Commissioner for Children and Young People Act 2006

The Act organises around a set of operational concepts that determine who decides, who must act and how information flows.

Paramount consideration and guiding principles. The Commissioner and any person acting under the Act must regard the best interests of children and young people as the paramount consideration (s 3). The Act specifies principles to guide administration, including protection from harm, recognising children’s contributions, giving serious consideration to children’s views and supporting families in their primary role (s 4). These establish the normative standard against which the Commissioner’s priorities and actions are to be assessed.

Office and independence. The statutory office is separate from the Public Service and is not to become an SES organisation (s 6(2)-(3)). The Commissioner is, except as provided in the Act, not subject to ministerial direction in performing functions (s 25). The Minister, however, may give written directions about general policy to be followed (s 26); such directions cannot be in respect of a particular matter and must be laid before Parliament and included in the Commissioner’s annual report (s 26(1), (2), (5)-(6)).

Functions and powers. The function list is expansive and mixes advocacy, monitoring, review and inquiry powers: promoting participation, monitoring trends and complaint handling by government agencies, initiating inquiries and reviews of laws and services, promoting public awareness and research, and advising the Minister and Standing Committee (s 19). The Commissioner has broad statutory power to do all things necessary or convenient to perform the functions, including publishing information (s 21). Delegation is allowed to staff for most powers but not those in Part 5 (special inquiries) (s 24).

Information compulsion and disclosure. The Commissioner may request disclosure of relevant information from government agencies and service providers; those entities must disclose unless such disclosure contravenes a prescribed secrecy or confidentiality enactment (s 22(2)-(3)). A disclosure made in good faith attracts statutory protection from civil and criminal liability and is not to be treated as breach of professional ethics (s 22(4)). During special inquiries the Commissioner may require attendance, production of documents, administer oaths and require answers; failure without lawful excuse attracts a fine and imprisonment (s 33-34). The statutory scheme narrows legal professional privilege in relation to government agencies (s 36(2)), while providing limited protection for privileged material through confidential reporting to the Standing Committee (s 36(3)-(4)).

Special inquiries and investigatory mechanics. Part 5 is the enforcement and evidence arm. A special inquiry must be notified in the Gazette/newspaper and may include public hearings (s 30-32). Authorised persons may enter premises with consent or warrant, and use reasonable force where the warrant allows (s 37-38). Answers given under compulsion are not admissible against the person in criminal or civil proceedings except for offences under the Act (s 35(2)); however, incrimination is not a lawful excuse to refuse under s 34(1) (s 35(1)-(2)).

Reporting, parliamentary oversight and publication. Annual and special inquiry reports are mandatory (s 42-43). Before including adverse matters about a person the Commissioner must provide an opportunity to respond (s 47). Draft reports must be given to the Minister who may comment; Ministerial comments must be included in the report (s 48). Reports are to be laid before Parliament and published, including a child‑appropriate version unless inappropriate (s 49-50). A joint Standing Committee is to be established by Parliament and its functions determined by agreement between the Houses; those functions are expressly declared non‑justiciable (s 51).

Accountability and protections. The Act contains mutual protections and constraints: persons providing information in good faith are shielded from liability (s 41; s 22(4)); staff and others are protected from tort claims for acts done in good faith (s 59); unlawful disclosure of information obtained under the Act is an offence with significant penalty (s 60). Cabinet proceedings are protected from disclosure by certificate from the Department of the Premier and Cabinet (s 62). The Commissioner must avoid duplication of other agencies’ functions (s 20(1)(g)), and is required to prioritise Aboriginal and Torres Strait Islander children and those who are vulnerable (s 20(1)(a)).

These core concepts structure how the Commissioner operates, how information is acquired and used, how the Commissioner reports and is held to account, and where the limits and protections lie for both the Commissioner and persons who interact with the office.

Primary subjects. The Act’s substantive focus is children and young people, defined as persons under 18 years of age (s 5). The Commissioner’s functions, obligations, reporting and publication duties concern matters affecting the wellbeing of this cohort, and the Office is required to consult and involve children from a broad range of socio‑economic and cultural backgrounds regularly (s 19(n); s 52(2)).

Government agencies and service providers. A central operational requirement is that government agencies (defined expansively to include departments, State agencies, local governments and bodies established under written law) and service providers contracted by them must disclose relevant information to the Commissioner on request, unless disclosure would contravene a prescribed secrecy or confidentiality enactment (s 5 definition; s 22(1)-(3)). Officers and employees of such agencies are similarly placed under an obligation to disclose, with the Act limiting the use of legal professional privilege by government agencies in special inquiries (s 36(2)). This places an evidential and administrative compliance burden on agencies and service providers: to identify, assemble and disclose relevant information when requested (s 22).

Contracted service providers and non‑government agencies. The definition of service provider in s 22(1) and the duty to disclose mean non‑government entities delivering services on behalf of government agencies are directly affected. They may be required to produce documents and answer questions during special inquiries, and they benefit from limited protection from liability for making good faith disclosures (s 22(4); s 41).

Parliament and the Standing Committee. Parliament is a recipient of reports, and must establish a joint Standing Committee to receive oversight reports and to consider confidential material referred by the Commissioner (s 51; s 36(3)-(4)). The Standing Committee can make recommendations on the Commissioner’s budget to the Treasurer (s 57). Members of Parliament and parliamentary staff will therefore engage with the office’s outputs and may be recipients of sensitive material under the Act’s procedure.

Minister and executive. The Minister interacts with the Commissioner in multiple ways: consultation (s 28), requests for information (s 27), and providing written directions about general policy to be followed (s 26). The Minister receives draft reports and may comment; comments must be included in the final report (s 48). The Governor appoints the Commissioner on the Premier’s recommendation (s 7(1)); the Premier must advertise and consult as part of the selection process (s 7(2)). Removal or suspension involves both Houses addressing the Governor (s 8(1)).

Children’s families and communities. The Act recognises families and communities as having primary roles and requires the Commissioner to support families in carrying out that role (s 4(d)). It also explicitly requires consultation with children from a range of backgrounds and engagement with advisory committees that must include children and non‑government agency representatives (s 52(2)-(3)).

Commissioner’s staff and authorised persons. Staff are appointed under the Public Sector Management Act Part 3 to enable the Commissioner to perform functions (s 16), and may be designated as authorised persons for Part 5 purposes (s 18). Authorised persons have powers to enter premises, apply for warrants and execute inquiries (s 37-38).

Persons subject to special inquiries. Individuals and organisations that are the subject of special inquiries may be required to attend, produce documents and answer questions (s 33). Legal professional privilege is limited for government agencies (s 36(2)). Persons who give false information or obstruct inquiries face criminal penalties (s 34; s 39; s 40).

Broader public. The Act imposes public reporting and publication obligations on the Commissioner (s 42-50). The Commissioner may publish reports and a child‑suitable version, increasing public information flows about policies, practices and systemic issues affecting children (s 50).

In short, the Act affects children and their families, government agencies and officers, contracted service providers, parliamentary structures, the Minister and the executive, and any person or body subject to inquiry. The compliance burden is concentrated on public sector entities and service providers who must disclose relevant information and engage with inquiries; costs of the office itself are borne by the State through appropriation and subject to Standing Committee budgetary regard (s 57).

Statutory duties of the Commissioner. The Commissioner’s duties are enumerated in s 19 and are wide ranging: to advocate for children and young people (s 19(a)); to promote participation in decision making and encourage agencies to seek appropriate participation (s 19(b)); to promote and monitor wellbeing generally (s 19(c)); to monitor how government agencies handle complaints by children and monitor complaint trends (s 19(d)-(e)); to initiate and conduct inquiries into laws, practices and services affecting wellbeing (s 19(f)); to monitor and review written and draft laws, policies and practices (s 19(g)); to promote public awareness and conduct research (s 19(h)-(i)); to conduct special inquiries under Part 5 (s 19(j)); to advise the Minister or Standing Committee on request or on the Commissioner’s own initiative (s 19(k)); and to consult annually with children across Western Australia (s 19(n)). The Commissioner may also perform any other function conferred by the Act or other written law (s 19(p)).

Paramount and priority duties. The Commissioner must regard the best interests of children and young people as the paramount consideration while performing functions under the Act (s 3). In performing functions the Commissioner must give priority and special regard to Aboriginal and Torres Strait Islander children and young people and to children who are vulnerable or disadvantaged (s 20(1)(a)). The Commissioner must also have regard to the United Nations Convention on the Rights of the Child, develop consultation methods appropriate to age and maturity, promulgate guidelines for agency participation practices, adopt accessible work practices and take steps to avoid unnecessary duplication of functions performed by other government agencies (s 20(1)(b)-(g)).

Duties on government agencies and service providers to disclose. The Act authorises the Commissioner to request relevant information and requires government agencies and service providers to disclose such information unless disclosure would contravene a prescribed enactment relating to secrecy or confidentiality (s 22(2)-(3)). Disclosure made in good faith attracts civil and criminal immunity and is not to be treated as a breach of professional ethics (s 22(4)).

Restrictions on the Commissioner’s role in individual matters. The Commissioner is precluded from investigating or dealing with complaints made by or about a particular child or young person as a function of the Commissioner (s 23(1)). The Commissioner may however provide information, referrals or use a matter about an individual to identify and examine systemic issues affecting wellbeing generally (s 23(2)).

Special inquiry powers and compulsion. For the purposes of a special inquiry the Commissioner may require attendance, production of documents, inspect and retain documents, administer oaths and require answers (s 33). Failure to comply without lawful excuse is an offence with a fine of $12 000 and imprisonment for 12 months (s 34). Incriminating answers are not a lawful excuse to refuse, but compelled answers and produced documents are not admissible in proceedings against the person except for offences under s 40 (s 35).

Limits on privilege and confidentiality. Legal professional privilege remains a ground to refuse in general, but government agencies and their officers cannot refuse to answer or produce documents on that ground (s 36(1)-(2)). The Commissioner may not include privileged answers or documents in a report to Parliament, but may report them confidentially to the Standing Committee which must consider them in private and decide whether to report to Parliament (s 36(3)-(4)). Cabinet proceedings are excluded from disclosure under the Act (s 62).

Delegation and internal administration. The Commissioner may delegate powers or duties to staff except powers or duties under Part 5 (special inquiries) (s 24(1)). Delegations must be in writing and are non‑delegable by the delegate (s 24(2)-(3)). Staff are to be appointed or made available under the Public Sector Management Act Part 3 (s 16), and the Commissioner may use public service staff and facilities by arrangement (s 17).

Ministerial interaction and rights. The Minister may give written directions about general policy (s 26). The Commissioner must comply unless there are reasonable grounds for refusal, in which case the Commissioner must include the reasons for refusal in the annual report (s 26(3)-(4)). The Minister may request the Commissioner to furnish information or give access to information and the Commissioner must comply unless reasonable grounds exist not to comply (s 27). Draft reports must be given to the Minister who may comment; any such comments must be included in the report (s 48).

Reporting and parliamentary rights. The Commissioner must prepare an annual report within three months after 30 June each year (s 42) and must prepare reports on special inquiries and other matters as applicable (s 43-44). Copies of reports must be laid before each House of Parliament within prescribed timeframes (s 49). Reports and a child‑appropriate version are to be published unless inappropriate (s 50).

Confidentiality and non‑disclosure duties. Persons engaged under the Act may not record, disclose or use information obtained in the course of performing functions except for specified purposes such as performing functions, investigating offences or as allowed under another written law; unlawful disclosure is an offence punishable by a fine of $12 000 and imprisonment for 12 months (s 60). Statistical or de‑identified information is permitted (s 60(2)).

Immunity and protection. Persons acting in good faith in performance of functions are protected from tort actions and the State is relieved of vicarious liability (s 59). Persons who provide information in good faith to the Commissioner for a special inquiry are protected from liability for loss or damage resulting from that disclosure (s 41). Conversely, persons who give false or misleading information or obstruct inquiries face criminal penalties (s 40; s 39; s 34).

These duties and rights create a framework where the Commissioner has broad functions and investigative tools, government agencies and service providers have statutory obligations to cooperate, confidentiality and privilege are constrained in service of systemic inquiry, and both legal protections and penal sanctions are used to shape behaviour in inquiries and in the ongoing operation of the Office.

Statutory penalties. The Act attaches significant criminal penalties to a range of specified behaviours, particularly in the context of Part 5 special inquiries and information management. Key offences with identical maximum penalties comprise a fine of $12 000 and imprisonment for 12 months: failure without lawful excuse to comply with a notice under s 33 to attend or produce documents (s 34(1)(a)-(b)); failure without lawful excuse to be sworn/make an affirmation or to answer questions when required under s 33 (s 34(2)); wilful insult of the Commissioner during a special inquiry or wilful interruption or obstruction of a special inquiry (s 39); giving false or misleading material during a special inquiry (s 40); and unauthorised disclosure of information obtained under the Act where the disclosure was not for permitted purposes (s 60(1)).

Regulatory offences. The Governor may make regulations creating offences and providing penalties not exceeding $6 000 (s 63(2)(c)). Regulations may also make provision for conduct of hearings and for prohibiting or restricting publication or disclosure of evidence given at hearings (s 63(2)(a)-(b)).

Compulsion mechanics and protections. For special inquiries the Commissioner may compel attendance of persons and require production of documents, administer oaths and require answers (s 33). Compliance is enforced by the statutory offence regime in s 34. The Act denies the right to refuse on the ground of self‑incrimination (s 35(1)), but protects compelled answers and documents from being admissible in proceedings against the person, other than proceedings for offences under s 40 (s 35(2)). This construct reduces the testimonial immunity normally available but preserves limited protection against use in subsequent criminal prosecutions except for offences tied to the inquiry itself.

Privilege limitations and Standing Committee confidentiality pathway. Legal professional privilege remains generally available, but government agencies and their employees cannot refuse to answer or produce documents on that ground (s 36(2)). If a government agency produces such privileged material, the Commissioner may not include it in a public report but may report it confidentially to the Standing Committee; the Standing Committee must consider it in private and may, if it considers appropriate, report it to Parliament (s 36(3)-(4)). This provides an internal parliamentary oversight channel for privileged material while preventing public inclusion in Commissioner reports.

Entry and warrant enforcement. Authorised persons may enter and inspect places with consent or under warrant issued by a magistrate of the Children’s Court if satisfied entry is reasonably required (s 37-38). Warrants may be executed using reasonable force (s 38(4)), and continue until the purpose is satisfied (s 38(5)). These powers enable enforcement of inspections and document recovery where consent is withheld.

Obstruction and general enforcement. The Act contains a broader obstruction offence that applies to anyone who obstructs or hinders a person performing a function under the Act, with the same maximum penalty as other serious contraventions (s 58). A refusal to give consent for an entry under s 37(2) is expressly not an obstruction (s 58(2)).

Protections and immunities that affect enforcement. The Act protects persons who act in good faith in performing functions from tort actions and removes State liability for such persons’ acts (s 59). Persons disclosing information in good faith to the Commissioner are protected from civil or criminal liability and professional sanction (s 22(4); s 41). These protections incentivise cooperation while insulating the State and individuals from litigation risk arising from good faith disclosure or execution of functions.

Enforcement oversight and parliamentary visibility. Ministerial directions must be laid before Parliament and included in the Commissioner’s annual report (s 26(5)-(6)), draft reports are given to the Minister and may include the Minister’s comments (s 48), reports must be laid before Parliament and published (s 49-50), and the Standing Committee provides a parliamentary conduit for confidential material (s 51; s 36(3)-(4)). These mechanisms provide layers of public and parliamentary scrutiny over the exercise of compulsory powers.

In sum, the enforcement architecture combines compulsory investigatory powers with substantial penal sanctions for non‑compliance, constrained privilege claims for public bodies, entry and warrant powers, and immunities to encourage disclosure and protect those performing functions in good faith. Agencies and service providers subject to inquiry must therefore prepare for compelled disclosure and potential criminal sanctions for bilaterally defined non‑compliance.

Overlap with confidentiality and secrecy laws. The duty on government agencies and service providers to disclose relevant information under s 22(3) is qualified by an exception where disclosure would contravene a prescribed enactment relating to secrecy or confidentiality. This means existing secrecy regimes created by other written laws may prevail in specific contexts. The Act does not list those enactments; it requires agencies to identify whether a prescribed secrecy law prevents disclosure in response to a Commissioner request.

Legal professional privilege and public law exceptions. The Act preserves legal professional privilege generally (s 36(1)) but expressly prevents government agencies and their employees from invoking legal professional privilege to refuse to answer questions or produce documents during a special inquiry (s 36(2)). Where privileged material is produced by a government agency, the Commissioner may not include it in a report to Parliament, but may report it confidentially to the Standing Committee (s 36(3)). The Standing Committee must consider it in private and may report it to Parliament if it decides to do so (s 36(4)). This creates a statutory carve‑out to privilege for public bodies, while channeling privileged content through parliamentary oversight rather than direct public disclosure.

Cabinet secrecy. The Act explicitly protects Cabinet proceedings and related documents from being required or authorised to be furnished under the Act (s 62(1)). A certificate issued by the chief executive officer of the Department of the Premier and Cabinet, with the Premier’s approval, is conclusive that information or documents relate to Cabinet proceedings (s 62(2)). This is a statutory barrier that intersects with the Commissioner’s investigatory powers and prevents compelled disclosure of Cabinet materials.

Public sector employment and staff arrangements. Although the Commissioner’s office is not in the Public Service and not an SES organisation (s 6(2)-(3)), staff are to be appointed or made available under the Public Sector Management Act 1994 Part 3 to enable the Commissioner to perform functions (s 16). The Commissioner may also use government staff and facilities by arrangement (s 17). Provisions exist to preserve public service entitlements where a public service officer is appointed as Commissioner or returns to the Public Service (s 13). Thus, operational interactions with the Public Sector Management Act and related employment and superannuation laws are embedded.

Evidence law and criminal law interactions. Compelled answers and documents produced in compliance with s 33 are not admissible in evidence in proceedings against the person, except for proceedings for an offence under s 40 (false information) (s 35(2)). Subsection 35(1) removes the right to refuse to answer on the ground of self‑incrimination. This creates an evidential interaction with criminal procedure and common law protections against self‑incrimination, narrowing testimonial immunity in the context of special inquiries but preserving non‑admissibility protections and criminal liability for false answers.

Regulatory and statutory frameworks for contracted service providers. Service providers who provide services for or on behalf of government agencies are defined and brought within the scope of s 22(1) and (2) for disclosure requirements. This interacts with contract law and procurement arrangements: contracts for service delivery may need to be interpreted, or amended, to accommodate disclosure obligations, confidentiality clauses and cooperation in inquiries. The Act does not itself prescribe contract drafting obligations, but service providers are statutorily required to disclose relevant information to the Commissioner when requested (s 22(2)-(3)).

Parliamentary privileges and non‑justiciable committee functions. Parliament must establish a joint Standing Committee to which the Commissioner reports; the functions and powers of the Standing Committee are determined by agreement between the Houses and are expressly declared not justiciable (s 51(1)-(2)). This places parts of the Act’s oversight and confidentiality resolution mechanisms within parliamentary privilege and internal parliamentary processes rather than subject to judicial review.

Interaction with the Public Interest Disclosure Act and other written laws. The Act permits disclosure of information for the purposes allowed by the Public Interest Disclosure Act 2003 and other written laws (s 60(1)(c)). This creates a pathway for disclosures that overlap with whistleblower protections, and requires cross‑analysis where agencies receive overlapping statutory duties.

Regulatory instruments. The Governor may make regulations to prescribe matters necessary to give effect to the Act, including conduct of hearings, prohibitions on publication or disclosure of evidence given at hearings and creation of offences with penalties up to $6 000 (s 63). Regulations therefore provide a mechanism to adapt operational detail and to create lesser offences and evidence management rules that interact with the Act’s core provisions.

Overall, the Act is layered onto existing statutory regimes. It imposes a strong disclosure obligation on public agencies and their service providers subject only to specified secrecy laws and Cabinet protection, narrows privilege for public agencies while creating a parliamentary confidentiality pathway, interacts with public sector employment law for staffing, and aligns with other disclosure regimes such as the Public Interest Disclosure Act. Practical interactions will hinge on identifying which secrecy laws are prescribed, the content of contracts with service providers, and how parliamentary procedures for the Standing Committee are framed.

The text supplied contains a compilation table listing the Act as enacted and subsequent amending Acts and clauses recorded in the compilation. The key recorded amendments and consequential material in the supplied compilation include:

• The Act was assented to on 4 October 2006 and most operative provisions commenced by proclamation on 10 December 2007, with ss 1 and 2 commencing on 4 October 2006 (Compilation table; s 2). The Financial Legislation Amendment and Repeal Act 2006 (No. 77 of 2006) made an amendment affecting s 42, coming into operation on 1 February 2007 (Compilation table; s 42 amended: No. 77 of 2006 Sch. 1 cl. 27).

• The Acts Amendment (Bankruptcy) Act 2009 (No. 18 of 2009) amended s 8 (s 8 amended: No. 18 of 2009 s. 17), with commencement recorded 17 September 2009 (Compilation table). The Statutes (Repeals and Minor Amendments) Act 2009 (No. 46 of 2009) included multiple amendments referenced in the Act text, including amendments to s 5, s 8 and s 19, and s 22 (see marginal amendment notes: s 5 amended: No. 46 of 2009 s. 5(2); s 8 amended: No. 46 of 2009 s. 5(5); s 19 amended: No. 46 of 2009 s. 5(3); s 22 amended: No. 46 of 2009 s. 5(5); s 52 and s 54 also show amendment notes referencing No. 46 of 2009 s. 5(5)). These amendments were assented to 3 December 2009 and commenced 4 December 2009 (Compilation table).

• The Public Sector Reform Act 2010 (No. 39 of 2010) amended s 56 with respect to remuneration and allowances for advisory committee members (see s 56 amended: No. 39 of 2010 s. 89); the compilation records commencement 1 December 2010 (Compilation table).

• The Statutes (Repeals and Minor Amendments) Act 2011 (No. 47 of 2011) effected later changes, including deletion of certain schedule provisions; one amendment (No. 47 of 2011 s. 11) is recorded as having commenced 26 October 2011 (Compilation table).

• The Local Government Legislation Amendment Act 2016 (No. 26 of 2016) contains an amendment reflected in the compilation notes to s 5 (s 5 amended: No. 26 of 2016 s. 44) and is recorded with commencement 21 January 2017 (Compilation table).

The Notes and Other notes in the compilation include further editorial and consequential observations:

• Schedule 1 cl. 2 of this Act had not come into operation when it was later deleted by the Statutes (Repeals and Minor Amendments) Act 2011 s. 11 (Other notes).

• A provision in this Act amending the Constitution Acts Amendment Act 1899 was omitted under the Reprints Act 1984 s. 7(4)(e) (Other notes).

• The Superannuation and Family Benefits Act 1938 was repealed, but its provisions continue to have transitional effect for some schemes as noted in the Act’s extant provisions regarding public service entitlement protection for persons appointed as Commissioner (s 13 and Other notes).

The compilation notes record the reprint status (Reprint 1 as at 9 March 2012) and identify an uncommenced provision in Schedule 1 cl. 3 slated for proclamation (Uncommenced provisions table). The Act’s marginal amendment notes identify where particular sections were amended and the amending Act provision (see bracketed amendment notes throughout the text).

This summary records only the amendments and dates that appear within the supplied document. Where the Act references other written laws (for example, the Public Sector Management Act 1994, Public Interest Disclosure Act 2003, Salaries and Allowances Act 1975 and various amending Acts), the practical effect of amendments may depend on those statutes’ subsequent changes which are not set out in the material provided here.

The supplied text of the Commissioner for Children and Young People Act 2006 does not include, and does not refer to, any judicial decisions or litigation history. There are no cases named in the Act, and the Act contains an express statement that the functions and powers of the parliamentary Standing Committee established under s 51 are determined by agreement between the Houses and are not justiciable (s 51(2)). Beyond that, the compilation and notes provided do not record any litigation or judicial interpretation of the Act.

Absent court decisions in the provided material, there is no source‑grounded case law to cite concerning interpretation of key provisions such as the scope of disclosure obligations under s 22, the limits of legal professional privilege under s 36, the circumstances in which the Commissioner may refuse a Ministerial direction under s 26(3), or the boundaries of the Commissioner’s investigatory powers in Part 5. Practitioners should therefore treat the statutory text and the legislative notes as the primary legal source and, when necessary, seek current case law databases for any judicial developments not captured in the supplied compilation.

Where matters might be subject to judicial challenge in practice, such as a dispute over whether a prescribed secrecy enactment prohibits disclosure, or a claim challenging the validity of a warrant issued under s 38,none of the supplied material records judicial outcomes. Users requiring case law should obtain up‑to‑date legal research covering decisions since the most recent compilation noted in the supplied text.

1. Commissioner cannot deal with individual complaints as a core function, but may use individual cases to investigate systemic issues. Section 23(1) bars the Commissioner from investigating or otherwise dealing with a complaint made by or about a particular child as a function. However s 23(2)(c) allows the Commissioner to investigate matters affecting wellbeing generally that arise from individual cases. Practically this means individuals should not expect case‑level remedies from the Commissioner, and agencies should recognise that individual matters can trigger systemic inquiries.

2. Government agencies cannot invoke legal professional privilege in Part 5 special inquiries. Section 36(2) removes legal professional privilege as a ground for government agencies to refuse to answer or produce documents. Privilege for government bodies is therefore curtailed and may be reported confidentially to the Standing Committee rather than included in a public report (s 36(3)-(4)). Private parties may retain privilege, but agencies must plan for compelled production.

3. Self‑incrimination exception is limited. Section 35(1) removes incrimination as a lawful excuse to refuse to answer or produce documents, while s 35(2) protects compelled answers and documents from admissibility in most proceedings except for offences under s 40. This alters the typical evidentiary calculus for compelled statements during special inquiries.

4. Cabinet materials are protected by conclusive certificate. Section 62(2) makes a certificate from the Department of the Premier and Cabinet’s chief executive, with the Premier’s approval, conclusive that material relates to Cabinet proceedings. Agencies and the Commissioner cannot compel Cabinet material, subject to that certificate, so inquiries that touch on policymaking records need attention to this exclusion.

5. Mandatory disclosure duty interacts with other secrecy enactments. Section 22(3) requires disclosure unless such disclosure contravenes a prescribed secrecy or confidentiality enactment. Identifying which enactments are “prescribed” is essential; agencies must reconcile competing statutory duties and possibly seek legal advice before disclosure.

6. Delegation constraints. The Commissioner may delegate powers or duties to staff except powers or duties under Part 5 (s 24(1)). Operationally this requires the Commissioner personally to oversee special inquiries’ exercise of compulsory powers and disallows delegation of those powers to staff.

7. Ministerial directions are limited to general policy but can be politically influential. The Minister may give written directions about general policy to be followed (s 26(1)), and is entitled to have the text laid before Parliament and included in the Commissioner’s annual report (s 26(5)-(6)). The Commissioner may refuse a direction where reasonable grounds exist, but must record reasons in the report (s 26(3)-(4)). The source thus creates a transparency mechanism for ministerial influence without judicial review of the policy content.

8. Serious penalties for non‑compliance and disclosure are large. Several offences attract a maximum penalty of $12 000 and 12 months imprisonment (s 34; s 39; s 40; s 58; s 60). Agencies and contracted providers should treat notices and inquiries seriously; legal risk is non‑trivial.

9. Standing Committee functions are non‑justiciable. Section 51(2) declares the Standing Committee’s functions and powers to be determined by parliamentary agreement and not justiciable. Confidential material reported to the Standing Committee moves into parliamentary processes that are shielded from judicial review, creating limits on court oversight of how such material is handled.

10. Publication obligations and child‑suitable versions. Section 50 requires publication of a version of reports suitable for children unless the Commissioner considers that inappropriate. The Commissioner retains discretion on what to publish, but must consider producing child‑appropriate materials, which creates operational obligations around report drafting, redaction and accessibility.

11. Office is not Public Service but draws staff from it. The office is outside the Public Service and not to become an SES organisation (s 6(2)-(3)), but staff are to be appointed or made available under the Public Sector Management Act Part 3 (s 16), and the Commissioner can use public sector staff and facilities by arrangement (s 17). This hybrid status can complicate human resources, secondee arrangements and workplace relations.

12. Protection from suits for good faith acts but exposure for false information. Section 59 provides immunity from tort for those acting in good faith, while s 40 criminalises knowingly false answers in inquiries. Persons should be trained in evidence handling and in the protection scope, and agencies must have procedures to detect and address false replies.

These are operational and legal “gotchas” that flow directly from the statutory text. Each requires procedural responses by agencies, service providers and the Commissioner’s office to manage legal risk and to ensure statutory obligations are met.

For government agencies and service providers

• Establish a central disclosure and inquiries protocol. Because s 22 requires disclosure of relevant information on request and s 33 empowers the Commissioner to require production, agencies and service providers should create a defined process to receive a Commissioner request, identify relevant records, assess whether a prescribed secrecy or confidentiality enactment bars disclosure, and coordinate production. Document the legal basis for any decision not to disclose.

• Map secrecy and confidentiality enactments. Identify applicable statutory secrecy regimes that might operate as lawful grounds to withhold disclosure under s 22(3). Maintain an up‑to‑date register of prescribed enactments and the statutory citations of the confidentiality provisions relied upon.

• Prepare privilege and legal review workflows. For government agencies, internal legal counsel should be ready to advise on privilege limitations under s 36(2). Where privileged documents are produced, identify the need to inform the Commissioner of the claim of privilege, and prepare for confidential briefing to the Standing Committee if required by the Commissioner’s process (s 36(3)-(4)).

• Develop hearing and witness procedures. Create internal guidance for staff who may be required to attend hearings or answer questions under s 33. Training should address oath/affirmation procedures, recordkeeping, the limited self‑incrimination protections under s 35, and the criminal penalties for false answers (s 40) and non‑compliance (s 34).

• Contract drafting with service providers. Update contracts with service providers to make clear the statutory disclosure obligations that arise under s 22, and include cooperation clauses that foresee compelled production or assistance with inquiries. Where confidentiality or indemnity clauses exist, revise them to avoid conflict with the Act’s disclosure requirements.

For the Commissioner’s office

• Ensure selection process compliance and documented involvement of children. The Commissioner’s appointment process must advertise nationally and involve consultation with specified political leaders and children and young people in the selection (s 7). Keep records to evidence compliance with s 7(2)-(3).

• Maintain written delegations and authorised person designations. Delegations must be in writing (s 24(2)) and authorised persons designated in writing under s 18. Ensure delegations explicitly exclude Part 5 investigatory powers and that terms are archived.

• Establish robust information management and confidentiality policies. The Act criminalises unauthorised disclosure (s 60) and requires secure handling of privileged material, including confidential referrals to the Standing Committee (s 36). Implement role‑based access controls, secure storage for privileged material and protocols for redaction and publication consistent with s 50 and s 47.

• Design inquiry procedures consistent with statutory formalities. For special inquiries follow the mandatory notice requirements (s 30) and conduct hearings in accordance with s 31-32. Ensure a legal team is available to draft notices under s 33, to seek warrants under s 38 where entry consent is not given, and to manage compliance and enforcement measures under s 34.

• Publish reports and ministerial comment. Provide draft reports to the Minister and include any written comments received under s 48(1)-(2); include the Minister’s comments in final reports (s 48(5)). Lay reports before Parliament within the 21 day period set out in s 49 and publish a child‑suitable version unless inappropriate (s 50).

For Ministers and parliamentary actors

• Use ministerial directions cautiously and transparently. Directions must be written, limited to general policy and laid before Parliament and included in the Commissioner’s annual report (s 26(1), (5)-(6)). If the Commissioner refuses to comply on reasonable grounds the Commissioner must record reasons in the annual report (s 26(3)-(4)). Maintain documented policy rationales and consult legal counsel when drafting directions to avoid encroaching on the statutory limit against directions on particular matters (s 26(2)).

For all entities facing inquiries

• Treat notices and hearings as high risk. Notices under s 33 carry strong compliance penalties (s 34) and false answers are an offence (s 40). Immediately engage legal representation, preserve document trails, and implement a sworn witness preparation process. Record the chain of custody for documents and consider seeking legal advice where disclosure may intersect with other statutory prohibitions.

• Manage stakeholder communications and publication risks. Because the Commissioner is required to publish reports and may produce child‑suitable versions (s 50), entities should plan communications strategies, prepare for potential reputational effects of being named or criticised in reports, and ensure internal compliance to remedy issues identified by the Commissioner.

Audit, training and governance

• Conduct periodic audits of records management, confidentiality and privilege practices to ensure rapid responsiveness to Commissioner requests.

• Train staff on oath and affirmation obligations, the limits of privilege in the public sector context, and the criminal risks associated with non‑compliance or false statements.

• Maintain a compliance log for Commissioner requests and actions taken to disclose or withhold material under s 22(3), including legal bases relied upon. This will facilitate internal accountability and evidence responses in parliamentary or judicial review contexts.

Budgetary and resourcing considerations

• Agencies should factor potential resource costs into cooperation plans. Assembling records and providing staff for inquiries is resource intensive. The Standing Committee’s budgetary recommendation power is to be regarded in budget determinations for the Commissioner (s 57), but agencies and service providers will bear the operational costs of cooperating with inquiries in the ordinary course.

In short, compliance requires coordinated legal, records, HR and communications processes. Government agencies and service providers should establish clear protocols to respond to Commissioner requests, train personnel on inquiry procedures and evidentiary restraints, and maintain documentation of decisions to produce or withhold information justified under prescribed secrecy enactments.
