

• Section 9(5) limits disclosure of information obtained by the Commissioner, but permits disclosure for the purpose of making reports under the Act or where authorised by the State authority or required by other law. The Commissioner and appointees are criminally exposed (maximum $10,000) for unauthorised disclosure (s 9(6) and penalty note). This creates a tension in handling commercially sensitive material: State authorities may be reluctant to hand over contracts or information; the Commissioner must treat such information carefully; and commercial parties will need to align their confidentiality clauses and procurement practices with this statutory regime. The Act does not create a bespoke regime to address conflicts with commercial confidentiality regimes , resolution will depend on inter‑agency agreements, redaction practices and, potentially, the operation of freedom of information and other disclosure laws.

Consultation “in such manner as the Minister/Commissioner thinks fit”

• Several duties require consultation “in such manner as” the Minister or Commissioner “thinks fit” (e.g. s 6(3), s 15(3), s 21(2)). That language gives wide discretion as to the intensity and form of consultation. In practice, stakeholders may find the degree and quality of consultation variable. The Act does however mandate specific consultation steps in s 17 for management plans; outside that, consultation processes can be shaped by executive discretion.

Delegation vs non‑delegable reporting power

• The Commissioner may delegate functions in writing (s 14) subject to formal requirements; however, the power under s 18(4) to report agency non‑cooperation or obstruction to the Minister and Premier “must not be delegated” (s 18(5)). Delegation may speed administrative work, but the Commissioner retains the key political reporting role. Organisations should therefore expect the Commissioner to exercise the reporting power personally in significant disputes.

No express funding mechanism for council costs

• Section 17(3)(c) requires the Commissioner to consult with an affected council if a draft plan has the potential to create additional costs for the council, including consultation on options for funding those costs. The Act does not, however, create an express funding obligation on the State. Councils may therefore face unfunded cost impacts if plan implementation is pursued without a commitment of State funding. The statutory duty to consult mitigates this risk but does not itself create a funding guarantee.

Five business day comment period can disrupt procurement timetables

• The statutory minimum interval for Commissioner comment on “prescribed kind” contracts is five business days (s 9(2)). For fast‑moving procurements, project managers and bidders must factor this pause into schedules; failure to do so may produce invalid procurement steps or reputational conflict if the Commissioner objects after contract execution.

Reporting remedy is reputational not coercive

• The Commissioner’s primary remedy against non‑cooperation is reporting to responsible Ministers, the Premier and Parliament (ss 9(3), 18(4)). Those are significant levers in a political environment but do not directly compel action. Entities dependent on timely decisions or contract certainty should treat the reporting mechanism as a potential source of delay or reputational exposure rather than as an instrument that will itself reorder legal obligations.

Regulatory dependence for key definitions

• Several operational elements depend on regulations (s 21) , notably the definition and exclusion of State authorities and the specification of “prescribed bodies” and “prescribed kinds” of contracts. Until regulations are made, affected parties face definitional uncertainty about the Act’s practical reach.

Overall, the “gotchas” are mainly operational: procedural pause points, confidentiality tensions, discretionary consultation modalities, and the Act’s deliberately non‑binding policy character. Organisations should plan for these pragmatic effects rather than expecting immediate statutory compulsion.

Compliance with the Act involves distinct responsibilities for the Commissioner, State authorities (including councils), Ministers, local advisory boards and third parties contracting with State authorities. Below are practical, source‑grounded compliance steps and institutional practices tied to the statutory text.

For State authorities (including administrative units and councils)

• Respond promptly to written information notices under s 9(1). The Commissioner may require information “within a reasonable time specified in the notice” (s 9(1)). Establish a named contact point and internal process to triage such notices, assess commercial confidentiality, prepare redacted versions where necessary and deliver information within the timeframe.
• If contemplating contracts potentially within the “prescribed kind” category, do not execute until the Commissioner has been provided a copy and at least five business days have elapsed for comment (s 9(2)). Where practicable, treat the five business day interval as a hard stop in procurement timelines or seek to obtain a waiver or concurrent review process with the Commissioner early in procurement planning.
• Where an information or contract disclosure request raises commercial‑in‑confidence issues, engage early with the Commissioner to negotiate redaction, confidentiality undertakings or staged disclosure. Note that the Commissioner’s use of information is limited by s 9(5); nonetheless the Commissioner may include matters in public reporting in certain circumstances, so consider the risk profile carefully.
• For councils: engage constructively with the Commissioner on proposed appointments to local advisory boards (s 15(3)) and on management plans that may create additional council costs. Section 17(3)(c) requires the Commissioner to consult councils where proposals may create additional costs and to consult on options for funding those costs. Councils should document cost estimates and funding options for those consultations.
• Maintain records of any refusals or failures to comply with Commissioner notices, and ensure these are escalated to responsible Ministers if appropriate. Remember that the Commissioner may report non‑compliance to the responsible Minister and the Premier (s 9(3)), and for councils the Commissioner may report to the Minister for Local Government who may act under s 272 of the Local Government Act 1999 (s 9(4)).

For the Commissioner and office staff

• Follow required draft and approval sequencing for management plans. Prepare draft proposals, seek Governor approval where required before broader consultation (s 17(3)(b)(i)), consult relevant local advisory boards, responsible Ministers, prescribed bodies and affected councils (s 17(3)(b)(ii)-(c)), give public notice and invite written representations (s 17(3)(e)), and make public representations available except where confidential (s 17(4)). Maintain formal records of consultations and the reasons for any departures from advice received.
• Ensure publication and website availability of adopted management plans and amendments and give public notice of amendments within a reasonable time (s 17(6)). Put in place document management and website publication processes to meet the public inspection obligations.
• Use information notice powers (s 9(1)) in a targeted, proportionate way. Where confidential material is sought, provide clear statements of purpose and legal basis for the information request to facilitate agency cooperation under s 9(5) confidentiality exceptions.
• Maintain strict confidentiality protocols. Section 9(6) attaches a maximum penalty of $10,000 for disclosure contrary to s 9(5) by the Commissioner and associated persons. Implement secure information handling, clear employee and contractor confidentiality clauses and redaction rules before any public reporting.
• Preserve the non‑delegable nature of the s 18(4) reporting power (s 18(5)). Although the Commissioner may delegate many functions (s 14), do not delegate the power to make formal reports to Ministers and Parliament about agency non‑cooperation.
• Include ministerial directions in annual reports and document consultation with the Minister before directions are issued under s 10. Ensure that any direction received is recorded in writing and included in the annual report (s 10(3)).

For Ministers

• Consult with the Kangaroo Island Council and the people of Kangaroo Island about proposed Commissioner appointments (s 6(3)). Keep records of the consultation process to demonstrate compliance with the statutory duty.
• Consult with the Commissioner before giving directions to the Commissioner and ensure directions are written and publicly disclosed in the Commissioner’s annual report (s 10).
• When proposing regulations under the Act, consult with the Kangaroo Island Council and the Commissioner (s 21(2)).

For local advisory boards

• Ensure members satisfy s 15(4)’s qualification requirement and apply honesty and accountability rules (s 15(7)). Keep formal minutes and records of advice given to the Commissioner and ensure procedural rules for board conduct are determined and documented as required by s 15(6).

For private contractors and bidders

• Be aware that contracts with State authorities may be subject to a statutory pause if classified as a “prescribed kind” under s 9(2). In procurement bids, build in time contingencies and be prepared for potential comment from the Commissioner during the five business day window.
• Where contractual confidentiality is proposed, expect the State authority to negotiate redaction or limited disclosure arrangements to satisfy both the Commissioner’s information requirements and the contractor’s commercial confidentiality needs.

Recordkeeping and transparency

• All affected parties should maintain clear records of consultations, notices, submissions, representations made during public consultation (s 17(3)(e) and s 17(4)), and the Commissioner’s reports and annual reports. The Commissioner must make public representations available except where they are made in confidence; agencies and submitters should mark confidential material carefully and be prepared to justify confidentiality claims.

Risk management and dispute avoidance

• Proactively engage in consultation and early negotiation over contentious aspects such as funding of additional council costs under s 17(3)(c), redaction of commercially sensitive material, and the timeframe for contract review under s 9(2). Where disputes arise, the Commissioner’s principal remedies are reporting and political exposure; resolving issues through negotiation can avoid reputational escalation.

Monitoring and review

• Note the statutory review timetable: the Environment, Resources and Development Committee must review the Act after two years and every four years thereafter (s 20). Stakeholders should prepare submissions to those reviews if systemic changes or clarifications are required, and track regulatory developments under s 21 that will fill in “prescribed” details.

In short, compliance is primarily about process controls: timely response to notices, documented consultation and publication, robust confidentiality handling, procurement scheduling to accommodate potential five business day comments, and proactive engagement with the Commissioner and the Kangaroo Island Council where plans may impose operational or financial implications.
